6 A. General provisions Art. 1 Scope Swisslos Contract Territory may register. Each person may register on the ISP once only. 1.1 Swisslos provides players with the option of participating in specific products (Swiss Lotto, Joker, EuroMillions plus 2 nd Chance, Super-Star, Totogoal, Sporttip set and one, virtual Instant Ticket products, virtual Bingo products (subsequently Bingo products ) and Jass products via an Internet Gaming Platform ( ISP ) made available by it. These Terms and Rules govern only participation in the products mentioned above in the Swisslos Contract Territory These Terms and Rules for participation in Swisslos products via Internet/mobile device (subsequently Terms and Rules for Internet Games ) are defined in more concrete form by the Terms and Rules for the individual products and form one unit. If there is any conflict with these latter Terms and Rules, the following Terms and Rules take priority as special regulations. B. Registration Art. 2 General principles Internet access to the products through the ISP is available to anyone who logs into the ISP via the Internet (it is not possible to log in via SMS). Only natural persons at least 18 years of age and residing in the Art. 3 Access to chargeable games 3.1 Registration enables Internet access to all Swisslos products available via the ISP. If a mobile telephone number has been provided and verified, registered persons may also subscribe to prize notifications, jackpots, etc. 3.2 Player data required for registration Players must provide the following data when registering: title, last name, first name, street and house number, postcode, place of residence, canton, landline telephone number (optional), date of birth, address, as well as user name and password and if players also wish to subscribe to prize notifications, jackpots, etc. by SMS a mobile telephone number. Only valid Swiss and Liechtenstein mobile telephone numbers will be accepted. Swisslos reserves the right to verify the correctness of this data at any time and to bar any player who does not satisfy (or no longer satisfies) the registration requirements and to delete from the player profile any mobile telephone number that is no longer valid. 7 pose. The ISP will then attempt to locate players names and addresses in a publicly accessible register (e.g. an electronic telephone directory). Customers who are not listed in the telephone directory or have not provided any means of identification must enter their name and address data manually. Subsequently, the following additional data must be entered: date of birth; address. This is used by the ISP for unambiguous identification of the registration. Prize notifications, unblocked access, etc. are also communicated via this address; user name/password Players wishing to subscribe to prize notifications, jackpots, etc. via SMS are also required to state their mobile telephone number. It is otherwise not mandatory to provide a mobile telephone number. Subscribed prize notifications, jackpots, etc. will be communicated to the registered person via this mobile telephone number. Subscribed services are subject to the current terms and charges published by Swisslos on charges will be debited directly to the mobile telephone bill. Players with a valid SuisseID may use it for registration purposes as long as Swisslos is able to obtain the following information from the SuisseID: sex, last name, first name and date of birth. All other mandatory data such as postal address, address and access data must be entered by players manually. Art. 4 Verification of the data provided 4.1 Players using a valid SuisseID for the registration process who are resident in the Swisslos Contract Territory and older than 18 will have their registration application approved and be registered as customers. 4.2 All registrations without a SuisseID will be checked against an address database. Players found in this database and who satisfy the conditions of registration will be registered. Players who cannot be unambiguously identified in the address database on the basis of their personal data will be required to provide proof of age. Provided that the data verification carried out by Swisslos shows that the registration requirements have been satisfied, players will be registered. 4.3 Players who also provided a mobile telephone number during registration will receive an SMS on this number requesting them to send the text REG to the number After this text has been received by the above-mentioned number, the player s mobile telephone number is deemed verified. 5

8 Art. 5 Changes to registered data 5.1 Players may change the name in their profile. After entering a name change, they must send in or upload a copy of their family record book for verification purposes. On receipt of the copy of the family record book, Swisslos will decide if the change satisfies requirements. 5.2 Players may change the address in their profile. After the change of address has been entered, Swisslos will decide if it satisfies requirements. If this is the case, it will be accepted; otherwise the change of address will be rejected and the player notified accordingly by Players may change the mobile telephone number in their profile. After the change of mobile telephone number has been entered, players will receive an SMS on this newly entered number requesting them to send the text REG to the number After this text has been received by the above-mentioned number, the player s changed mobile telephone number is deemed verified. Art. 6 Additions to registered data Players may also have their mobile telephone number placed on file and verified after registration. To do so, players must log in and enter their mobile telephone number on the Profile page set up for this purpose. Players having registered a change of mobile telephone number will receive an SMS on this number requesting them to send the text REG to the number After this text has been received by the above-mentioned number, the player s mobile telephone number is deemed verified. C. Wallet Art. 7 Creation of a wallet After registration, a wallet is created for the player. Game credits can be loaded into this wallet for participation in the products available via the ISP. Art. 8 Purchase of game credits 8.1 There are various online payment options (accessible via a link) available to players for purchasing stakes, or they can do so using orange or red payment slips. These stakes are credited (as game credits) to the wallet created at registration. Stakes cannot be purchased for the wallet via SMS. 8.2 Within a period of 30 days, a player may purchase stakes for a maximum of CHF 10, This period is calculated retroactively from the date of the most recent purchase. 6

9 8.3 Players may only purchase stakes for as long as the game credits accumulated in their wallet do not exceed the amount of CHF 9,999. However, regardless of whether this limit is reached, any prizes or refunds may be credited (as game credits) to this wallet at any time; the same applies to game credits received as promotions or gifts. The relevant wallet balance is that stored on the server. 8.4 Within the limits stipulated in these provisions, game credits accumulated through prizes, refunds or payments may be freely used by players to participate in the products available via the ISP. With regard to game credits accumulated through promotions, the restrictions imposed in connection with the respective promotion will apply. Used game credits will be deleted (i.e. debited) from the wallet. Game credits are personal and non-transferable. Art. 9 Credits Game credits may be accumulated in the wallet through prizes credited (Art. 30 and 31) refunds amounts credited under promotions (Art. 35) amounts gifted (Art. 41) Art. 10 Repurchase of game credits In exceptional cases, in response to players requests submitted via Internet (requests sent by SMS will not be considered), Swisslos is prepared to repurchase players game credits and transfer the corresponding amount to a bank or postal account in the player s name. A refund is only possible in the following cases: if the wallet is liquidated on deactivation of the user account; if the wrong amount is inadvertently paid in (e.g. CHF 1,000 instead of CHF 100) and this is reported within 24 hours; if the same amount is inadvertently paid in several times in succession and this is reported within 24 hours. Game credits purchased and games credits accumulated under promotions or by redeeming gifts cannot be paid out. Swisslos reserves the right to refuse to reimburse stakes if players improperly or unduly avail themselves of the payout option for amounts paid in. A legitimately requested payout will be transferred within 5 to 10 working days. Art. 11 Expiry of game credits In principle, game credits in a wallet have no expiry date. Wallets not registering any movements for more than 2 years will be liquidated by Swisslos. The game credits in question will expire with no entitlement to compensation and will be used for the charitable purpose to which Swisslos contributes. 7

Blocked access Art. 12 Access blocked at the player s instigation A request to block personal access to the products available via the ISP can be made directly via the Internet hotline (Art. 45) during business hours. While the ISP is available, players may themselves block their own personal access to different specified products in the Limits & blocking section. Art. 13 Unblocking After entering the wrong password three times, players can request that access be unblocked subject to submitting their user name or address via the ISP. In such a case, a link for setting a new password will be sent to the address given at registration. Where a player has made a request via the Internet hotline (Art. 45) to block access, this can be rescinded subject to the furnishing of sufficient proof of identity. Art. 14 Access blocked by Swisslos At any time and without specifying the reasons, Swisslos is entitled to block a player s access to the products available via the ISP if it objectively judges this measure to be appropriate. Access will in any case be blocked if the registration requirements are no longer satisfied. E. Termination of right of access Art. 15 By the player 15.1 Players may at any time terminate their right of access to the ISP by cancelling the registration and thus closing the wallet. Registration is cancelled by entering the Delete profile command (under the Profile menu). Termination will be effective as soon as the following conditions are satisfied: The wallet no longer contains any game credits and/or unredeemed gifts or coupons. If the wallet still contains game credits, they will be repurchased as stipulated in Art. 10. There are no outstanding tickets for picks still to be played in one or more draws or bets under products available via the ISP. There are no outstanding unplayed virtual instant tickets, no open Bingo product games and no matches still running under a Jass product. There are no outstanding tickets with prizes not yet paid out or with Replay prizes not yet redeemed. There are no outstanding gifts ordered by the player that have not yet been redeemed or cancelled. Any Abo Nonstop subscriptions will be automatically cancelled on termination of right of access. 8

11 There are no outstanding tickets for a Totogoal Abo Fix subscription that is still running and still valid for participation in one or more Totogoal bets Players may also choose solely to terminate the option to receive prize notifications, jackpots, etc. by SMS. This is done by deleting the mobile telephone number from the player s profile and can be requested directly via the Internet hotline (Art. 45) during business hours. Players cannot delete their mobile telephone number from their profile themselves. Art. 16 By Swisslos At any time and without specifying the reasons, Swisslos may terminate right of access to the ISP by cancelling the registration and closing the wallet. Termination will be effective as soon as the following conditions are satisfied: There are no outstanding tickets for picks still to be played in one or more draws or bets. There is no outstanding unplayed virtual instant ticket. Instant tickets which at the time of termination have not been played in full will automatically be evaluated in accordance with the applicable Terms and Rules for the online system. The same applies to open Bingo product games and matches still running under a Jass product. There are no outstanding tickets with prizes not yet paid out or with Replay prizes not yet redeemed. There are no outstanding gifts ordered by the player that have not yet been redeemed or cancelled. Any Abo Nonstop subscriptions will be automatically cancelled on termination of right of access. There are no outstanding tickets for a Totogoal Abo Fix subscription that is still running and still valid for participation in one or more Totogoal bets. If at the time of entry into force of the termination instigated by Swisslos the wallet still contains a credit balance, Swisslos will liquidate the wallet and pay the balance out to the player. Any coupons not redeemed will be forfeited. Any gifts not redeemed will be cancelled and the debited gift amount will be credited back to the gifter. An Abo Nonstop subscription that has been suspended for more than 180 days will be automatically cancelled by Swisslos via the system. An Abo Nonstop subscription that has been cancelled for more than 180 days will be deleted, i.e. removed from the subscription status list. 9

Gaming Contract Art. 17 Conclusion of the Gaming Contract 17.1 The Gaming Contract, which confers the right to participate in the products made available by Swisslos via the ISP, is deemed concluded between Swisslos and the player if the player is registered and has acknowledged acceptance of the Terms and Rules in force for the respective product and the Terms and Rules for Internet Games; the stake for the respective transaction or play request has been placed; the participation transaction data has been transferred via web interface to Swisslos, the product has been bought and participation has been recorded on the Swisslos host in accordance with the regulatory provisions and a corresponding entry confirmation ticket has been generated on the ISP. In respect of sports bets, Swisslos reserves the right to refuse to conclude a Gaming Contract without specifying the reasons or the right to stipulate certain conditions for the conclusion of a Gaming Contract (e.g. a limit on the amount of the stake, restrictions regarding the matches to be played). The right to refuse to conclude a Gaming Contract is excluded if it is under a Totogoal Abo Fix subscription that was legitimately concluded and paid up If an Abo Nonstop subscription is concluded, in addition to the entry confirmation ticket a subscription ticket is generated and stored in the player s ticket archive under Jackpot subscriptions. Subscription tickets contain the following information in particular: subscription type (for Totogoal only Abo Fix or Abo Nonstop); subscription status; the link to the individual entry confirmation tickets; as well as a unique identification code (=subscription number) The provisions of Art. 25 remain unaffected In concluding a Gaming Contract with Swisslos, the player recognizes unreservedly these Terms and Rules as well as all other Swisslos provisions applicable to participation in the products listed in Art

Nature of participation Art. 18 Participation options 18.1 With regard to participation in the products made available by Swisslos via the ISP, solely the following play slips and instructions are valid: In respect of Internet games: the Internet play slips on the Swisslos website www. swisslos.ch. Swisslos reserves the right to change the graphic representation of play slips at any time. In respect of subscription plays: o Swiss Lotto and EuroMillions plus 2 nd Chance The Abo Nonstop subscription, which allows the subscribed player to play the desired number (stipulated when creating the subscription) of individual picks or the desired system and, as the case may be, picks for Joker (Swiss Lotto only) and Super-Star (EuroMillions plus 2 nd Chance only) until the subscription is cancelled or the wallet balance is insufficient or the right of access to the ISP has been terminated. Players may select the jackpot amount as of which they wish to participate. o Totogoal: The Abo Fix subscription, which allows players to participate in the fixed number of bets (between two and ten) defined by them. Players will be notified by prior to expiry of an Abo Fix subscription, if they so request. The Abo Nonstop subscription, which allows the subscribed player to play the desired number (stipulated when creating the subscription) of individual picks every week until the subscription is cancelled or the wallet balance is insufficient or the right of access to the ISP has been terminated. Reactivation of an Abo Nonstop subscription suspended owing to an insufficient wallet balance and termination or cancellation of an Abo Nonstop subscription suspended for more than 26 weeks are subject to the corresponding provisions (Art. 16) System and subscription plays can be but do not have to be offered for all products sold via the ISP With regard to participation in virtual instant ticket, Bingo or Jass products via the Internet, the sole legitimate products are the virtual instant ticket, Bingo and Jass products on the Swisslos website www. swisslos.ch which are issued or allocated by Swisslos in accordance with the Terms and Rules for Virtual Instant Tickets, the Terms and Rules for Post-drawn Virtual Bingo Lottery Products and the Jass Terms and Rules. 11

14 18.4 Players must fully play out every purchased virtual instant ticket in accordance with the applicable Game Rules on the instant ticket. A virtual instant ticket is deemed to have been fully played out when the result (win or loss) has been established. If a player purchases a virtual instant ticket but does not play it out in full, when that virtual instant ticket is next called up on the ISP, the status when the player left the respective page will be shown. If the most recently purchased virtual instant ticket has not been played out in full, it will automatically be evaluated by the ISP Gaming System after no later than 90 days (see Terms and Rules for Virtual Instant Tickets) The correct playing of virtual instant ticket, Bingo and Jass products is controlled by the ISP via the dialog Swisslos reserves the right to amend or delete existing modes of participation and instructions and/or to introduce new ones. Art. 19 General remarks Entries on the Internet play slips will be controlled by the ISP via the dialog. Markings must be entered via the user interfaces. Incomplete Internet play slips cannot be played. In the case of subscription plays, the corresponding entry confirmation ticket on the ISP is definitive, not the ticket issued for the purchased subscription. Art. 20 Swiss Lotto and EuroMillions plus 2 nd Chance 20.1 Players can choose between individual picks and system plays. A Jackpot Abo subscription option allowing players to participate in multiple draws on a subscription basis is also available for individual picks and system plays Players can either select their picks themselves or use the quick pick option. Players making individual picks can also play using the pick generator ( random numbers ). For both the quick pick and pick generator options, Swisslos produces picks or predictions by random generator on the ISP. In the case of quick picks, the number of entry fields desired and the corresponding stake can be determined by the player. In the case of the pick generator, the system completes a single entry field on the Internet play slip with the required quantity of numbers, which can later be changed manually. When redeeming a Replay prize (Swiss Lotto only), participation is in the form of a quick pick; players cannot and do not need to provide further instructions. Players may, however, opt to participate in a Joker game The Joker numbers and Super-Star combinations for Joker games and Super-Star 12

15 are produced by random generator. Players participating via the Internet who would like other Joker numbers or Super-Star combinations can have other numbers generated by the system For players participating via the ISP, the Replay number (Swiss Lotto only) will be produced by Swisslos by random generator at the time the data on the Internet play slip is transferred to Swisslos (Art. 25) and be indicated on the entry confirmation ticket (Art. 26). The generated Replay number cannot be changed. must choose the quick pick option. The maximum number of picks is 12 (full Internet subscription play slip). In accordance with the pairing principle, at least two or a multiple of two quick picks must be played In each grid of the Internet play slip used by players to participate in a Totogoal bet, they must indicate by mouse click their prediction for the respective outcome of matches 1 to 13 selected for the Totogoal bets as well as the result of match 14 (R) or have predictions produced via pick generator or be determined by the system. Art. 21 Totogoal 21.1 Players can choose between individual picks and system plays. Under the individual picks option, players can also choose to participate in several bets in succession (subscription play), for which special Internet subscription play slips are available Players can either select their picks themselves (one, two or three-way predictions or in the fields provided on the Internet play slip for system plays), choose expert picks or play using the quick pick option. For both the expert pick and quick pick options Swisslos produces picks through the ISP by random generator. In the case of quick picks, the number of entry fields desired and the corresponding stake can be determined by the player. Subscription players Art. 22 Sporttip 22.1 Players can choose between Sporttip set and Sporttip one. There are separate Internet play slips for each of these two game options. The play slips are in the form of betting programmes On each Internet play slip used by players to participate in the bet, they must indicate by mouse click their choice of sporting event(s) from the betting programme displayed and predict the respective outcome or the result on which the bet is decided. In addition to the choice of sporting event(s) and the picks and predictions, the amount of the stake is to be stipulated; for Sporttip set plays the bet or type of bet is also to be stated. In the case of a system bet, the system selected must be indicated as well. 13

16 Art. 23 Storage of completed Internet play slips 23.1 Lotteries Internet play slips for individual picks and system plays can be stored and reused. A stored play slip does not in any way constitute proof of participation in a draw Sports bets Internet play slips for Totogoal and Sporttip bets cannot be stored and reused since a new betting programme is published for each betting period. An expired Totogoal Abo Fix subscription can, however, be renewed on the subscription ticket. H. Stake and limits Art. 24 Payment of the stake 24.1 In respect of Internet Games, the total stake per transaction or play request is debited from the player s wallet on the ISP when the data are sent via the respective interface to Swisslos. In the case of a subscription play under an Abo Nonstop subscription, participation per Swiss Lotto, Joker, EuroMillions plus 2 nd Chance or Super-Star draw or per Totogoal bet is considered to be one play request. Accordingly, the stake is debited weekly from the wallet for the subsequent draw or betting round. In the case of a subscription play under a Totogoal Abo Fix subscription, the subscription concluded is considered to be one play request for the total number of bets selected, i.e. on purchase of the subscription, the entire stake for all bets played on the basis of the Totogoal Abo Fix subscription is deducted once from the wallet. The amount of the price per virtual instant ticket, Bingo or Jass product is defined separately for each product and laid down in the respective Game Rules If there is an insufficient balance in the wallet to cover the complete transaction or order request, the corresponding play slip(s) cannot be played and the wallet will not be debited. In the case of a subscription play under an Abo Nonstop subscription, this means that if there is an insufficient balance in the wallet for the subsequent play request, the subscription will be provisionally suspended. As long as they have not previously cancelled the subscription via the Internet hotline (0), players will receive a balance mail via , inviting them to purchase stakes in accordance with the provisions of Art. 8.1 to Art. 8.3 in order to continue participation under the Abo Nonstop subscription. In every case of insufficient coverage, this balance mail will be sent once only until such time as payment has been made. It applies to all Abo Nonstop subscriptions for all products played via the ISP in cases where an insufficient balance in the wallet means that the subsequent play request can no longer be executed. Players following this invitation and purchasing stakes will be notified by 14

17 that they have further Abo Nonstop subscriptions which are no longer active. Players will be referred to the Jackpot subscriptions menu, where they will find an overview of the status of their Abo Nonstop subscriptions and be able to reactivate them. Subscriptions may only be reactivated if the balance in the wallet is sufficient for at least one entry. Players may reactivate a suspended Abo Nonstop subscription via the Jackpot subscriptions menu at any time if their wallet has been reloaded by means other than payments, e.g. through prizes, refunds, coupons or gifts The maximum total stake per transaction or play request is CHF 7, Within this maximum total stake, game credits accumulated through payments, prizes or refunds may be freely used by the player to participate in a draw or bet. With regard to game credits accumulated through promotions or gifts, the restrictions imposed in connection with the respective promotion or gift will apply. Used game credits will be deleted (i.e. debited) from the wallet. Game credits are personal Prior to purchasing the first virtual instant ticket, Bingo or Jass product, players will be asked to state the maximum amount that they are willing to stake per day, per 7 days and per 30 days. Prizes, refunds and promotion credits paid out into the wallet will increase the limits. Combined limits apply for virtual instant tickets and Bingo products and special limits for Jass products. The selected limits will be posted under the Limits & blocking menu. Players may themselves set these amounts (limits), within the upper limits stipulated by Swisslos Limits set by players in accordance with Art may be changed by them at any time; downward changes (i.e. reductions) in individual limits take effect immediately, and increases after a period of 72 hours In the interests of responsible gaming, Swisslos reserves the right to make information available to players about their gaming conduct when specific limits are reached Each SMS from Swisslos will be debited to the player at the current charges per MT (mobile terminated) SMS. The current charges per SMS for the different subscription services can be seen at www. swisslos.ch. Swisslos reserves the right to revise the charges at any time subject to appropriate publication. I. Treatment of data Art. 25 Collection and storage of data The collection of data or the purchase of a virtual instant ticket, Bingo or Jass product is initiated by the player. The process for purchasing virtual instant ticket, Bingo and 15

18 Jass products is controlled by the ISP via the dialog. The virtual instant tickets, Bingo cards or Jass cards pregenerated by the system are allocated by Swisslos to players on a random basis. They are recorded at the Swisslos data processing centre for evaluation purposes and stored and secured there. Only predictions duly stored on the Swisslos host in accordance with regulatory provisions and for which a stake has been paid in line with these Terms and Rules are eligible for the evaluations applicable to the respective product and can form the basis of a claim to a prize. Quick picks, Replay numbers, Joker numbers and Super-Star combinations are generated at the Swisslos data processing centre. J. Entry confirmation ticket Art. 26 Issue 26.1 After the Internet play slip has been sent via the interface through the online system to Swisslos or immediately after allocation of the virtual instant ticket or Bingo or Jass cards or card sets via interface through the Swisslos ISP Gaming System and after the corresponding game credits have been automatically deducted from the player s wallet on the ISP, an entry confirmation ticket is generated for the player and filed in his ticket archive under Game account In the event that the data or predictions indicated on the entry confirmation ticket or replacement ticket were not stored by Swisslos in accordance with the regulatory provisions, the player will be excluded from the corresponding draws or sports bets shown on the ticket in the interest of safeguarding the secure and reliable execution of the lotteries and sports bets and to protect the interests of all players. Art. 27 Content 27.1 Swiss Lotto and/or Joker Entry confirmation tickets for participation in Swiss Lotto contain the following information in particular: the type of participation; the players predictions and/or the quick picks generated for Swiss Lotto; the number of the system selected in Swiss Lotto, if applicable; the Replay number produced by the Swisslos random generator; the Joker number(s) with which the player is participating in the Joker game, if applicable; the number of draws selected (validity period) as well as the date of the draw in which the player will participate (in the case of subscription plays, the dates of the first and the last draws in which the player will participate); 16

19 the stake paid; the date and time of receipt of the data by Swisslos; a unique identification code (=ticket number), as well as the status of the ticket EuroMillions plus 2 nd Chance and/ or Super-Star Entry confirmation tickets for participation in EuroMillions plus 2 nd Chance contain the following information in particular; the type of participation: the players predictions and/or the quick picks generated for EuroMillions; the number of the system selected in EuroMillions, if applicable; the Super-Star number(s) with which the player is participating in the Super-Star game, if applicable; the number of draws selected (validity period) and the date of the draw in which the player will participate (in the case of subscription plays, the dates of the first and the last draws in which the player will participate); the stake paid; the date and time of receipt of the data by Swisslos; a unique identification code (=ticket number); the status of the ticket, as well as for Extra EuroMillions draws, an unambiguous nine-character combination of letters and numbers (Extra Millions combination) per prediction or a corresponding section for combinations of letters and numbers Totogoal Entry confirmation tickets for participation in a Totogoal bet contain the following information in particular: the type of participation; the players predictions and/or the quick picks generated for Totogoal; the number of the system selected, if applicable; the date on which the player will participate in the Totogoal bet; the stake paid; the date and time of receipt of the data by Swisslos; a unique identification code (=ticket number), as well as the status of the ticket Sporttip Entry confirmation tickets for participation in a Sporttip bet contain the following information in particular: the product and type of the Sporttip bet entry (Sporttip set or Sporttip one); the type of bet (for Sporttip set only); the individual sporting event(s) selected and the player s prediction(s) and/or picks; the odds for each bet; 17

20 the date and time of receipt of the data by Swisslos; a unique identification code (=ticket number), as well as the status of the ticket. plus, for single Sporttip set bets: the odds for each single bet or the overall odds; the winning amount for a correct prediction with a single bet; confirmation of the stake paid; plus, for Sporttip set system bets: the designation of the system selected; all the single bets made using the selected system, together with the overall odds; confirmation of the stake paid for each single bet and the total stake; plus, for Sporttip one: confirmation of the stake paid for each prediction and the total stake, if applicable Virtual instant ticket products Entry confirmation tickets for participation in virtual instant ticket products contain the following information in particular: the name of the instant ticket product (= name of the virtual instant ticket played); the stake paid; the date or date of issue of the entry confirmation ticket; a unique identification code or the instant ticket number including the number of the respective lottery or instant ticket series; the date of the last day of sale; expiry date; the status of the entry confirmation ticket (instant ticket bought, instant ticket played); the prize (only after the virtual instant ticket has been played in full) Bingo products Entry confirmation tickets for participation in Bingo products contain the following information in particular: the name of the Bingo product; the stake paid; the date or date of issue of the entry confirmation ticket; a unique identification code or the number of the Bingo play request; the status of the ticket Jass products Entry confirmation tickets for participation in Jass products contain the following information in particular: the name of the Jass product; the stake paid; the date or date of issue of the entry confirmation ticket; 18

21 a unique identification code or the number of the Jass play request; the status of the ticket. Art. 28 Validity Only entry confirmation tickets with a clearly identifiable identification code may be used as proof of participation and to claim a prize. As an additional precaution, all players are recommended to print out the entry confirmation ticket immediately and keep it in a safe place. Art. 29 Complaints Immediately after the entry confirmation ticket has been generated, the player is required to check it for correctness and completeness, in particular whether all details according to Art. 28 have been correctly and completely recorded and reproduced. In the event that mistakes or discrepancies are discovered, the player must report this immediately via the Internet hotline (Art. 45). If mistakes or discrepancies are discovered on issue of the entry confirmation ticket, the player must lodge an objection within 10 days of the date of sale. Under no circumstances may players participate in draws or sporting events that have taken place in the intervening period. Complaints received later can no longer be considered. Entry confirmation tickets issued in connection with the redemption of Replay prizes (Swiss Lotto) cannot be corrected. In all other respects, Art. 34 applies. K. Winnings Art. 30 Prizes up to max. CHF 1, Prizes up to max. CHF 1, per entry confirmation ticket are credited automatically and directly as game credits to the winner s wallet without the player being required to claim them or present the entry confirmation ticket. In the case of subscription plays, this limit applies to all prizes per entry confirmation ticket that were won on the same draw or bet date. Furthermore, players who have subscribed to the Prize notification newsletter will be notified immediately by (or by SMS if requested) if they have won a prize. In the case of virtual instant ticket, Bingo or Jass products, any prizes will be displayed immediately to the player when logged in. Art. 31 Large prizes above CHF 1, Players who have subscribed to the Prize notification newsletter will be notified immediately by (or by SMS if requested) if they have won a large prize of more than CHF 1, per entry confirmation ticket. In the case of virtual instant ticket, Bingo or Jass products, any prizes will be displayed immediately to the player when logged in. If the player has already provided Swisslos with details of a bank or postal account in his name, the prize will be paid out directly into this account after three working days without the player being required to claim it. Players who have not provided Swisslos with details of a 19

22 bank or postal account in their name will, when they next log into the ISP via the Internet with their user name and password, automatically be requested to provide details of their bank or postal account so that the prize can be paid out. Moreover, players who have subscribed to the Prize notification newsletter will receive an request from Swisslos to provide details of their bank or postal account when they next log into the ISP. Once players have supplied the necessary information, the prize will be paid out into the specified account. Art. 32 Payout 32.1 If Swisslos has the relevant account details, large prizes above CHF 1, (Art. 31) will be paid out directly into the player s bank or postal account within 3 working days without the player being required to claim it. Where the player only provides details of his bank or postal account in response to a corresponding request according to Art. 31, the payout will be made within 3 working days of receipt of the relevant information. If the player fails to respond to this request within 42 days of the date of public notification of the result of the draw, the prize will be paid out by outpayment order or cheque to the address registered by the player. Payouts may only go to the address of the registered player and must be made out in the latter s favour Account details provided to Swisslos will also automatically be used for the payout of any prizes, wallet balances or refunds to be made by Swisslos in the future. Players wishing to change their account details may do so when an outstanding payout is due or by contacting and notifying the Internet hotline (Art. 45) Within 26 weeks of the day of the draw or bet or refund, players may request via Internet that prizes credited directly to their wallet (Art. 30) and refunds paid into the wallet (Art. 9) be paid out in full or in part to their bank or postal account. Within the payout period, prizes and refunds may only be paid out in an amount not exceeding the credit balance in the wallet. Art. 33 Replay prizes (Swiss Lotto) and prizes from virtual instant ticket, Bingo or Jass products In the case of Replay prizes, the number of Replay quick picks won entitling the player to participate in the subsequent Swiss Lotto draw are automatically generated by the Swisslos online system as soon as the player redeems his Replay prize, but by no later than within the 26-week period. An entry confirmation ticket for the Replay quick picks will be generated for the player and filed in his personal ticket archive under Game account. 20

23 If the player does not redeem the prize within 26 weeks, the Replay prize will be automatically played for the player by the ISP, i.e. the number of Replay quick picks won entitling the player to participate in the subsequent Swiss Lotto draw are automatically generated by the Swisslos online system. An entry confirmation ticket for the Replay quick picks will be generated for the player and filed in his personal ticket archive under Game account. After the virtual instant ticket, Bingo or Jass product has been played, the result will be displayed to the player. The win display triggers prize processing. If the player does not navigate to the win display, the prize will automatically be processed after the period stipulated by the system. Art. 34 Objections Players whose alleged prizes were not displayed or paid out in accordance with these Terms and Rules may lodge an objection within 10 days of the date they took note that they had not been notified of the prize, but by no later than expiry period set by the respective lottery. Entitlement to the prize will otherwise lapse and it will be used for the charitable purpose to which Swisslos contributes. The objection must be submitted by registered letter addressed to Swisslos and handed in at an office of Swiss Post by no later than the final day of the period for objection. The appeal must include the player s name and address, the designation of the lottery product or sports bet, the date of purchase and the grounds for objection. Moreover, the ticket supporting the claim, or any other documents supporting the claim, must be enclosed. Objections received late or which do not include all the necessary information cannot be considered. Solely those predictions which are stored with Swisslos in compliance with the regulatory provisions are relevant for the assessment of entitlement to a prize in accordance with these Terms and Rules. L. Promotions Art. 35 General remarks 35.1 In association with its promotions or advertising events (hereinafter collectively known as promotions ), Swisslos reserves the right to deliver benefits to players if they fulfil the criteria laid down by Swisslos for that particular promotion. Swisslos determines the type of promotion, its duration, the benefits to be offered by the promotion and the criteria for entry. Non-designated players are not entitled to participate in a promotion Players cannot reject the benefits offered to them. Benefits offered cannot be exchanged or paid out in cash. They are non-transferable and may not be sold, auctioned or gifted. Benefits can only be used during the time in which the particular products are valid. 21

24 Art. 36 Benefits With regard to participation in the products offered by Swisslos, the following benefits in particular are available: Free participation in a game: Under this promotion, players receive a free quick pick for a Swiss Lotto or EuroMillions plus 2 nd Chance draw or a Totogoal bet. The free quick pick is automatically generated by the system (players are neither required nor able to give instructions) with participation triggering allocation of the benefit for the next Swiss Lotto or EuroMillions plus 2 nd Chance draw or Totogoal bet. Players cannot change a free quick pick. A separate entry confirmation ticket is generated for players and filed in their ticket archive under Game account. The stake is indicated on the entry confirmation ticket as free. Free Joker (Swiss Lotto only): Under this promotion, players receive a free Joker entry. Free Joker entries are automatically generated by the system (players are neither required nor able to give instructions) with participation in Swiss Lotto triggering allocation of the benefit for the next Joker draw(s). Players cannot change a free Joker entry. Free participation in a Joker draw or draws is indicated accordingly on the entry confirmation ticket after the Joker number. Game credits: Under this promotion, the player receives a coupon for game credits to reload his wallet on the ISP. A distinction is made between game credits which can be used for all products that can be played on the ISP and those for selected products only. After the coupon has been redeemed for game credits, the balance is credited to the player s wallet. It is listed separately and only deducted when the first play request is submitted after the credit entry has been made. Where more than one promotion coupon has been redeemed, the coupon with the earliest expiry date will be deducted first. Percentage discount: Under this promotion, players receive a coupon for a percentage discount on a future stake. A distinction is made between percentage discounts which can be redeemed for all products that can be played on the ISP or for selected products only. The discount coupon must be redeemed within the period of validity via the Redeem now link on the coupon overview page. The stake, the discount given and the effective debit entry are then all indicated on the entry confirmation ticket. Non-cash prizes: Under this promotion, players receive a non-cash prize stipulated in advance by Swisslos. This and the corresponding information will be sent to the address posted in the players profile. M. Gifts Art. 37 General remarks Swisslos offers players registered on the ISP the opportunity to gift game credits to third parties via to reload their wallets. The gift is made on the basis of a contract between the gifting player 22

25 ( gifter ) and Swisslos via ch in favour of the third party ( giftee ). The contract is concluded by the gifter by means of the gift function on www. swisslos.ch. Insofar as the following provisions conflict with the other regulations under these Terms and Rules for Internet Games or with the product-specific Terms and Rules, they take priority as special regulations. Art. 38 Conditions 38.1 Gifters must be registered on the ISP and have reached their 18 th birthday. A gift can only be made if the gifter s wallet has a sufficient balance. If the balance is too small, the wallet will not be debited. In accordance with the online payment options (Art. 8.1), gifters may purchase stakes within the specified limits (Art. 8.2 and 8.3) and then continue the gifting process Gifts may only be received by persons registered on the ISP. Where these conditions are not satisfied, Swisslos reserves the right to cancel the gift order and to reverse any provisional debiting of the gifter s wallet in the amount of the gift. Art. 39 Nature and amount of the gift 39.1 Game credits credited to the giftee s wallet qualify as permissible gifts. A distinction is made between game credits which can be used for all products that can be played on the ISP and those for selected products only With regard to the amount of the gift, the following regulations and limits apply: Whole franc amounts only may be gifted. Gifters may freely choose any amount between a minimum of CHF 5 and a maximum of CHF 7,500. Art. 40 Issue and acceptance of the gift order 40.1 The gifter issues the gift order by pressing the Give gift button after having entered the following details and data: personal gift message; title, last name, first name, address and language of the giftee; and ticking to confirm acceptance of the Terms and Conditions for Giving Gifts If the gifter s wallet has a sufficient balance, after entry of the above-mentioned data by the gifter, Swisslos will accept the latter s gift order in favour of the giftee. The gifter s wallet will be provisionally debited in the amount of the gift. The gifter may view the corresponding debit notice at any time. The ISP generates a code for the giftee that the latter can use to redeem the gift. Gift orders issued by the gifter can be changed neither by him nor by the giftee. 23
