The Board of Elko County Commissioners met in regular session on Wednesday,, at 1:30 p.m., at the Nannini Administration Building, Suite 102, 540 Court Street, Elko, NV There were present: County Commissioners Demar Dahl Cliff Eklund Jon Karr Rex Steninger, Vice Chair CFO/Asst. Cash Minor Deputy District Attorney Kristin McQueary Deputy County Clerk Michele Merkley A) CALL TO ORDER Vice-Chairman Steninger called the meeting to order at 1:30 p.m. and noted all Commissioners were present aside from Chairman Andreozzi who was absent. B) PLEDGE OF ALLEGIANCE Commissioner Dahl led the meeting participants in the Pledge of Allegiance. C) COMMENTS BY THE GENERAL PUBLIC Elko County Manager Robert K. Stokes Executive Assistant Michele Petty Deputy Clerk Michele Merkley Annette Kerr, Elko County Emergency Manager, challenged everyone to attend National Night Out on August 7 th from 6-9 p.m. at the Elko City Park. She advised the canines will be there putting on a demonstration as well as helicopters, SWAT, ambulances, and SRO's. It is a way for the community to talk with first responders and law enforcement. Assemblyman John Ellison wanted to get put on a future agenda or have the Commission draft a letter to NDOT and to the Governor in regards to Highway 93. There have been more accidents and passing lanes are a necessity. He will take a letter to Carson City if the Commission drafts one. Commissioner Karr stated he had their support. Commissioner Eklund advised this would have to be placed on a future agenda.

2 Rhonda Morfin, NDOT, was asked to come and share contact information for I-11. She provided the information for Kevin Verre, phone number Thad Ballard concurred with Assemblyman Ellison and stated Highway 93 was very troubling. William Glover advised he would like to see a situation where people who live off the grid could come to a public well that was fee free to get water. D) WELLS RURAL ELECTRIC D.1 Presentation by Thad Ballard of Wells Rural Electric on Ballot Question 3 that will appear on the General Election ballot. Layla Walz, Wells Rural Electric, made a presentation regarding ballot question #3 and how it would impact Elko County residents (presentation attached.) Commissioner Eklund asked what startup costs could cost $100 million. Layla advised there would be regulations, legislations, agreements, and restructuring of government agencies. Thad Ballard advised in other states where this was implemented, state-run websites were set up for vendors to post offers. Those websites are complicated and expensive. The PUC estimated they would have to triple or quadruple their staff. Other costs would be integrating with the California system. Commissioner Dahl asked why they would have to be tied to California utilities. Thad advised Idaho and Utah were not part of a competitive wholesale market. In order to make a wholesale market work, they have to have a neutral landscape for all the power providers to be on. California is the most logical way to set that up currently. Commissioner Eklund asked if some of the reasons mentioned were the cause of rolling blackouts. Thad advised they paid $3.38 per kilowatt and in the recent weeks, the rate has been as high as $990 per kilowatt in order to meet California's demands. Thad continued the presentation. Vice Chairman Steninger asked if the legislation was proposed yet. Thad advised it was not, and they had concerns because it was a constitutional amendment and left a lot of unanswered questions. Vice Chairman Steninger stated it was complicated and he had gone back and forth on the issue. He stated if they wanted a resolution it would have to be put on an agenda and they would have to hear the pros as well as cons. Thad advised the amendment didn t address distribution operation so they would still be confined to their designated service territory. Layla advised it was a common misconception that people could pick their provider but NV Energy would still own the power lines and substations and would still deliver the power to them. Commissioner Karr asked if Barrick and Newmont were buying their own power. Thad advised consumers with more than a megawatt of consumption were allowed to go out to market purchase. 704B states if you are going to leave the incumbent system you cannot leave a burden on the remaining customers. Assemblyman Ellison advised they had met with legislators and there were concerns about changing the constitution. He also has concerns about changing the co-ops and damaging the pivots in fields due to costs. He stated they are trying to do whatever they can. Vice Chairman Steninger stated the question would not change the constitution, it would direct the legislature to fix it. Page 2

3 Commissioner Eklund stated cost and dependability influenced people in regards to utilities. He asked what was being fixed by doing this. Assemblyman Ellison stated if the ballot question passes it would go to the legislature and they would try to amend the Nevada constitution. He stated he would like to see all the Counties speak up. E) I-11 INTERSTATE ROUTE E.1 Presentation from White Pine County Chair Richard Howe regarding the I-11 Interstate route and possible request to reconsider the route to include passage on the eastern side of the state. Richard Howe, White Pine County Commission Chairman, advised he and Jim Garza put together the reasons why I-11 should go up 93 instead of 95. The original route was to go up 95 to Fernley, to the Spaghetti Bowl in Reno, and then up 395 into Northern California and Oregon. The state engineers have recently decided to go with Route B, which goes up 95 to Fernley, to Fallon, Winnemucca, through Central Oregon and to British Columbia. He stated Route A was 872 miles, Route B is 1,018 miles and Route C which is US93 is 535 miles. Route C goes to Twin Falls and then gives access into Montana and Canada. By going up 95, private lands would need to be purchased and there are at least 4 tribes that would have to give permission to go through their land. He is asking Elko County to get on board with White Pine County and Idaho to influence the state to take a second look at option C. He stated 93 was a dangerous road but was a vital part of Eastern Nevada. The Government owns the right of ways on the land, so it would be a large cost savings. He stated they were building I-11 from Phoenix to Las Vegas, and in 2034 the new route North would begin. He advised this would not be a state highway it would be a federal highway. Commissioner Karr thought they should take the information under consideration and not take action at this time. Commissioner Eklund asked if Richard was asking for a written statement of support. Richard advised that he was. F) CONGRESSMAN MARK AMODEI F.1 Presentation from Congressman Mark Amodei on issues at the federal legislative level and their impact to our state and county. Congressman Mark Amodei discussed lands bills including the Pershing County public lands act which has passed the House and is waiting for action in the Senate. There are also 2 bills lined up, the Nevada Lands Technical Corrections act and a clean-up bill to keep the Anaconda Copper Mine Site off the superfund list. It is in Congress because they are transferring 2200 acres of land. He stated it would cost $39 million to do the cleanup. He advised they have kept track of how they funded PILT and their focus has been on getting it fully funded. He stated if they want a long-term solution, changing the language that governs it would be something to address. He discussed sage hen and stated they should talk about the habitat that has been burned and habitat that hasn't burned. They should be managing fuels for wherever they think is the biggest threat. He stated the cattle business was shrinking and intensively managed through the federal land management system. He suggested that the commission use their authority to say they wanted to know what burned 10 years ago and what burned from today to 10 years ago. He stated there would be a final proposed EIS in December. He introduced Martin Paris and Ken Brook. He discussed trade and agribusiness and stated a lot of what is imported is feed. He stated his analysis is that there are 375 votes for anything that funds or starts Yucca Mountain and thinks a Yucca Page 3

4 Mountain measure will come to the Senate floor. The bill that passed the House had routing information in it for Clark County. In regards to I-11, he agreed with Chairman Howe that it should be on their radar. He stated they are working on giving the BLM Elko District office money to run the Trail Center. They are making good progress and getting ready to close the fiscal year appropriations process. Commissioner Karr stated equal access to justice funds were a big problem in why the BLM can t make decisions because lawyers are constantly suing based on those funds. If the funds dry up or become more difficult to attain, lawsuits may decrease. Congressman Amodei advised they had worked on this and he will get a rundown on how the appropriations have changed. Commissioner Dahl stated this commission had passed a resolution to support the task force report which became bill He stated he made a presentation to the legislative lands committee and told them they are considering 1484 light. He thought it made more sense to go every County to ask their concerns and then incorporate them into one bill that represents the whole state. Congressman Amodei advised any lands legislation would be driven at the county or state level. He stated it was hard to pass a bill that gave land to the state when the state didn t want it to go through the legislature. He advised that to use resources in the remaining days to start a new public lands initiative would be very difficult. Commissioner Dahl stated they had 17 counties vote to support it as well as NACO. Congressman Amodei advised when it came time for the hearing in DC, NACO did not show. Commissioner Dahl stated their thinking was to offer 1484 light which would transfer the land already designated for disposal. Congressman Amodei advised Clark County wants a public lands bill. He stated he would not tell them what to put into their bill if it was something this commission wanted, it was his job to get it through the house. Vice Chairman Steninger stated the bill regarding daylight savings had not gone anywhere. Congressman Amodei stated Arizona opts out and they would look into it. G) KANE COUNTY V. UNITED STATES CLASS ACTION SUIT G.1 Discussion and consideration to join the Kane County v. United States Class Action Lawsuit to recover Payment in Lieu of Taxes (PILT) underpayments for fiscal years 2015 through Commissioner Dahl stated this was a no-brainer. Vice Chairman Steninger stated it was estimated that we were underpaid by $139,453. Kristin McQueary stated the law firm was doing it on a 33% basis plus extra fees and costs, so they could get around $90,000 if the lawsuit is won. She stated they would be paying their share so the cost would depend on how many other counties joined. She stated class counsel would ask for 1/3 of the amount recovered plus actual out of pocket expense, filing fees, etc. She was unsure if they would have the pay the federal government if the suit was unsuccessful. She spoke to District Attorney Tyler Ingram and he had no objection to the Commission joining the lawsuit and using outside counsel. Vice Chairman Steninger stated there was a letter from Jonathan from National NACO and he was comfortable with this. Cash Minor advised four Nevada counties had joined as well as multiple states. Kristin thought this was more of a political statement than a money maker for the counties and did not think it would cost them very much money. Page 4

5 Commissioner Dahl moved to approve. Commissioner Eklund seconded the motion. Commissioner Karr thought this was more of a legislative problem than a lawsuit. Commissioner Dahl stated they have to go to the federal government to ask for money to run their own County because they own the majority of the land. Commissioner Karr voted nay. Vice Chairman Steninger voted aye. The motion carried. H) NEVADA OUTDOOR SCHOOL H.1 Presentation from Melanie Erquiaga of the Nevada Outdoor School on the education and outreach programming of the past year. Melanie Erquiaga, Nevada Outdoor School, wanted to share results from the past year and wanted people to realize that the programs they offer are meaningful and impactful. She discussed the programs they offered for the summer and stated they also do programs and lessons during the school year. She introduced Jackie Lucero, Elko Director of Programming. She discussed the field trip programs and stated they collaborate with multiple agencies. Next year they will have 3 full-time Americore naturalists on staff. They have had 6000 participants in the programs in 6 months. She stated they pay for a staff member at the California Trail Center to help with programming. She stated she will be coming back with a proposal for a small amount of funding to help support these programs. They have an agreement with the School District who will be giving them $5000/year for the next 5 years. Commissioner Dahl asked about their Leonard Creek field trip. Melanie advised they would be fishing, archery, survival skills, and horseback riding. Vice Chairman Steninger called for a recess at 3:35 p.m. Vice Chairman Steninger reconvened the meeting at 3:45 p.m. I) NEVADA DEPARTMENT OF TRANSPORTATION I.1 Discussion and consideration of the revocable application for Occupancy of the Nevada Department of Transportation's Right of Way at the intersection of Lamoille Highway (SR227) and Trescartes Avenue in Spring Creek. Improvements were made at this intersection including ADA improvements connected to the existing bicycle path, a cattle guard was removed and the approach was widened to the developed width of the road. The County is to maintain the Trescartes intersection and drainage system. I.2 Discussion and consideration of approval of the Bike Path agreement with the Nevada Department of Transportation. Vice Chairman Steninger advised these items would be tabled. J) ENHANCED 911 J.1 Update on the Enhanced 911 Surcharge collections. Cash Minor advised they finished the year with $84,000 in collections and collected $12,700 last month. Page 5

6 J.2 Presentation from Ben Reed, Chair of the Elko County Enhanced 911 Board, regarding the Enhanced 911 Board's recommendations on the surcharge rate and discussion of potential rate increase to cover costs of the NextGen 911 system for a future Commission agenda. Chief Ben Reed, Chair of the Enhanced 911 Board, advised the advisory board had discussed the surcharge and voted unanimously to recommend to this board to consider raising the fee to $1. He discussed NRS 244A.7643 which allowed counties to increase the surcharge. He stated they were waiting on confirmation from Homeland Security on the grant but expect the grant letter in September. The consultant estimated $150,000 in annual maintenance fees and the idea is that those fees will come out of the surcharge. He stated it is estimated that the current surcharge would bring in only enough to cover the maintenance. He advised the GIS had to be developed whether or not Owyhee was included, and that would be one of the next steps taken. He advised the additional surcharge funding could be used for upgraded computer-aided dispatch software, devices compatible with FirstNet, electronic mapping solutions for all 3 PSAPS, land/mobile radios, etc. Many agencies also have an IT person on staff paid for by the surcharge and they discovered several counties had higher surcharges. He stated they only had one citizen show up to their meeting and he was in favor of this. He encouraged the board to place this on a future agenda for action. Vice Chairman Steninger stated he had reservations about going from $.25 to $1. Chief Reed stated the fee would go to all three centers, including equipment and radios. He stated mobile data terminals could be upgraded and they would be able to receive citizen photos and videos in the field. He stated the NRS allowed them to use the surcharge for any technology communication. Commissioner Karr recommended that this board forward questions to the advisory board to be answered and brought back. Cash Minor commented that the operational costs would grow based on the consultant's estimate. He stated they are barely touching the tip of the iceberg, and there are several other pieces that will be needed. He asked that the board forward him any questions. Commissioner Eklund stated Clark County had attached it to their property taxes. Cash advised because of population Clark County was bifurcated from the per line charge and received special legislation to allow them to do so. K) FIRE UPDATE REPORTS K.1 Elko County Fire Protection District update report on area fires by Linda Bingaman. Linda Bingaman, Elko County Fire District, advised they have had approximately 93 incidents in the last 30 days. There were 38 wildland fires, 1 structure fire with wildland extension, and 3 vehicle fires. She discussed the large fires within the County. She stated the Martin fire burned 200,000 acres in an 8 hour period, and things are burning very quickly. She discussed the Goose Creek Fire and stated they had been working with the ranchers and rancher liaison. She provided maps and the incident action plan. She stated July 24 th they had 8 confirmed starts and multiple false alarms. K.2 Bureau of Land Management update report on area fires by Greg Deimel. Commissioner Dahl asked about the meeting with the ranchers. Greg Deimel, BLM, advised the fire started Thursday and the rancher liaison had been in communication with the ranchers since Friday. He stated they received a list of ranchers on the Utah side on Monday and started reaching out. The fire was at 35% containment as of this morning and was very Page 6

7 steep. He advised they have had 2 large fires, the Martin Fire and the Goose Creek Fire. August looks like it will be the same with above normal potential for fires. He stated they have 13 fires on Inciweb, all of which are 300 acres or more. There has been approximately 350,000 acres burned so far. He discussed the Martin rehabilitation plan and stated they were looking at doing 500-foot green strips instead of fuel breaks. They are completing their plan and will be back to brief the commission. He advised there was very little livestock loss on the Elko side but one rancher on the Winnemucca side lost everything. They are predicting that September will see a decline. He stated there have been no major injuries, but a few heat-related illnesses. He thanked the community and everyone on the fire lines for all their support. There has been minimal structure loss and stated the crews were doing a tremendous job. Commissioner Dahl advised they have half the amount of cows on the lands that they did in the 1980s and more fuel. He stated when he was young they did not have the fires that they have now because they attacked the fires early and the land was being grazed. Greg advised they have two outcome based grazing projects and one targeted grazing project. The area where the targeting grazing took place helped slow or stop the fire. Commissioner Dahl stated there was too much money in fires and too many people had too much to gain from fires growing. He stated during the fire South of Wells there were 6 airplanes on the ground in Wells and they could not go out. Greg advised planes are controlled nationally and he does not control them. He advised they burned some wilderness study area below the Pequops and got permission to do full suppression. He advised they had resource advisors who go out on every fire to protect the assets in the area. He stated the crews were working very long hours and didn t always get their days off. L) ELKO COUNTY LIBRARY BOARD OF TRUSTEES L.1 Report and review of Board of Trustees activities and minutes including issues related to the operation of the County Library. Kassie Antonucci, Library Director, stated July was a busy month and provided the statistics for programs, participants, visits, and circulation. She advised on August 18 th they will be hosting a tech fair in partnership with GBC and will have VR equipment set up. They will also have a 3D printer on loan from Carson City. GBC will be bringing a welding simulator and a programmable robot for demonstrations. She advised they were waiting for the camera mounts to fit on the building and then the security cameras will be up and live. M) ELKO COUNTY DISTRICT ATTORNEY'S OFFICES M.1 Discussion and consideration of a request from Cliff Gardner to ask the Elko County District Attorney's Office to seek an Attorney General's opinion on the Federal Government's "unlimited" jurisdiction over public lands and the effect on the constitutional rights of the citizens of our state. Vice Chairman Steninger advised Cliff had contacted Patty Cafferata and she advised him the best way to proceed would be to go through the Commission and ask the District Attorney to present the questions to the Attorney General. He read Cliff Gardner's questions into the record. Vice Chairman Steninger stated he could vouch for the fact that Cliff was a sincere, thoughtful, and concerned man and was very concerned about the direction this country has taken. He stated the courts and federal agencies Page 7

8 have assumed Article 4 powers and the courts have ruled that those powers are not limited by the constitution. Cliff Gardner stated what has happened in regards to the fires and federal management of the lands was a disgrace and shame should be placed on the entire nation for allowing it. Commissioner Eklund moved to ask the District Attorney s Office to forward Cliff's questions to the Attorney General s office. Commissioner Dahl seconded the motion. The motion passed unanimously. N) ELKO COUNTY PLANNING AND ZONING N.1 Parcel Map Roadway Easement Dedication of Elko County Road 754 (Upper Metropolis Road) for public use. The 30' wide roadway easement is for a Parcel Map for Carl. O. Peavey Family Trust located in Section 29, Township 39 North, Range 62 East. The easement to be dedicated is 30' wide and approximately 350' long. This roadway easement is North of the City of Wells. Peggy Pierce-Fitzgerald, Planning and Zoning, advised this was a parcel map that had been split up. They are dedicating this piece because it was never dedicated to the County whereas the other 30 feet had been dedicated in She stated it would equal 60 feet wide. Commissioner Dahl moved to approve. Commissioner Eklund seconded the motion. The motion passed unanimously. O) ELKO COUNTY NATURAL RESOURCES O.1 Discussion and consideration of approval of a new position entitled Natural Resources Director. Vice Chairman Steninger advised when Randy Brown retired the budget committee decided not to replace him. The commission refilled the position in December, but John Baldwin left after 6 months. When discussing how to replace John they tried to get an engineer that had community development experience. That fell through, and then John Kingwell announced he was retiring. They thought they could replace John Baldwin with someone who had natural resource expertise and replace John Kingwell with someone that had community development expertise. Kristin McQueary asked if they had developed a job description. Vice Chairman Steninger advised it would be similar to John Baldwin's minus the community development. Commissioner Karr asked if they had a chain of command, job duties, title, etc. Amanda Osborne, HR, advised they did not. Commissioner Karr asked who would report to who. Vice Chairman Steninger advised this position would report to the County Manager. Amanda advised they need to have these conversations before they approve this position. Vice Chairman Steninger stated he was told the first step they needed to take was to approve the position. Commissioner Karr stated this needed to be thought out and detailed out before being approved. Commissioner Eklund asked if this was an administrative or staff position. Page 8

9 Amanda advised it would be whatever they wanted it to be. She stated some of the changes needed to be taken into consideration. She stated they need to look down the road to the future. Commissioner Dahl stated in the meantime they need someone in this position. Kristin McQueary stated Randy Brown started out as the County Surveyor and the job grew around his talents and abilities. She had spoken with John Baldwin before he left and there were aspects of the job he was not aware of. She stated they would be doing a disservice to anyone if they didn't have a clear vision of how they wanted the jobs and functions laid out. She stated John Kingwell is the zoning and code enforcement officer and was not a licensed surveyor. Commissioner Eklund advised he would like to see a job description on this. Commissioner Dahl stated the job description would be someone who takes care of the natural resources issues. Kristin stated they could move to create the position and then work with Amanda on the job description and advertise it. Commissioner Dahl moved to create the position. Commissioner Eklund seconded the motion. Commissioner Karr was in agreement that this needed to be done immediately but was in disagreement that they work with Amanda on the job description. He stated the County Manager should be presenting the position and what it would be doing. He did not think this was presented properly to them. John Kingwell, Planning and Zoning, advised he was retiring in about 6.5 weeks and after that, there will be no one to present the Planning Commission issues. He agreed that they needed the natural resource position but they will be having applications approved simply because it couldn't be heard. He stated Peggy had been in the same position for 22 years but had taken on a lot more responsibility. Commissioner Karr voted nay. Vice Chairman Steninger voted aye. The motion carried. P) ELKO COUNTY CODE P.1 Discussion and consideration of the First Reading of Ordinance , entitled, AN ORDINANCE MODIFYING TITLE 4, CHAPTER 9, SECTION 4 OF THE ELKO COUNTY CODE TO ALLOW THE COUNTY TO ACCEPT APPLICATIONS BEFORE THE HOMEOWNERS' ASSOCIATION HAS APPROVED THEM; AND ALL OTHER MATTERS PROPERLY RELATED THERETO. This ordinance would allow the permit process of the Elko County Building and Safety Department to start before a Homeowners' Association has approved a project. Kristin McQueary advised this came up through the building department, currently, with code , they don t take action on permit applications until it had been through the homeowner s association process. This would allow the County to start initial processing of the permits. Vice Chairman Steninger stated it seemed like that would be putting County staff to work for something that might not be approved by the homeowner s association. Kristin advised the majority of permits are approved. Commissioner Karr stated he lives in a homeowner s association and was unsure how this would be any quicker. Kristin stated the building department had brought this up. She thinks this is a political question and not a legal question of how they want the codes. Page 9

10 Commissioner Eklund stated this would just be the start of the permit process and the final approval wouldn't go through until the HOA approved it. Kristin stated the current code is set up so that if there is an active HOA it had to be approved by them before permits are issued. Commissioner Karr moved to leave this as is. Commissioner Eklund seconded the motion. The motion passed unanimously. Commissioner Eklund seconded the motion. The motion passed unanimously. R) CONSENT AGENDA R.1 Presentation and review of claims for approval which are available for public review at the Elko County Manager's Office. R.2 Approval of Minutes from July 11, Commissioner Dahl moved to approve. Commissioner Eklund seconded the motion. The motion passed unanimously.
