The property is currently vacant, and no changes have been made to the building since the occupancy permit was issued in 2009; stating that the City s finding that reestablishment of use of a bar, which has been vacant for several years is unlawful, and as an initial matter, that statement is factually inaccurate, stating that this property has been vacant for a few months, having closed in mid-2017; and that City will cause irreparable harm to TAC and its business operations. Docket A West 106 th Street WARD: 15 (Matt Zone) Richard Wynn, Owner of the Two Dwelling Units Two-Family Residence Two Story Frame Property appeals from a NOTICE OF VIOLATION EXTERIOR MAINTENANCE, dated No-vember 29, 2017; appellant is requesting more time to address the issues. -POSTPONED- (Rescheduled for May 02, 2018) Docket A Lake Avenue WARD: 15 (Matt Zone) Darius Gavis, Owner of the Two Dwelling Units Two-Family Residence Three Story Wood Frame/Siding/Masonry Veneer Property appeals from a NOTICE OF VIOLATION UNAU- THORIZED/ILLEGAL USE, dated January 04, 2018; appellant states that the City alleges that the structure has been advertised and used as a hotel, but such is not the case; advertising which is attached was done with HomeAway.com wherein the property was listed as a house for the structure type with the entire dwelling being the subject of rental and not individual rooms; stating that plans were in place to list with Expedia.com for a private Vacation Rental, nowhere are there listings for a hotel : Appellant has attempted to resolve this situation with the City and agreed to comply with all requirements for limited lodging, but the City insists that the structure s use meets the definition of a hotel: In that the City asserts the usage is that of a hotel, Appellant asks that this violation be set aside, and that Appellant is willing to abide by all requirements for usage of the structure under limited lodging. 3 appeals from a NOTICE OF VIOLATION EXTERIOR MAINTENANCE, dated January 29, 2018; appellant states that they just purchased this property and that they are currently renovating the entire property, including the list of violations that have been listed on the Violation Notice, but due to the weather conditions at this time, they will not be able to complete the exterior items before the date of February 28, 2018: Appellant is hoping that all of the items listed will be completed once the weather breaks, and that by the end of March they will be able to complete the violations.
