That Tate Creek Community Centre Annual Financial Contribution Service Establishment Bylaw No. 2147, 2014, as amended, be given three readings. 3. That the following Board Resolution No. RD/14/08/41 be rescinded: That the Regional District Board approve the Assent Voting (referendum) question for Tate Creek Community Centre Annual Financial Contribution Service Establishment Bylaw No. 2147, 2014, as follows: Are you in favour of the Peace River Regional District Board adopting Service Establishment Bylaw No. 2147, 2014 which will permit the Regional District to provide an annual financial contribution to the Tomslake and District Recreation Commission for the operations of the Tate Creek Community Centre (previously the Tate Creek Elementary School) at a maximum annual tax requisition limit that is the greater of $200,000 (Two Hundred Thousand Dollars) or $1.78 per $1,000 against the net taxable value assessed on improvements within the service area? 4. That the Regional District Board approve the Assent Voting (referendum) question for Tate Creek Community Centre Annual Financial Contribution Service Establishment Bylaw No. 2147, 2014, as follows: Are you in favour of the Peace River Regional District Board adopting Service Establishment Bylaw No. 2147, 2014 which will permit the Regional District to provide an annual financial contribution to the Tomslake and District Recreation Commission for the operations of the Tate Creek Community Centre (previously the Tate Creek Elementary School) at a maximum annual tax requisition limit that is the greater of $200,000 (Two Hundred Thousand Dollars) or $1.40 per $1,000 against the net taxable value assessed on land and improvements within the service area (with cost recovery on the basis of the net taxable value of improvements only)? 2 Report Chair and Directors September 11, 2014 Page 2 of 2 BACKGROUND/RATONALE: At its August 7, 2014 regular meeting, the Board gave three readings to Bylaw No. 2147, 2014 and the bylaw was subsequently forwarded to the Ministry of Community, Sport and Cultural Development for its approval. During that review, it was found that the bylaw required a revision. Section 6 of the August 7 th version established a maximum rate per thousand applied to the net taxable value of improvements only when, in fact, the Local Government Act requires that the maximum rate be applied to the net taxable value of land and improvements. Section 5 (Cost Recovery) of the bylaw has been corrected to reflect that the property value taxes imposed for this proposed service will be on the basis of the net taxable value of improvements only. With these necessary amendments to the bylaw, it would be appropriate for the Board to consider the recommendations offered. STRATEGC PLAN RELEVANCE: None FNANCAL CONSDERATON(S): Should this proposal receive elector assent, the new service will be included in the annual Financial Plan. COMMUNCATONS CONSDERATON(S): A synopsis of the bylaw will be included in all statutory advertising. Other opportunities for notifying residents of this proposed service and referendum will be pursued. OTHER CONSDERATON(S): Attached: Amended Bylaw No. 2147, 2014

3 PEACE RVER REGONAL DSTRCT Bylaw No. 2147, 2014 A bylaw to establish a service to provide an annual financial contribution to the Tomslake and District Recreation Commission WHEREAS pursuant to sections 796 and 800 of the Local Government Act the Peace River Regional District may establish and operate any service that the Board considers necessary or desirable for all or part of the Regional District; AND WHEREAS the Peace River Regional District Board wishes to establish a service for the purpose of providing an annual financial contribution to the Tomslake and District Recreation Commission for the operations of the Tate Creek Community Centre; AND WHEREAS the Regional District Board has obtained the approval of the electors, through Assent Voting (referendum), in accordance with the Local Government Act and Community Charter; NOW THEREFORE the Peace River Regional District Board, in open meeting assembled, enacts as follows: 1. SERVCE BENG ESTABLSHED The Peace River Regional District hereby establishes a service to be known as the Tate Creek Community Centre Annual Financial Contribution Service for the purpose of providing an annual financial contribution to the Tomslake and District Recreation Commission for the operations of the Tate Creek Community Centre. 2. BOUNDARES The boundaries of the Service Area are a portion of Electoral Area D (Tomslake, Tupper and Gundy) as identified in Schedule A attached to and forming part of this bylaw. 4. PARTCPATNG AREA The participating area is Electoral Area D. 5. COST RECOVERY As provided in section 803 of the Local Government Act, the annual cost of providing the Service shall be recovered by one or more of the following: (a) (b) (c) (d) property value taxes imposed pursuant to the provisions of the Local Government Act, on the basis of the net taxable value of improvements only; parcel taxes imposed in accordance with Division 4.3 of the Local Government Act; revenues raised by way of agreement, enterprise, gift, grant or otherwise; and, revenues raised by other means authorized by the Local Government Act or another Act.

MAXMUM REQUSTON LMT Peace River Regional District Bylaw No. 2147, 2014 n accordance with section 800.1(1)(e) of the Local Government Act, the maximum amount that may be requisitioned in any one year for the service is the greater of $200,000 or an amount equal to the amount that could be raised by a property value tax of $1.40/$1,000 when applied to the net taxable value of land and improvements in the service area. 7.
