5 1991 REALIGNMENT- THEORY VS REALITY 1991 Realignment (Sales Tax and VLF) Full Funding Assertion POISON PILLS State Mandates Poison Pill: Section 209 (a) of AB 1288 would make the provisions of the realignment bill inoperative if a final judicial determination is made by a California court appellate jurisdiction that any provision of the act is a state-mandated local program requiring state reimbursement in excess of $1 million Indigent Care Poison Pill Section 210 (b) of AB1288 would repeal the increase in the Vehicle License fee if a final judicial determination is made by a California court of appellate jurisdiction that counties are owed additional funds for indigent health care under law of 1982 which transferred responsibility for medically indigent adults from the state to the counties.

6 POISON PILLS Vehicle License Fee Poison Pill: Section 210 (a) would repeal the increase in the Vehicle License Fee if a final decision is made by a California court of appellate jurisdiction that the Legislature had earmarked the funds generated by the Vehicle License Fee. This provision should prove to be unnecessary upon passage of ACA 35 which amends the constitution to earmark the VLF increase for realigned programs. Proposition 98 Guarantee: Section 211 of AB1288 would repeal the ½ cent increase in Sales Tax that has been earmarked for realigned programs if a final decision is made by a California court of appellate jurisdiction that these revenues are subject the Proposition 98 guarantee.
