1 SPECIAL MEETING OCTOBER 2, 2009 The President of the Brooklyn City School District Board of Education called the Special Meeting of the Board of Education to order in the Treasurer s Conference Room, 9200 Biddulph Road, Brooklyn, Ohio, on Friday, October 2, 2009 at 6:18 a.m. Members Present: Mrs. Bonnie Bartczak, Mr. Kit Krause, Mr. Roy Thiel, Mr. Rocky Neale, Mr. Jim Oper Members Absent: Discussion: Regarding the flow of traffic and the time it takes to pickup students or drop off students at Brookridge. Mrs. Walker indicated that over the course of the last few weeks the administrations as well as board members have timed the flow of traffic. The time studies have indicated a range of seven to fifteen minutes. The majority of cars on any given day are able to get in and out of Brookridge within ten minutes. Mr. Krause stated after visiting other elementary schools in neighboring communities, specifically to time their traffic flow, that Brookridge s traffic flow is significantly better. Mrs. Bartczak inquired about the two mile bussing limit. Mr. Ferian explained the financial implications of the two-mile limit, versus bussing one mile. Mr. Ferian shared with the Board a cost analysis of the Transportation Expenditures over the past five years (see attached). The Board and the administration will continue to monitor the situation. 10/2/09

2 RESOLUTION NO EMPLOYMENT OF CLASSIFIED PERSONNEL APPROVE Moved by Mr. Neale, Seconded by Mrs. Bartczak the Brooklyn City School District Board of Education hereby approves the employment of the following personnel for the 2009/2010 school year: Annette Safran** Dishwasher Appendix B Step 1 3 ½ hours per day and Bus Driver Appendix B Step 2-3 hours per day effective Sept 21, 2009 **Classified On-Call: Michelle Beverly as playground monitor, student monitor, health aide. Christina Baldwin as playground monitor and cafeteria. RESOLUTION NO PROCEED WITH POLICY APPROVE Moved by Mr. Krause, Seconded by Mrs. Bartczak the Brooklyn City School District Board of Education hereby intends to develop board policy, in regards to the care of students with chronic health conditions, including peanut or other food allergies, in consultation with parents, school nurses, other school employees, school volunteers, students, and community members

3 10/2/09 RESOLUTION NO VALUATION SETTLEMENT- APPROVE Moved by Mr. Neale, Seconded by Mrs. Bartczak the Brooklyn City School District Board of Education hereby approves tax valuation settlement. Whereas, authority was given to settle a tax valuation matter involving the 680-unit Westbrook Village Apartments located at 4000 Westbrook Drive in Brooklyn ( Subject Property ) owned by Westedge Residential Ltd., an Ohio Limited Liability Company ( Westedge ); and Whereas, the Cuyahoga County Auditor s fair market value of the Subject Property for tax years 2007 and 2008 is $14,755,400; and Whereas, on June 19, 2007, Westedge purchased the subject property for $24,000,000. Whereas, the School Board in 2008 filed a complaint with the Cuyahoga County Board of Revision ( BOR ) requesting the BOR to increase the fair market value of the Subject Property to $24,000,000 for tax years 2007 and Whereas, an agreement was reached between all parties which provides for a stipulation to retain the Auditor s valuation of $14,755,400 for tax years 2007 and Whereas, the Auditor will later establish the valuation of the subject property for tax year 2009, 2010 and Whereas, for tax years 2009 through 2011 the parties agree the Auditor shall value the property at $14,755,400 Whereas, Westedge has agreed to pay the School Board for all of the gain of revenue for tax years 2007 through 2011 had the BOR or an appellate body increased the value of subject property to $ 24,000,000. Whereas, settlement payments by Westedge will be made to the School Board totaling $192,001 for tax years 2007 and 2008 at the time of signing the agreement.

4 RESOLUTION NO cont d 10/2/09 Whereas, settlement payment will also be made by Westedge to the School Board on or before February 1 of 2010 through 2012, for tax year 2009 through 2011, respectively, to provide the School Board with the additional revenue had the valuation been increased to the sale price of $24,000,000 in place of the Auditor s valuation for each tax year. Now Therefore, Be It Resolved by the Board of Education of the Brooklyn City School District that: Section 1. The Board approves the Settlement Agreement negotiated with Westedge. Section 2. The Board authorizes its President and Treasurer to affix their signatures to said settlement agreement and by doing so accepts the terms of this agreement in its entirety. Be It Further Resolved, that it is hereby found and determined that all formal actions of this Board concerning and relating to the adoption of this resolution were adopted in open meeting of this Board, and that all deliberations of the Board and any of its committees that resulted in such formal actions were in meetings open to the public in compliance with all legal requirements, including of the Ohio Revised Code. : RESOLUTION NO ADJOURNMENT 7:07 A.M.
