DEMANDE DE SUBVENTION POUR UN PROJET SOLAIRE MEGHA HOLDINGS INC. SUBJECT Application for grant submitted by JAZZ Miigwetch II LP on behalf of Megha Holdings Inc. for a Solar Panel Project on the property legally described as Part of Lot 22, Concession 5 being Part 1 on Plan 50R and known as 832 Burton Road in Vars (417 Industrial Park). RECOMMENDATION The Planning Department recommends that a resolution in support of a grant under the small Communities Fund of a Solar Panel Project be submitted to JAZZ Miigwetch II LP on behalf of Megha Holdings Inc. for the property legally described as Part of Lot 22, Concession 5 being Part 1 on Plan 50R-1014 and known municipally as 832 Burton Road in Vars (417 Industrial Park). 8 PROJECT DESCRIPTION DU PROJET HISTORY, REFERENCE AND SUPPORTING INFORMATION In 2009, the Province of Ontario introduced their FIT/MicroFIT program under the Green Energy Act to be administered by the Ontario Power Authority (OPA). These feed-in tariff programs allow home owners, business owners, community groups, and developers to generate renewable energy through approved wind, solar, water, and bioenergy projects and enter into contracts to sell the energy produced to the province at a guaranteed price for a fixed-term of 20 years. In 2012, the requirements for FIT projects were revised with projects now receiving two priority points (the system used to measure the value of a project by the OPA) by having the support of municipal council. In November 2013, Council approved Report PD which specified the process by which requests for municipal support of solar panel project were to be dealt with by Township Staff. HISTORIQUE, RÉFÉRENCE ET INFORMATION DE SUPPORT En 2009, la province de l'ontario a présenté son programme TRG / microtrg en vertu de la Loi sur l'énergie verte qui sera administré par la Commission de l énergie de l Ontario (CEO). Ce programme de tarifs de rachat garantis permet aux propriétaires de maison, aux propriétaires d entreprises, aux groupes communautaires et aux développeurs, de générer de l énergie renouvelable par le vent, le soleil, l eau et des projets de bioénergie, et de conclure des contrats de vente de l'énergie produite dans la province à un prix garanti pour une durée déterminée de 20 ans. En 2012, les conditions requises pour les projets TRG ont été révisés avec des projets bénéficiant désormais de deux «points prioritaires» (le système utilisé pour mesurer la valeur d'un projet par l'oeo), en ayant l'appui du conseil municipal. En novembre 2013, le Conseil a appuyé le rapport PD qui précise le processus par lequel les demandes de soutien municipal de projet de panneaux solaires devaient être traitées par le personnel du canton. 3 Page 8 of 61

9 On November 18, 2013, Council approved a resolution in support of an application for a rooftop project for an industrial building in the 417 Industrial Park. The applicant, JAZZ Miigwetch II LP on behalf of Megha Holdings Inc., wishes to install solar panels on the roof of the new warehouse building. The panels will generate up to 500 Kw of electricity and will be connected under the Ontario Power Authority s FIT 3 Program. The current request is the second phase of the initial application from last year s submission. A resolution is required to support the application for a grant under the Small Communities Fund. A final resolution to support the Application to proceed will be required in Spring of Le 18 novembre 2013, le Conseil a approuvé une résolution appuyant une demande concernant un projet de panneaux solaires sur un toit d'un bâtiment industriel dans le parc industriel 417. Le requérant, JAZZ Miigwetch II LP au nom de Megha Holdings Inc., souhaite installer des panneaux solaires sur le toit du nouveau bâtiment de l'entrepôt. Les panneaux produiront jusqu'à 500 kw d'électricité et seront rattachés sous le programme TRG 3 de la Commission de l énergie de l Ontario. La demande actuelle est la deuxième phase de la demande initiale datant de l'an dernier. Une résolution est nécessaire pour soutenir la demande de subvention au titre du Fonds des petites collectivités. Une résolution finale pour appuyer la demande de procéder sera nécessaire au printemps de As described in PD , requests for Municipal Support of a Solar Panel Project will be brought to Council in the form of a report with an evaluation of five (5) criteria. The Planning Department has considered the current request according to the following criteria: CONFORMITY WITH THE OFFICIAL PLAN Policy 3.6 of the United Counties of Prescott-Russell s Official Plan states that: 4 Page 9 of 61

10 It is a policy of this Plan to encourage the use of alternate energy sources, such as wind, solar and energy from waste heat and gases. The Township of Russell s Official Plan, under Policy 6.8, recognizes the importance of supporting policies aimed at reducing energy consumption and reliance on carbon-based fuels in order to develop greener, healthier communities and a culture of conservation. Specific to this application is Policy which states that: The Township shall promote alternative and renewable energy systems as accessory and standalone uses. The proposed Solar Panel Project will assist in achieving these policy objectives. COMMUNITY BENEFIT The proposed rooftop solar panels will be connected to the local power distribution system under the Ontario Power Authority and any surplus electricity will be fed into the system thus providing clean renewable energy to the community. FINANCIAL BURDEN TO THE TOWNSHIP OF RUSSELL The proposed Solar Panel Project is a private sector initiative facilitated under the Ontario Power Authority s FIT 3 Program and will not result in any financial burden to the Township. PROPERTY USE RISK MITIGATION The proposed Solar Panel Project requires a Building Permit and the Building Department will review the project for conformity with the Building Code. CONFORMITY WITH THE ZONING BY-LAW 5 Page 10 of 61

11 The subject property is zoned Industrial Park (MP) and the warehouse use and building complies with the relevant performance standards of Zoning By-law # OTHER OPTION(S) TO THE RECOMMENDATION 1. Ne pas appuyer le projet de panneaux solaires PIÈCE(S) JOINTE(S) Annexe 1 : note d information Appendix 1 Briefing Note To: Clerk, Township of Russell From: JAZZ Solar Solutions Background: The Ministry of Infrastructure announced in mid-august an intake to identify priority municipal projects for the federal government s Small Communities Fund (SCF). The full Program Manual and the Expression of Interest (EOI) Form may be accessed at This funding, which is supported by both the Ontario Provincial and Federal governments will provide small communities, under 100,000 in population, with access up to $4 million per project and total funding across the Province of Ontario of $272 million from each of the federal and provincial governments. JAZZ Solar submitted an EOI s on behalf Poplar Hill First Nation community. Opportunity: 6 Page 11 of 61

12 Both oil and grid supplied electricity are expensive and becoming more expensive each year. The community administration and the community residents are struggling with rising costs of energy and are seeking solutions, especially opportunities for economic support, energy conservation, and green energy. Poplar Hill First Nation received notice to proceed to a Full Application. The proposed project is a 500 kw solar rooftop installation under Ontario FIT program and is located in Vars of the Township of Russell. This project will create revenue for Poplar Hill First Nation. The project location was chosen because of grid capacity in the Vars area and because where Poplar Hill does not have a grid connection to the central distribution system controlled by the IESO suitable to support such a project. The project will enable the First Nation to receive the economic benefits from participating in such a project whilst promoting their fundamental belief in environmental sustainability from within. Upon successful application, the communities will be funded for up to 25% of the cost of their project. The community will benefit economically, socially, and most importantly the Township of Russell, the First Nation community, and the Province of Ontario will benefit environmentally. The project will benefit the community of the Township of Russell through job creation, economic and environmental sustainability. There is no cost to the Municipality to support this project. Municipal support will provide benefit to the region as a whole. Timelines: Deadline for submitting Full Application DUE Ontario to assess and prioritize projects for review Funding recipients announced December 19th, 2014 January/February 2105 February/March 2015 (Estimated) Action Required: JAZZ Solar Solutions, on behalf of Poplar Hill First Nation is requesting a Municipal Council Resolution from the Township of Russell indicating their support in the project. The MCR is needed prior to the application deadline of December 19 th, 2014 for SCF. 7 Page 12 of 61

RECOMMENDATION The Executive Director of Administrative Services / Treasurer recommends that Council appoints Richard Godin as Deputy-Treasurer. FINANCIAL IMPLICATION Funds are sufficient in the 2014 budget. This is not an additional position in the finance department but rather a reorganization of the current positions. 15 CORPORATION OF THE TOWNSHIP OF RUSSELL By-law # Being a by-law to appoint a Deputy-Treasurer WHEREAS subsection 286 (2) of the Municipal Act, S.O of the Municipal Act states that the municipality may appoint a deputy treasurer who shall have all the powers and duties of the treasurer under this and any other Act; AND WHEREAS the Council of The Corporation of the Township of Russell now deems it necessary and appropriate to appoint a Deputy-Treasurer for the Corporation of the Township of Russell; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF RUSSELL ENACTS AS FOLLOWS: 1. That Richard Godin be and is hereby appointed Deputy Treasurer for The Corporation of the Township of Russell. 2. This By-Law shall come into force and take effect upon final reading thereof. 20 CORPORATION OF THE TOWNSHIP OF RUSSELL By-law # Being a by-law to authorize temporary borrowing from time to time to meet current expenditures during the fiscal year WHEREAS Section 407 of the Municipal Act, 2001, as amended, provides authority for a council by by-law to authorize the head of council or the treasurer or both of them to borrow from time to time, such sums as the council considers necessary to meet, until taxes are collected and other revenues are received, the current expenditures of the Municipality for the year; and WHEREAS the total amount which may be borrowed from all sources at any one time to meet the current expenditures of the Municipality, except with the approval of the Municipal Board, is limited by Section 407 of the Municipal Act, 2001; NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF RUSSELL ENACTS AS FOLLOWS: 1. The head of the council or the treasurer or both of them are hereby authorized to borrow from time to time during the fiscal year (hereinafter referred to as the current year) such sums as may be necessary to meet, until taxes are collected and other revenues are received, the current expenditures of the Municipality for the current year. 2. The lender(s) from whom amounts may be borrowed under authority of this by-law shall be the Royal Bank of Canada and such other lender(s) as may be determined from time to time by by-law of council. 3. The total amount which may be borrowed at any one time under this by-law plus any outstanding amounts of principal borrowed and accrued interest under Section 407 together with the total of any similar borrowings that have not been repaid, shall not exceed from January 1 st to September 30 th of the current year, 50 percent of the total estimated revenues of the Municipality as set out in the budget adopted for the current year, and from October 1 st to December 31 st of the current year, 25 percent of the total of the estimated revenues of the Municipality as set out in the budget adopted for the current year or $1,500,000., whichever is less. 4. The treasurer shall, at the time when any amount is borrowed under this by-law, ensure that the lender is or has been furnished with a certified copy of this by-law, (a certified copy of the resolution mentioned in section 2 determine the lender,) if applicable, and a statement showing the nature and amount of the estimated revenues for the current year and also showing the total of any other amounts borrowed from any and all sources under authority of Section 407 of the Municipal Act that have not been repaid. 21 5. a) If the budget for the current year has not been adopted at the time an amount is borrowed under this by-law, the limitation on total borrowing, as set out in the section 3 of this by-law, shall be temporarily calculated until such budget is adopted using the estimated revenues of the Municipality as set forth in the budget adopted for the next previous year. 5. b) If the budget for the current year has not been adopted at the time an amount is borrowed under this by-law, the statement furnished under section 4 shall show the nature and amount of the estimated revenues of the Municipality as set forth in the budget adopted for the previous year and the nature and amount of the revenues received for and on account of the current year. 6. For purposes of this by-law the estimated revenues referred to in section 3,4 and 5 do not include revenues derivable or derived from, a) any borrowing, including through any issue of debentures; b) a surplus, including arrears of taxes, fees or charges; or c) a transfer from the capital fund, reserve funds or reserves. 7. The treasurer be and is hereby authorized and directed to apply in payment of all or any sums borrowed under this by-law, together with interest thereon, all or any of the moneys hereafter collected or received, either on account of or realized in respect of the taxes levied for the current year and previous years or from any other source, that may be lawfully applied for such purpose. 8. Evidences of indebtedness in respect of borrowings made under section 1 shall be signed by the head of the council or conform to the treasurer or both of them. 9. The Bank shall not be responsible for establishing the necessity of temporary borrowing under this by-law or the manner in which the borrowing is used. 10. This by-law shall come into force and take effect on the day of the final passing thereof. 35 the plan or consent relates, as Council may require or that the owner pay for local connections to storm drainage facilities installed at the owner's expense, or administrative, processing or inspection fees. 6. Calculation of Development Charges 6.1 The Development Charge with respect to the use of any land, buildings or structures shall be calculated as follows: a) in the case of residential development, or the residential portion of a mixed-use development, based upon the number and type of dwelling units; or b) in the case of non-residential development, or the non-residential portion of a mixed-use development, based upon the gross floor area of such development. 7. Amount of Charge Residential 7.1 The Development Charges described in Schedule "B" to this By-law shall be imposed on residential uses of lands, buildings or structures, including a dwelling unit accessory to a non-residential use and, in the case of a mixed use building or structure, on the residential component of the mixed use building or structure, according to the type of residential use. 8. Amount of Charge -Non-Residential 8.1 The Development Charges described in Schedule "B" to this By-law shall be imposed on non-residential uses of lands, buildings or structures, including a non-residential use accessory to a dwelling unit and, in the case of a mixed use building or structure, on the non-residential component of the mixed use building or structure, according to the type of non-residential use. 9. Special Provision 9.1 Notwithstanding Sections 6,7 and 8, if an owner has prepaid the Sewer Services component under an agreement with the Township, on or before July 7, 2009, for the applicable development, the charge related to Sewer Service in Schedule "B" shall not be imposed and collected, subject to the terms, provisions and limitation of the prepayment agreement. 10. 36 10.1 The Development Charges set out in Schedule "B" attached hereto shall be adjusted without amendment to this By-law annually on January 1 st in each year, commencing January 1 st, 2015, in accordance with the most recent twelve month change in Statistics Canada Quarterly, Construction Price Statistics with the base index value being that in effect as at August 31 st in the prior year. 11. Phasing, Timing of Calculation and Payment 11.1 The residential Development Charges set out in this are not subject to phasing in and are payable in full, subject to the exemptions and credits herein from the effective date of this By-law The non-residential Development Charges set out in this By-law are not subject to phasing in and are payable in full, subject to the exemptions and credits herein from the effective date of this By-law Subject to Section 18 (with respect to redevelopment) and Subsection 11.4 below, the Development Charge shall be calculated as of, and shall be payable, on the date the first building permit is issued in relation to a building or structure on land to which the Development Charge applies Notwithstanding Subsection 11.3 above, the Township may require an owner to enter into an agreement, including the provision of security for the owner's obligations under agreement pursuant to Section 27 of the Act providing for all or part of a Development Charge to be paid before or after it otherwise would be payable. The terms of such agreement shall then prevail over the provision of this By-law. 12. Payment by Money or the Provision of Services 12.1 Payment of Development Charges shall be by cash or by cheque In the event that payment is made by cheque, payment shall be deemed to be made when the funds are credited to the Township's bank account. In the event of an NSF cheque, services charges as set out in the Township's fee by-law will apply in addition to the amount of the outstanding Development Charge In the alternative to payment by the means provided in Subsection 12.1 above, the Township may, at its sole discretion and by way of an agreement entered into with the owner, accept the provision of services in full or partial satisfaction of the Development Charge otherwise payable provided that: a) if the credit exceeds the amount of the charge for the service to which the work relates, i) the excess amount shall not be credited against the charge for any other service, unless the Township has so agreed in an agreement under Section 38 of the Act ; and Page 36 of 61
