GOI, Min of P, PG & Pensions, Deptt. of P&PW OM No.38/37/2016-P&PW (A)(i) dated, the 4 th August, ***************************** The Govt. of India, Ministry of Personnel, Public Grievances & Pensions, Deptt. of Pension & Pensioners Welfare in their O.M. No 38/37/2016-P&PW (A) (i) dated, the 4 th August, 2016 have issued orders for implementing Govt s decision on the recommendations of Seventh CPC revising provisions of pension/commutation of pension with effect from (copy enclosed). With a view to implement the Govt. decision, the following procedural changes are made in regard to submission of fresh pension/family pension and commutation of pension claims. 2.1 Consequent on application of the C.C.S. (RP) Rules, 2016 and Deptt. of P&PW OM dated 4 th August, 2016 referred to above, it has been decided that all pension claims shall be submitted to this office in the revised LPC Cum Data Sheets enclosed as Appendix- E and F to this circular. 2.2 Pension claims in r/o individuals who have drawn pay and allowances in the revised scale of pay will be floated by the Head of Office in the revised LPC Cum Data Sheet as per Appendix- E. Another Data Sheet (Rev) has been designed as Appendix F for proposing amendments/revision of pensionary awards (for issue of corrigendum PPO) notified in the original PPO based on LPC Cum Data Sheet (Appendix- E ) as stated above. 3. The new designed Data-sheets, viz, Appendix E & F, will be given effect for implementation as soon as Pay under Seventh CPC is fixed and H.O.O. is in a position to initiate the pension cases on the revised formats. However, no case on the old Data-sheets will be accepted after It may please be noted
2 that this is an essential requirement for expeditious notification of pension/revision of pension. 4. In this connection, sets of each data sheet alongwith instructions are forwarded herewith for transmission of the same to the lower formation/unit/hoo under your control. The unit/formation declared as H.O.O. may be instructed to use the data sheets alongwith supporting documents as per the revised procedure. Additional copies of data sheets and instruction, if required, may please be prepared/printed at your end for circulation. A copy of the instruction issued by you to your unit/formation/hoo may please be endorsed to this office. 5. These orders do not apply to those cases (retired after but got pensions as per 6 th CPC) where the pension at the old rates has already been finalized. For revision of pension of such cases, a separate Circular will be issued. Separate proforma for preparation of Data-Sheets in such cases, as provided in the Circular, would be used. ` The receipt of this communication may please be acknowledged. 7 COLUMN WISE INSTRUCTIONS FOR FILLING UP OF LPC CUM DATA(Appendix- E Post-2016) SHEET FOR DEFENCE CIVILIANS Column 1:- (Organisation Code) Organisation Code will be filled with reference to the Annexure-1 to Data Sheet. Column 2(ORG. GROUP for GPF-NO.) This column will be filled with reference to the Annexure-2 to Data Sheet. Column 3(GPF-NO.) This column will be filled with 9 d i g i t s GPF NO. of the individual. If the GPF NO. is less than 9 characters it should be prefixed by sufficient no of zeros to make it of 9 characters. Column 4(Office/Unit Formation) This column will be filled with 36 characters office name of the individual Column 5(Head of office) This column will be filled with 50 characters H e a d o f office of the individual. Column 6(Name) The name of the individual as recorded in the Service Book may be filled in this column. One box may be left blank between first, middle and surname etc. Column 7(Nationality Code) The nationality of the individual may be filled in as under:- Indian -I Nepalese -N Bhutanese -B Column 8(SEX) The Sex of the individual may be filled in as under:- Male -M Female -F Column 9(Post Last Held) The Post Last Held of the individual as recorded in the Service Book. One box may be left blank between first middle and Last. Column 10(Industrial/Non-Industrial) following codes may be used to fill up this column Industrial - I Non-Industrial- N Scientist(R&D)- S Column 11(Date of Birth) (DDMMYYYY) Date of birth may be filled from Service Book. In case the verified date of birth is not available therein, the matriculation certificate may be relied upon for this information. Example: - The Date of Birth is 5/2/2008 it will be filled in as under: Column 12 (Date of Joining) (DDMMYYYY) Dated on which first recruitment of the individual may be filled in this column. Column 13 (Date of Retirement/Superannuation) (DDMMYYYY) This column may be filled from the Retirement order.
8 Column 14 (Retirement FN/AN) This column may be filled as under. FORNOON RETIREMENT:- F AFTERNOON RETIREMENT:- A Column 15:- (Nature of Pension) Nature of Pension Code will be filled with reference to the Annexure-3 to Data Sheet. Column 16 (Total Service(Current Spell)) (YY MM DD) This column may be field from the Retirement order. Column 17 (Non- qualifying service) Total non- qualifying service, if any, may be filled in this column. It may be verified from the Service Book. Column 18 (Former service) (YY MM DD) The period of former service, if any, to be counted towards pensionary benefits may be filled in this column Example- If the individual has the former service of 01 year 03 month and 12 days; the same will be completed as under Column 19 (Net- qualifying service) (YY MM DD) Total Net- qualifying service, may be filled in this column. Column 20 (Medical Allowance) This column may be filled as under. If individual want Medical Allowance:- Y If individual does not want Medical Allowance:- N Column 21 (Medical Allowance Option Date) If individual want Medical Allowance then this column should be filled with date of option. If Medical Allowance Column is N then this Column should be filled with Column 22 (Group) This Column should be filled with A for group A officer, B for Group B officer/staff, C for Group C staff. Column 23(Aadhaar No.) This column may be filled with 12 Digit Aadhaar No. of the claimant. Example: - The Aadhaar no. is it will be filled in as under: Column 24(PAN No.) This column may be filled with PAN No. of the claimant Column 25( Id.) This column may be filled with Id. of the claimant. Column 26(a)(Pensioner Address.) This column may be filled with Residential Address of the claimant. Column 26(b)( State Code) This column may be filled with Residential State Code as per Annexure-IV of the
9 claimant. Column 26(c)(Pin Code) This column may be filled with Residential Pin Code of the claimant. Column 26(d)(Mobile No.) This column may be filled with Mobile No. of the claimant. Column 27(Level In Pay Matrix) This column may be filled with Level In Pay Matrix as per Annexure-4. If Level In Pay Matrix is less than 3 characters it should be prefixed by of zeros before digit to make it of 3 characters. The same will be completed as under. L 0 1 sufficient no For Pay Level 13A A 1 3 Column 28(Pay in Pay Matrix) Pay in Pay Matrix drawn in the Pay Level by the individual at the time of retirement should be filled in this Column. In no case it should be left blank or filled with zeroes. Column 29(NPA/MS Pay) NPA/MS PAY - In case of Doctors employed as Defence Civilians, Non practicing allowance drawn at the time of retirement should be filled in this Column. In case of MNS LOCAL Officers, MS PAY drawn at the time o f retirement should be filled in this Column. Column 30(Date of Last Pay Drawn)(DDMMYYYY) This Column should be filled with date of Last Pay drawn by the individual. Column 31(10 Months Average) 10 MONTHS AVERAGE: The average pay which includes sum of Pay in Pay Band, Grade Pay and non-practicing allowance(npa)/ms Pay actually drawn by the individual during the last 10 months period preceding the date of his retirement will be shown in this Column. This field contains 5 boxes for rupee and 2 boxes for paisa. This field should not be left blank. Column 32( Gal Award) These columns may be filled with reference to the codes provided for different Gallantry Awards in Annexure- 5 to the Data Sheet. In first box gallantry awards code and in second box bar code will be filled. Column 33( Last Pay reduced due to penalty) This Column should be filled with Y, if pay of individual reduced due to any penalty. In other case it should be filled with N. Column 34, 35 &36 (On A/c of RDR Head, On A/c of other than RDR Head, Interest on RDR Demand) These columns may be filled with demands if any to be recovered from the pensionary benefits.
10 Column 37 Column 38 This columns may be filled with interest payable, if any. This columns may be filled with refund, if any. Column 39(Date of Receipt of Comm. Appl. /Date of Medical Examination) This column may be filled with the date on which Office/Unit has received the commutation application. Column 40(Percent to be commuted in %) This column may be filled with reference to the percentage of commutation opted by the officer in his commutation application. However, it may be seen that percentage commuted may not exceed 40%. Column 41 (Loading in Age) (YY) Loading in age may be filled in completed years only. This may be verified with reference to Release Medical Examination Report/Medical board Report. Column 42(Whether Married) If the individual got married before retirement, this column may be filled with Y otherwise N may be indicated. Column 43(Spouse Alive) Wife alive or not should be filled as under: If wife alive- Y If wife is not alive N If marriage is under dispute or plural marriage- T If a case of Divorce- D Column 44(Name of Spouse) The name of spouse may be filled with reference to family details as per Service Book. On space may invariably be left blank between first, middle and last portions of the name. Column 45(Nationality of Spouse) The nationality of the spouse may be completed as under: Nationality Code Indian I Nepalese N Bhutanese B Column46 (spouse Date of birth) If the officer married and spouse is alive, the date of birth of spouse may be entered in this column. The data will be filled as under: (DDMMYYYY) Column 47(Spouse Aadhaar No.) This column may be filled with 12 Digit Spouse Aadhaar No. Column 48 (PAN No.) This column may be filled with PAN No. of the spouse. Column 49 (PDA Code) In this column codes are given as under, may be filled for different pension disbursing agencies.
11 PDA CODE DPDO 1 Post Office 2 Treasury 3 Indian Embassy, Nepal 4 PAO 5 Directorate of Accounts, Panaji, Goa 6 Finance Secretary, Gangtok 7 Political Officer, Thimpu 8 Public Sector Banks 9 Column 50 (DPDO Code) This column may be completed only if the PDO code in the column 29 is 1 i.e. the officer desires to draw his pension from DPDO. A list of codes for all the DPDOs is given in the Annexure-6 to the Data Sheet. The appropriate code for the DPDO concerned may be ascertained and filled in this column. Example- If the individual desires to draw his pension from DPDO, Gurgaon Column 30 will be filled as under 1 8 Column 51(PDA Station) PDA Station Field will be used for bank station also. The station where the paying bank branch is located may be entered in this column. If pensioner desires to draw his pension from a Sub Treasury, then it should be filled Sub Treasury name after then PDA station name. One box may be left blank between Sub Treasury name and PDA station. For example: Sub Treasury is Meja and PDA station is Allahabad. M E J A A L L A H A B A D Column 52(PDO State Code) The station from where the officer desires to draw his pension may be entered in this column. Alphabetic codes assigned to various states as per Annexure-7 to the Data Sheet may be used to fill up this column. Column 53(Bank /sub-treasury code) Three digital alphabetic codes assigned to various public sector banks as shown in Annexure-8 to the Data Sheet may be used to fill up this column. Abbreviation of sub treasury as SUB may filled up in this column, if the individual desires to draw his pension from a sub treasury. Column 54(BSR Code Link Bank/CPPC) The code allotted by RBI to each bank branch. (Annexure-9) Column 55(IFSC Code Paying Branch) The code allotted by RBI to each bank branch. Please also attach a cancelled cheque for
12 verifying Bank A/c no. and IFSC code. Column 56(Bank account Number) The bank account number of the paying branch may be entered in this column. Example: If the account number of the officer is SB/4502 It should be filled as under S B / Column 57(Dual Family Pension) In the dual family pension case, the code D should be filled in this field otherwise the code S should be filled in this field. D denotes for Double and S for single. Where government employee died after retirement but before 24/09/2012, the Dual family pension will not be notified/processed through Civil pension Data Sheets. Such cases will be processed through Civil F. P. Data sheets. Where employee retired before 24/09/2012, before processing of Dual F. P. case through civil pension Data sheets it may be ensured that the individual was alive on 23/09/2012. Column 58(Gratuity withheld) If any Government dues on a/c of Government accommodation are outstanding then in this column Ý should be filled otherwise it should be filled with N. If N is required to be filled in the revised data sheet i.e. in case Retirement/death gratuity is not to be withheld for the purpose of recovery of outstanding Government dues. Column 59 (i) to 59 (v) Name Column The name of the dependant members of officer may be filled in these columns. One box may be left blank between first middle and surname etc. Whether Handicapped This column may be filled with Y if the officer is having a handicapped otherwise it should always be filled with N and in no case it should be left blank. No 38/37/2016-P&PW(A)Ci') Government of India Ministry of Personnel, Public Grievances & Pensions Department of Pension & Pensioners' Welfare Lok Nayak Bhawan, New Delhi Dated the 4th August, 2016 OFFICE MEMORANDUM Sub: Implementation of Government's decision on the recommendation of the Seventh Central Pay Commission - Revision of provisions regulating pension/gratuity/ commutation of pension/family pension/disability pension/ex-gratia lump-sum compensation, etc. The undersigned is directed to state that in pursuance of Government's decision on the recommendation of the Seventh Central Pay Commission, the President is pleased to introduce the following modifications in the rules regulating pension, Retirement/Death/Service Gratuity, Family Pension, disability pension, ex-gratia lumpsum compensation, etc. under the CCS (Pension) Rules, 1972 and Commutation of Pension under CCS (Commutation of Pension) Rules, 1981, CCS (Extraordinary Pension) Rules, 1939, etc. 2. These orders apply to Central Government Employees governed by the CCS (Pension) Rules, Separate orders will be issued by the Ministry of Defence, Ministry of Railways and the AIS Division of the DOPT in respect of Armed Forces personnel, Railway employees and the officers of All India Services respectively on the basis of these orders. DATE OF EFFECT 3.1 The revised provisions as per these orders shall apply to Government servants who retire/die in harness on or after Separate order have been issued in respect of employees who retired/died before Where pension/family pension/gratuity/commutation of pension, etc has already been sanctioned in cases occurring on or after , the same shall be revised in terms of these orders. In cases where pension has been finally sanctioned on the pre-revised orders and if it happens to be more beneficial than the pension
19 becoming due under these orders, the pension already sanctioned shall not be revised to the disadvantage of the pensioner in view of Rule 70 of the CCS (Pension) Rules, EMOLUMENTS 4.1 The term 'Emoluments' for purposes of calculating various pensionary benefits other than various kinds of Gratuity shall have the same meaning as in Rule 33 of the Central Civil Services (Pension) Rules, Basic pay in the revised pay structure means the pay drawn in the prescribed level in the Pay Matrix with effect from but does not include any other type of pay like special pay, etc. 4.3 In the case of all kinds of gratuity, dearness allowance admissible on the date of retirement/death shall continue to be treated as emoluments along with the emoluments as defined in Paragraph 4.1 above. PENSION 5.1 Subject to para 5.2, there shall be no change in the provisions regulating the amount of pension as contained in Rule 49 of the CCS(Pension) Rules. 5.2 The amount of pension shall be subject to a minimum of RS.9000/- and the maximum pension would be 50% of highest pay in the Government (The highest pay in the Govt. is Rs 2,50,000 with effect from ). The provisions of sub-rule (2) of Rule 49 of the CCS (Pension) Rules, 1972 shall stand modified to this extent. 5.3 The quantum of additional pension/family pension available to the old pensioners/ family pensioners shall continue to be as follows:- Age of ~ensioner/famil~ ~ensioner From 80 years to less than 85 years From 85 years to less than 90 years From 90 years to less than 95 years From 95 years to less than 100 years Additional guantum of ~ension 20% of revised basic pension/ family pension 30% of revised basic pension / family pension 40% of revised basic pension / family pension 50% of revised basic pension / family pension 100 years or more 100% of revised basic pension / family pension.. The Pension Sanctioning Authorities should ensure that the date of birth and the age of a pensioner is invariably indicated in the pension payment order to facilitate payment of additional pension by the Pension Disbursing Authority as soon as it becomes due. The
20 amount of additional pension will be shown distinctly in the pension payment order. For example, in case where a pensioner is more than 80 years of age and his pension is Rs.10,000 pm, the pension will be shown as (i) Basic pension=rs.10,000 and (ii) Additional pension = Rs.2,000 pm. The pension on his attaining the age of 85 years will be shown as (i). Basic Pension = Rs.1 0,000 and (ii) additional pension = Rs.3,000 pm. Retirement! Death Gratuity 6.1 The rates for payment of death gratuity shall be revised as under: Length of qualifying service Rate of Death Gratuity Less than One year 2 times of monthly emoluments One Year or more but less than 5 6 times of monthly emoluments years 5 years or more but less than times of monthly emoluments years 11 years or more but less than times of monthly emoluments ~ears 20 years or more Half month's emoluments for every completed six monthly period of qualifying service subject to a maximum of 33 times of emoluments. Accordingly, Rule 50(1 )(b) of CCS (Pension) Rules, 1972 shall stand modified to this extent. 6.2 The maximum limit of Retirement gratuity and death gratuity shall be Rs. 20 lakh. The ceiling on gratuity will increase by 25% whenever the dearness allowance rises by 50% of the basic pay. Accordingly, first proviso under Rule 50(1 )(b) of CCS (Pension) Rules, 1972 shall stand modified to this extent. FAMILY PENSION Family pension shall be calculated at a uniform rate of 30% of basic pay in the revised pay structure and shall be subject to a minimum of Rs p.m. and maximum of 30% of the highest pay in the Government. Rule 54(2) relating to Family Pension, 1964 under CCS (Pension) Rules, 1972 shall stand modified to this extent. 7.2 The amount of enhanced family pension shall be 50% of basic pay in the revised pay structure and shall be subject to a minimum of Rs p.m. and maximum of 50% of the highest pay in the Government. (The highest pay in the Govt. is Rs. 2,50,000 with effect from ). 7.3 There will be no other change in the provisions regulating family pension, enhanced family pension and additional family pension to old family pensioners.
21 COMMUTATION OF PENSION 8.1 There will be no change in the provisions relating to commutation values, the limit upto which the pension can be commuted or the period after which the commuted pension is to be restored. 9.1 The pension/family pension under para 5 and 7 above shall qualify for dearness relief sanctioned from time to time, in accordance with the relevant rules/instructions. FIXED MEDICAL ALLOWANCE 10.1 Fixed Medical Allowance to the pensioners who are residing in non-cghs areas and are not availing OPD facility of CGHS shall continue to be paid at the existing rate till a final decision is taken on the basis of recommendations of the Committee constituted for the purpose. CONSTANT ATTENDANT ALLOWANCE 11.1 The amount of Constant Attendant Allowance to pensioners who retired on disability pension with100% disability under the CCS (Extraordinary) Pension Rules, 1939, (where the individual is completely dependent on somebody else for day to day functions) shall continue to be paid at the existing rate till a final decision is taken on the basis of recommendations of the Committee constituted for the purpose. EX GRATIA LUMPSUM COMPENSATION 12.1 The amount of ex gratia lump sum compensation available to the families of Central Government Civilian employees, who die in the performance of their bona fide official duties under various circumstances shall be revised as under: Circumstances Amount Death occurring due to accidents in course of performance of duties 25 lakh ~. Death in the course of performance of duties attributed to acts of 25 lakh violence by terrorists, anti social elements etc. Death occurring in border skirmishes and action against militants, 35 lakh terrorists, extremists, sea pirates Death occurring while on duty in the specified high altitude, 35 lakh unaccessible border posts, etc. on account of natural disasters, extreme weather conditions Death occurring during enemy action in war or such war like 45 lakh engagements, which are specifically notified by Ministry of Defence and death occurring during evacuation of Indian Nationals from a war-torn zone in foreign country
22 13.1. Formal amendments to CCS (Pension) Rules, 1972 and CCS (Extraordinary) Pension Rules, 1939 in terms of the decisions contained in this order will be issued in due course. Provisions of the CCS (Pension) Rules 1972, CCS (Extraordinary) Pension Rules, 1939, and CCS(Commutation of Pension) Rules, 1981 which are not specifically modified by these orders, will remain unchanged These orders issue with concurrence of the Ministry of Finance Department of Expenditure vide their U.O.
