2 SUBJECT: APPROVAL TO CONTRACT FOR DESIGN AND BUILDING OF THE 2001 COUNTY EXHIBIT AT THE CALIFORNIA STATE FAIR page 2 DISCUSSION: Presentation of the Statement of Purpose and design of the Stanislaus County Fair Exhibit for the 2001 California State Fair. This year's theme for the exhibit is "Did you know? Stanislaus County has it." This year's exhibit highlights all the things in Stanislaus County that most people are not aware of. This ranges from the Hershey Factory, to the wine and poultry industry all the way to water sports at Knight's Ferry and a California State University. POLICY ISSUE: STAFFING IMPACT: The Board of Supervisors is the approving authority for the concept and contract for the State Fair Exhibit. None

Did you know that the 20 cities, towns and communities of Stanislaus County offer a diversity of venues, each with its own unique history, events and population? And did you know that Stanislaus County is home to such diverse activities as a chocolate factory, premium dairy, poultry, almond and wine producers, recreation and water sports, shopping, business and government, a State University and even a minor league baseball team! Now you know! Stanislaus County has it!

5 Fair Display Agreement This agreement is made this-day of March 2001, between the County of Stanislaus, hereinafter referred to as "County" and Mark F. Gaffney of Gaffney Display, hereinafter referred to as "Gaffhey Display. " WHEREAS, the County is desirous of entering a display at the 2001 California State Fair, August 17, 2001 through September 3, 2001 and WHEREAS, Mark F. Gaffney of Gaffney Display is in the business of designing, building, and installing exhibits at fairs; and WHEREAS, the County is desirous to make use of the services of Gaffney Display, and Gaffney Display is agreeable to providing such services; and NOW THEREFORE, in consideration of the mutual promises contained herein, and at the mutual benefit to be derived thereunder, the parties agree as follows: 1. Gaffney Display will design, build, install, maintain, and remove an exhibit at the California State Fairgrounds, with any premiums and award monies released to Gaffney Display. Gaffney Display retaining ownership of said exhibit when fairs are over. 2. That said exhibit will be an accurate reflection of the sketch submitted by Gaffney Display to the County. 3. County will agree to pay Gaffney Display for its services a total sum of $ The sum of $ shall be total compensation paid pursuant to this agreement unless additional finding comes through other sources. The first installment of three-thousand, five hundred dollars will be due upon the signing of this contract. A. The sum of $ to be paid on receiving invoice.

Gaffney Display shall be responsible for and hold the county harmless of any claims or actions filed against the parties to this agreement as a result of Gaffney Display's services pursuant to this contract.
