2 What is CP86? On 19 December 2016, the Central Bank of Ireland issued its Feedback Statement along with its final guidance for fund management companies. The Guidance is the result of three years of work carried out by the Central Bank on improving the governance, compliance and effective supervision of funds, and follows the completion of the industry consultation process.

3 The new Guidance has increased the requirements for the following companies: Self Managed Funds (SMICs) What do fund management companies need to do and by when? Existing fund management companies, including SMICs, need to ensure compliance with the new Guidance by 1 July New companies must be compliant from launch. How will CP86 impact existing fund structures? The Guidance means increased costs and a more onerous workload for directors performing the day-today management of funds including: Increased investment in technology to ensure UCITS Companies Alternative Investment Fund Managers compliance with both CP86 and the relevant resulting regulations Increased oversight of investment management and the funds distribution network Increased costs in rewriting business plans, policies and procedures.
