1 GUIDELINES FOR COMPLIANCE IN TERMS OF THE PRIVATE SECURITY INDUSTRY REGULATION ACT DURING EVENTS 1. INTRODUCTION 1.1 The purpse f the Private Security Industry Regulatin Act (Act N 56 f 2001) (the Act) is t prvide fr the regulatin f the private security industry; fr that purpse, t establish a regulatry Authrity; and t prvide fr matters cnnected therewith. The primary bject f the Authrity is t regulate the private security industry and t exercise effective cntrl ver the practice f the ccupatin f security service prviders in the public and natinal interest and the interest f the private security industry itself. Basic t the regulatin f the security industry is the requirement that all thse wh fall within the definitin f security service prvider and wh prpse t render a security service, must cmply with registratin prcedures and be registered and apprpriately trained befre becming active in the industry. The definitin f a security service as cntemplated in the Act, includes a persn prviding a service aimed at ensuring rder and safety n the premises used fr sprting, recreatinal, entertainment r similar purpses. 1.2 Sectin 20 f the Act determines registratin as a security service prvider as prerequisite fr being active in the private security industry. In terms f this Sectin n persn, except a Security Service cntemplated in Sectin 199 f the Cnstitutin may in any manner render a security service fr remuneratin, reward, fee r benefit, unless such a persn is registered as a security service prvider in terms f the Act. 2. CATEGORIES OR CLASSES OF SECURITY SERVICE PROVIDERS THAT NEED TO REGISTER FROM AN EVENT PERSPECTIVE 2.1 Any persn wh prtects r safeguards a persn r prperty in any manner; Page 1 f 6

2 2.2 Any persn wh prvides a reactive r respnse service in cnnectin with the safeguarding f a persn r prperty (s-called buncers ); 2.3 Persns giving advice n the prtectin r safeguarding f persns r prperty (cnsultants); 2.4 Any persn wh prvides a service aimed at ensuring rder and safety n the premises used fr sprting, recreatinal, entertainment r similar purpse fr remuneratin, reward, fee r benefit must be lawfully registered as a security service prvider; 2.4 Persns installing, servicing r repairing security equipment (CCTV, access cntrl, alarms, fire detectin, metal detectin, x-ray inspectin, etc.); and 2.5 Persns mnitring signals r transmissin frm security equipment. In summary, the fllwing categries r classes f security service prviders at venues must be registered with the Private Security Industry Regulatry Authrity: Guarding Sectr Security Officers; Clse Prtectin Officers; Respnse Security Officers (reactin fficers, tacklers, etc.); Event Security Officers; Cntrl Rm / Surveillance Operatrs (CCTV, alarm, etc.); Persns managing, cntrlling r supervising security services; Installers / Repairers f security equipment (CCTV, alarm, access cntrl, bmb detectin, metal detectin, x-ray inspectin, etc.); Persns giving advice n prtectin r safeguarding f a persn r prperty r n the use f security equipment - cnsultants; Car Guards. Further, in terms f the Training f Security Officers Regulatins, 1992 and Bard Ntice119 f 1998, the fllwing categries f special events security services must als be trained in accrdance t special event requirements: Any persn wh effects a bdily and / r physical search at any entry pint t a special events venue; Any persn wh effects clse prtectin duties at an event; Any persn wh perfrms part f a security reactin team at a special event; Page 2 f 6

3 Any persn handling a dg at a special event. In additin, such persn shall be required t have undergne a dg training curse with an Authrity accredited dg training center; and Any persn wh frms part f a field cntrl r crwd cntrl team at a special event. 3. STEWARDS The Safety at Sprts and Recreatinal Events Act (Act n f 27 May 2010) makes prvisin fr a steward at an event. In terms f the said Act, a steward is defined as... a persn appinted in terms f sectin 4(4)(b), and exempted in terms f sectin 20(5) f the Private Security Industry Regulatin Act, 2001 (Act N.56 f 2001), t be respnsible fr the marshalling and verseeing f the safe and general flw f spectatrs, the prvisin f event infrmatin, including safety and security infrmatin t spectatrs, the prvisin f ushering services and the prvisin f assistance with emergency evacuatin prcedures t persns within a stadium r venue and their precincts The use f stewards are nly relevant if they have been exempted by the Minister f Plice frm the registratin requirement as per sectin 20(5) f the PSIR Act. Unless the steward can demnstrate that he/she is in pssessin f an exemptin frm the Minister f Plice, registratin with PSiRA will be required if perfrming the abve functins at an event. 4. TRAINING FOR SECURITY SERVICE PROVIDERS RENDERING A SECURITY SERVICE AT AN EVENT In terms f the regulatins, the relevant grade curse must be cmpleted depending n the particular wrk perfrmed by a security fficer as defined in the Labur Legislatin, Sectral Determinatin 6. In terms f these jb descriptins, a security fficer cnducting guarding thrugh patrlling, must cmplete Grade E. A security fficer wh perfrms access cntrl and search gds r vehicles must cmplete Grades E and D. All security fficers wh perfrm a security service at an event must, in additin, als cmplete the special events curse as mentined in paragraph 2. Page 3 f 6

4 4.1 TRAINING REQUIREMENTS All security fficers must be lawfully registered as security service prviders in terms f the Private Security Industry Regulatins Act (Act 56 f 2001). The training requirements are as fllws: Security fficers utside the venue The security fficers n the utside f the stadium / venue respnsible fr cnducting general patrls, must have cmpleted at least the Grade E curse. Hwever, if they required at sme pint t enter the stadium, they will need t cmply with the training requirement as per belw Security Officers at entry pints and inside the venue parameter (search pints, turnstiles and inside stadium) Security fficers that are required t cnduct a bdily and/r physical search at any entry pint t the venue, must at least cmplete the Grade E and D curses as well as the special event curse. The security fficers inside the stadium / venue must als, in terms f law, cmplete the Grade E and D prgramme as cntrlling and reprting n the mvement f persns r vehicles thrugh checkpints r gates as well as general searching f persns, gds r vehicles will be a requirement. In additin, the special event curse must als be cmpleted. 5. VERIFICATION OF COMPLIANCE It is vital that all security service prviders cmply with the Private Security Industry Regulatin Act (Act 56 f 2001) and requirements as set ut abve. Security businesses must be able t prf cmpliance in respect f the freging, prir t the event. In rder t ensure that nly legitimate security service prviders are used, the Authrity will als be able t submit the fllwing infrmatin t the relevant stakehlders pertaining t the security service prviders: Page 4 f 6

5 Cmpliance f security businesses This reprt will include, inter alia, the fllwing infrmatin: - registratin status f the business; - details f wners / members / directrs and their cmpliance in terms f the Act; - number f security fficers in the emply f the business, including their registratin and training status; and - general issues f cmpliance. Cmpliance f security fficers In this regard, the Authrity will verify the registratin as well as training status f all the security fficers earmarked fr deplyment t render the particular security service at the event. Emphasis will be placed t ensure that the security fficers are apprpriately trained as required in terms f the Training Regulatins. See checklist attached that can be used t assist with cmpliance verificatin. These guidelines are made in cnjunctin with sectins 4(k) and 44(2)(b) f the Private Security Industry Regulatin Act, 2001 (Act 56 f 2001) read with sectin 32(1) f the Security Officers Act, 1987 (Act 92 f 1987) and Bard Ntice 119 f 1998, Gvernment Gazette N dated 24 July 1998 (Security Officers Bard Ntificatin f Establishment f Registratin Criteria and Minimum Training Standards Fr Security Officers Prviding A Special Events Security Service). Their primary purpse is t assist security service prviders in familiarizing themselves with the requirements f the Bard Ntice and als cnstitute a useful pint f reference in the deplyment f security fficers at special events. 6 COMPLIANCE IN TERMS OF PRIVATE SECURITY INDUSTRY REGULATION ACT DURING EVENTS A. SECURITY BUSINESS 1. Is the security business registered as a security service prvider? 2. Did the business submit a valid registratin certificate cnfirming registratin with PSiRA? 3. Des the security business have a sufficient number f registered and trained security fficers? B. SECURITY OFFICERS 1. Are all the security fficers registered with PSiRA? 2. Are all security fficers at search pints / entry pints and inside the venue trained in the special events curse as prescribed by PSiRA? 3. Are all security fficers carrying their PSiRA issued ID cards? 4. Are all security fficers wearing a distinctive unifrm? Page 6 f 6
