2 DEPARTMENT OF LAW AND PUBLIC SAFETY OFFICE OF THE ATTORNEY GENERAL EXECUTIVE SUMMARY On December 30, 1999, the State of New Jersey and the United States of America agreed upon the terms of a Consent Decree in Civil No (MLC) ( Consent Decree ). 3 Pursuant to Consent Decree 114, this is the nineteenth semiannual public report of aggregate data ( Nineteenth Data Report ). This Nineteenth Data Report contains information in Motor Vehicle Tables (Exhibits A-G) and Misconduct Investigation Table (Exhibit H) for the six-month period November 1, 2008 through April 30, 2009, which is retrievable through presently existing technology and procedures. Data are reported in the Nineteenth Data Report using the format of the Eighth Data Report. In the Motor Vehicle Tables, the following data for motor vehicle stops are reported by race or ethnicity of driver: A. Stops 1. Moving; 2. Nonmoving; 3. Other. B. Law Enforcement Procedures (Post-Stop Interaction): 1. Occupant Exit Vehicle -- Reports the number of motor vehicle drivers who were requested to exit from the vehicle; 2. Occupant Protective Frisk (Pat-Down) -- Reports the number of motor vehicle drivers who were subjected to a protective pat-down or frisk of their person for weapons; 3. Occupant Searched -- Reports the number of motor vehicle drivers who were subjected to a search of their person for evidence of a crime or incidental to their arrest; 4. Force Deadly -- Reports the number of motor vehicle drivers who were subjected to deadly force; 5. Force Physical -- Reports the number of motor vehicle drivers who were subjected to physical force; 6. Force Mechanical -- Reports the number of motor vehicle drivers who were subjected to mechanical force (e.g., baton); 7. Force Chemical -- Reports the number of motor vehicle drivers who were subjected to chemical force (e.g., pepper spray ); May 1, 2007 to October 31, The Seventeenth Data Report contained this information for the six-month period November 1, 2007 to April 30, The Eighteenth Data Report contained this information for the six-month period May 1, 2008 to October 31,
4 8. Consent to Search Vehicle Requested -- Reports the number of consensual requests to search a motor vehicle; 9. Consent to Search Vehicle Conducted -- Reports the number of consensual motor vehicle searches; 10. Probable Cause Search of Vehicle Conducted -- Reports the number of motor vehicle searches supported by probable cause; and 11. Drug Dog Employed -- Reports the number of motor vehicle stops during which a drug detecting canine was summoned to the motor vehicle. C. Dispositions (Summons/Warnings): 1. Summons moving; 2. Summons nonmoving; 3. Warnings moving; 4. Warnings non-moving; 5. Summons moving and warnings moving; 6. Summons non-moving and warnings non-moving; 7. Summons and/or warnings/moving and/or non-moving; and, 8. Other. The Motor Vehicle Tables contain data for each troop and station within the Division of State Police. 3 On these tables, the race or ethnicity of the motorist is listed horizontally and the motor vehicle enforcement action or procedure is listed vertically. More specifically, the vertical axis of the Motor Vehicle Tables lists Stops, Law Enforcement Procedures (Post-Stop Interaction) and Dispositions. The Stops and Dispositions information was obtained through the Computer Aided Dispatch ( CAD ) system. In the Sixteenth Data Report, the CAD data for two stations (Atlantic City Expressway and Atlantic City Airport) incorporated data from NJSP s new CAD system for the period from July 16, 2007, the new system s implementation date in those stations, 3 As noted in the Eleventh Data Report, effective January 8, 2005, the Community Partnerships Troop (Troop CP) was created within the Field Operations Section. Data for the troop are displayed separately, as of the Eleventh Data Report (Exhibit F). However, no separate arrest data are available as all arrest reports are filed exclusively with the respective community jurisdictions. In previous reports, the data for the Initiative were included with those for Other Units. Effective May 13, 2006, during the Fourteenth Data Report time period, the Community Partnerships Troop was dissolved. The Operations South Unit became the Metro South Unit in Troop A and the Operations North Unit became the Metro North Unit in Troop B. The stop data are aggregated either in the Community Partnership Troop, or in Troops A and B, accordingly. In October 2005, Troop E Holmdel Station moved to a new station and is now known as Sayreville/Holmdel substation; the data reported are comparable to those previously published for Holmdel Station. On April 12, 2008, Allennwood Station was dissolved. Data presented in the Seventeenth Report for Allenwood Station reflected the reporting period through April 11,
5 through the end of the reporting period. On January 23, 2008, the remaining stations in Troop A were brought on-line for the new CAD system, followed by all of Troop C on April 14, Troops D and E were brought online on May 15, 2008, after the beginning of the eighteenth reporting period. The new CAD was implemented in Troop B on June 18, The data presented in the Eighteenth Data Report were thus aggregated from both the old and new CAD systems. The data presented in this Nineteenth Data Report are the first to be reported only from the new CAD system. The data reflect the race or ethnicity of the motorist as observed by the Trooper for motor vehicle stops initiated by the Trooper. 4 The information regarding summonses and warnings reflects whether a summons or warning was issued, but not the number of summonses or warnings issued. Under the CAD reporting system, if an arrest occurs and a summons is issued in connection with the motor vehicle stop, then only the arrest would be reflected; if no summons or warning is issued with the arrest, the disposition would be displayed here as other. The vertical axis of the Motor Vehicle Tables also lists Law Enforcement Procedures (Post-Stop Interaction). This information was obtained through input of data recorded on the Motor Vehicle Stop Report. 5 State Police procedures require Troopers to complete these reports whenever a law enforcement procedure occurs during a motor vehicle stop. The data here reflect law enforcement procedures in any stop, including those not initiated as such by the Trooper, such as motorist aid or accident incidents. The number of total interactions is reflected, not of incidents with a law enforcement procedure of a certain type. 6 The vertical axis of the Motor Vehicle Tables also lists total criminal arrests and patrol-related arrests as compiled utilizing Uniform Crime Report ( UCR ) methodology. 4 In the CAD system, if the race or ethnicity of the driver is not captured in the data for the Trooper initiating the stop, the stop is not included for CAD elements. The total number of Trooper-initiated motor vehicle stops for the current report was 248,595; 247,677 stops are reported here. For the remaining 918 stops (0.4% of the total), race and ethnicity or some other information was not available. Prior to the Seventeenth Data Report, data reports routinely excluded about one percent of stops for which the race or ethnicity of the driver was not available. In the Seventeenth and Eighteenth Data Reports, the high proportion of excluded stops because of incomplete race and ethnicity were attributable to stations acclimating to the new CAD system. With full implementation of the new CAD reflected in this Nineteenth Data Report, the percentage of excluded stops has returned to pre-seventeenth Data Report levels. Data on race and ethnicity reported for law enforcement procedures are also the Trooper s observation as recorded in Motor Vehicle Stop Reports and in arrest reports. Law enforcement procedure data are unaffected by the implementation of the new CAD system. 5 On January 1, 2008, NJSP implemented enhanced data entry for Motor Vehicle Stop Report data in its Record Management System. Data reported in the Seventeenth Data Report aggregate information entered in both the old and the new protocols. Beginning with the Eighteenth Data Report, all post-stop interaction data are reported from the new protocol. 6 Interactions displayed for other units assigned to individual troops are aggregated in Other Division Assigned Units as well, but are counted just once in the Division totals of poststop interactions
6 The arrest data come from arrest-report computer files. Patrol-related arrests are, in turn, more specifically listed as arrests for drugs, weapons, and other patrol-related arrests. The vertical axis also lists arrests for driving under the influence, listed as DUI. These arrests are all those recorded for the respective unit during the time period, regardless of why the stop was initiated. As required by Consent Decree 114, Exhibit H 7 contains misconduct investigation data on a statewide basis from the Office of Professional Standards. Exhibit H reports whether an investigation was initiated by an internal (i.e., from a State Police member) or external (i.e., from a citizen who is not a State Police member) complaint. The most serious substantiated complaint is listed under complaint classification and it is the status of this allegation recorded under disposition. If allegations are pending or no allegation is substantiated, the most serious allegation is listed under complaint classification. Thus, the numbers represent misconduct cases, but not all allegations associated with them. This exhibit reports misconduct investigations initiated on or after November 1, 2008, and does not reflect the progress of investigations previously initiated. Exhibit H reflects the progress of these misconduct investigations over the period November 1, 2008 through April 30, Exhibit H lists the categories of violations vertically and then their dispositions horizontally. Generally, the violations comprising the other category are less serious complaints. In this Nineteenth Data Report, the dispositions are listed under the following categories: Substantiated Unfounded Exonerated and Insufficient Evidence The information in this Nineteenth Data Report was generated through use of the CAD reporting systems and the Nineteenth Motor Vehicle Stop Report database. In the case of consent search data, the information was further refined by a review of the underlying consent search reports and supplemental reports themselves. The number of requests seeking consent to search a motor vehicle made by state troopers increased during this reporting period from eighty-two to one hundred eighty-six. The number of consent searches undertaken by state troopers during this reporting period increased from forty-six to one hundred forty-six. We believe the increase in the number of requests for consent to search a motor vehicle and the number of consent searches actually conducted by state troopers may be in due part to a recent decision of the New Jersey Supreme Court. In State v. Pena-Flores, 198 N.J. 6 (2009), the court outlined the circumstances in which law enforcement officers in New Jersey may conduct a warrantless search under the automobile exception. We believe the court's decision has served to limit the use of exigent circumstances as a basis for the warrantless searches of automobiles. 7 might no longer be a viable option in instances where troopers developed probable cause to believe that a stopped vehicle contained contraband. The State Police have since modified its practices and procedures to limit the use of exigent circumstances as a basis to conduct warrantless searches of automobiles. This has caused a corresponding increase in the number of requests seeking consent to search a motor vehicle and the number of consent searches undertaken by state troopers. We believe the increase is the result of individual state troopers utilizing consent requests as one of the few remaining exceptions to the warrant requirement where probable cause exists to believe a stopped vehicle contains contraband or evidence of a crime. The State is encouraged with its progress in gathering and collecting data as reflected in this Nineteenth Data Report. This progress is the result of the acceptance of and adherence to the principles underlying the Consent Decree, and the commitment of substantial resources and effort, by members of the Department of Law and Public Safety and the New Jersey State Police. The State remains committed to continuing this progress towards complete compliance with the provisions of the Consent Decree
