4 INTRODUCTION The Department of Justice and the State of New Jersey filed a joint motion terminating the 1999 Consent Decree effective September 21, The parties conditioned termination of the Consent Decree on codification of the Decree's reforms. Accordingly, the Legislature enacted the Law Enforcement Professional Act of 2009 (N.J.S.A. 52:17B-222, et. seq.) (the Act). The Act established the (OLEPS) and codified the Tasks delineated in the Consent Decree. OLEPS is, therefore, empowered with the responsibilities previously held by the independent monitors. It maintains the continued integrity of law enforcement activities performed by the Division of State Police, and further, has the authority to provide guidance to other law enforcement entities statewide. The Act mandates that OLEPS publish a report listing aggregate statistics on State Police traffic enforcement activities and procedures on a semi-annual basis. This report is the Fifth Public Report of Aggregate Data of Traffic Enforcement Activities, 1 which covers the reporting period of January 1 through June 30, This report presents data on motor vehicle stops, criminal arrests, and internal misconduct investigations as previous reports have done. The fifth release of OLEPS Aggregate Data is the fourth report written by OLEPS to contain data for a six-month reporting period. 1 Appendix Two lists all previously published reports of aggregate data, their publication dates and the periods for which they provide information. 5 AGGREGATE DATA OF TRAFFIC ENFORCEMENT FIFTH PUBLIC REPORT Data The data utilized in this report are obtained from the (NJSP) Information Technology Bureau. The NJSP maintains a database of all motor vehicle stops that includes information on drivers, passengers, and all actions or enforcements that resulted from the stop. The data for this report are drawn from all stops made between January 1, 2011 and June 30, Stops Stop information was obtained through the Computer Aided Dispatch (CAD) system. 2 The data reflect law enforcement procedures in any stop, including those not initiated by a trooper, such as motorist aids, accident incidents and mobile data terminal hits. The categories of stops are: Moving: Any law enforcement procedures pertaining to the movement of a vehicle, such as rate of speed or unsafe lane change. Non-Moving: Any law enforcement procedures pertaining to the non-movement of the vehicle, such as use of seatbelts or maintenance of lamps. : Any law enforcement procedures in a stop, other than moving and non-moving, such as BOLO or directed stop. This also includes procedures not initiated by the trooper, such as motorist aid, accident incidents, and mobile data terminal hits, such as warrants on vehicle owner, unregistered/uninsured vehicles. Law Enforcement Procedures (Post-Stop Interaction) Information on Law Enforcement Procedures (Post-Stop Interaction) is obtained through input of data recorded on the Motor Vehicle Stop Report (MVSR), maintained in the Records Management System (RMS). State Police procedures require troopers to complete these reports whenever a law enforcement procedure occurs during a motor vehicle stop. These data do not represent the total number of post-stop interactions for this period. Rather, these data represent the total number of stops involving at least one post stop interaction. Each stop may have more than one post-stop interaction. The categorizations of Law Enforcement Procedures reported are: Occupant Exit Vehicle: The number of motor vehicle occupants who were requested to exit the vehicle. Occupant Protective Frisk (Pat-Down): The number of motor vehicle occupants who were subjected to a protective pat-down or frisk of their person for weapons. Occupant Searched: The number of motor vehicle occupants who were subjected to a search of their person for evidence of a crime or incidental to their arrest. Force Deadly: The number of motor vehicle occupants subjected to deadly force. 2 If the race/ethnicity of the driver is not recorded in CAD, the stop is not represented in these data. Page 2 of 99

6 Force Physical: The number of motor vehicle occupants subjected to physical force. Force Mechanical: The number of motor vehicle occupants subjected to mechanical force, such as a baton. Force Chemical: The number of motor vehicle occupants who were subjected to chemical force, such as pepper spray. Consent to Search Vehicle Requested: The number of consensual requests to search a motor vehicle. Consent to Search Vehicle Conducted: The number of consensual motor vehicle searches. Probable Cause Search of Vehicle Conducted: The number of motor vehicle searches supported by probable cause. Drug Dog Employed: The number of motor vehicle stops during which a drug-detecting canine was summoned to the motor vehicle. Dispositions (Summons/Warnings) Data on the Dispositions disseminated are obtained via the CAD system. The information reflects whether a summons or warning was issued in a stop, but not the number of summonses or warnings issued. Under the CAD reporting system, if an arrest occurs and no summons or warning is issued with the arrest, the disposition would be displayed here as other, along with all stops in which there were no traffic enforcement outcomes. The categorizations of dispositions are below: Summons moving: The number of motor vehicle stops that were issued a summons for a moving violation. Summons non-moving: The number of motor vehicle stops that were issued a summons for a nonmoving violation. Warnings moving: The number of motor vehicle stops that were issued a warning for a moving violation. Warnings non-moving: The number of motor vehicle stops that were issued a warning for a nonmoving violation. Summons moving and warnings moving: The number of motor vehicle stops that were issued a summons and a warning for a moving violation. Summons non-moving and warnings non-moving: The number of motor vehicle stops that were issued a summons and a warning for a non-moving violation. Summons and/or warnings/moving and/or non-moving: A combination of all the above moving and non-moving violations. : The number of motor vehicle stops that did not result in a summons or warnings. 7 Criminal Arrests Criminal arrest data are classified utilizing the Uniform Crime Report (UCR) methodology. The arrest data come from arrest reports and are presented here by race/ethnicity of the driver. The criminal arrests total reflects the sum of arrests classified as Drugs, Weapons, and DUI. These arrests are all those recorded for the respective unit during the reporting period, regardless of why the stop was initiated. Arrests were classified as follows: Patrol Related Arrests: The detainment of a person(s) into legal custody during a motor vehicle stop. For this report, patrol related arrests reflect the sum of Drugs, Weapons and arrests. Drugs: The number of arrests of motor vehicle occupant(s) carrying drugs. Weapons: The number of arrests of motor vehicle occupant(s) carrying weapons. DUI: The number of arrests of motor vehicle operators driving under the influence of alcohol. : The number of arrests of motor vehicle occupant(s) for reasons other than the above mentioned. Misconduct Investigations 3 This table presents the statewide Internal Misconduct Investigation Summary (Exhibit G) from the Office of Professional Standards, as required by the Act. The data represent misconduct investigations initiated on or after January 1, 2011, and do not reflect the progress of investigations previously initiated. Because each misconduct case may involve several allegations, allegations are classified into broader classifications. For example, an allegation of a trooper using improper language might be categorized as attitude and demeanor. Additionally, because each case may have multiple allegations, only the categorization for the most serious allegation in a case (according to OPS) is used here. Thus, the data represent misconduct cases, but not all allegations associated with them. The dispositions for each case are the following: Substantiated: A preponderance of the evidence shows that a member violated State Police rules, regulations, protocols, standing operating procedures, directives or training. Unfounded: A preponderance of the evidence shows that the alleged misconduct did not occur. Exonerated: A preponderance of the evidence shows that the alleged misconduct did occur, but did not violate State Police rules, regulations, protocols, standing operating procedures, directives or training. Insufficient Evidence: Based upon the preponderance of the evidence standard, there is insufficient evidence to determine whether the alleged misconduct occurred. 3 This exhibit has been changed to "Exhibit G" in OLEPS Fifth Report. 8 Administratively Closed: When the Office of Professional Standards' review of the reported incident reveals that a trooper has not violated any of the Division's rules and regulations, standing operating procedures or applicable federal or state laws, the incident is classified as an administrative matter. The data in Exhibit G will not be discussed in this report as the present this information in an Annual Report by The Office of Professional Standards. The Annual Report is available at: The data for this report are organized into tables presenting the total numbers of each topic listed above. The data are broken out by racial/ethnic groups in addition to presenting overall numbers. For this period, data in the tables represent count data (i.e. the number of times each incident occurred). RESULTS The data for the entire Division of State Police are discussed below. Appendix One contains the disaggregated data for each troop 4 and station within the Division of State Police. In each table, the motor vehicle stop activities are listed by the race/ethnicity of the driver. Data are presented on the types of Stops, Law Enforcement Procedures, Dispositions, and Criminal Arrests. Stops There were 247,408 motor vehicle stops by state troopers in this reporting period. This is a 2.8% decrease in the number of stops since the last reporting period (Fourth OLEPS Aggregate Data Report), where 254,492 motor vehicle stops were made. However, there is a 6.0% decrease in the number of stops made for moving violations since the last reporting period. Only 207,794 of all stops were moving violations compared to 220,414 in the previous reporting period. While the NJSP stopped fewer drivers overall in this reporting period, they stopped slightly more based on non-moving violations and other violations than in the previous period. While percentages have changed slightly, they are not substantial changes and are likely due to decreases in 4 Effective as of January 1, 2011, Troop D and Troop E merged to form one troop, Troop D. 9 the number of total stops. In terms of racial/ethnic disparity, the numbers indicate a higher frequency of stops for White drivers than Black, Hispanic,,,, or drivers. This is expected, as Whites are the largest racial/ethnic group in the state of New Jersey. The overall proportion of White drivers stopped did not change significantly from the previous period (63.2% compared to 62.8% here). Each racial/ethnic group s percentage of violation types did not appear to change substantially for this reporting period either. The percentage of moving violations for which White, Black, or Hispanic drivers were stopped is similar to the percentage from the previous reporting period. Law Enforcement Procedures (Post-Stop Interaction) In total, 11,838 motor vehicle stops resulted in some sort of Law Enforcement Procedure for this reporting period. During this reporting period, 4.8% of all stops had at least one post-stop interaction compared to 8.2% in the previous reporting period. This decrease in stops with post-stop interactions is likely the result of decreases in the total number of stops. As in the Fourth OLEPS Aggregate Data Report, the most common post-stop interaction was an occupant vehicle exit. Roughly, 96% of all stops had an occupant vehicle exit. Of special interest to OLEPS and the NJSP are the number of consent searches. For this period, 1,585 requests for consent to search a vehicle were made. This is an increase of about 46.7% from the number of consent requests in the previous reporting period, which reported only 1,080 requests for consent to search a vehicle. The pattern of consent requests based on race and ethnicity appears to have changed slightly in this period. Overall, this reporting period indicates a higher percentage of all consent search requests were posed to White drivers (47.1%) than Black drivers (37.0%), and Hispanic drivers (12.3%). The number of consent searches conducted actually increased for each racial/ethnic group, but the percentages for each group remained roughly the same. These increases in the number of searches conducted likely reflect the continued effects of the NJ Supreme Court's ruling, State v. Peña-Flores, 198 N.J. 6 (2009). 6 The number of consents to search a vehicle requested and the number of consents to search a vehicle conducted continue to remain well above the numbers prior to Peña-Flores (See Independent Monitor s Aggregate Reports, Eighteenth Data Report and earlier). 6 State v. In addressing when a warrant-less search of an automobile is legally permissible, the Court established the criteria to be used: The stop is unexpected. The police have probable cause to believe that the vehicle contains contraband or evidence of a crime. Exigent circumstances exist under which it is impracticable to obtain a warrant. [Id. at 28] The number of probable cause searches in this period was 699, substantially fewer than the 3,306 probable cause searches reported in the Nineteenth Data Report, but similar to the 648 searches reported in the last report. White drivers comprised the highest percentage of probable cause searches, making up 53.1% of these searches. Black drivers also increased in the number and percentage of probable cause searches this period compared to the second half of Hispanic drivers showed a slight decrease in the number and percentage of probable cause searches this period compared to the last reporting period. The increases for White and Black drivers were found despite the overall increase in Probable Cause searches. Page 7 of 99

11 For all Law Enforcement Procedures, the data indicate that higher percentages of all enforcements involved White drivers. This represents a similar trend from the previous reporting period. Black drivers then, made up a smaller percentage of enforcements in all categories with the exception of Mechanical Force, Chemical Force and Drug Dog Employments. No clearly discernable pattern emerged for Hispanic drivers. Dispositions (Summons/Warnings) There were 61,379 summonses for moving violations and 28,041 summonses for non-moving violations issued by troopers in this reporting period. The racial/ethnic distribution of stops with dispositions indicates no drastic change in the proportion of each disposition type since the last reporting period. The overall pattern remains that between 55 and 67% of all disposition types involved White drivers. Black drivers on the other hand vary more, especially in the combination categories for summons and warnings. For moving violations, which resulted in either a summons or a warning, Black drivers comprised a very low percentage (14.8%) while they were a much higher percentage for non-moving violations which resulted in summonses or warnings (26.3%). In the previous reporting period, similar variation was also observed. Patrol related arrests made up the largest percentage of total arrests for this reporting period. These arrests accounted for 70.4% of all criminal arrests in this reporting period, while they were at a slightly higher proportion, 72.1% in the previous period. Patrol related arrests represent a sub total; they are those arrests classified as Drugs, Weapons, or charges. The racial and ethnic breakdown of arrests indicates that with the exception of Weapons charges and Page 8 of 99

12 charges, White drivers comprised the highest percentage of arrests in each category. For this period then, 40.1% of all arrests for other charges and 43.9% of weapons charges involved Black drivers. In the previous reporting period, a similar pattern was also observed. 13 SUMMARY These data indicate the volume of trooper stop related activity for the January 1 to June 30, 2011 reporting period. This brief look suggests that even though there was a decrease in the total number of stops reported, White drivers were involved in the majority of interactions between motorists and the NJSP. The percentage of White drivers who were stopped, who were the recipients of Law Enforcement Procedures, who received some sort of disposition, and who were arrested, is higher than the corresponding percentages of Black drivers, Hispanic drivers, and all other racial and ethnic categories. The above information refers only to aggregate data for the entire. Appendix One presents the same data for each troop and each station within each troop. 7 Law Enforcement Procedures for units assigned to a troop, but which are not stations, such as traffic enforcement units, are aggregated as " Units". They are also included in the aggregation of " Division Assigned Units" (Exhibit F) for the Division, along with procedures for any unit not assigned to a troop, such as overtime units. In the divisionwide total, the troop-assigned other units are counted once. The State adheres to the principles underlying the Consent Decree and commits substantial resources and effort by members of the Department of Law and Public Safety and the. The State remains committed to continuing the progress in producing these data in the spirit of the Consent Decree as codified now in the Act. 7 Appendix One presents the same data with the exception of the racial/ethnic category of.
