1 5.3 To: From: Aboriginal Relations Committee Marino Piombini, Supervisor, Aboriginal Relations, Legal and Legislative Services Date: April 15, 2014 Meeting Date: April 30, 2014 Subject: New Relationship Agreements in British Columbia, RECOMMENDATION That the Aboriginal Relations Committee: a) receive for information the report, dated April 15, 2014, titled New Relationship Agreements in British Columbia, ; and b) recommend that the Board forward a letter to the Minister of Aboriginal Relations and Reconciliation requesting that Metro Vancouver be consulted on New Relationship agreements within the region between the BC Government and First Nations prior to those agreements being finalized. PURPOSE To provide the Aboriginal Relations Committee with an information summary of New Relationship Agreements in British Columbia signed by the provincial and federal governments with BC First Nations between 2008 and BACKGROUND In the 2008 Memorandum of Understanding between the Union of British Columbia Municipalities (UBCM) and the Province of British Columbia, which was renewed in 2012, the mandate of treaty advisory committees and local government Aboriginal relations committees was expanded and led to the creation of New Relationship agreements. New Relationship agreements are intended to bolster First Nation lands, resource and economic development opportunities as well as enhance social and cultural initiatives in Aboriginal communities throughout British Columbia. The New Relationship was also intended to provide more opportunities for local government input and consultations on Aboriginal issues and initiatives. Since 2008, the Province has made data available on New Relationship agreements and on the accomplishments involving the Government of British Columbia, Aboriginal groups and/or third parties. Examples of these quarterly summaries are provided in Attachments 1 and 2. The agreements and accomplishments are divided into two categories one list includes lands, resources and economic development while the other list covers social initiatives. Both lists are grouped by sector within the identified geographic region. The reports are published quarterly and sent to key partners and stakeholder groups for information and further distribution. 2 Metro Vancouver staff has tabulated these summaries over the past six years (Attachment 3); the results are briefly analyzed in this information report. This report was presented for information to the Municipal Technical Advisory Committee (MTAC) on Aboriginal Relations at its meeting on March 19, DISCUSSION Since 2008, there have been 751 New Relationship agreements in British Columbia, with the majority of these agreements (423 or 56%) addressing social initiatives. The total financial commitments made by the Province (93%) and Canada (7%) total $1.93 billion over the past six years. The majority of the 751 agreements (463 or 62%) were made in the first three years ( ), with 2008 having been the year with the highest total number of agreements signed (186). The fewest agreements were signed in The majority of financial commitments for all agreements, in terms of dollars, were also made in those first three years ($1.22 billion or 64%). Over 30% of the total funding (or $585.8 million), for lands, resources and economic development as well as social initiatives, was made in The average financial commitment (in dollars) per New Relationship agreement over the past six years is $2.57 million, with the highest average recorded in 2009: $3.425 million per agreement. It should be noted that these figures do not take into consideration the value of all lands in landrelated agreements or contributions and commitments made by third parties, such as foreign governments. Also not included are the financial commitments that are made, on an ongoing basis, by the federal and provincial governments to First Nations in British Columbia. The key Lands, Resource and Economic Development sectors that have benefitted from these agreements over the past six years are: Lands and Resources (96 of the 328 agreements, or 29%) and Forestry (26%). The key sectors generating the most agreements under Social Initiatives are: Education (96 of the 423 agreements, or 23%), Employment and Training (20%) and Culture and Heritage (19%). Since the inception of New Relationship agreements in 2008, the Province has committed 29 of the 328 Lands, Resources and Economic Development agreements (or 8.8%) within the Lower Mainland area (which includes the Fraser Valley). In terms of dollars, 10.7% of Lands, Resource and Economic Development agreements were targeted for the Lower Mainland. By comparison, 16.5% of the 423 Social Initiatives agreements (or 70 agreements) were committed to the Lower Mainland area. The Lower Mainland area received 19.7% of the funding dollars for Social Initiatives. ALTERNATIVES 1. Receive the report, dated April 15, 2014, for information, and recommend that the Board forward a letter to the Minister of Aboriginal Relations and Reconciliation requesting that Metro Vancouver be consulted on New Relationship agreements within the region between the BC Government and First Nations prior to such agreements being finalized. 2. 3 FINANCIAL IMPLICATIONS Between 2008 and the end of 2013, the report reveals that there have been a total of 751 New Relationship agreements signed in BC, totaling nearly $2 billion. Of these agreements, 99 of them have been committed to First Nations within the Lower Mainland area. Although local governments were to have been notified of such agreements being negotiated within their respective regions prior to their finalization in order to provide local government with the opportunity to provide comments, such notifications have not occurred. Local governments only receive quarterly summaries of agreements that have already been signed and committed to by the provincial and federal governments. Under Alternative 1, the report sent to the provincial government serves to raise the issue with the Minister of Aboriginal Relations and Reconciliation that local governments are not being notified in advance of New Relationship agreements being finalized. Under Alternative 2, the Committee may wish to provide alternative direction to staff, including the option not raising this matter with the Minister at this time. SUMMARY / CONCLUSION This report presents a summary of New Relationship agreements in British Columbia between 2008 and Although the New Relationship was intended to provide more opportunities for local government input and consultations on Aboriginal issues and initiatives, Metro Vancouver has neither been advised, nor consulted by the Province on any of the agreements signed to date with First Nations in the Lower Mainland area. ARR, Tsawwassen First Nation The province expands the area covered by the Babine Lake Community Forest Agreement by 36%, giving the Burns Lake Community Forest Society the right to harvest up to 10,088 cubic metres of timber per year from 8,939 ha surrounding Granisle. The BLCFS is a joint venture between the Lake Babine First Nation and the Village of Granisle. Tk emlúps and Skeetchestn First Nations are now receiving a portion of provincial revenues resulting from production at New Gold s New Afton Mine. The revenues are result of BC s first Economic and Community Development Agreement (ECDA) mine revenue-sharing agreement was signed earlier between the two FNS\s and the provincial government. The First Nations Clean Energy Business Fund (FNCEBC) funds 10 capacity-building and two equity ventures for clean energy projects. Over three years, the province has funded to 95 FN clean-energy projects, including solar, wind, biomass and hydropower projects. Total Commitment: $1.31 million The Tsawwassen First Nation Final Agreement Implementation Report is released. The report covers the activities of the treaty implementation committee and other matters, including land-use planning, development, natural resources and governance in order to keep the public informed on all activities during the implementation period. The proposal was made in partnership with community liaisons and leaders from the 14 NTC FNs as part of the ongoing effort to monitor clean up and dispose of tsunami debris from the 2011 Japanese earthquake and tsunami. The $96,000 funding for the project was provided by the Japanese Government. The MOU also ensures a comprehensive and respectful approach to First Nations engagement through information sharing and attending meetings with FNs. Eight Nlaka pamux bands begin to benefit from an Economic Development Agreement signed in March The bands receive $7 million as a result of a revenue-sharing agreement with the Province from the expansion of the Highland Valley Copper mine. The ECDA also spells out how BC will meet its legal obligations to consult and accommodate the eight First Nations. The Upper and Lower Similkameen Indian Bands receive more than $400,000 of mineral tax revenues from the operation of the Copper Mountain Mine near Princeton thanks to a revenue-sharing agreement in an Economic and Community Development Agreement signed in The ECDA also commits the province to a comprehensive consultation process with the bands related to the ongoing operation of the mine. BC and the MTS sign an MOU that contains provisions allowing the creation of a framework agreement to guide activities in the ongoing implementation of the treaty. In addition, the province and each of the Maa-nulth First Nations sign foreshore agreements which enable them to make laws to regulate business and provide services in the foreshore area that will attract investors and provide viable, environmentally appropriate developments in the foreshore area. Okanagan FLNR, Westbank First Nation The Westbank First Nation is awarded a replaceable forest licence to enhance economic and employment opportunities. The licence covers approximately 9,000 ha and gives the FN the right to harvest up to 32,400 cubic metres of time a year over 15 years in its traditional territory. The Tahltan First Nation Clean Energy Business Fund (FNCEBF) Revenue-sharing Agreement signed with the BC Government enables the First Nation to share revenue from the Pine Creek Micro-Hydro Project, a 2.1 megawatt hydro facility near Atlin. Once the project is fully operational, revenue to the FN is forecast to be approximately $6,000 per year. The Maa-nulth First Nations Final Agreement Implementation Report is released. The report covers the activities of the treaty implementation committee and other matters, including lands and resources, governance, legislation, and programs and services in order to keep the public informed on all activities during the implementation period. From Oct. 1 Dec. 31, 2013, the Province signed Forestry Consultation and Revenue Sharing Agreements (FCRSAs) with four First Nations, bringing the total to 109 agreements throughout the province since FCRSAs were introduced in December FCRSAs provide FN communities with economic benefits returning directly to their community based on harvest activities within their traditional territories.
