2 LEGISLATIVE FRAMEWORK-Transposition of Directive Law on Chemicals, (Official Gazette No 36/09, 88/10, 92/11 and 93/12); of Production, Placing on the Market and Use of Chemicals ( Official Gazette of the RS number 90/13) Provisions of this Rulebook have been in force in Serbia since The provisions on the limitations of the maximum concentration of VOC compounds applied in two phases: Phase I - June 1, 2012 Phase II - December 1, 2013 The remaining provisions will be transposed in National legal act which will be adopted by Republic of Serbia - Bilateral screening Chapter 27 Environment and Climate Change

6 Enforcement and penalties The inspection and control of compliance according to Article 86 of the Law on Chemicals, supervision over implementation of the Law on Chemicals and regulation promulgated thereof shall be done by the Ministry competent for environmental protection. The inspection and control of compliance shall be conducted by: Ministry in charge of environmental protection through the environmental inspectors Ministry in charge of health through sanitary inspectors Ministry in charge of trade through market inspectors Economic offences for banned chemical is prescribed for the legal entity by the Law on Chemicals, Article 97, paragraph 1, point 19 Enforcement arrangements under The Paint Directive duties and the powers of inspectors, as well as the list of offences and penalties for noncompliance to the Directive will be part of national legal act. 7 COMPETENT AUTHORITY (CA) Ministry of Agriculture and Environmental Protection is the competent authority for Directive 2004/42 transposed rules under the Law on Chemicals with the Department for Chemicals as the central administration Ref: Law on Chemicals, Art.5 ( Official Gazette of Republic of Serbia, number 36/09, 88/10, 92/11 and 93/12) and Law on Ministries Art. 5 ( Official Gazette of Republic of Serbia, No 44/14) CA under Directive will be officially designated in National legal act Republic of Serbia - Bilateral screening Chapter 27 Environment and Climate Change

8 ADMINISTRATIVE CAPACITIES contd. In Division for Chemicals Management within Department for Chemicals 1 person is engaged on transposing Directive and implementation Central staffs have acquired knowledge and practical experience on transposition of the Paints Directive rules during several years Capacities of central staffs and inspectors have been further built with support of international projects: IPA 2008 Strengthening Administrative Capacities for the Implementation of a Chemicals Management System ; Serbian-Swedish bilateral project Chemicals Risk Management in Serbia ; Republic of Serbia - Bilateral screening Chapter 27 Environment and Climate Change

9 EXPERIENCE IN IMPLEMENTATION Adequate knowledge on chemicals is available and will be continuously improved A number of seminars with industry participation are organized in Cooperation with industry is established - for the purpose of determining the deadlines for entry into application of restriction VOC content in paint and varnishes ( ) Information for distributers and retailers who are placing paints and varnishes on the market is published in 2012 Information about determination of content of the Volatile Organic Compounds (VOC) in certain paints, varnishes and coatings for road reparation vehicles is published in 2010 System for collecting data on VOC content is in place through the Integrated Chemicals Registry (product subcategory, quantity and VOC content) Republic of Serbia - Bilateral screening Chapter 27 Environment and Climate Change

11 SUMMARY HIGHLIGHTS Serbian system for chemicals management is harmonized with The Paint Directive to the maximum extent possible for a non-member country, except provisions which require EU membership Monitoring program for the purpose of verifying compliance with this Directive will be conducted through the available data from Integrated Chemicals Registry including also data from inspection supervision Republic of Serbia - Bilateral screening Chapter 27 Environment and Climate Change
