1 SCREENING AGENTS FOR SUITABILITY Prior to an agent being contracted to do business through Wealth Partners Inc. a full screening process must be conducted. Barrington Wealth Partners Inc. conducts screening process in good faith and always begins with face to face interview. Once the interview process is complete, Barrington Wealth Partners if they wish to pursue an offer of engagement and request the agent to fill in the Standard Form for Contract or Sponsorship Once the offer has been extended it is understood to be conditional upon Barrington Wealth Partners conducting an investigation, that the applicant is suitable to carry on business as an agent. 2 Appendix A New Agent Procedure: Reference Document: SCREENING AGENTS FOR SUITABILITY: STANDARD FORM FOR CONTRACT OR SPONSORSHIP AND INSTRUCTIONS FOR ITS USE (re: Guideline G8) The Standard Form for Contract or Sponsorship was developed as a tool for use by CLHIA member companies in connection with their screening activities. It is not mandatory to use this form, although the questions it contains are considered to be the minimum amount of information that would be required to properly commence screening. Insurers who want to minimize any risk of a human rights violation are encouraged to conduct their screening in good faith, consistent with the following recommendations: 1. An insurer should not provide its Standard Form for Contract or Sponsorship to any agent for completion for screening purposes until after the insurer or its representative has met with the agent and conducted a face to face meeting (an interview ). 2. Following the interview, the insurer should not provide the agent with the Standard Form for Contract or Sponsorship for completion if it is not interested in the agent and should so advise the agent. 3. Following the interview, if the insurer is interested in the agent, any offer of contract or sponsorship should be made conditional upon completion of the Standard Form and conditional upon the insurer being satisfied, after investigation, that the applicant is suitable to carry on business as an agent.
3 Clarification Note Under the Insurance Act, Barrington Wealth Partners Inc has an obligation to diligently screen prospective life agents for their suitability to carry on business as a life insurance agent. This process necessitates our obtaining personal and financial details relevant to these obligations. The questions on the standard industry application form attached have been carefully structured to avoid making any inquiries that would be considered inappropriate under applicable human rights legislation. With regards to that legislation, we would ask that you please take a moment to read the following notes and clarifications: Question 2(b) Courtesy Titles The purpose of this question is to determine how you prefer to be addressed in future correspondence. The question is entirely voluntary and need not be answered if you have no preference as to our use of a courtesy title. Question 10(a) Spousal Support Orders If the only judgment or order against you is a spousal support order that is not in arrears, do not answer yes to this question. Only provide information regarding spousal support orders if an order against you is in arrears. Question 10(g) Provincial Offenses Do not answer yes to this question if the only offences or charges in question arise under provincial law. By way of example, an offence under the Highway Traffic Act arises under provincial law. Also, do not provide any details regarding convictions or charges under provincial law. Question 2(e) and 2(g) Social Insurance, Driver s License and Business Identification Numbers The purpose in requesting this information is to ensure the accuracy of the information obtained as a result of background checking. Social Insurance Numbers may also be used by Barrington Wealth Partners Inc to report taxable earnings. Canadian Life and Health Insurance Association Inc., Canadian Life Association canadienne and Health Insurance des compagnies d assurances Association Inc. de personnes inc.
4 Advisor Duty of Care Screening Form This form is to be completed by the MGA Barrington Wealth Partners Inc. This form must then be filed along with CLHIA form to be completed on broker prior to contracting with insurance carriers. Applicant s Name: If a corporation, partnership or business style name, list the name of the individual who will be soliciting insurance on behalf of the corporation. 1. Were References contacted? If Not, Why? 2. Was Referencing done with former Employer, Agencies, MGA, etc? a) Name, Position of person contacted b) Briefly describe reference as to character, ethics,etc c) Where previous employer(s) provided financial services any indication of improper sales practices?(if yes, provide details and attach) 3. Business with other insurers: a) Was persistency rate verified? b) Is there debt owing to insurer? c) Was license and E&O validated by you? I have interviewed the above named Applicant and am aware of nothing, which precludes me from reasonably recommending the applicant for contract with Barrington Wealth Partners Inc. 5 Virtgate License &E&O Update Procedures Barrington Wealth Partners Inc. has compliance rules and procedures that must be followed. One very important step for the administrative staff is to be sure that broker s licenses and E&O coverage is up to date at all times in Virtgate. The following is a procedure guide on how to keep Virtgate up to date with Licenses and E&O coverage. Each month compliance staff of Barrington will run an Expiry Notification report and will electronically contact the Key Admin Staff to ensure the advisor is renewing the E&O and the provincial licenses. Failure to keep licenses & E&O coverage updated can result in Compensation NON-PAY status and eventually Contract Termination by Barrington. Steps to follow to Update Virtgate with Licenses and E&O Coverage: Once in a broker s information in Virtgate, click on the Compliance screen in the top portion of the screen. Click the EDIT COMPLIANCE INFO and you may create new license record for each province the advisor is licensed in Or edit the existing licenses. There is only one record required for the Errors and Omission Insurance policy information, capture it at the top of the Compliance screen. E&O Policy- from the E&O copy, enter the certificate number assigned to this Advisor s policy. E&O Carrier- from the E&O copy, enter the E&O Insurance Company. CHLIA application- optional information CHLIA Expiry- optional information Licensed with- from the drop down, select the province of license. License #- from the provincial license copy, enter the full license number Expires- from the provincial license copy, enter the expiry date. Accuracy and consistency in the information stored is extremely important as all internal staff utilize this information to determine the validity of the Advisor. At all times, anyone must be able to determine the status of the Advisor s licenses by viewing the compliance data. The information must be kept current. The Advisor also views this information from their login ID. Uploading the License and E&O document in Virtgate: Once in a broker s information is in Virtgate, click on the Documents screen in the top portion of the screen. Click the EDIT DOCUMENTS. Then click the BROWSE button and find the saved License or E&O document saved on your computer. Then Name the document ie. John Doe s BC License May Then click UPLOAD ABOVE DOCUMENT. A copy of the document has now been saved in Virtgate! Once this has all been done please us at Barrington at bwpsupport@barringtonwealth.com so we can update all contracted insurance carriers.
