6 INSTRUCTION TO BIDDERS 1. BIDS Bids shall be made upon the forms furnished by the Architect. Numbers shall be stated both in writing and in figures; and the signatures shall be clearly and legibly written in long hand. No oral, telephonic or telegraphic bids or modification will be considered. Bids shall be signed with the full name of each and every person interested therein; in case of partnership, the full name of each individual partner shall be given, in the case of a corporation, the corporate name shall be signed by someone of its officers duly authorized to do so. Bids shall be enclosed in an opaque envelope furnished by the Bidder, endorsed with the name of the Bidder and work bid upon, sealed and delivered to the hereinbefore mentioned office of the Owner. The Contractor shall submit with his Bid a list of all subcontractors, material suppliers and materials included in his contract. Bids submitted without this listing may be the basis of rejection. The Owner reserves the right to reject any and all bids. No bid will be accepted from any Contractor who has failed in any respect to comply with every provision of any previous contract, such failure being construed as irresponsibility. Each bidder shall be responsible for being completely familiar with the Work of other Bid packages which require interface of Work with the bid package the Bidder is working on. For purposes of establishing insurance costs, the estimated total cost of the base bid project has been established at approximately $ 150, WRITTEN AND ORAL EXPLANATION Should a Bidder find discrepancies in or omissions from the drawings, or specification, or should he be in doubt as to their meaning, he shall at once notify the architect, Stephen Ciciretto,A.I.A., Architect (440) responsible for any oral instructions. No questions will be addressed if submitted within 96 hours of Bid Opening. Any addendas issued during the time of bidding shall be covered in the proposal, and in closing a contract, they will become a part thereof.

VISITING THE SITE: All Bidders shall, before presenting their proposals, visit the site and thoroughly familiarize themselves with the scope of the work in connection therewith, and the conditions under which it will have to be executed. Lack of such knowledge will not be accepted as valid excuse for granting compensation, or for failure, neglect or refusal to perform any or all of the work in this contract. An optional, but recommended, Pre Bid Conference is scheduled for Wenesday, August 1, 2018, at 9:00 a.m. local time at Wst Geauga Middle School (Board of Education Entrance), 8615 Cedar Road, Chesterland, Ohio SALES AND EXCISE TAX EXEMPTIONS The Owner is exempt from the Ohio Retail Sales Tax. The Owner is exempt from the Federal Transportation Tax where it is the consignee of the material shipped. There is, of course, the usual exemption for the Ohio Gasoline Tax where fuel is consumed in stationary gas engines or in equipment which does not operate on the Public Highways. The Contractor may or may not take these items into consideration in submitting his bid at his discretion. The Owner assumes no responsibility as to which items are sales tax exempt and which are not so exempt. 5. BID GUARANTEE: Each bidder shall submit along with his bid a 100 percent bid bond drawn in favor of the Board of Education, West Geauga Local Schools District, 8615 Cedar Road, Chesterland, Ohio 44026, covering the Base Bid and all additive alternates (if any). Each bidder shall submit along with his bid a Bid Guarantee of 5 percent certified check, cashier's check or letter of credit drawn in favor of the Board of Education, West Geauga Local Schools District, 8615 Cedar Road, Chesterland, Ohio covering the Base Bid and all additive alternates. Bid Guarantee will be left in escrow with the Owner, it being understood the amount is a measure of the liquidated damages which the Owner will sustain by the failure, neglect or refusal of the successful Bidder to execute and deliver the contract performance bond within ten (10) days after written notification from the Owner of contract award to the successful bidder. 8 It is further understood that the Owner will retain the bid guarantee of the two (2) lowest bidders until the successful responsible bidder executes and delivers the contract and performance bond, or in case of default of the successful responsible, until the contract is consummated with the successful bidder or the lowest responsible bidder if new bids are required. 6. SUBSTITUTIONS: The name or make of any article, device, materials, form of construction, fixture, etc., named in the specifications, shall be known as a standard. All bids or proposals shall be based on the specified standards. Where two or more standards are specified bidders may bid upon any one to the standards specified. Bidders may submit substitutions for the standards specified provided they name on the Substitution Sheet attached to the Bid or Proposal Form, the substitute bid on and the addition, deduction or no change it will make in their bid along with complete specifications and descriptions of the substitute. Complete specifications and descriptions of the substitutes bid upon shall be furnished to the Architect prior to the award of the Contract. If the bidder names no substitutes on the Substitution Blank, the standard specified shall be used. No substitutes shall be allowed by the Architect subsequent to the award of the contract. 7. PRIME SUBCONTRACTORS: Each prime bidder shall state on his letterhead, the subcontractors he proposes to use on the project, and shall attach this letterhead to the bid form. 8. QUALIFICATIONS OF BIDDERS The Owner and Architect will have the right to take such steps as he deems necessary to determine the ability of the Bidder to perform the Work, and the Bidder shall furnish the Owner such data for this purpose as the Owner may request. When requested, this shall clearly show the Bidder's financial resources, his construction experience, his organization, and equipment available for Work contemplated. Within 24 hours after receipt of the bids the apparent low bidders will complete and submit to the Architect, AIA Document A305, Contractor Qualifications Statement, and thereafter provide the Construction Program Manager promptly such additional information as he may request regarding the Bidder's responsibility. 9 Additionally, upon request, other Bidders shall promptly complete and submit to the Architect, AIA Document A305, Contractor's Qualification Statement, and such additional information as the Architect and Construction Program Manager may request regarding the Bidder's responsibility. The right is reserved to reject a bid where an investigation of the available evidence of information does not satisfy the Owner that the bidder is qualified to properly carry out the terms of the Contract Documents. The Owner reserves the right to reject the bid of a bidder who has previously failed to perform properly or to complete Contracts of a similar nature on time, who is not in a position to perform the Contract, or who has habitually, and without just cause neglected the payment of bills or otherwise disregarded his obligations to subcontractor's, material men or employees. 9. AFFIDAVIT AS TO PROPERTY TAXES: The successful Bidder will be required to submit, prior to the time of the entry into the Contract, an affidavit in the form required by Section , Ohio Revised Code, regarding the status of the lowest Bidder's property taxes. The Bidder shall furnish the Project Taxing District a statement under oath that he or his company has or does not have delinquent personal property taxes due and payable within the county of the Project. After the award by a taxing district of any contract let by competitive bid and prior to the time the contract is entered into, the person making a bid shall submit to the district's fiscal officer a statement affirmed under oath that the person with whom the contract is to be made was not charged at the time the bid was submitted with any delinquent personal property taxes on the general tax list of personal property of any county in which the taxing district has territory or that such person was charged with delinquent personal property taxes on any such tax list, in which case the statement shall also set forth the amount of such due and unpaid delinquent taxes and any due and unpaid penalties and interest thereon. If the statement indicates that the taxpayer was charged with any such taxes, a copy of the Treasurer within thirty days of date it is submitted. A copy of the statement shall also be incorporated into the contract, and no payment shall be made with respect to any contract to which this section applies unless such statement has been so incorporated as a part thereof. 10 10. RETAINAGE: Eight percent retainage shall be held in an escrow account for the first 50% of the project, after which all payments shall be made at the rate of 100%. 11. SCHEDULE OF CONSTRUCTION The General Contractor shall be responsible for the coordinating work of all other trades.
