The tender document must be duly filled in and enclosed in the Technical Bid along the following documents - a) Covering Letter along with Company Profile. b) EMD Page No.

2 c) Copy of PAN / TAN / TIN d) Copy of the Technical Specification, Make, Model or Catalogue/leaflet of the product proposed to be supplied with complete specifications. e) Self-Attested copy of ID-Proof, Address Proof, Pan Card and a recent passport size colored photograph of authorized representative. f) Scanned copy of Authorization Certificate issued by the OEM in favour of the bidder, if the bidder is not the Manufacturer of the goods to be supplied. g) A minimum of 5 Work orders (Completion Certificates Desirable) for the supply and installation of the equipment of similar Make & Model, as specified in Annexure I, at reputed Education Institutions, Government Departments, Autonomous Bodies or Public Sector Undertakings, by the Vendor. The concerned government department, autonomous body or PSU must have issued the Certificate where such equipment was supplied. h) Scanned/copy of the Bank Details of the firm to release the payment and EMD. i) Proof of minimum 0 years experience in supplying or manufacturing gym equipment. j) Address and contact details of service center. Incomplete bids will be summarily rejected. 3. The Financial Bid will contain only BOQ in the prescribed in Annexure II. Page No. 2

3 General Terms & Conditions. The Principal of the college reserves the right to terminate this tender at any stage before making the purchase without assigning any reason thereof. 2. In the event of specified date of opening of tender is declared a holiday, the tender shall be opened at the same place and same time on the next working day. 3. The vendors must quote brand/make & models of the goods in the relevant tables in Annexure I and Annexure II. 4. Incomplete or wrong information will disqualify the tender. 5. The Earnest Money i.e.,00,000 of the bidding amount will have to be paid through Bank Draft/Pay Order, drawn in favor of Principal, Jesus & Mary College. It will be refunded (without interest) to the bidders within 90 days from the last date of receipt of tender document. Without Earnest Money Deposit (EMD), the tender will be REJECTED. EMD in any other form will NOT be accepted. 6. Performance Guarantee: The successful bidder shall be required to furnish a Performance Guarantee in the form of Fixed Deposit Receipt/Bank Guarantee issued from any scheduled bank in favour of the Principal, Jesus & Mary College, at 0% of contract value. The Performance Guarantee shall be valid for a period of year. Jesus and Mary College shall issue the supply order on the receipt of Performance Guarantee. The Performance Guarantee will be released after a period of year. If the vendor selected for the award of contract refuses to execute the Purchase Order or fails to deposit the Performance Guarantee within 7 days from the date of issue of Letter of Intent, Jesus and Mary College shall forfeit his Earnest Money Deposit and the vendor shall be blacklisted from participation in tenders in Jesus and Mary College for next 5 years. 7. Grounds for Forfeiture of Earnest Money Deposit (EMD) EMD of the successful bidder shall be liable to be forfeited under the following conditions: (i) (ii) If any bidder withdraws his tender before the expiry of the validity period or before selection of the successful bidder, whichever is earlier, or makes any modification in the terms and conditions of the tender which are not acceptable to Jesus & Mary College. If it is found at any stage of the processing of the bids/finalization of the contract that the bidder has/had furnished false information/document(s) or withheld some vital information/document(s) or the services as per the contract have not been provided to the utmost satisfaction of Jesus & Mary College. 4 (iii) (iv) (v) If it is found at any stage of the processing of the bids /finalization of the contract that the bidder was blacklisted by any Government department or organization. If the products/goods are not delivered and installed by 5 th March. If the supplied goods are not as per the prescribed technical specifications and agreed to by the bidder. 8. The Technical Bids of the bidders received within the prescribed date and time and with the prescribed EMD shall be opened on 2th February, 207 at 0:00 p.m. Representatives of the bidders/tenderers may be present when the technical bids are opened. The decision of the College to accept or reject any technical bid shall be final and no grievance shall be entertained in this regard. 9. The standard configurations/ specifications have been given provided in Annexure I. The bidder needs to provide the detailed specifications along with make and model of the goods, which he proposes to supply. In case, the configurations/ specifications offered by the bidder are found to be inferior to the configurations/ specifications prescribed in the nomenclature, then, the tender of such bidder shall be rejected out rightly. 0. The bidder must have a service center in Delhi/NCR to facilitate timely service /repairs/ maintenance of the supplied equipment/product.. All items of interrelated works considered necessary to make the installation complete and operational are deemed to be included by the contractor in the schedule of quantities at no extra cost. 2. All pages of the Tender Document must be signed by the authorized signatory and sealed with the stamp of the bidding firm as token of having accepted all the Terms & Conditions of this tender. 3. The Financial Bids of only those bidders, who fulfill the technical qualification criteria and are declared qualified in the Technical Bid evaluation, will be opened. 4. Revision of rates is not allowed after the bids have been opened. 5. Item wise bids will be considered only in the absence of bidders willing to supply all items specified in I(A) and clause I(B) of annexure I. 6. The rates shall be inclusive of excise duty, cartage, loading, unloading etc. Nothing extra shall be paid on any account. 7. Award of Contract: The Technical Bids shall be decided strictly by the College as per its requirements, and keeping in view the eligibility criteria and the technical specifications specified in Annexure Page No. 4

5 I. The bid being the same, preference shall be given to the bidders supplying products/goods superior to the specifications provided in the description of the item. 8. Time Allowed: The products/goods should be delivered and installed by 5 th of March. 9. The supply shall be treated as completed only after successful installation of the products/goods to be done by the vendors at Jesus and Mary College, University of Delhi, Chanakyapuri, New Delhi-002. Wherever required, the vendor must provide all the cables, components, accessories, software and manuals for making the system fully functional and operational. 20. Schedule of Payment: - 00% payment will be made within 30 days of successful installation of products/goods to the satisfaction of the College. 2. The successful bidder will be solely responsible for any damage to supplied goods till the time of final installation and handover. 22. The Supplier shall maintain the college premises in good condition and shall not cause any damage thereto. If any damage is caused to the premises by the Supplier or his workers or agents or clients / customers, the same shall be made good by the Supplier or at his/her cost either by rectifying the damage or by paying cash compensation as may be determined by the college. 23. Force Majeure: In the event of either parties being rendered unable by force majeure to perform any obligations prescribed in the tender, then under the agreement, the relative obligation of the vendor effective by such force majeure shall be suspended for the period during which such case lasts. The terms force majeure as embodied herein shall mean acts of God, War, riot fire, flood sabotage and acts and regulations of Government. Upon occurrence of such clause and upon its termination, the vendor alleging that he has been rendered unable as aforesaid hereby shall notify alleged beginning & ending of such occurrence giving full particulars and satisfactory evidence in support of the claims. Time for performance of relative obligation suspended by the force majeure shall stand extended by the period for which such case lasts. If progress of work is suspended by force majeure conditions lasting for more than two months, the Principal, Jesus and Mary College, shall have the option of canceling the contract in whole or in part at its discretion. 24. Arbitration: If any dispute or difference arises between the parties hereto as to the construction, interpretation effect and implication of any provision of the purchase/work order including the right or liabilities or any claim or demand of any vendor against other or in regard to any other matter under these conditions but excluding any matters, decisions or determination or which is explicitly provided for in the work order, such disputes or difference shall be referred to the sole arbitration of Principal, Jesus and Mary College or that of its nominee. A reference to the Arbitration under this clause shall be deemed to be in submission within the meaning of the Page No. 5

6 Arbitration and conciliation Act, 996 and the rules framed there under for the time being in force. The venue of the Arbitration shall be at Jesus and Mary College. Each party shall bear and pay his own cost of the arbitration proceedings. The High Court at Delhi and courts subordinate to it shall have exclusive jurisdiction in all matters concerning the work order, including any matter arising out of the Arbitration Proceedings or any Award made therein. 25. Indemnity: The concerned vendor shall always keep Jesus and Mary College indemnified of any action/damages or other legal proceedings and liabilities that may arise directly or indirectly on Jesus and Mary College with respect to the supply and installation of products/goods provided by the concerned vendor. Such liability of the concerned vendor shall always survive irrespective of the duration of any agreement made with the concerned vendor. The vendor will be liable to remove the rejected material within 5 days from receipt of rejection report at his risk and cost failing which Jesus and Mary College shall not be responsible for its safe custody. 26.
