MAIN STREET STANTON, MICHIGAN PHONE: NOTICE TO BIDDERS Sealed bids will be received by the Board of County Road Commissioners of Montcalm County at their offices located at 619 West Main St, PO Box 337, Stanton, Michigan 48888, until 11:00 A.M., MONDAY, FEBRUARY 2, 2015 for the following: H.M.A. PAVING All bids are to be in sealed envelopes, plainly marked with the contents and the bidder's name. Faxed bids will not be accepted. Further information upon which bids shall be based is available at the Road Commission s office listed above. The Road Commission for Montcalm County reserves the right to reject any or all bids or any portion thereof and to accept the bid that in the opinion of the Board is in the best interest of the Road Commission for Montcalm County. 2 ROAD COMMISSION for MONTCALM COUNTY BITUMINOUS MIX ASPHALT PAVING SPECIAL PROVISIONS Traffic Control All traffic control, including signing and flagmen, will be furnished by the contractor. All advance warning devices must meet specifications as outlined in the Michigan Manual of Traffic Control Devices. Material 13A HMA shall meet all requirements of Michigan Department of Transportation s current Standard Specifications, utilizing PG58-28 asphalt cement. Tack coat will not be a bid item but will be incidental to the project; application rate will be 0.05 to 0.15 gallons per square yard. Bidder must enclose a job mix formula (JMF) with the bid. Road/Street Intersections All gravel intersections shall have a 50-foot paved approach, measured from the edge of the newly paved roadway surface. All hard-surfaced intersections shall be feathered in, a minimum of one (1) foot per inch of thickness of bituminous material or as directed by project engineer. The cost of intersection approaches is considered incidental to the bituminous paving. Driveway Approaches All gravel driveway approaches shall have a two-foot (2 ) driveway tab. Bituminous driveway approaches shall be constructed along bituminous paved roads at existing concrete or bituminous residential and commercial driveways, as directed by the engineer. The work shall be performed in accordance with Section 501 of the current Michigan Department of Transportation s Standard Specifications for Construction, except as modified herein. The driveway approaches shall be placed in prepared (graded, shaped and compacted) areas, which shall be cleaned and tacked, as appropriate, by the contractor prior to placing HMA. The approaches shall be placed to form a smooth slope from the edge of the new roadway surface to the existing driveway surface. The approach shall be constructed to a depth of three (3) inches and meet the dimension requirements as specified in the Road Commission for Montcalm County s Specifications and Administrative Rules Regulating Driveways, Road Approaches, Banners and Parades on and over Highway, adopted October 6, The length of the approach is to be limited to five feet (5 ) measured from the edge of roadway pavement to the butt joint at the driveway, unless otherwise directed by the engineer. The material used shall be the bituminous mixture used for the top course of bituminous roadway. The completed work for HMA driveway approaches shall be measured and paid for at the contract unit price for the following contract pay item, which includes all material, equipment and labor to complete this item of work. Pay Item: HMA Driveway Approach Pay Unit: Square foot Payment for bituminous roadway approaches, tapers or driveway tabs will not be made separately under this item of work, but will be considered to be included in mainline bituminous paving. HMA Spillway Bituminous spillway shall be constructed in accordance with the detail as shown on Appendix A, using the bituminous top course mix specified for the project. The length and location of the spillway will be as shown on the plans or as directed by the engineer. The materials used will be the bituminous mixture used for top course or driveways. The completed work as measured for bituminous spillway will be paid for at the contract unit price for the following contract pay item and includes all material, equipment and labor to complete this item Pay Item: HMA Spillway Pay Unit: Square foot HMA Paving Page 2
3 Mobilization The contractor shall give at least five (5) working days notice to the Superintendent prior to starting project(s). Option #1: Contractor shall furnish labor and equipment to grade and shape gravel roads and driveway approaches prior to paving at the below-listed additional cost per square yard. Option #2: The contractor shall place and compact 23A gravel on shoulders at the below-listed additional cost per ton (when or where a scale is not available, measurement shall be in cubic yards and conversion factor of 1 cubic yard = 3,200 pounds shall apply). The shoulders will vary in width from two feet (2 ) to five feet (5 ) and depth depends upon the existing road conditions. The Road Commission will furnish and load the 23A gravel. The material will come from a county-owned stockpile located at either Anderson Pit in Douglass Township or Warner Pit located adjacent to the west county line at Reynolds Township. Additionally, gravel may be supplied from other pits located closer to job sites; however, the Road Commission reserves the right to make that determination. Completion Date Completion date for all paving projects is October 16, Insurance Requirements: 1. Contractor shall save harmless and indemnify the Road Commission, as well as their employees, against all claims for damages to public or private property and for injuries to persons arising out of and during the progress and to the completion of work all in accordance with the current Michigan Department of Transportation s "Standard Specifications for Construction", Division 1, paragraph , with the following minimum requirements: Workman's Compensation: Statutory Coverage Bodily Injury and Property Damage Other Than Automobile: Each Occurrence $1,000,000 Aggregate $2,000,000 Bodily Injury Liability and Property Damage Liability Automobile: Bodily Injury Liability $500,000 Each Person, Each Occurrence $1,000,000 Property Damage Liability $1,000,000 Each Occurrence Combined Single Limit for Bodily Injury and Property Damage Liability: Each Occurrence $2,000,000 Insurance Certificate declaring the Road Commission for Montcalm County as additional insured not certificate holder must be issued and shall become part of contract. 2. Contractor shall maintain current up-to-date insurance coverage during the term of the contract and failure to do so shall result in termination of said contract. 3. Certificate must be submitted within ten days upon notification of award of Contract and prior to contract signing. HMA Paving Page 3
4 Non-Discrimination The RCMC, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 USC 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Federally-assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, minority business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of gender, disability, race, color, or national origin in consideration for an award. During the performance of this contract, the contractor, for itself, its assignees and successors in interest (hereinafter referred to as the contractor ) agrees as follows: 1. Compliance with Regulations: The contractor shall comply with the Regulations relative to nondiscrimination in Federally-assisted programs of the Department of Transportation, Title 49, code of Federal Regulations, Part 21 as they may be amended from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by reference and made a part of this contract. 2. Non-discrimination: The contractor, with regard to the work performed by it during the contract, shall not discriminate on the grounds of race, color, or national origin in the selection and retention of subcontractors, including procurements of materials and leases of equipment. The contractor shall not participate either directly or indirectly in the discrimination prohibited by section 21.5 of the Regulation, including employment practices when the contractor covers a program set forth in Appendix B of the Regulations. 3. Solicitations for Subcontracts, Including Procurements of Materials and Equipment: In all solicitations either by competitive bidding or negotiation made by the contactor for work to be performed under a subcontract, including procurements of materials or leases of equipment, each potential subcontractor or supplier shall be notified by the contractor of the contractor s obligations under this contract and the Regulations relative to non-discrimination on the grounds of race, color, or national origin. 4. Information and Reports: The contractor shall provide all information and reports required by the Regulations, or directives issued pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its facilities as may be determined by the Road Commission for Montcalm County to be pertinent to ascertain compliance with such Regulations or directives. Where any information required of a contractor is in the exclusive possession of another who fails or refuses to furnish this information, the contractor shall so certify to the State highway department, or the Federal Highway Administration as appropriate, and shall set forth what efforts it has made to obtain the information. 5. Sanctions for Non-compliance: In the event of the contractor s non-compliance with the nondiscrimination provisions of this contract, the Road Commission for Montcalm County shall impose such contract sanctions as it or the Federal Highway Administration may determine to be appropriate, including, but not limited to: (a) (b) Withholding of payments to the contractor under the contract until the contractor complies, and/or Cancellation, termination or suspension of the contract, in whole or in part. 6. Incorporation of Provisions: The contractor shall include the provisions of paragraphs (1) through (6) in every subcontract, including procurement of materials and leases of equipment, unless exempt by the Regulations, or directives issued pursuant thereto. The contractor shall take such HMA Paving Page 4
5 action with respect to any subcontract or procurement as the Road Commission for Montcalm County may direct as a means of enforcing such provisions including sanctions for non-compliance: Provided, however, that, in the event a contractor becomes involved in, or is threatened with, litigation with a subcontractor or supplier as a result of such direction, the contractor may request the Road Commission for Montcalm County to enter into such litigation to protect the interests of the County, and, in addition, the contractor may request the State highway department to enter into such litigation to protect the interests of the State and/or the United States to enter into such litigation to protect the interests of the United States. 6 H.M.A. PAVING BID SHEET The undersigned has examined the specifications described herein and is fully informed as to the nature of the work and the conditions relating to its performance. The undersigned proposes to furnish all labor, materials, equipment, and services necessary to complete the work in accordance with current Michigan Department of Transportation Specifications in consideration of the unit prices stated below and agrees that this document will constitute the contract if accepted by the Board of County Road Commissioners of Montcalm County. The undersigned understands and agrees that the Road Commission for Montcalm County reserves the right to reject any and all proposals and to make contractual agreements that are in the best interest of Montcalm County and the Road Commission. Proposals must be in a sealed envelope marked "PAVING BID" and must be received at the Road Commission's office, 619 West Main Street, P.O. Box 337, Stanton, MI no later than 11:00 AM, MONDAY, FEBRUARY 2, 2015, at which time they will be opened and publicly read. No later than May 1, 2015, the successful bidder shall provide a certified or cashier's check or bank money order payable to the Road Commission for Montcalm County, in the amount of $5,000.00, as a guarantee of good faith. If the undersigned fails to execute all the terms of this contract, said bid deposit shall be forfeited to the Road Commission.
