7 Charity Protector and Bsiness Association Gard Claim Examples General : A chamber of commerce was holding their monthly membership meeting at a local hall. One of the attendees tripped on an extension cord the chamber was sing for a presentation and broke his leg. He then filed a sit against the chamber to cover his medical expenses for his slip and fall. Medical bills exceeded $10,000. A parent teacher organization was helping set p for gradation night. While attempting to hang p a banner, a volnteer fell from ladder sstaining a broken wrist. Sit was filed against the organization for medical expenses of $5,000. Nonprofit Directors and Officers: The trstees of a trade association decided to expand their activities into areas that were not explicitly envisioned by the fonders. Their state s attorney general broght an action against them alleging misse of fnds and property for operating otside their charter, even thogh no third party had raised a complaint. A local chamber of commerce pblished a qarterly newsletter that inclded a torism section promoting places of interest, attractions, restarants, etc. A new restarant approached the chamber with a reqest to advertise in the pcoming isse. The chamber agreed and accepted a minimal advertising fee from the restarant. It was discovered on the next isse that the exective director never accommodated the restarant s reqest and kept the money. The restarant then sed the chamber for breach of fidciary dty, breach of contract and interference with economic interests. A donor made a large contribtion to a fondation to aid stdents in need of tition. The board instead voted to expand their headqarters and commit a portion of the donation to the bilding fnd. The donor filed sit, alleging misappropriation of fnds. Damages inclded retrn of the fll contribtion pls interest. As some of the money was already spent, the fondation was financially nable to retrn the entire donation. Employment Practices : A chamber of commerce advertised an open position for a secretary. The organization received seven applications. Only one applicant was a male, who was 57. He was not interviewed. He alleged he was not interviewed becase of his age and filed sit against the organization for age discrimination for a total of $45,000. (General ): A local chamber of commerce had a one-day concert to raise fnds for one of its members. A tent at the fndraiser was not anchored properly and blew over and damaged mltiple parked cars. The car owner sed for repairs. Damages exceeded $5,000. A membership organization was having a fndraising event to raise money for breast cancer. An attendee was strck by a motorcycle where the event sponsor was directing traffic. She sffered torn ligaments and tendons in her ankle along with back injries. Medical bills and loss of wage claims exceeded $68,000. A booster clb was holding its annal charity event and an attendee tripped over speakers that were set p too close to the sidewalk. He sffered a fractred arm reqiring srgery, which totaled in $23,500 in medical bills. A fondation was hosting a charity golf tornament and dinner. At the dinner, one of the attendees tripped over a sprinkler head while walking to the clbhose. He sffered a fractred knee cap, and needed reconstrctive srgery. Medical bills totaled $10,000. (Host Liqor ): A trade association was hosting its annal holiday party. An attendee that was drinking heavily drove home, lost control of her vehicle and hit another vehicle head on. The other driver broght sit against the host of the party for negligence in serving the intoxicated attendee. The driver s injries totaled $300,000. (Commercial Liqor ): A minor attendee was served alcohol at a festival sponsored by a membership organization. After leaving the festival, the nderage attendee got into the car, lost control of his vehicle and strck a telephone pole, reslting in severe facial lacerations. The attendee sed the event sponsor and the beer vendor for illegal service to a minor to cover the medical bills totaling $150,000. An intoxicated individal attending a charity event was strck and killed while crossing the street on foot. An aggressive investigation determined the individal, with a.26% blood alcohol level, was refsed service by the insred. The reslting lawsit was dropped bt $15,000 was paid ot in attorney s fees and cort costs. This docment does not amend, extend or alter the coverage afforded by the policy.
