The policy language and cases that have construed similar language provide a basis for denying coverage. Although the result is particularly harsh the rationale is based on the idea that claims-made policies are fundamentally different than occurrence policies. Claims-made policies do not provide for the long "tail" of coverage that occurrence policies do. Because the carrier can more accurately predict the potential exposure and risk on a claims-made policy it can price it more cheaply.
