Johnson & Speakman 869 F.2d 422 (8th Cir. 1989)(applying Minnesota law); See Also Lexington Ins. Co. v. St. Louis Univ. 88 F.3d (8th Cir. 1996)(applying Missouri law to hold the "notice-prejudice" rule did not apply to claims made policies). The policy language and cases that have construed similar language provide a basis for denying coverage. Although the result is particularly harsh the rationale is based on the idea that claims-made policies are fundamentally different than occurrence policies. Claims-made policies do not provide for the long "tail" of coverage that occurrence policies do. Because the carrier can more accurately predict the potential exposure and risk on a claims-made policy it can price it more cheaply. In turn the insured is afforded less coverage. 41 Specialty Food Systems Inc. v. Reliance Ins Co of Ill. F. Supp. No. Civ A (E.D. La. January )(1999 WL 20934). 42 Id. At #2. 11
