1 CLUB RULES JR. PROGRAM All players need to check in at the Tennis Office. All guests need to check in and pay their guest fee before they start play. All players need to provide their own tennis balls; tennis baskets are for teaching purposes only. Members have priority over Non-Member for all Clinics & Club Play sign-ups. Proper tennis attire is required: TENNIS SHOES are required, no running, black bottom or dress shoes that mar the court will be allowed. SHIRTS and SHOES must be worn at all times on the courts and in the clubhouse. No bathing suits or sports bras are allowed. No beverages in glass containers, food, or gum are allowed on the courts. No food or drink is permitted in the clubhouse. No alcoholic beverages will be permitted on clubhouse grounds. No profanity will be permitted. Smoking is NOT permitted. Balls are not to be hit against the clubhouse or inside the clubhouse. No running in the upstairs clubhouse or surrounding patio. Lockers are available during play only for our members. You must provide your own lock. You must empty your locker after play. Any Locker left overnight with a lock on it will be emptied by the Murrieta Tennis Club and your contents will be confiscated. Please do not hit balls up against the windscreens. They are not to be used as backboards. Please do not use court benches or chairs as targets in any way. Parents are responsible for and must control their children with due regard to the comfort of other players. Children are not permitted to run unattended about the clubhouse or the clubhouse grounds. Adults taking tennis lessons must provide for their children s supervision. All children must be adult supervised on and off the courts. No pets or animals are permitted on the Murrieta Tennis Club property. We reserve the right to refuse or turn away problem players. Management may from time to time, add, delete and/or change any rule or regulation of the Tennis Club that they deem necessary. Management shall have the authority to regulate the hours of operation, as it deems necessary. Murrieta Tennis Club is not responsible for articles lost, stolen or mislaid. ALL USERS OF THE FACILITY ARE LIABLE FOR PROPERTY DAMAGED OR DESTROYED BY THEM.

2 COURT RESERVATION JR. POLICY PROGRAM Only Members of the Murrieta Tennis Club can reserve courts. Members can reserve a court no more than 48 hours in advance. Court time for non-members is based on court availability. Members may reserve a court by calling the tennis office ( ) texting ( ), (info@murrietatennisclub.com) or on our website ( Member may use their online accounts to reserve tennis courts. To reserve courts online you must set up your online account go to then member login. If a player does not have an online account (i.e. not a member) to make reservations, then he/she may make a reservation at the front desk on the same day of play. Non-members may also call in on the day of to make a court reservation if available, and pay over the phone with a valid credit card. No refunds will be issued for cancellation of same day reservations. Court reservations are mandatory after 8:00 p.m. Members can only reserve one court at a time. Maximum court reservation time is for an hour and a half (1 ½), additional playing time is based on court availability. Court time will be held for 30 minutes after the scheduled time, then reassigned if other players are waiting. We do not guarantee preferences regarding a specific court. Murrieta Tennis Club tournaments league events, special functions and lessons have preference of court times. Out of courtesy to other players, members are expected to cancel their court time as soon as possible. Failure to show or not to cancel several times may result in players losing their court reservation privileges. The ball machine will be booked for a maximum of one (1) hour per reservation. Ball machine rentals must be done during Murrieta Tennis Club office hours and not during prime time hours. Please see the Ball Machine policy for more information.

3 BALL MACHINE JR. PROGRAM SHOTMAKER Ball Machine by Sports Tutor Murrieta Tennis Club has a top-of-the-line Sports Tutor Shotmaker Deluxe ball machine. This machine is your most reliable hitting partner for tuning up your forehand or backhand. It can hit the softest drop shots or the fiercest deepest drives. It can hit with topspin or backspin. It can run you all over the court. Do you want to drill at the net, run from sideline to sideline or simply hit from the baseline? What more could you ask for in a hitting partner? It has endless endurance and it never tires. When you really need to work on your groundstrokes or volleys, play against our new ball machine. Various Speed Ranges (10 MPH-95 MPH) Interval control for customized timing between shots (1-6 seconds) Adjustable spin (Heavy Topspin, flat, Heavy Underspin) Adjustable trajectory (Groundstroke and Lob) Programmable or Random Oscillator Functions Ball Capacity of 300 Ball Machine Rental Rates Members $15 per hour Non-Members $18 per hour *Reservation is required. Ball Machine Rental Policy Rental fee is paid, in advance, in the tennis office. If using sessions from a pre-paid package, member must sign for each prepaid session. Ball Machine rental is for a minimum/maximum of one-hour time blocks at a time. A member may reserve the ball machine no more than 48 hours in advance. Court time must also be reserved with the ball machine. The ball machine may not be available during prime time usage hours; this will be based on court availability. Ball machine rental must be done during Murrieta Tennis Club office hours. Pre-paid ball machine purchases are non-refundable. All children under 14 years old must have on court adult supervision at all times. Children using the machine must have adult supervision on the court at all times. For your safety please do not stand directly in front of the ball machine or aim balls directly at another person. Please do not hit balls directly at the ball machine. Please do not put hands into the ball machine. Each member is responsible for picking up all of their balls and returning the machine and balls to the storage area. An additional service fee of $5 will be charged if balls are not picked up.

4 MEMBERSHIP AGREEMENT TERMS JR. & CONDITIONS PROGRAM NEW CLIENTS* If you are a NEW client (meaning you are new to MTC and have not played at the club before or received a free lesson, Get Started or Groupon lesson) then you will receive a free half-hour private lesson with your membership in your first month. Single Membership New clients will receive one half-hour private lesson for FREE in their first month only. Family Membership New Clients will receive a total of two half-hour private lessons (per membership not per person) for FREE in their first month only. *FINE PRINT - Valid for New Clients Only. Limit 1 per person. Introductory Offer only. Can not be combined with other offers. All goods and services must be used by the same person. All free lessons expire 1-month from the date of purchased. Once a package is purchased you will be contacted one of our tennis pros to schedule your private lesson. All new clients receiving our introductory free private lesson must pay for 1 full calendar month prior to being eligible to cancel. (Example: if your start date is March 15th, and you wish to cancel you may do so after April 30th.) MEMBERSHIP & GUEST POLICY Nature of Membership. All memberships are mere licenses which shall give the holder thereof the revocable right to use and enjoy the Murrieta Tennis Club facilities subject to the rules and regulations established by the CLUB. It is expressly agreed and understood that the holders of licenses in the form of membership shall neither individually nor collectively have any proprietary right or interest in or to any of the properties, assets, premises, or any other thing or matter whatsoever with respect to the Murrieta Tennis Club or its facilities, or the operations of the Club. Memberships and membership cards are not transferable. Single Membership. An adult membership shall consist of an individual, whether married or not. The spouse and/or children, if applicable, may be guests in accordance with the Club s Guest Policy. shall not be entitled to the rights and privileges of this type of membership, but Family Membership. A family membership shall be defined as a primary member and his or her spouse, if applicable, and their dependent children under twenty-one (21) years of age living in the same household. Junior Membership. A junior membership shall consist of a junior 21 years and under. Guest Policy. Guest privileges are available for an additional charge. Members are responsible for their guest and their guest fees. Limited use. MEMBERSHIP DUES & BILLING Month to Month EFT. All Memberships are Month-to-Month (EFT required, auto renews monthly), cancellation policy applies. See cancellation policy section for more details on canceling a membership. I understand that I am signing a contract with the Murrieta Tennis Club and agree to pay for membership for the specified period of time, this contract is binding and I understand I will receive no refunds and that this is a continuous membership with no extensions/refunds for non-use. Billing: I understand my monthly dues will be deducted via Electron Funds Transfer (EFT) from my bank account or Visa/MC/Amex on the 1st each month (including monthly dues, late fees, any additional charges, past due amounts) I understand that I am in full control of my payment, and if at any time I decide to make any changes, I will write to or visit the Murrieta Tennis Club. If payment is declined for any reason balances are due 5 days after the billing date will incur a late fee of $15, past due accounts are subject to collections. Membership Dues. The Murrieta Tennis Club shall, from time to time, fix the amount and terms of payment for goods, services and the use of the Club s facilities by members and their guests. The Murrieta Tennis Club reserves the right to change the amount of the dues, given thirty (30) days written notice. The Murrieta Tennis Club may assess additional charges for membership status changes, replacement cards, lockers, and returned payments. In addition to the health and fitness services which the Murrieta Tennis Club provides pursuant to this contract, the Club may, from time to time, also provide additional services which are specifically set forth in the Club s Rules and Regulations and/or newsletter. Those services are available to members upon request and are subject to an additional charge. The Club s reserves the right to change the services provided and/or the amount charged therefore without written notice. All dues, fees for other services and obligations owed to the Club by a member shall be due and payable on the first day of each month and shall be delinquent if not received by the fifth of each month. Any failure to make payments of the monthly installments and charges due will cause the cancellation of the member or member s add-on parties to make monthly installments and the full amount remaining shall become immediately due and payable. Acceptance of any payment after default will not release member from any obligations under this Contract. You agree to pay court costs and reasonable attorney s fees involved in collecting amounts owed under this Contract, as determined by the court. Electronic Funds Transfer ( EFT ). A member using Electronic Funds Transfer has authorized his or her bank to pay membership dues and other charges on the 1st day of each month. If funds cannot be collected on that date, the member will be charged a service fee by the Club in addition to any service fee which the member s bank may charge, and the member will be responsible for payment of the amount due. Finance Charge. If full payment of the member s account is not received by the 1st of the month, any balance unpaid will be subject to a finance charge of 10%. The finance charge will be added to the unpaid balance after deducting payments and before adding current charges. Return Charge. There will be a $15.00 charge for any returned check debit or credit card decline for any reason. RULES AND REGULATIONS A holder of membership and all persons entitled to privileges, including guests, under said membership shall abide by and fully comply with Rules and Regulations which are, from time to time, adopted by the club with respect to reasonable and safe us and enjoyment of the facilities of the Murrieta Tennis Club. CANCELLATION POLICY Voluntary Cancellation. This membership is a continuous payment plan and will continue until the buyer cancels the contract in writing with a clients signature. Cancellations must be receive by the last day of the month to be effective the following month. Cancellations received on or after the 1st of the month will take effect the following month. Cancellations will not be taken over the phone. Non-usage of the club and/or non-payment of dues are not methods of canceling a membership. A membership cancellation is not retroactive and terminated members shall not be entitle to a refund of any part of the paid monthly dues - All new clients receiving our introductory free lesson offer must pay for 1 full calendar month prior to being eligible to cancel. (Example: if your start date is March 15th, and you wish to cancel you may do so after April 30th.) Involuntary Resignation. The Murrieta Tennis Club shall have the right, with or without cause, to revoke any membership at any time. The membership of any member who is thirty (30) days in arrears with respect to the payment of the member s account may at the sole option of the club be terminated, in which case the member shall be responsible for dues and charges through the date of termination. Re-activation Policy. If membership was terminated in good standing there will be an enrollment fee plus the current month s dues. If membership was terminated for non-payment of dues then the back dues prior to membership, current dues and the enrollment fee will be accessed. Membership Hold Policy. Membership holds are granted for medical reasons only. A member must give written notice and attach a written notice from your physician. Memberships can be put on hold for a maximum of 90 days. A member wishing to put their membership on hold for more than 90 days is considered a cancellation. If you cancel your membership, and then wish to re-activate your membership, you are considered a new member and any membership hold you had taken previously is erased and our re-activation policy applies. Assumption of Risk, Release of Liability and Indemnification: In consideration of being permitted to use the Murrieta Tennis Club facilities and equipment, on behalf of myself, my family, my heirs, and my assigns, I hereby release Murrieta Tennis Club, it s owners, employees, and agents, from liability for injury, death, or loss suffered by me, while using the facility, equipment or in any way associated with participating in any and all Club activities now or in the future, resulting from ordinary negligence of Murrieta Tennis Club, it s agents, or employees. By the execution of this agreement, I assume full responsibility for any and all injuries or damages which may occur to me (including loss or theft of personal property) as a result of negligence on the part of Murrieta Tennis Club or it s employees, in or about the Club premises. I affirm there are inherent risks in all health and fitness club activities, that I am aware of and appreciate these risks, and that I assume all responsibility for personal inj ury, death, or loss resulting from these injuries. In addition, I authorize Murrieta Tennis Club to take emergency action in the event of an accident. The undersigned hereby agrees to defend, indemnify, and hold harmless the Murrieta Tennis Club and its officers, employees and agents from and against any and all loss, liability charges and expenses (including attorney s fees) and costs which may arise by reason of participation in any program. As parent/guardian, I hereby consent to emergency treatment of my minor child as a result of accident or injury. I further agree to pay any and all cost incurred as a result of said treatment, I agree to carefully inspect and satisfy for myself that the facilities provided are reasonably safe for their intended use. Once having conducted the inspection, I agree to expressly assume the risk of participating at the premises. I understand that the Murrieta Tennis Club retains the right to use photos taken during activities for publicity purposes.

5 JR. PROGRAM BILLING JR. POLICY PROGRAM Billing Jr. Program All Jr. Group classes are on a perpetual billing cycle. Meaning you will be billed every month until you notify us in writing of a cancellation. DIRECT MONTHLY BILLING TO A CREDIT CARD OR CHECKING ACCOUNT IS REQUIRED FOR ALL JR. PROGRAM AND JR. ACADEMY GROUPS. Jr. Academy Advanced Stars, JR/HS Tournament Training, Junior Team Tennis, Jr. Round Robin, Tournament Training Students. Please see the Jr. Academy Billing Policy for more detailed billing & policy information Classes are drop-in, but reservations must be made 24 hours in advance. Jr. Academy students may house charge these classes and accounts will be billed on the 1st of the following month. All sign-ups & communication for our Jr. Academy will be done by so please use an that you check on a regular basis. RESERVATIONS REQUIRE CLIENTS TO HAVE DIRECT MONTHLY BILLING TO A CREDIT CARD OR CHECKING ACCOUNT. THIS IS REQUIRED FOR ALL JR. PROGRAM AND JR. ACADEMY GROUPS. Missed Classes Due to our ratio standards (7 to 1) we have a strict NO MAKE-UPS policy. If students miss a scheduled class, we do not offer the option to take another class as a make-up. Holidays MTC will not have classes on Labor Day, Memorial Day, Fourth of July, Thanksgiving Day, Christmas Eve, Christmas Day, New Years Eve and New Years Day. Full class rates are due during this time. Make-Ups, Rainouts & Canceled Classes Credits for Rainouts or classes canceled by the Murrieta Tennis Club are for class credit only and must be used within 30 days; 48 hour pre-registration is required. It is the student/parents responsibility to call the club to verify rainout cancellations. We cancel classes one hour prior to class time if it is raining. Changing Classes Paperwork is required in order to change your child/children to a different class. Classes may be changed no more than once a month. Additional charges may apply. In the event Murrieta Tennis Club changes your child's class day or time you will be notified. If an instructor recommends that your student change classes or levels the parent or student must make the appropriate changes at the front desk. Instructors evaluate students and recommend that they change levels as they master the skills, but this is not a notice to change classes. Holds If you are planning a vacation or will be gone for an extended amount of time, please be sure to fill out appropriate forms PRIOR to the month in which you d like any change to take effect. Any changes made ON OR AFTER THE 1ST OF THE MONTH WILL NOT TAKE EFFECT UNTIL THE FOLLOWING MONTH, please keep this in mind. Canceling your Jr. Program All cancellations for classes must be received in writing. Cancellations received on or after the 1st of the month will take effect the following month. Cancellation must be receive by the last day of the month to be effective the following month. NOT ATTENDING CLASSES AND/OR NON-PAYMENT AT THE CLUB AND/OR NONPAYMENT OF GROUP LESSONS ARE NOT METHODS OF CANCELING. Clubs Rules & Regulations All customers and their guests shall abide and fully comply with the Rules and Regulations of the Murrieta Tennis Club. Liability Waiver The undersigned agrees and understands that the student will attend classes at his/her own risk. Murrieta Tennis Club shall not be liable for any damages arising form personal injuries sustained during classes on or off premises of the Murrieta Tennis Club. I understand that I may contact the Murrieta Tennis club to request removal of any such photographs, video, written articles, and audio recording at anytime.

6 JR. ACADEMY BILLING JR. POLICY PROGRAM Jr. Academy Jr. Academy, Advanced Stars, JR/HS Tournament Training, Junior Team Tennis, Jr. Round Robin, Tournament Training Students. Classes are drop-in, but reservations must be made 24 hours in advance. Jr. Academy students may house charge these classes and accounts will be billed on the 1st of the following month. All sign-ups & communication for our Jr. Academy will be done by so please use an that you check on a regular basis. RESERVATIONS REQUIRE CLIENTS TO HAVE DIRECT MONTHLY BILLING TO A CREDIT CARD OR CHECKING ACCOUNT. THIS IS REQUIRED FOR ALL JR. PROGRAM AND JR. ACADEMY GROUPS. - ALL JR. ACADEMY STUDENTS MUST BE PRE-APPROVED FOR THEIR SPECIFIC GROUP PRIOR TO ATTENDING Advanced Stars Tuesdays & Thursdays 4:30-6 PM - $15 Member / $20 Non-Member per class - Intermediate, 7-14 yrs. old, Pros Approval Required - The Advanced Star has developed good strokes from all aspects of the court. They can rally from the baseline and are starting to play points. This class is designed to teach better placement and control. Singles and Doubles point play is developed. These players should be playing Jr. Team Tennis, Novice level tournaments & Satellite tournaments. Jr/Hs Tournament Training Fridays 5-6:30 PM $15 Member / $20 Non-Member per class Intermediate, yrs. old, Pros Approval Required - These players can demonstrate the ability to hit with power and control. Players are competing in High School tennis, Jr. Team Tennis and Satellite level USTA tournaments. This class emphasizes proper strokes, footwork, and point play that will help players achieve success in High School and USTA tournaments. This class is partial drills/partial live hitting. Players will learn how to construct winning points and prepare for high school league play. Tournament Training Monday & Wednesdays 4:30-6:30 PM - $20 Member / $25 Non-Member per class Advanced, yrs. old, Pros Approval Required This group is our highest level of Jr. Player. These players are the top players on their High School Teams. They play USTA Open and National level tournaments. This class is designed to work on the skills that will be needed to achieve a high USTA ranking and compete at the College Level. Most of our tournament players will go on to receive college tennis scholarships. This class is partial drills/partial live hitting. Players will learn how to construct winning points for tournament play at a high competitive level. Jr. Academy Weekly Sign-Ups To sign-up for any of our Jr. Academy groups on a weekly basis by using one of the following: Sign-Up Online from the Jr. Academy page on our website, Sign-Up or by using our Murrieta Tennis Club App (available in the itunes or android app store for download). Then you will just need to enter your login and from there you can sign up for any of our Jr. Academy Groups. Sign-Up by responding to the weekly you will receive. * When using the app or signing up online you have the choice of either purchasing at the time of sign-up or as unpaid. By choosing unpaid you will be billed for this group on the 1st of the following month. Jr. Academy Billing The Murrieta Tennis Club bills all clients on the 1st of the month via Direct Billing from a Credit Card or Checking account. The Murrieta Tennis Club reserves the right to change the amount of the group lessons, given thirty (30) days written notice.
