5 PAYMENT PLAN SECTION Payment in Full: 1. Online and Telephone Banking Online and telephone banking is available through most major banks. The insured simply adds Aviva Insurance Company of Canada as a bill payee on their bank s Internet site or on their bank s telephone banking system. Authorized payments will be uploaded into our billing system within two business days. 2, By Cheque or Money Order Payment in full, made payable to Aviva Insurance Company of Canada. 3. One Shot Credit Card Payment Payment, in full, using Visa or MasterCard. Payments by credit card can be initiated by clicking the credit card button from the New Business Summary screen or the Policy Inquiry Billing Screen in the Broker Portal. Guidelines and Eligibility for Credit Card Available to all personal lines product processed on the portal. The CVV number must be entered for each type of credit card transaction. Can be processed as part of new business, mid-term changes, renewals. If a new business was paid by credit card, the renewal will be issued as Direct Bill. The client may contact their broker to pay by credit card. Brokers are not able to process credit card payments for policy reinstatements. These are processed by the Aviva Billing Department. Installment Plans: 1. Post-dated Cheque Plan The insured s annual premium is divided into two, three, or four equal payments. The first payment is due on the policy effective date. Post-dated payments are due in 30, 60 and 90 day intervals. If a client chooses any of our post-dated cheque options, a $10.00 service charge must be added to their first payment and all cheques should be mailed together. 2. Multi-payment Online/telephone banking The insured s annual premium is divided into two, three, or four equal payments. The first payment is due on the policy effective date. Subsequent payments are due in 30, 60 and 90 day intervals. There is no charge for this convenient payment plan. 3. Pre-Authorized Chequing Plan (PAC) Premiums are automatically collected monthly from the client s bank account by means of electronic deduction and can be arranged through Canadian Banks, Trust Companies, Credit Unions, or any other financial organization where the client has chequing privileges. No down payment is required, and an installment finance charge of 3% will apply. NOTE: A $25.00 service charge will be levied against payments returned by the bank due to insufficient funds or payments not cleared. Ontario 1 Elite Insurance Company June 15, 2009

6 PAYMENT PLAN SECTION Eligibility for Installment Plans: All personal lines policies are eligible for enrolment into our installment plans, providing the following criteria is met: PAC applications must be accompanied by a sample VOID cheque and signed withdrawal authorization form. All PAC applications must be received within 30 days of the policy inception date. The annual premium must be a minimum of $ Guidelines for Installment Plans: Postdated payments are accepted for new business and renewal premiums; endorsements are due on the effective date. Postdated payments are due in 30 day intervals from the policy effective date. The client must notify us in writing, at least 14 business days prior to their withdrawal date, of any changes to their PAC information. A down payment can be accepted on a credit card, with the remaining premium being collected by pre-authorized chequing. Calculation of PAC Installment Amounts: Our billing system uses a catch-up feature for new business and renewal premiums. Catch-up, or aggregate billing, is a collection process used to bill all accumulated installments due. To calculate the insured s monthly payment, simply divide the annual insurance premium (including applicable taxes and finance charge) by 12. The first installment is due 30 days before the policy effective date. Therefore, the first payment may include premium for two or three months, depending on the date the PAC authorization is processed. Example: New Business (effective Jan 15 th -- entered Feb 1 st ) Policy premium (including taxes and finance charge) $ The first installment on Feb 15 th would be for $ (December, January and February payments) Subsequent installments (March 15 th to November 15 th ) would be $ Since the last installment is due two months prior to the expiry date of the policy and the first renewal payment is due 30 days prior to the inception date, the client will have continuous monthly deduction. Example: Renewal (effective Jan 15 th -- entered Nov 15 th ) Policy premium (including taxes and finance charge) $ equal installments of $ commencing Dec 15 th until Nov 15 th NOTE: For Quebec policies, the first installment is due on the policy effective date. 7 PAYMENT PLAN SECTION PAC Withdrawal Date: The client can select to have their insurance premium withdrawn on any date of the month. If the client does not choose a specific date we will use the policy effective day. There are three situations when an installment will be withdrawn on a date other than the monthly date chosen by the client: If the client s bill day falls on a weekend, or statutory holiday, the withdrawal will take place on the next banking day. If the new business or renewal installments are in arrears and the clients selected date of withdrawals is more than fourteen (14) days in the future (see Initial installment amount may have a different bill date for details). If the policy is not renewed, and all regular installments have been billed, a one time special billing will occur fourteen (14) days following the transaction entry date (see PAC Endorsements for details). A client can choose to change the date of billing at any time; if the date is in the future and within the current month, the change is immediate. If the date is in the past, we will deduct the next billing amount on the original scheduled withdrawal date and the following deduction will be billed on the new date. NOTE: In Quebec, the client s preferred day of billing must be after the effective day of the policy, due to legislation preventing advance billing. The Initial Installment amount may have a different bill date: Our system delays billing if a new business or renewal premium are entered too close to the client s preferred billing date. Our basic rule is to allow our client at least 14 days notice prior to billing a pre-authorized deduction. This does not mean we are willing to wait until the next month to bill our initial catch-up installment. If the difference between the entry date and the next bill day is less than 14 days, we add 14 days to either the entry date or the current month bill date, whichever is greater. This will result in an irregular billing date, the next installment will be billed on the selected bill date. Theoretically, there could be two PAC installments in the same month. Example (A): Effective date: December 28 th Entry date: January 28 th Preferred bill date: 20 th The difference between January 28 th (the entry date) and February 20 th (the next bill date) is more than 14 days; therefore, a delay in billing is not required and the first installment will be billed on February 20 th. Example (B): Effective date: March 16 th Entry date: February 17 th Preferred bill date: 1 st Current bill month February 1 st The difference between February 17 th (the entry date) and March 1 st (the next bill date) is less than 14 days; therefore, a delay in billing is required. Add 14 days to February 17 th (the greater of the entry date and the current bill month) and the first installment will be billed on March 3 rd, the second installment will be billed on April 1 st. 8 PAYMENT PLAN SECTION Example (C): Effective date: March 16 th Entry date: February 17 th Preferred bill date: 27 th Current bill month February 27 th The difference between February 17 th (the entry date) and February 27 th (the next bill date) is less than 14 days; therefore, a delay in billing is required. Add 14 days to February 27 th (the greater of the entry date and the current bill month) and the first installment will be billed on March 13 th, the second installment will be billed on March 27 th. PAC Endorsements: The catch-up feature is not used for endorsements. Our system will spread the premium equally over the remaining installments. If the difference between the entry date and the regular bill date is less than 14 days, and the endorsement is an additional premium, the system will delay one month prior to changing the installment amounts. Return premiums do not necessitate a delay; installment amounts will be reduced immediately. If an additional premium is processed after all regular installments have been billed, the full amount will be added to the first renewal deduction. If a renewal is not processed, the full amount of the additional endorsement will be deducted fourteen (14) days after the transaction entry date. If a return premium is processed after all installments have been billed, the first renewal installment(s) will be reduced. If a renewal is not processed, we will issue a refund cheque to the insured ten (10) days after the last transaction date. Change to Banking Information: In the event that a client changes their chequing account number, or transfers to a different financial institution, a new VOID cheque and authorization form must be completed and sent to our company at least 14 business days prior to the payment withdrawal date. The policyholder should be advised to keep sufficient funds in the old account to cover any scheduled withdrawals. Disbursements: Our billing system is designed to automatically issue disbursement cheques on policies in a credit position ten (10) days after the transaction entry date or effective date, whichever is greater. This delay allows the majority of payments and charges to clear the client s bank account prior to reimbursement. Registered letters of cancellation are mailed without enclosing the refund cheque. The registered letter wordings indicate any refunds will follow pending clearance of all payments and charges. Refunds are usually issued after the policy cancellation effective date. 9 PAYMENT PLAN SECTION Direct Bill Reminder Notices: If a client chooses one of our direct payment plans (by cheque, credit card or online/telephone banking) we allow a minimum of 30 days to secure payment. Each underwriting transaction generates a billing invoice. This premium change document is considered our first notice. Our next notice is a Final Reminder Notice. The reminder notice is issued 15 days after the first notice, or on the policy effective date, whichever is greater. If a partial payment is received, and the policy has equity, the client will receive a Reminder Notice. This notice is a non-threatening reminder of an outstanding premium owing for the policy. Final reminder notices are pink and equity reminder notices are white. If the client receives a pink notice, payment must be made within 15 days to avoid a registered letter of cancellation due to nonpayment. Registered Letter of Cancellation for Non-payment: Direct Payment (by Cheque, credit card or Online/Telephone Banking): If a client s payment is not received within 15 days following a final pink Reminder Notice, we will assume the client no longer wants our insurance protection and the system will automatically cancel the policy by registered letter for non-payment. Pre-Authorized Chequing (PAC) If the bank, due to some failure on the client s part, dishonors an installment, Aviva will be as lenient as possible in allowing the situation to be rectified. There are many reasons why the bank could return these withdrawals and we have special notices and cancellation criteria to cover each of them. If the initial installment of a new business is returned for insufficient funds (NSF) or funds not cleared, we will cancel the policy immediately. If an installment returned for insufficient funds or funds not cleared is a first occurrence within a 12- month period (other than the initial payment on a new business) we will re-bill the missed payment with the next monthly withdrawal. The client will receive written notification and a warning that a second occurrence will result in cancellation of their insurance coverage. If an installment is returned due to a problem with the client s bank account, i.e., account closed, account frozen, account transferred, cannot trace, incorrect payer name, etc. Our system will issue a notice to the client requesting new banking. If the new banking information is not processed within 15 days, the policy will be cancelled for non-payment. If a client places a payment stopped against an installment, we will assume they no longer want insurance and cancel the policy immediately for non-payment. 10 PAYMENT PLAN SECTION Reinstatement: If a policy has been cancelled for non-payment, reinstatement will be permitted under various circumstances. Please remember that these policies will only be reinstated if they are of sound underwriting quality. The following are only guidelines; the ultimate decision to reinstate resides with our underwriting department. It s OK to reinstate: 1. Payments crossed in the mail, providing: The policy cancellation date has not expired. Policy is paid in full 2. Policies cancelled for 2 NSF's, providing: The policy cancellation date has not expired. Policy is paid in full by certified cheque, credit card or money order. A senior underwriter approves reinstatement. 3. Policies with a prior cancellation (within 3 years), providing: The policy cancellation date has not expired. Policy is paid in full by certified cheque, credit card or money order. A senior underwriter approves reinstatement. 4. Policies cancelled due to invalid banking, providing: The policy cancellation date has not expired. Amount in arrears (certified) is collected and no evidence of prior payment problems. New banking is received. 5. Policies cancelled due to an error, providing: We have adequate proof that the broker, company or bank is fully responsible for the error. The policy cancellation date has not expired. 6. If the cancellation has expired but the money was received by the broker or the company prior to the expiry date, providing: The full outstanding balance is received (certified) We receive confirmation of no intervening losses. 7. Reinstate and Change to a different bill type, providing: The policy cancellation date has not expired. If a PAC application crossed in the mail, the amount in arrears (certified) must be paid If the PAC policy is paid in full (certified) the policy can be amended to direct bill Change to Broker Bill requires issuance of a new policy -- not recommended as an alternative collection tool. 8. Reinstatement of broker bill policy, providing: The policy cancellation date has not expired. Policy is paid in full. Ontario 6 Elite Insurance Company June 15, 2009

11 MANUFACTURED/MOBILE HOME GUIDELINES SECTION MANUFACTURED/MOBILE HOMES: The Elite Manufactured/Mobile Home policy has been developed to provide coverage for mobile or manufactured homes. A manufactured or mobile home is a building which has been fully constructed inside a factory. These homes are built on a steel frame chassis that forms part of the floor structure of the home. The steel frame has axles, wheels, and a hitch, that are removed after it has been delivered to the homeowner's site. These homes are complete when they leave the factory except for incidental assembly on site. Manufactured/Mobile homes are usually set on concrete piers or blocks. Once the home is occupied, it is not generally moved. CLAIMS REPORTING All Manufactured/Mobile Home claims are to be reported by the broker to Elite as soon as possible. 13 MANUFACTURED/MOBILE HOME GUIDELINES SECTION BROKER BINDING AUTHORITY Brokers are authorized to bind coverage on our behalf providing: The risk is acceptable according to the underwriting rules specified in this manual Premiums are quoted in accordance with the rating rules specified in this manual There is no amount owing on a policy previously issued by the company The Manufactured/Mobile Home is fifteen years of age or newer The replacement value of the mobile home does not exceed $150,000. ALL RISK Mobile Home Coverage Eligibility Owner Occupied Model year 1985 or newer Primary heat must be factory installed and not solid fuel Fully skirted Not had more than 1 loss in the past 3 years Must have policy limit to 100% of replacement cost of Manufactured/Mobile Home. $65 per square foot is a recommended minimum guideline Units 1984 and older do not qualify for All Risk or Replacement Cost coverage. PLEASE SUBMIT THE FOLLOWING FOR CONSIDERATION PRIOR TO BINDING Unbound application together with a current photograph of front and back must be submitted prior to binding and rating on: Manufactured/Mobile Homes over fifteen years of age on New Business Vacant or unoccupied Manufactured/Mobile Homes Manufactured/Mobile Homes with an actual cash value or replacement cost in excess of $150,000 on building Risks with more than two losses past three years Manufactured/Mobile Homes with wood stoves as primary heat Risks with business conducted on premises Manufactured/Mobile Homes with roomers or boarders Risks which to your knowledge have been cancelled, lapsed or declined by any insurer Manufactured/Mobile Home with oil tanks Manufactured/Mobile Homes with 60 amps or less without a letter from an electrician Risks with incidental farm use Ontario 1 Elite Insurance Company April 1 / May 1, 2006

14 MANUFACTURED/MOBILE HOME GUIDELINES SECTION BUSINESS NOT WRITTEN Risks with an oil tank over fifteen years of age. Risks with oil tanks fifteen years and older will not be renewed unless it has been replaced Any underground oil tanks Risks that are physically sub-standard or poorly maintained Risks situated on premises used for farming as primary occupation Risks with a known moral hazard Risks with homemade or unapproved wood stoves Any risk located within 50km of an area under restriction during forest fire alerts by any civil authority Any area where there is an impending flood MODULAR HOMES Use the same underwriting guidelines as you would for Manufactured/Mobile Homes APPLICATIONS In order for us to properly rate a policy it is vital that the application be fully completed and signed by the applicant. The Manufactured/Mobile Home Application Form can be found on the Elite website. POLICY TERM Twelve month policy terms only may be written. All rates quoted in this manual are for a twelve month term. MINIMUM PREMIUM The minimum premium for which a policy will be issued is $125. CANCELLATIONS By Insurer - When a policy is cancelled by the Insurer, the pro-rata unearned premium is refunded to the Insured. By Insured When a policy cancelled at the request of the Insured, the unearned premium is calculated from the appropriate short rate table. OIL TANKS Oil Tanks 15 years of age and older will not be accepted. A photo of the oil tank and a completed oil tank questionnaire are to be submitted with all New Business applications. 15 MANUFACTURED/MOBILE HOME GUIDELINES SECTION WOOD HEAT/STOVES (including Pellet stoves and Fireplace Inserts) All wood stoves must be CSA, ULC or Warnock-Hersey approved and professionally installed or wett inspected and approved with all recommendations completed to meet installation standards. Each wood stove requires a completed wood stove questionnaire with a recent photo or Wett Certificate. Additional premium surcharge* for auxiliary wood heat see applicable rate page. If three bush cords of wood or more are burned annually, the wood heat is considered the primary heat source, refer to company. A bush full cord of wood measures: 1.2 m x 1.2m x 2.4m (4 x 4 x 8 feet) Three face cords of wood equals one bush cord. *NOTE These surcharges are not subject to any premium credits and are in addition to minimum premiums. 53 RECREATIONAL TRAILERS GENERAL SECTION CANCELLATION If insurance is cancelled at the request of the Company, the earned premium will be calculated pro rata. If insurance is cancelled at the request of the Insured, the earned premium will be calculated short rate. New Business- No flat cancellation is permitted. Renewals - Flat cancellation is permitted if policy returned within 30 days of the renewal date. Risks cancelled by registered letter will not be reinstated. CLAIMS All claims made against the policy will be considered in the rating including Liability losses and losses categorized as Catastrophic. DEDUCTIBLES The standard deductible is $300. The following deductibles are available: $500 $1,000 $1,500 $2,500 $5,000 $10,000 DISAPPEARING DEDUCTIBLE The disappearing deductible reduces the deductible appearing on the Certificate of Property Insurance by 20% of the original deductible amount for each consecutive year the location is claims free. Eligibility: Premium: New business and renewals qualify if the policy holds a $300, $500 or $1000 deductible New Business risks must provide previous insurer(s) and policy number(s). included Once the risk is 5 years claim free, the deductible will be reduced by 100% to zero. 54 RECREATIONAL TRAILERS GENERAL SECTION LETTERS OF BROKERAGE (AUTHORIZATION) Mid-term letters of authorization are not acceptable. If an insured wishes to change brokers mid-term, the policy must be cancelled and a new policy issued. We will allow pro-rata cancellation in these cases. We accept LOAs on renewal. For both mid-term changes and LOAs at renewal, we require a fully completed and signed application. PERMANENTLY PARKED RECREATIONAL TRAILERS Permanently Parked Trailers are acceptable. If the recreational trailer is permanently parked and professionally skirted and located on permanent foundation, it may qualify for our Park Model program subject to underwriting eligibility. TERM The maximum term is one year. AWNING EXCLUSION Applies if the risk has had more than 2 awning claims of any kind within the preceding 5 years. This excludes a total loss. If insurance is cancelled at the request of the Insured, the earned premium will be calculated short rate. New Business- No flat cancellation is permitted. Renewals - Flat cancellation is permitted if policy returned within 30 days of the renewal date. Risks cancelled by registered letter will not be reinstated. CLAIMS All claims made against the policy will be considered in the rating including Liability losses and losses categorized as Catastrophic. DEDUCTIBLES The standard deductible is $300. The following deductibles are available: $500 $1,000 $1,500 $2,500 $5,000 $10,000 DISAPPEARING DEDUCTIBLE The disappearing deductible reduces the deductible appearing on the Certificate of Property Insurance by 20% of the original deductible amount for each consecutive year the location is claims free. Eligibility: New Business and Renewals qualify if the policy holds a $300, $500 or $1000 deductible New Business risks must provide previous insurer(s) and policy number(s). Once the risk is 5 years claim free, the deductible will be reduced by 100% to zero. After a loss occurs, the deductible returns to the original amount and subsequently reduces again by 20% for each full year of being claims free. LETTERS OF BROKERAGE (AUTHORIZATION) Mid-term letters of authorization are not acceptable. If an insured wishes to change brokers mid-term, the policy must be cancelled and a new policy issued. We will allow pro-rata cancellation in these cases. We accept LOAs on renewal. For both mid-term changes and LOAs at renewal, we require a fully completed and signed application. PERMANENTLY OCCUPIED PARK MODEL TRAILERS The Park Model Trailer must be used for Seasonal occupancy only. 95 MOTOR HOMES GENERAL RULES SECTION MOTOR HOME PLAN The Elite Motor Home policy has been developed to provide coverage for Motor Homes and their owners. This policy is for self-propelled motorized vehicles designed exclusively for travel and used for pleasure purposes only. Eligibility for this program is based upon the following: All drivers must be licensed at least 8 years in Canada. The Motor Home is used for pleasure purposes only. The Motor Home must be insured for full value including all taxes. A bill of sale is required where the insured is the original owner. The vehicle is equipped with both cooking facilities and a washroom. CLAIMS REPORTING All Motor Home claims are to be reported by the broker to Elite as soon as possible. 96 MOTOR HOMES GENERAL RULES SECTION DEFINITIONS AND EXPLANATIONS ACCIDENT An occurrence resulting in a claim under the Third Party Liability, Accident Benefits, Collision or the Collision portion of the All Perils Coverage arising out of the ownership, use or operation of an automobile in consequence of which is either an At-Fault accident or a Not-At-Fault accident, defined as follows; At-Fault Accident (a) An amount has been paid or would have been paid but for the existence of the Direct Compensation - Property Damage Section of the Ontario Insurance Act or the Quebec Direct Compensation Agreement or; (b) A loss remains unsettled or unpaid or; (c) A civil suit is pending or has been commenced against the insured person. (d) An occurrence where the Insured s degree of fault is determined to be 25% or less will be considered at fault for risk eligibility but will not be considered in the rating of the vehicle. Note: An accident as defined above is still considered At-Fault when determining the Driving Record even if there was no insurance in effect or the amount of the loss was repaid to the Insurer or the insured chose not to present the claim. Not-At-Fault-Accident (a) Damage to the automobile while it is legally parked provided the accident was reported to the police within 24 hours; (b) Damage resulting from the automobile being struck by an unidentified automobile provided the accident was reported to the police authorities within 24 hours; (c) Damage resulting from the negligence of an uninsured driver who is totally responsible for damage caused; (d) An occurrence in which the Insured s degree of fault is determined as 0% at fault. ACCIDENT FORGIVENESS Accident forgiveness does not apply to any vehicles under the Elite Motor Home Plan. Please see Endorsements for additional protection available. ACCIDENT RATING No accident will be used more than once in determining the additional charges in respect of vehicles insured by Elite whether or not on the same policy, however for a two (2) vehicle policy with one operator and one at fault loss the highest rated vehicle must be rated for the accident. 97 MOTOR HOMES GENERAL RULES SECTION DEFINITIONS AND EXPLANATIONS (Cont d) AGE The age on the birthday immediately prior to the policy period will be used for rating purposes, or, in the case of an additional or substitute driver, as at the effective date of the addition/substitution. APPLICATIONS In order for us to properly rate a Motor Home, the application must be fully completed and signed by the applicant. Incomplete applications will be returned. Motor vehicle driving abstracts and claims experience reports are requested on all drivers. It is important therefore to ensure that applicants answer all questions on the application relating to convictions and claims fully and honestly. BROKER BINDING AUTHORITY Our brokers have authority to bind coverage for the Company for Motor Homes risks in accordance with all the rules within this manual, subject to all of the following restrictions: The broker must not bind any risk that meets the criteria under RISKS TO BE REFERRED BEFORE BINDING or meets the criteria under REASONS FOR DECLINATION. The applicant or named insured must consent to access to personal information as provided by the approved application form A fully completed and signed application has been received by the broker, or the broker has an electronic or voice recording version of the application form in a format that meets standards set by the Company. Note: the Company reserves the right to require a written application if needed as part of an underwriting review. The risk is submitted to the Company in writing (or by any other means of communication accepted by the Company, including upload to the Broker Portal) within 5 business days. If the date coverage has been bound and the effective date of the application is the same date, the TIME coverage was actually bound must be clearly documented in the application and on the temporary liability card and in the policy notes in the Broker Portal. The effective date shown on the policy should be 12:01am of the day following the day the coverage was actually bound. Coverage must not be backdated. Risks must not be bound for a period of more than 30 days. Any misrepresentation or non-disclosure of information will void binder, application and/or policy. The broker must contact the Company if uncertain about risk eligibility or rating rules. BUSINESS USE The operation of a private passenger automobile for Commercial purposes shall be deemed Business, i.e. anyone who either is paid for the use of his vehicle, or profits from the use. COMMON-LAW RELATIONSHIP A man and woman or same sex partners who have co-habited continuously for a period of not less than three years are rated in the same manner as persons legally married and residing with spouse. COMPANY, PARTNERSHIP OR CORPORATION AUTOMOBILES Automobiles of partnerships, companies or corporations used solely for pleasure purposes are rated in the same manner as though the principal operator is the applicant. COMPLIANCE WITH RATING AND UNDERWRITING REGULATIONS All of our brokers and all of our employees are required to comply with all of the applicable laws and regulations of the Province of Ontario that govern rating rules, underwriting rules, processes and practices. All rules and rates are filed with and approved by the regulator and must be applied exactly as written in this manual. PROHIBITED FACTORS: When a person uses a prohibited factor in connection with any matter relating to quotations for automobile insurance, applications for automobile insurance or renewals of existing contracts of automobile insurance. Prohibited factors include any of the factors listed under Regulation 664 that cannot be used to refuse insurance or cannot be used for rating. See Regulation 664 details below. FAILURE TO OFFER LOWEST RATE OF AFFILIATED INSURERS: When a person fails to provide the lowest rate available from any affiliated automobile insurer available to the broker, in accordance with the declination rules. This requirement applies at the policy level which may include more than one vehicle or exposure. It will pay for legitimate claims against the Insured up to the limit of coverage, and will pay the costs of settling the claims. Accident Benefits Coverage Provides benefits if the Insured is injured in an automobile accident, regardless of who caused the accident. These benefits include: Supplementary medical care, rehabilitation and other care; A tax-free income benefit for wage earners or self-employed; An income benefit to those who have no income from employment; An educational benefit to those unable to attend school; An allowance when a caregiver is injured; and When a person dies in an accident, funeral expenses and death benefits. 101 MOTOR HOMES GENERAL RULES SECTION COVERAGE (Cont d) Optional Increased Accident Benefits Increased Income Replacement - the standard level of income replacement provided in the policy ($400 per week maximum) may be increased by purchasing optional coverage so that the weekly limit is up to $600, $800 or $1,000. All income replacement benefits are based on 70% of gross weekly income. Increased Medical, Rehabilitation and Attendant Care - the standard benefit pays up to $50,000 for non-catastrophic medical and rehabilitation expenses, with a 10 year time limit in most cases, and up to $36,000 for non-catastrophic attendant care expenses. If catastrophically impaired, the standard benefit pays up to $1,000,000 for medical and rehabilitation expenses and up to $1,000,000 for attendant care expenses. Optional coverage may be purchased for non-catastrophic medical and rehabilitation expenses up to $1,000,000 and non-catastrophic attendant care expenses up to $72,000. If catastrophically impaired, medical and rehabilitation coverage increases up to $1,000,000 and attendant care coverage increases up to $1,000,000. Additional optional coverage may be purchased for medical and rehabilitation up to $1,100,000 for noncatastrophic expenses and up to $1,072,000 for non-catastrophic attendant care. If catastrophically impaired, medical and rehabilitation coverage increases up to $2,000,000 and attendant care coverage increases up to $2,000,000. Medical & Rehabilitation benefit level for minor injuries is capped at $3,500. Increased Caregiver, Housekeeping and Home Maintenance Expenses optional caregiver, housekeeping and home maintenance expenses benefit ($250 per week for the first person and $50 per week for every additional person and $100 for housekeeping and maintenance) is available only for a personal who is catastrophically impaired. An additional optional benefit can be purchased to provide this coverage for all impairments. Dependant Care there is no standard dependant care benefit for persons who are employed and care for dependants. An optional benefit may be purchased to receive weekly dependant care expenses of $75 for the first dependant and $25 for each additional dependant up to $150 per week. Increased Death and Funeral - the standard level of death benefits paid to the surviving spouse and dependant of a person who is killed, ($25,000 to surviving spouse; $10,000 to surviving dependant;) can be doubled by purchasing optional coverage ($50,000 surviving spouse, $20,000 surviving dependant). This optional coverage also increases the basic funeral expense benefit from $6,000 to $8,000. Direct Compensation - Property Damage Covers Insured in Ontario for damage to Insured's automobile and to property it is carrying when another motorist is responsible. Loss or Damage Coverages (Optional) All Perils This option combines the coverages of Collision or Upset and Comprehensive see below. This coverage includes loss or damage caused if a person who lives in the Insured s household steals a described automobile. Coverage also applies if an employee who drives or uses, services or repairs a described automobile, steals it. Collision or Upset - Covers losses caused when a described automobile is involved in a collision with another object or tips over. Object includes: Another automobile that is attached to the automobile, The surface of the ground, and Any object in or on the ground. Comprehensive - Covers losses, other than those covered by Collision or Upset, including: DRIVER Perils listed under All Perils, Falling or flying objects, Missiles, and Vandalism. 104 MOTOR HOMES GENERAL RULES SECTION MULTIPLE DRIVERS AND VEHICLES Where there is more than one vehicle and driver in a household each driver should be assigned as a principal driver for rating purposes with any additional drivers assigned as secondary or occasional drivers as appropriate. OWNERSHIP CHANGE If a policy is cancelled because the insured has disposed of the described automobile, the policy coverage must be cancelled by the insured. Transfer of ownership is not permitted. A new application may be submitted for the new owner, subject to underwriting criteria. PERMISSION TO RENT OR LEASE Where vehicles insured are leased from a leasing company the policy will read in the name of the Lessee with the Lessor shown in the space provided on the certificate of insurance. An OPCF 5 Policy Change Form must be attached to the policy. Separate policies are required when not all vehicles insured are leased or more than one leasing company is involved. POLICY FORMS OAP 1 - Ontario Automobile Policy OPCF - Ontario Policy Change Forms as listed herein Ontario Policy Change Forms are used to change the coverage and/or conditions of an automobile policy after issue. To calculate mid-term changes, use original rates for substitutions and deletions; use current rates for additions. When adding coverage to an existing vehicle mid-term use rates in effect at the time the policy or current renewal was issued. The same underwriting guidelines as New Business are applicable. NOTE: In regard to age of a driver, period licensed, period of ownership, period since the date of an accident and period since the date of a traffic offence conviction, the rating is always based on the position as at the effective date of the policy period (or, in the case of a subsequent addition/substitution of a driver or addition of a vehicle, as at the addition/substitution date). Midterm re-rating is NOT permissible in respect of changes that occur in regard to those matters during the period of insurance merely because of the lapse of time. Explanations of commonly used Policy Change Forms and Methods of Rating can be found in this manual. POLICY TERM Twelve-month policy terms only may be written. PROOF OF FINANCIAL RESPONSIBILITY When a certificate is required as Proof of Financial Responsibility such filing shall not affect the rating of the policy under driving record. 105 MOTOR HOMES GENERAL RULES SECTION VALID OPERATOR'S LICENCE Means that the driver holds a valid driver s license to drive the type of vehicle insured. Valid operator s licenses are of two types, Rateable and Non-Rateable as defined below: Rateable 1. A Level One Class G1 license where the holder is the owner of the insured vehicle and there is no other operator in the household with a valid driver s license to be listed as principal operator. 2. A Level Two Class G2 license. 3. All other license types not listed as Non-Rateable. Non-Rateable 1. A learner s license or a Level One Class G1 license. 2. A license to operate a motorcycle. 3. An International license. Only Rateable License types will be considered valid for automobile insurance purposes. CANCELLATIONS By Insurer - When a policy is cancelled by the insurer, the pro-rata unearned premium is refunded to the insurer By Insured When a policy cancelled at the request of the insured, the unearned premium is calculated from the appropriate short rate table. FLAT CANCELLATIONS Flat cancellations will be allowed only if the renewal is returned to the Company within 30 days of the inception date of the renewal. Rating: No charge - the policy is rated based on manual rules and rates as they apply to the lessee. OPCF 13C - Restricting Glass Coverage For use with an OAP 1 policy to restrict the Comprehensive coverage purchased for loss of, or damage to, the glass of the automobile. Coverage under the "Comprehensive", section applies only for loss or damage to glass caused by: fire theft or attempted theft vandalism lightning windstorm hail rising water earthquake explosion riot or civil disturbance falling or forced landing of aircraft or parts of aircraft, or the stranding, sinking, burning, derailment or collision of any kind of transport in, or upon which, your automobile is being carried on land or water. This endorsement requires the Insured's signature. Rating: All Perils premium less 10%. OPCF 19 - Limitation of Amount For use with an OAP 1 policy. This endorsement is added to all policies with All Perils coverage. The standard policy insures up to the actual cash value of an automobile. This policy change form is used to limit coverage where the Insurer wishes to provide cover only up to a specific amount, as in the case of antique or special type automobiles. An appraisal or evaluation may be required, and the automobile is rated according to the amount stated in the policy change form. This change form does NOT provide a guaranteed amount to the Insured, but either the actual cash value at the time of loss or damage, or the amount stated in the policy change form, whichever is the lesser. It provides for joint payment to the Insured and the lienholder if the vehicle is not repaired or lost or damaged parts are not replaced in the event of a loss under Loss or Damage Coverages (Optional). It also provides for 15 days written notice to the lienholder in the event of cancellation of any subsection under Loss or Damage Coverages (Optional). Rating: No charge. OPCF 28A - Excluded Driver For use with an OAP 1 policy. This policy change form eliminates some coverages under the policy if the described automobile, a temporary substitute automobile, or a newly acquired automobile are driven by the driver named as the excluded driver. Coverages eliminated are: All coverages under Liability and Direct Compensation- Property Damage. Income replacement coverage under Accident Benefits (for the excluded driver). Uninsured Automobile Coverage. Damage to the described automobile under Loss or Damage Coverages (Optional) where the excluded driver is liable for the damage. NOTE: Rating: This change form should not be used without the prior approval of the Company. A signed copy must be obtained prior to deletion of coverage. Premium should be established on the basis of the driving record of listed drivers, removing any premium adjustment that would have been required due to the driving record of the Excluded Driver. This endorsement requires the signature of the insured and the excluded driver. OPCF 40 - Fire Deductible For use on an OAP 1 policy. This change form does not provide any excess coverage over the Basic Accident Benefits. OPCF 47 - Agreement Not To Rely on SABS Priority of Payments Rules This endorsement is available for persons who are entitled to receive optional statutory accident benefits under this policy but, by the priority of payment rules, are required to claim under another policy that does not provide them with the optional statutory accident benefits that have been purchased under this policy. This endorsement allows these persons to claim Statutory Accident Benefits (SABS) under this policy including the optional statutory accident benefits provided by this policy, provided they do not make a claim for SABS under another policy. A maximum zero deductible applies if there have been no losses assigned within the preceding 5 consecutive years. When a claim is assigned under All Perils, Collision, Comprehensive or Specified Perils, all deductibles will revert to the original deductible amount at the next renewal. (2) Accident Surcharges 2 Accidents in 36 months 20% Each Additional Accident 10% (3) Conviction Surcharges NOTES: For each insured vehicle, the conviction record of all persons who are regular or frequent drivers, are reviewed to establish which of the conviction records develops the highest surcharge percentage in accordance with the Schedule hereunder, and that record is used to calculate the additional charges. 1. 145 GENERAL RULES Number of Watercrafts to one Policy Only one watercraft may be listed per policy, with the exception of a tender, which may be added to the larger watercraft. Billing Method All new policies will be issued as Direct Bill (full payment or multi payment). If Agency Bill or Preauthorized Payment is required, it must be stated on the application (a pre-authorization form and void cheque is required for this option). Coverage Type All Risk and Liability only. Coverage forms available are Agreed Value/Replacement Cost and Actual Cash Value. Liability Limits The minimum liability limit is $1,000, and the maximum liability limit is $2,000, These limits are available for all watercraft types. Minimum Physical Damage Limit The minimum amount available for physical damage is $2, on PWCs and the balance of watercraft classes will be $5, If value is less than these amounts, only liability coverage will be offered. Supporting Business No supporting business is required for any marine policy. Change in Ownership A newly completed application must be submitted by the new registered owner(s). This must be submitted as new business. Watercrafts Purchased in the USA Any watercraft purchased in the USA is subject to the same guidelines as a watercraft purchased in Ontario. Lay-Up Period The Insured s watercraft must be laid up on land and duly winterized from November 30 th at noon to April 1st at noon inclusive. The Insured s watercraft must not be used or inhabited during this period of time. Extensions may be granted by underwriting and a surcharge may apply. Other Insurance This policy is always considered as excess insurance in the event that other insurance is in effect that applies to a loss or a claim or would have applied if this policy did not exist. Binding Authority - New Business and Renewals Broker binding authority is watercraft(s) valued up to $200,000. Over this amount please refer to underwriting. Renewals previously approved do not require further approval if conditions remain the same. Underwriting approvals will be completed within a 48-hour turn around time. Business Not Written More than one lien holder Watercrafts used for racing, speed tests, or competition, with the exception given to Sailboats. This includes, but is not limited to, shootouts, drag races with other boats, attempts to pass other watercraft in speed, or single watercraft high speed runs to determine the watercraft s maximum speed. The watercraft must be out of the water when photos are taken, clearly showing all sides including the underside of the hull Copy of watercraft license Copy of operator s card Operator(s) date of birth Copy of CPS or other training certificate, should a training discount be offered Serial number of watercraft Serial number of engine Year, make and serial number of trailer Year, make and serial number of dinghy Optional Policy Information Copy of trailer ownership Recent photos of the watercraft Serial numbers of portable equipment Serial numbers of electronic equipment Cancellation and Reinstatement Procedures If insurance is cancelled at the request of the Company, the earned premium will be calculated pro rata. If insurance is cancelled at the request of the Insured, the earned premium will be calculated short rate. New Business- No flat cancellation is permitted. Renewals - Flat cancellation is permitted if policy returned within 30 days of the renewal date. Policies which have been cancelled for non-payment by registered mail may be reinstated if full outstanding payment is received prior to the cancellation date. If payment is received after the cancellation date of the policy, a new application must be submitted. Premium is fully earned when a total loss has been paid. Endorsements Policy changes are required in writing with premium calculated on a pro-rata basis. Single Limit The Single Limit amount of Insurance is equal to the cumulative sum of the amount of insurance of the following items (if they are described on the declarations page): 1. Hull 2. 148 GENERAL RULES (Cont d) Personal Effects Defined as the wearing apparel, personal items and sports equipment of the Insured and their guests or volunteer crew while they are on board the insured watercraft. Coverage is always based on actual cash value Section E of the policy provides $5,000 in coverage for personal effects subject to a $500 deductible. For any additional increased limit, refer to underwriting. Coverage E is not available under Liability Only Policies. Navigation Equipment Means the devices, electronics and other equipment used to guide the insured watercraft. A $250 deductible applies and the amount of insurance for these items is included in Section A. Newly Acquired Watercraft Automatic coverage is provided for 15 days following the purchase of a replacement or additional watercraft only if the Insured provides full details of the acquisition within this time period and pays additional premium, if required. The amount insured during this period is the Amount of Insurance under Section A, up to the actual cost of the acquisition to the Insured. See the policy wordings for full details Operation of Other Watercraft Coverage under this section is offered provided that the Insured has the owner s permission and is using the non-owned watercraft for private pleasure purposes. Coverage applies only to the Insured on the policy. The limit of insurance is be the least of: 1. The actual cash value at the time of loss of the non-owned watercraft; 2. What it would cost to repair or replace the damaged property with another of like kind and quality 3. The limit of insurance specified under Section A of this policy. 149 Marine Surveys Must be carried out by qualified surveyors who inspect the interior, exterior and engine(s) of a watercraft in order to verify its condition and value Must be carried out while the watercraft is out of the water Are mandatory when the watercraft(s) reaches 20 years of age, and every 5 years thereafter Applicable to watercraft over 30ft in length and over $30,000 in current value. For watercraft under these limits, we will only require photos of all sides of the boat The above conditions are minimum requirements, however a marine survey can be requested by underwriting at any time. A list of marine surveyors can be found in the Products & Documents section of avivapartner.ca (applicable to Ontario only. All regions, contact local marinas or marine dealers for a reference.) In areas where a marine surveyor is difficult to locate (e.g.; Northern Ontario, the Western Provinces & Territories), we will accept a Condition and Valuation Report on the Insured Watercraft from a reputable local marina. We would recommend a marina that is a member of the Provincial Marina Operators Association. Winterization During the lay-up period from November 30 th to April 1 st inclusive, the Insured s watercraft must be professionally winterized by the marina in which the watercraft is stored. Winterization completed by the insured will also be acceptable if receipts are kept, and the Insured has adequate knowledge and training per the watercraft manufacturer s requirements for the winterization process. Any additional living expenses incurred while your watercraft is being replaced or repaired. Emergency Towing We will cover costs incurred by the Insured should the watercraft become disabled for any reason. Available for all watercraft classes except Personal Watercraft (i.e. Seadoo). We will pay the reasonable cost, up to $1,000 (no deductible applies) for: 1. Towing to the nearest repair facility; 2. Cost of delivery of fuel or repair parts to the site of disablement, including the cost of fuel; or 3. Cost of emergency labour performed at the site of disablement. Theft Deductible Endorsement Applicable to Personal Watercrafts (i.e. Seadoo s), Jet Boats, Sport Boats or as required by underwriting.
