I wanted to clarify that the original Businessowners Garage Keepers Form, BPM 3111, was previously filed and approved with a corresponding rating rule back in January However; with the current filing, we are proposing to replace BPM 3111 with a company/state specific version: BPM 3111-MA. As a result, an exception rule will need to be filed which corresponds to BPM 3111-MA. The rating rule, which will be submitted in a separate companion filing, will be filed with the same proposed effective date as the form: 10/1/2012. As such, the rating methodology for the Garage Keepers Coverage Form has been established, filed and approved via the January 2009 filing. The exception rule we are submitting now, will simply state our intent to replace BPM 3111 with BPM 3111-MA. The content of the rule remains the same. Thank you for your advisement on how to best handle the corresponding rule filing. We will provide the additional details concerning the submission of the companion rule with our objection response. Thank you for your time and attention to this matter. Sincerely, Hollie Carter carterh@msagroup.com PDF Pipeline for SERFF Tracking Number NGMC Generated 07/31/ :28 AM

I called you a few minutes ago, but got your voice mailbox, which seems to be full, so I'm sending you this Note. Your message indicated that the rating rule, which the first objection in my June 22 Letter regards, needs to be developed and submitted. However, this is a filing for a revision to a form that was originally placed on file in January I am not sure I understand how the form would have been placed on file originally without its rating rule, nor how the Filing Company would have been issuing a premium-bearing form without the rule that determines the premium. Nevertheless, if the rating is something that needs to be developed and submitted, it will need to be submitted in a separate Rate/Rule filing as the Filing Type for this filing (Form) cannot be changed. Please note that full Rate filing requirements would apply to the companion filing. Please respond to the objection addressing both points in the paragraph above: why the rating rule doe snot currently exist, and when the companion filing will be submitted. Please note as well that this filing's review will be suspended until the rating rule is submitted, so it may be reviewed with the form. Thank you. Daniel J. To $1,000] Deductible For Each Customer's Auto. $ Total Premium For All Locations $ Information required to complete this Schedule, if not shown above, will be shown in the Declarations. COVERAGE OPTIONS Indicated below with an "X" which, if any, Coverage Option is selected. LEGAL LIABILITY If this box is checked, coverage applies on the basis of the insured s legal liability. DIRECT PRIMARY If this box is checked, coverage applies without regard to your or any other "insured's" legal liability for "loss" to a "customer's auto" and is primary insurance. A. This endorsement provides only those coverages: 1. Where a Limit of Insurance and a premium are shown for that coverage in the Schedule; and 2. For the location shown in the Schedule. B. Coverage 1. We will pay all sums the "insured" legally must pay as damages for "loss" to a "customer's auto" or "customer's auto" equipment left in the "insured's" care while the "insured" is attending, servicing, repairing, parking or storing it in your "garage operations" under: a. Comprehensive Coverage From any cause except: (1) The "customer's auto's" collision with another object; or (2) The "customer's auto's" overturn. b. Collision Coverage Caused by: (1) The "customer's auto's" collision with another object; or (2) The "customer's auto's" overturn. 2. We will have the right and duty to defend any "insured" against a "suit" asking for these damages. However, we have no duty to defend any "insured" against a "suit" seeking damages for "loss" to which this insurance does not apply. We may investigate and settle any claim or "suit" as we consider appropriate. Our duty to defend or settle ends for a coverage when the Limit of Insurance for that coverage has been exhausted by payment of judgments or settlements. C. Exclusions 1. This insurance does not apply to any of the following: a. Contractual Obligations Liability resulting from any contract or agreement by which the "insured" accepts responsibility for "loss". But this exclusion does not apply to liability for "loss" that the "insured" would have in the absence of the contract or agreement. Page 2 of 3 BPM 3111MA 0612

15 b. Theft "Loss" due to theft or conversion caused in any way by you, your "employees" or by your shareholders. c. Defective Parts Defective parts or materials. d. Faulty Work Faulty "work you performed". 2. We will not pay for "loss" to any of the following: a. Tapes, records, discs and other sound reproducing devices designed for use with sound reproducing equipment. b. Any device designed or used to detect speed measurement equipment such as radar or laser detectors and any jamming apparatus intended to elude or disrupt speed measurement equipment. 3. We will not pay for "loss" caused by or resulting from the following. Such "loss" is excluded regardless of any other cause or event that contributes concurrently or in any sequence to the "loss": a. War, including undeclared or civil war; b. Warlike action by a military force, including action in hindering or defending against an actual or expected attack, by any government, sovereign or other authority using military personnel or other agents; or c. Insurrection, rebellion, revolution, usurped power, or action taken by governmental authority in hindering or defending against any of these. D. Limits Of Insurance And Deductibles 1. Regardless of the number of "customer's autos", "insureds", premiums paid, claims made or "suits" brought, the most we will pay for each "loss" at each location is the Limit of Insurance shown in the Schedule for that location minus the applicable deductibles for "loss" caused by: a. Collision; or b. Comprehensive 2. The maximum deductible stated in the Schedule for Comprehensive Coverage is the most that will be deducted for all "loss" in any one event. 3. Sometimes to settle a claim or "suit", we may pay all or any part of the deductible. If this happens you must reimburse us for the deductible or that portion of the deductible that we paid. E. Conditions The following Conditions apply to Physical Damage Coverage. Actual Cash Value Whenever the appraised cost of repair of an auto plus the probable salvage value of the auto may be reasonably expected to exceed the actual case value of the auto, we shall determine the auto s actual cash value. Our determination shall be based on a consideration of all of the following factors: 1.) The retail book value for an auto of like kind and quality, but for the damage incurred; 2.) The price paid for the auto plus the value of prior improvements to the auto at the time of the accident, less appropriate depreciation; 3.) The decrease in value of the auto resulting from prior unrelated damage which is detected by the appraiser; and 4.) The actual cost of purchase of an available auto of like kind and quality but for the damage sustained. F. Additional Definitions As used in this endorsement: 1. "Customer's auto" means a customer's land motor vehicle or trailer or semitrailer. This definition also includes any customer's auto while left with you for service, repair, storage or safekeeping. Customers include your "employees", and members of their households who pay for services performed. 2. "Loss" means direct and accidental loss or damage and includes any resulting loss of use. 3. "Garage operations" means the ownership, maintenance or use of locations for the purpose of a business of selling, servicing, repairing, parking or storing "customer's autos" and that portion of the roads or other accesses that adjoin these locations. "Garage operations" also includes all operations necessary or incidental to the performance of garage operations. 4. "Work you performed" includes: a. Work that someone performed on your behalf; and b. The providing of or failure to provide warnings or instructions. BPM 3111MA 0612 Page 3 of 3

Page 2 of 3 BPM 3111MA

22 b. The maximum deductible stated in the Schedule for Comprehensive or Coverage is the most that will be deducted for all "loss" in any one event. E,F. BPM 3111MA Page 3 of 3
