1 PROM CONTRACT AGREENMENT All City CAR & LIMOUSINES, LLC. Has adopted a set of guidelines to ensure the safety of all concerned. All City has always had successful proms and our intention is to keep it that way. Please read over the guidelines carefully. Fill in information needed and return with signed contract and deposit (if required). Customer/student agrees that any of his/her activities or behavior deemed by the chauffeur to be illegal (intoxication, alcohol, drugs etc.) or perilous will result in immediate termination of the job with no refund. All chauffeur requests must be followed. Any significant arguments or fighting amongst or between the students or any students/persons or chauffeur will be dealt with by contacting the police. No body part is allowed outside the vehicle when the vehicle is moving. If the chauffeur deems it necessary for safety, the sun/moon roof or windows will be locked closed. This rule is strictly enforced. If the chauffeur deems it necessary for safety, the privacy divider will be locked open. General itinerary needs to be presented to All City prior to reservation commencement. The adult/student purchasing the contract or the contact parent must approve any significant changes in itinerary after departure. The chauffeur will call the contact parent or purchaser if passengers request a significant change in itinerary. Additionally, all changes in stops or itinerary are not guaranteed and are subject to All City s approval. Significant changes will be denied

2 without parent and chauffeur approval. Significant changes are changes in the agreed upon itinerary or whatever changes the written contract for 30 minutes or longer over the scheduled drop-off time. The purchasing adult or contact person may, if desired, give prior approval, in writing, to the chauffeur, explaining which changes may or may not be made during the length of the contract. The chauffeur is always the final authority; the final decision in all matters rests solely with All City and the chauffeur. In exchange, All City and the chauffeur agree to be respectful of each student and their needs and to maintain the safety of the group. We agree not to double book, triple book or switch our vehicle. We agree to be dedicated to your group and your group alone during the entire contracted reservation period ensuring your event is a success. The chauffeur will provide his/her vehicle cell phone number to the contract purchaser or contact parent. A contact parent s name along with phone number MUST be provided to the chauffeur. Contact parent needs to be available by phone for the length of the contract. This form needs to be signed by purchasing adult, contact parent and initialed by each student and be returned along with reservation contract and deposit. Termination of this contract will occur in the event of ANY serious safety violation, breach of contract or defiance of the rules which involves the safety of the students or chauffeur. This form needs to be signed by purchasing adult, contact parent and each student and returned along with reservation contract and deposit. A contact parent s name along with their phone number MUST be provided to the chauffeur. Contact parent needs to

3 be available by phone for the length of the contract. In the event of a serious safety violation or breach of contract which involves the safety of the students or chauffeur, the chauffeur HAS THE OPTION of contacting the contact parent before any termination of a reservation. Contact parent may need to provide transportation for the students. STUDENT AND CREDIT CARD HOLDER ACCEPTS FULL RESPONSIBILITY FOR CUSTOMER CAUSED VEHICLE DAMAGE OR SPECIAL CLEANING, AND AUTHORIZES COMPANY TO CHARGE FOR THE EXPENSES REGARDLESS AND IN ADDITION TO ANY PRIOR UNDERSTANDING AND AGREEMENTS. 2. ALL CITY IS NOT RESPONSIBLE FOR LOST OR STOLEN PERSONAL ITEMS LEFT IN THE VEHICLE EITHER DURING OR AFTER THE RENTAL PERIOD. 3. DUE TO THE NATURE OF THE 9-16 PASSENGER LIMO BUS, AND THAT IT IS A BUS, DESIGNED TO ALLOW STANDING, ALL PASSENGERS ARE AWARE

4 AND DECLARE THAT THEY HAVE BEEN INSTRUCTED BY ALL CITY TO REMAIN SEATED AT ANY TIME THE VEHICLE IS IN MOTION. 4. ALL PASSENGER S MUST INITIAL THIS DOCUMENT THAT ALL CITY HAS INSTRUCTED THEM THAT DUE TO THE NATURE OF THE 9-16 PASSENGER LIMO BUS, AND THAT IT IS A BUS, THAT ALLOWS STANDING, THAT EACH PASSENGER RIDES AT THEIR OWN RISK. ALL CITY WILL NOT BE RESPONSIBLE FOR ANY PASSENGER THAT INJURES HIS OR HERSELF IN ANY WAY WHILE ABOARD THE VEHICLE OR DURING THE RENTAL PERIOD. ALL CITY WILL NOT BE RESPONSIBLE FOR INJURIES SUSTAINED TO ANY PASSENGER, INFLICTED BY ANOTHER PASSENGER EITHER ACCIDENTALLY OR PURPOSEFULLY. 5. BY INITIALING BELOW, I RELEASE AND FOREVER DISCHARGE ALL CITY LIMOS, AFFILIATES AND ADMINISTRATORS AND ASSIGNS FROM ALL MANNER OF ACTIONS, CAUSES OF ACTIONS, DEBTS, ACCOUNTS, BONDS, CONTRACTS, CLAIMS AND DEMANDS FOR OR BY REASON OF ANY DAMAGE, LOSS OR INJURY TO PERSON AND PROPERTY WHICH HAS BEEN OR MAY BE SUSTAINED AS A CONSEQUENCE OF THE FOLLOWING: 6. THE CLAIM OR DISPUTE AROSE AS A RESULT OF DAMAGES OR INJURIES CAUSED AS A RESULT OF DRUGS AND/ OR ALCOHOL CONSUMPTION IN ALL CITY CAR AND LIMOUSINES, LLC AND AFFILIATES VEHICLES. 7. THE CLAIM OR DISPUTE AROSE AS A RESULT OF INJURIES OR ILLNESS CAUSED AS A RESULT OF THE USE OF ALL CITY LIMOUSINES AND AFFILIATES VEHICLES. IN THE EVENT THAT ANY PART OF THIS CONTRACT IS DECLARED UNENFORCEABLE, THE REMAINING PROVISIONS SHALL REMAIN IN FULL FORCE AND EFFECT. DAMAGES TO THE FOLLOWING WILL BE PAID FOR IMMEDIATELY BY CHARGING THE FOLLOWING AMOUNTS TO THE CUSTOMER S RENTAL AGREEMENT: SICKNESS IN VEHICLE $ EACH BROKEN GLASSWARE, MISSING $5.00 EACH READERS GUM, MAJOR SPILLS, SMOKING IN VEHICLE $ EACH DAMAGED CD/ DVD PLAYER/ TV $ EACH BROKEN WINDOW UP TO TEAR, CUT OR BURN TO COUCH $ EACH $ EACH MISSING CD, DVD, CORKSCREW $30.00 EACH ANYTHING ELSE WILL BE ESTIMATED BY A PROFESSIONAL PERSON I INITIAL BELOW WITH FULL AGREEMENT AND UNDERSTANDING OF THE TERMS AND CONDITIONS HEREIN AS WELL AS THE PARENT/STUDENT PROM PROMISE ABOVE.
