3 Clear Listening LLP (Clear) Johansen IAS Provider Training Terms and Conditions: Cancellation Policy Places will only be confirmed once the full course fee has been received. Notification of cancellation must be received in writing. Cancellation prior to 28 days prior to the beginning of the course 100% of course fee, less 25 administration fee will be refunded. Cancellation between 14 and 28 days prior to the beginning of the course 50% of the course fee less 25 administration fee will be refunded. Cancellation less than 14 days prior to the beginning of the course no refund. In the event of illness or accident affecting either Camilla Leslie or Diana Crewdson or their immediate families, Clear reserves the right to decide on one of the following courses of action: 1) Cancel the course and reimburse the course fee. 2) Cancel the course and offer a place on a future course at no extra charge. 3) Present the course with one Speaker only. In the event of cancellation of the course for any reason Clear will not be held responsible for travel or accommodation costs already incurred by course applicants. The Provider is welcome to use them for presentations, marketing purposes or when implementing any Johansen IAS programme but full accreditation must be given to Clear. 4 Agreement REGISTRATION To register with CML to enable CML to supply Johansen Individualised Auditory Stimulation Music to The Provider completion of this agreement is required. THE MUSIC Johansen Individual Auditory Stimulation ( Johansen IAS) uses music created by Rotna Music (The Music). The Music is fundamental to Johansen IAS and no other music is used and if other music is used it is not a Johansen IAS programme and cannot be described as such. The Music will be customised to a specific client s needs (either by the choice of The Music or by customisation of The Music) and each client, or in the case of a Johansen Alpha programme each school, will be provided with a recording or recordings of The Music (Recording) which can only be used for that client or school. The Recording may be provided on a CD or by other means but in any case is not transferrable and must only be used with the client or school it has been designed for. The Recording must not be copied. The Recording may be provided by any Johansen IAS National Director or Supervisor. In the UK CML is the National Director and makes the majority of Recordings. The Music is copyright and CML will pay the royalties to Rotna Music. THE CLINICAL DECISIONS The Provider is the only person who will have direct contact with the client and it is up to The Provider to obtain all the relevant information and decide whether or not Johansen IAS is appropriate and if so the type of Recording they require. This will often be based on an Audiogram but other clinical information will be relevant as well. In order to maintain the standard of the Johansen IAS programme when ordering Recordings from CML it is requested that this information is given to CML who may discuss the choice of Recording or the clinical decision with The Provider. CML and Clear Listening LLP (Clear) during courses run by them will also generally be happy to discuss cases with The Provider and suggest possible Recordings or other actions but as neither CML nor Clear has assessed the client the final decision of choice of Recording and customisation required or other course of action will remain with The Provider. At all times The Provider will remain solely responsible for all clinical decisions made in respect of their clients. The Provider is also solely responsible for the supervision of the Johansen IAS programme with their clients and making sure that their client is using the programme properly and in a safe and appropriate manner and that any problems are resolved. INDEMNITY FOR LOSSES AND INSURANCE The Provider is an independent practitioner and is not under the supervision of CML. The Provider confirms by signing this Registration Agreement that they have adequate Professional Indemnity Insurance and undertake to keep this cover in place. So far as the law allows The Provider will indemnify Clear and CML for claims and all losses including any indirect, special or consequential loss of The Provider or their client and for any such claims of whatsoever nature made by any such clients or any other person advised by The Provider. TRAINING Training of Johansen IAS is regulated by Johansen IAS international standards and CML in the UK and only authorised individuals are allowed to train others in Johansen IAS and Johansen Alpha. The Johansen IAS Provider Training Course is only intended to train The Provider to implement Johansen IAS programmes for individuals and Johansen Alpha in schools and you may not train anyone else as a provider of Johansen IAS or Johansen Alpha programmes. UPDATES It is The Provider s responsibility to keep up to date on developments in the Johansen IAS programmes. There is an international protocol that The Provider is required to attend an update at least every 3 years.

5 MATERIALS All course materials provided by Clear are the Copyright of Clear. The Provider is welcome to use them for presentations, marketing purposes or when implementing any Johansen IAS programme but full accreditation must be given to Clear. DATA PROTECTION In accordance with the Data Protection Act 1998 CML and Clear will use personal information collected from The Provider for the purposes of 1) Support, billing and other similar activities 2) Keeping The Provider informed about products, services, offers and upcoming events. In order for CML to provide The Music The Provider will also provide personal information on their client. CML may retain this information and The Provider must obtain their client s explicit consent in writing to give the information to CML and advise that it may be retained by CML as long as CML requires to do so. TERMINATION OF SUPPLY OF RECORDINGS CML reserves the right at her own absolute discretion not to supply Recordings to The Provider at any time. Recordings may be supplied by other authorised National Directors or Supervisors. LAW OF SCOTLAND In the event of any dispute arising, the Law of Scotland will apply to this Agreement and any such dispute, including non contractual disputes of claims, will be heard in the Scottish Courts.
