2 GENERAL INFORMATION BROKER BINDING AUTHORITY Brokers are authorized to bind risks which meet the eligibility requirements contained in this manual. If a Broker wishes to bind outside of the prescribed underwriting rules and guidelines, the Broker must secure the approval of the Company prior to binding. The following must be referred to the Company for approval prior to binding: Vehicles with a value in excess of $100,000 Applicants claiming driving experience outside of North America Any risk where the Insured is requesting to apply an OPCF 28A (Excluded Driver Endorsement) Applications where the applicant/operator requires a Financial Responsibility Certificate Vehicle(s) imported to/purchased outside of Canada A risk containing 2 or more claims of the same kind or a combination of 3 or more claims in the preceding 6 years Applicants with 2 or more AB claims in the preceding 3 years Applicants requesting Collector Car program coverage on vehicles with a value in excess of $25,000 US Exposure Vehicles 15 years of age and older Leased vehicles 5 years of age and older A risk with 1 or more Cancellations for Non-Payment in the preceding 3 years APPLICATION / SUBMISSION Brokers are authorized to bind the Company for 30 days. No extensions of a binder beyond 30 days will be permitted without the approval of the Company. The binder may not be amended to indicate a longer period. Backdating of coverage is not permitted. All risks submitted must have complete and appropriate risk information on file as well as a completed and signed application from the Insured. Submission should be entered on our system within 5 business days of enactment. A fully completed and signed OAF 1 may be required at renewal to obtain risk information necessary to confirm continued eligibility and rating. A copy of the vehicle ownership (Plate & Permit portion) may be requested in order to validate the registered owner, use and risk exposure. Renewals: October 1,

3 GENERAL INFORMATION When a vehicle is registered in two names, or two vehicles exist which are registered under separate names such as in the case of applicant & spouse, the application must be signed by both parties and one policy is adequate. Under the remarks field a note must indicate which vehicle is owned by which spouse. If other than applicant and spouse, one vehicle is registered to one person and the other vehicle to another, two separate applications must be completed. A copy of the Bill of Sale or Lease Agreement must be obtained and retained by the Broker in their office when a request is being made for an OPCF 43 or 43A to be applied to a vehicle. POLICY PERIOD New Business policies are written for a term of 6 months or 12 months. Existing business may be written on a variable policy term not exceeding 12 months. The premiums quoted in this manual are for a term of 365 days unless otherwise specified. PREMIUMS All premium calculations for each coverage shall be rounded to the nearest dollar. A premium of 50 cents is rounded to the next highest dollar. CANCELLATION Cancellation by the policyholder will be on a short rate basis. The request for cancellation must be made in writing, either by signing the policy on the back or by signing a Lost Policy Voucher (LPV). Where a policy has been issued under two names a signature must be obtained from both Named Insureds. Cancellation initiated by the Insurance Company will be on a pro-rata basis as prescribed under OAP 1. Flat cancellation of New Business is not permitted. Flat cancellation of Renewal shall only be allowed if the signed off Renewal is returned to the Company within 30 days of Renewal date, provided there have been no claims. Note: Flat cancellation means that any premium paid for the term will be refunded in full from the effective date of the Renewal, provided there are no claims during the policy term. LETTERS OF AUTHORIZATION From time to time, Insureds will want to change Brokers while retaining coverage with Unica. A completed Letter of Authorization should be addressed directly to Unica. The Letter of Authorization must include: The Insured s name Address Policy number(s) The name of the new Broker to which the policy is being transferred The name of the current Broker Renewals: October 1,

4 GENERAL INFORMATION The effective date the policy is to be transferred to the new Broker The Letter of Authorization must be dated and signed by all the Named Insureds on the policy A Letter of Authorization to change a Broker will be accepted upon Renewal. We may request that new Autoplus and Motor Vehicle reports and a new automobile application be completed. Renewal rules and rating will apply. As an accommodation, if the Insured wishes to change their Broker mid-term, we will require a Letter of Authorization to process a pro-rata cancellation of the existing policy and set up a new policy. Rates and rules will follow those in effect on the prior policy until such time as the new policy renews. On the subsequent renewal, renewal rates and rules will apply and Unica will request a new fully completed and signed application, together with new Autoplus and Motor Vehicle reports. CHANGE OF OWNERSHIP OR NAME When the ownership of an automobile is changed, a new policy must be issued. In addition, a fully completed and signed application is required. It will not be necessary to issue a new policy or obtain a new application, if the transfer is being made: Between a husband and wife residing together Because of a legal change of name To correct a spelling error If a leased vehicle is bought by the lessee PRIVATE PASSENGER AUTOMOBILE A private passenger automobile is defined as: An owned or leased motor vehicle of the private passenger automobile, station wagon, utility vehicle or mini van/compact van type used for pleasure or business purposes; or An owned or leased motor vehicle that is not classed as a commercial vehicle pursuant to the Automobile Statistical Plan; or An owned or leased motor vehicle of the van, pickup or other commercial vehicle type with a gross vehicle weight not in excess of 4,500 kg used for pleasure purposes only. The above is subject to the following exclusions for Personal Lines: An owned or leased motor vehicle of any type that is: - Part of a fleet, synthetic fleet or group plan. Vehicles meeting this description can be referred to Unica s Commercial Lines Department, unless the vehicle is individually rated in accordance with rates contained herein and coded as a private passenger nonfleet automobile under the Automobile Statistical Plan; - Used as an ambulance, invalid car, funeral vehicle, taxi, limousine, rental vehicle, driver training vehicle, for police work, commercial delivery, for demonstrating or testing or where held for sale by an automobile dealer; - Used for delivery or transportation of: goods, materials and/or non-owned tools or equipment of any nature, to any location; owned tools anywhere other than one permanent place of employment; - Designed and used for the purpose of transporting more than 10 persons; - Used as a business vehicle and operated by an employee of the business. 5 GENERAL INFORMATION VALID OPERATOR S LICENCE A valid licence means one which is not suspended and is valid to drive the type of automobile insured; e.g., a G1, G2 or G class licence. An International licence is not considered to be a valid operator s licence in Canada, unless the operator is a temporary resident, e.g., embassy staff, exchange student or a tourist. New Ontario residents, in accordance with the Ministry of Transportation guidelines, must transfer their current operator s licence to an Ontario driver s licence within 60 days, otherwise they will be considered to be unlicensed. GRADUATED LICENSING All new operators applying for their first private passenger vehicle licence enter Ontario s Graduated Licensing System. The two-step licensing process takes 20 months to complete, unless the operator was previously licensed in a jurisdiction that has a reciprocal agreement with Ontario and the operator may get a G class licence subject to certain requirements. The first step being Class G1 includes the following terms: The new operator must be at least 16 years old Cannot operate a vehicle without being accompanied by a fully licensed driver (G class), who has been fully licensed in Canada / USA for 4 years A new driver must hold a G1 licence for at least 12 months before they can attempt the G1 road test. If the new driver has successfully completed an approved driver education course the time can be reduced to eight months The second step being Class G2 includes the following terms: The new driver may drive without an accompanying driver on all Ontario roads anytime A new driver must hold a G2 licence for a minimum of 12 months before they can attempt the G2 road test. If successful they will be promoted to a G class licence and are considered to be fully licensed At a G2 level the driver has more privileges and fewer restrictions due to their Years Licensed. Once a G1 driver has graduated to a G2 class he/she must be listed under the insurance policy and will be rated according to the terms under this manual. RISK The term risk is used in relation to the ownership, use or operation of a single vehicle. It may include multiple coverages and/or operators in relation to that one vehicle. If the policy insures more than one vehicle, each vehicle is considered a separate risk. In the case of an Occasional operator, the principal exposure and the underage exposure constitute a single risk. RATING TERRITORY The rating territory applicable should be that in which the automobile is and will be chiefly used and usually kept. Renewals: October 1,

6 GENERAL INFORMATION INSPECTION OF AUTOMOBILE Under the policy Statutory Conditions Inspection of Automobile, it gives the insurer the right to inspect the automobile and its equipment at all reasonable times. HIGHEST RATED AUTOMOBILE The highest rated automobile is the one, which develops the highest premium before any discounts are applied. Premiums for Specified Perils, Comprehensive (including Comprehensive portion of the All Perils premium) and OPCFs should not be considered as part of this calculation. LIST PRICE NEW List Price New means the retail (selling) purchase price new, including taxes and equipment permanently attached thereto. PRINCIPAL OPERATOR The Principal operator is the person who normally drives the automobile the most. If there are two or more automobiles in the household and the number of operators, including occasional operators, equals or exceeds the number of automobiles, each operator must be assigned as a Principal operator of each vehicle. The same operator cannot be a Principal operator of more than one vehicle when he or she is not the only operator in the household/policy. Another operator must be assigned as a Principal operator of the other automobile(s). E.g., A risk with four vehicles and four operators, mom, dad and two children; each operator would be assigned to each automobile as a Principal operator. If there were only three vehicles then one of the operators would be assigned as an Occasional or Secondary operator. SPOUSE Defined as either of two persons: Who are married to each other; Have together entered into a marriage that is voidable or void, in good faith on the part of the person making a claim under this policy; or Have lived together in a conjugal relationship outside marriage continuously for a period of not less than three years; or in a relationship of some permanence, if they are the natural or adopted parents of a child. INSURANCE FRAUD Is when the Insured or any person who is a regular operator of vehicle has been found by a court of competent jurisdiction in either criminal or civil proceedings to have committed a fraud in any way connected with automobile insurance. 7 GENERAL INFORMATION MATERIAL FACT Anything that would cause an Underwriter to reject a risk, charge a different premium for the risk or change the coverages or terms of the policy. MATERIAL MISREPRESENTATION Is where within the preceding 6 years an applicant for a contract: Gives false particulars of the described automobile to be insured to the prejudice of the insurer; or Knowingly misrepresents or fails to disclose in the application any fact required to be stated therein. DRIVING EXPERIENCE This is defined as the number of full continuous years that the operator has held a valid operator s licence for the type of vehicle concerned. A valid licence includes a licence in another jurisdiction within Canada or the United States. Years Licensed in Canada / USA is calculated based on the first date licensed in Canada or the USA (rather than the Date First Licensed shown on the Motor Vehicle Record). Driving experience obtained in a foreign country (other than the USA) is not considered experience for the purpose of establishing Years Licensed in Canada / USA. A learner s permit (G1) will not be recognized as this is not considered to be a valid licence, unless there is no other licensed driver in the household and they are the Principal Operator. PLEASURE USE Includes driving the automobile between the residence and the place of employment and includes car pools, share-the-ride agreements, as well as driving part way to work such as to a bus, subway or train station. BUSINESS USE Other than driving to and from work, the vehicle is regularly used or required by any operator in the pursuit of his/her occupation. A personal vehicle will be classified as a business use vehicle if it is used for business purposes. This includes situations where the Insured is paid for the use of his/her vehicle, is able to claim for vehicle expenses on their tax return, or otherwise profits from the use of their vehicle. Some examples of where Business Use Rating would apply would be Real Estate Agent, Insurance Broker, Sales person, Social Worker etc. DRIVE TO WORK Includes driving the automobile between the residence and the place of employment and includes car pools, share-the-ride agreements, as well as driving part way to work such as to a bus, subway or train station. 8 GENERAL INFORMATION ACCIDENT An occurrence resulting in a bodily injury, personal injury, death, damage to property of others or collision damage arising out of ownership, use or operation of an automobile. CHARGEABLE ACCIDENT Chargeable Accident (in conjunction with the NOTE below) means an occurrence for which the Applicant, Insured or operator is deemed to be wholly, or partially responsible and results in Bodily Injury, and/or Damage to Property of Others, and/or Collision or the Collision portion of All Perils coverage arising out of the ownership, use or operation of an automobile in consequence of which: An amount has been paid or would have been paid but for the existence of provincial Direct Compensation laws or agreement; or A claim remains unsettled or unpaid; or A civil suit is pending against the Applicant, Insured or operator; or The loss was uninsured due to absence of coverage or a policy violation and the right to indemnity was forfeited resulting in the claim to be paid by an insurer under Uninsured Automobile or OPCF 44R coverage. It is not considered a Non-Chargeable Accident as defined below. NOTE: BEFORE SEPTEMBER 1, 2010: accidents occurring before September 1, 2010 are chargeable if the Applicant, Insured or operator is deemed to be more than 0% responsible. AFTER SEPTEMBER 1, 2010: Accidents occurring on or after September 1, 2010 are chargeable if the Applicant, Insured or operator is deemed to be more than 25% responsible. A chargeable accident is always taken into account even though: There was no insurance in effect, or The claim was repaid to the insurer by or on behalf of the Applicant, Insured, or operator. NON-CHARGEABLE ACCIDENT The following situations will be considered as Non-Chargeable Accidents: The Insured's degree of fault is determined (in conjunction with the NOTE below) under the relevant provincial fault determination laws or agreements or dispute resolution mechanisms Damage to the vehicle resulted from the automobile being struck by an unidentified vehicle and the incident is reported to the police within 24 hours of the occurrence For Private Passenger Automobiles only, an accident will be considered a minor accident if all of the following circumstances exist: - The cost of damage to the automobile(s), including any associated property damage, did not exceed $2,000 individually; Renewals: October 1,

9 GENERAL INFORMATION - The cost of all such damages was paid by or on behalf of the At-fault driver; - No personal injuries were sustained as a result of the accident; and - No payment was made by an insurer with respect to damage to any automobile or property resulting from the accident. Such incidents will not affect rating and eligibility. However, if a second Minor accident occurs within the three-year time period following the first Minor Accident, the second Minor Accident will be rated and considered when determining eligibility. An uninsured party is responsible and the repair cost was paid under the Uninsured Motorist portion of the policy, or the deductible is recovered in full from an Unsatisfied Judgement or similar fund Impact with an animal NOTE: BEFORE SEPTEMBER 1, 2010: accidents occurring before September 1, 2010 are non-chargeable if the Applicant, Insured or operator is deemed to be 0% responsible. AFTER SEPTEMBER 1, 2010: Accidents occurring on or after September 1, 2010 are non-chargeable if the Applicant, Insured or operator is deemed to be 25% or less responsible. ANTI-THEFT DEVICES Immobilizer: this system cuts power to the ignition and prevents vehicle start-up. It can be deactivated by a plate hidden in the vehicle or by pushing one of the vehicle s accessory buttons. Examples include the PFK Autowatch 329, MasterGard M6000 and the Powerlock-Canada Immobilizer. Central Tracking Device: this system features a signal transmission device hidden in the vehicle and makes it possible to track the vehicle s position via GPS. Examples include Boomerang and Lo-Jack. VIN Engraving: the vehicle s Vehicle Identification Number (VIN) is permanently etched onto the vehicle s windows. The etching can be completed by the Insured with a kit such as VINetcher or VINshield, or by the vehicle dealer. PORTFOLIO TRANSFERS Risks submitted to us as part of a portfolio transfer will be treated as Renewal business from the standpoint of applying rate, underwriting rules regarding chargeable accidents, convictions and nonpayment of premium. 10 GENERAL INFORMATION VEHICLE BRANDING: SALVAGE / REBUILT / IRREPARABLE VEHICLES A vehicle which has been branded Salvage must be upgraded to Rebuilt in order for it to be legally driven on Ontario roads. Vehicles branded Irreparable can never be driven on Ontario roads; they can only be used for parts or scrap. Unica will insure vehicles that have been upgraded to Rebuilt provided the following criteria have been met: The vehicle successfully passed an inspection in accordance with the requirements in Ontario s Regulation 611 of the Highway Traffic Act. This includes the issuance of a Structural Inspection Certificate and a Safety Standards Certificate. Has upgraded their vehicle from Salvage to Rebuilt and has been declared Fit by the Ministry of Transportation. Note: Statutory Condition # 8 Inspection of the Automobile of the OAP # 1 policy states: The Insured shall permit the insurer at all reasonable times to inspect the automobile and its equipment. Unica will not offer Section 7 coverage for Rebuilt automobiles. Renewals: October 1,

11 GENERAL INFORMATION CHECKLISTS FOR POLICY CHANGE Treat Policy Change the same as New Business, obtaining full and complete details. This includes but is not limited to providing Car Codes, Territory, Rating Information (Years Licensed in Canada / USA, Gender, Age of Operator, Type / Assignment of Operator, Commuting & Annual Mileage Distances, Use of Vehicle, Claims and Convictions), Surcharges and Discounts. Ensure the Insured(s) sign any necessary documentation; e.g., OPCF 19 or OPCF 13C Obtain the Effective Date and Time of the transaction Document all coverage offered but declined by the Insured VEHICLE ADDED/SUBSTITUTED/DELETED ADDING A DRIVER Name of Registered Owner (If leased full name & address of Leasing Co) Year, make, model, body type, VIN Type of fuel used? Vehicle modified or customized? Any unrepaired damage? Operator s full name Relationship to the Insured Operator s licence # and date licensed If Driver Training Certificate applies, please obtain copy of DTC and attach to change request. Ensure that DTC applies based on our filed guidelines Coverage required on new vehicle or changes to existing vehicle Are there any additional endorsements required? Any requiring signature? Use of the additional vehicle or changes to existing/remaining vehicle Order MVR and Autoplus on any operator being added to the policy for the first time or any previously listed or Excluded Driver who has been previously removed from the policy Record Report details Dates and type of Convictions, if any? Claim details if any? And prior carrier history Estimated annual driving distance Licence Class and Status Car pooling or share-ride information Any change in operator information. E.g., who drives the new or existing vehicle? Are there any new operators not previously disclosed? Will the operator be insured elsewhere? Details of new carrier (name, policy #) Does the rating or use of the vehicles change as a result of deleting this operator? Ask the Insured to formally acknowledge/ confirm all changes in coverage that are being made and document who requested the change Why is coverage being deleted or added? (E.g., possible material change in risk? Licence suspended? Or does the Insured have a claim to present under a coverage not currently provided?) If the Insured is requesting coverage to be deleted and on file there is a Lienholder or Lessor, written authorization must be obtained from the interested party ADDRESS CHANGE CANCELLING A POLICY DELETING A LIENHOLDER / LESSOR Does the Rating Territory change? Has the use of the vehicles changed? Signed request by the Named Insured(s) including a signed LPV / signed back Renewal documents How far is the vehicle driven to work? What is the estimated annual driving distance? Has the Principal operator of the vehicle changed? Are there any new operators in the household? 13 ELIGIBILITY & RATING RULES RULES FOR DECLINING TO ISSUE NEW BUSINESS, TERMINATING OR REFUSING TO RENEW A CONTRACT ARE: APPLICANT VEHICLE 1. The Applicant or listed operator has been cancelled or has had a claim denied for material misrepresentation or nondisclosure in the preceding 3 years 2. The Applicant or listed operator has knowingly misrepresented or failed to disclose in the application for insurance or when requesting a change to the existing policy any fact required to be stated, including giving false particulars of the described automobile to the prejudice of the insurer 3. The Applicant or listed operator is the only licensed operator in the household and their driving status is suspended, unrenewable or unlicensed 4. The Applicant or listed operator has had a licence suspension in the preceding 3 years for an alcohol related conviction 5. The Applicant or listed operator has wilfully made a false statement in respect to a claim under the contract 6. The Applicant or listed operator has failed to provide all information or documentation required for the purpose of investigating or assessing a claim under a policy 7. The Applicant or listed operator fails to provide the necessary underwriting information as described in the OAF 1 to determine our loss exposure and properly rate the risk 8. The Applicant or listed operator has failed to notify the Insurer within 14 days of any material change (that is within the Insured s knowledge) on the information supplied in the original application for insurance, such as additional drivers, vehicle modifications, or a change in the way the vehicle is used 9. The Applicant refuses to provide a safety certificate or other evidence of mechanical fitness when the safe operation of the vehicle is in question 10. The Applicant or listed operator has been convicted of auto insurance fraud in the preceding 10 years 11. The Applicant or listed operator has permitted someone not authorized by law to drive or allowed an excluded driver to operate a vehicle when excluded under the OPCF 28A, in the preceding 3years 12. The Applicant, regular or frequent operator is not a resident of Ontario 13. All regular or frequent operators do not have valid Ontario Driver s licences 14. The Applicant or listed operator owes outstanding automobile premium to Unica Insurance Inc. 15. The behaviour of the Applicant or listed driver is abusive or threatening to the Insurer or Brokerage staff and the appropriate charge has been made with the police 16. Vehicles with a value in excess of $200, Non-factory vehicle accessories, modifications and customizations (except where approved by the Company through an acceptable current appraisal determining value, if necessary, or under $2,000). Performance related modifications/customizations are not permitted 18. Kit cars and replicas 19. Propane powered vehicles not factory installed or converted professionally 20. Public vehicles and commercial vehicles 21. The vehicle has an expired Ontario licence plate or is not plated or registered in Ontario 22. A vehicle that has failed a government inspection for roadworthiness ( Safety Standards Certificate ) 23. A vehicle that has been branded as Salvage and the Insured refuses to provide a government inspection Safety Standards Certificate, a copy of the Structural Inspection Certificate and current photographs of the vehicle 24. A vehicle with Comprehensive or Specified Perils only and there is no other vehicle on the policy carrying mandatory coverage 25. A vehicle permanently kept outside the province of Ontario 26. Vehicle(s) indicative of commercial exposure (e.g., containing logos) 27. Vehicle(s) driven by employees, whether or not the vehicle is registered under a Business name 28. A vehicle that is 15 years of age and older and the Insured refuses to provide a current acceptable Ontario Safety Standards Certificate and current photographs of all sides of the vehicle within 10 business days 29. A vehicle that is deemed unsafe or unfit as determined by a Safety Standards Certificate or other evidence of mechanical fitness. 30. A vehicle that has unrepaired damage affecting the mechanical fitness and safety, where the Insured refuses to provide a Safety Standards Certificate or other evidence of mechanical fitness within 10 business days 31. The vehicle is right hand drive 32. The vehicle was not manufactured for sale or distribution in Canada / USA Renewals: October 1,

Risks with a USA exposure that cumulatively exceeds a period of 6 months in a year 34. Vehicles rented or leased to others 35. Vehicles used for purposes other than private passenger use such as wholesale & retail deliveries, fast food deliveries, taxis, courtesy cars, vehicles held for sale or used for demonstrating or testing, driver training vehicles, funeral vehicles, emergency vehicles and vehicles used to carry tools, materials and any other artisan s equipment 36. The vehicle is used for racing, timed road or speed tests, on a track or closed course of any kind, or is taken off-road 37. Motorcycles, mopeds, scooters, dirt-bikes, personal transporters and any other 2-wheeled or 3-wheeled motorized vehicles RULES FOR TERMINATING A CONTRACT ARE: VEHICLE INSPECTIONS 38. If the policy has been in effect for 60 days or less, and either the company has not received a vehicle inspection report within 30 days from the date requested or the insured notifies the company that a vehicle inspection report will not be provided Renewals: October 1,

18 ELIGIBILITY & RATING RULES PROPANE VEHICLES We will accept a propane-fuelled vehicle provided it was factory converted. The vehicle must also be equipped with a Stop Fill Valve, which has been professionally installed (CSA/ULC approved). This valve restricts the amount of fuel to 80% of tank capacity, allowing 20% for fuel expansion. Vehicles which have been converted from gas to propane, other than factory conversions, will not be accepted. VEHICLE MODIFICATIONS We will insure vehicles which contain modifications to accommodate a disability or for wheelchair accessibility. Values for such modifications must be included in the vehicles Rate Group. Please use the vehicle modifications table to identify the appropriate Rate Group. Proof of such values will be required either by providing a detailed invoice listing all the modifications (if they were factory installed), or a professional appraisal (for modifications installed after-market ). The application of an OPCF 19 will be required on such risks. We will not insure any vehicle containing modifications that relate to the engineering or the performance features of the vehicle such as oversized engines, turbo or superchargers, raised or lowered suspension, installation of roll bars, nitrous oxide, hydraulics, special effect lighting, etc. Panel or van type vehicles fitted with sleeping or cooking facilities will not be insured as a private passenger vehicle type. This type of vehicle would have to be insured as a miscellaneous vehicle, applying Motorhome criteria and rates. Such risks will require an appraisal to establish the vehicle(s) value. An OPCF 19 will be required on such risks. Other types of modifications such as elaborate and expensive interior furnishings, exterior paint, glass and body changes and installation of additional equipment exceeding $2,000 in value will be reviewed with Underwriter on a per risk basis. Risks may require a vehicle appraisal to establish values to be insured. An OPCF 19 will have to be applied to such risks. CUSTOM / REPLICA / KIT CARS We will not insure any custom, replica, or kit cars. These types of vehicles fall within a unique category, which will require a specialty market carrier. A customized vehicle or altered vehicle is one, which has been changed from the original factory design. These changes will create a one of a kind vehicle. The changes increase the cost to repair or replace the vehicle over a factory-produced model. A kit car is a vehicle purchased in parts which must be individually assembled. Again this type of vehicle is unique. Confirmation of values and establishment of value is impossible in these types of vehicles. Replicas are vehicles which are reproductions. They are assembled or produced one at a time to emulate or duplicate a make no longer manufactured or available. Renewals: October 1,

19 ELIGIBILITY & RATING RULES VEHICLES PURCHASED OUTSIDE CANADA Vehicles manufactured/imported from outside Canada are not insurable unless the appropriate documentation is provided (e.g., a vehicle purchased in USA and shipped to Canada). We will insure these vehicles provided the following is submitted: Safety Certificate (must be current within the last 90 days) A recent appraisal (within the last 12 months) Current photographs of the vehicle Copy of registration Bill of sale APPRAISALS Appraisals will be required under the following circumstances: For vehicle(s) rated under our Collector Car Automobile program Vehicle(s) requiring optional coverage(s), where the vehicle is 15 years of age and older Vehicle(s) imported to/purchased outside of Canada Non-factory vehicle modifications and accessories, which increase the value of the vehicle The following information must be included for an appraisal to be considered acceptable: For New Business the appraisal(s) must have been performed within the last 12 months and for Renewals an updated appraisal will be required every 5 years Appraisal(s) must be performed in Canada by a qualified vehicle appraiser (Ministry of Finance Tax Evaluation Forms are not acceptable) Values are stated in Canadian currency Applicable taxes have been included in the vehicle value Must provide current photographs of the interior and exterior of the vehicle Unica reserves the right to determine appraisal acceptability. Appraisals must be multipaged and text based (no check boxes) VEHICLE INSPECTIONS Vehicle inspections may be required for the following: Vehicles that have unrepaired damage Vehicles that may have unacceptable modifications Vehicles that were previously used for commercial purposes or that are commercially plated SAFETY STANDARDS CERTIFICATES A valid Safety Standards Certificate is one that has been completed within the last 60 days by a certified mechanic. Safety Standards Certificates will be required under the following circumstances: Where the Insured chose a cash settlement rather than repairing the vehicle, or where there is unrepaired damage from a prior loss affecting the mechanical fitness and safety of the vehicle Where a vehicle has been branded Salvage or Rebuilt by the Ministry of Transportation Vehicle(s) which are determined to be a total loss and the Insured retains the salvage Vehicle(s) 15 years of age and older must have current photographs of all sides of the vehicle accompanying the safety certificate Vehicle(s) imported to/purchased outside of Canada Renewals: October 1,

20 ELIGIBILITY & RATING RULES LETTERS OF EXPERIENCE & DRIVER S ABSTRACT Letters of Experience from insurers within Canada and the USA will be acceptable as proof of claims free experience. For drivers from Canadian Provinces other than Ontario, or from the USA, as New Business, we will recognize and credit the Insured with their current Years Licensed in Canada / USA and Years Accident Free, provided that an acceptable Letter of Experience has been received by the Company. A Letter of Experience must be submitted as proof of prior insurance and claims free status. The following information must be included: All listed operators Prior claims within the preceding 6 years Driving Record Dates the policy was in force Previous Carrier and Policy # Current status/reason policy was cancelled The Letter of Experience must be provided by the insurance company, submitted on company letterhead and signed by an authorized representative. The Broker will be required to see the original document and must retain a copy for their records. In addition to a Letter of Experience, an individual residing in Ontario less than 3 years ( new resident ) coming from the United States or from another province or territory in Canada will be required to submit a Driver s Abstract detailing their licence & conviction history for the preceding 3 years. DRIVER S TRAINING QUALIFICATION A certificate signed by a responsible official is required, certifying that the driver has successfully completed a driver education course conducted by certified instructors, provided: The course was composed of a minimum of 25 hours of classroom instruction plus 6 hours behind the wheel of a dual equipped automobile with automatic transmission, or 8 hours for those with standard transmission; The course has the approval of the Provincial Department of Education or other Government Department having jurisdiction, or any Driving School Association approved by the provincial government. A licensed driver who qualifies as above may be eligible for the Driver s Training Certificate Discount. See Discounts & Surcharges section for eligibility guidelines. DRIVING EXPERIENCE Drivers new to Canada / USA will be rated at 0 Years Licensed in Canada / USA. Every subsequent year on Renewal, the rating will progress by 1 up to a maximum of 20+ Years Licensed. USA EXPOSURE A risk with a USA exposure longer than 1 month represents an additional risk. Currently, there is no surcharge for USA exposure. Unica will not provide insurance for vehicles with a USA exposure that cumulatively exceeds a period of 6 months in a year. 21 ELIGIBILITY & RATING RULES BUSINESS USE Business Use is limited to Private Passenger type vehicles (see definition in General Information section) and does not include Private Passenger Automobiles used for any retail or wholesale delivery (e.g., newspapers, courier, food, mail, drug store delivery, etc.) or for carrying passengers for compensation (taxi, school bus, driver training school, etc.). Where there is no commercial exposure, but the vehicle is registered in a business name, it will be rated Business Use. The Insured must provide full details including licence numbers for all the owners of the business. This will allow us to obtain all the necessary information to properly review the risk exposure and rate the policy accordingly. In addition to the above, Unica s Personal Lines Department will not insure vehicles with logos, or vehicles driven by an Insured s employee(s). This type of risk can be referred to our Commercial Lines Department. Risks where employees drive the vehicle(s) are not to be insured under a Personal Lines policy regardless of whether the vehicles are registered under a business name or not. Such risks must be referred to our Commercial Lines department. MID-TERM RE-RATING No mid term re-rating for: Driver age changes during the policy term, Rating progression (e.g., a conviction expires during the policy term, a claim becomes a year older or the Insured has an additional year licensed in Canada / USA) will be authorized. Such changes will only be reflected once the term expires and a Renewal is offered. Exceptions to this guideline: When the Insured has a change in licence class from G1 to G2 or G2 to G class. 26 ELIGIBILITY & RATING RULES RATING INFORMATION YEARS LICENSED IN CANADA / USA QUALIFICATION Years Licensed in Canada / USA is based on the number of full continuous years that the driver assigned as Principal Operator to the automobile has held a valid operator s licence for the type of vehicle concerned. A valid licence includes a licence in another jurisdiction within Canada or the USA. Years Licensed in Canada / USA is calculated based on the actual date first licensed in Canada or the USA (except for those drivers who have had a rateable lapse due to a licence suspension). For rating purposes, the range of Years Licensed in Canada / USA is 0 to 20+. YEARS ACCIDENT FREE QUALIFICATION Years Accident Free is based on the number of full years all drivers assigned to the automobile have been chargeable accident free as evidenced by insurance history or an acceptable Letter of Experience. For rating purposes, the range of Years Accident Free is 0 to 10. Newly licensed drivers will be given 10 Years Accident Free rating, as they have not incurred a chargeable accident. The Years Accident Free rating will drop in the event: The driver has a chargeable accident, The driver has a rateable lapse in Driver s licence for 90 days or more due to driving convictions or an accumulation of Demerit points (this will yield a rating of 0 Years Accident Free), The Applicant is not able to provide the name of the insurance company, policy number and expiry date of their most recent automobile insurance (either for a Named Insured or a listed driver). This will result in a rating of 0 Years Accident Free. Every subsequent year on Renewal, the rating will progress by 1 up to a maximum of 10. Note: Each vehicle s rating is established separately and independently considering assigned operators and claims. Years Accident Free, Years Licensed in Canada / USA and Convictions are separate rating factors. For the purpose of determining rating, the Occasional operator under 25 years of age will be regarded as a separate vehicle. YEARS VEHICLE OWNED/LEASED Years Vehicle Owned / Leased is based on the number of years since the purchase or lease date of the vehicle described on the policy. If the vehicle has been transferred to the insured from an immediate family member, we will honour the consecutive number of years that the vehicle was owned or leased by an immediate family member. Once the driver has qualified for a G2 licence, he/she will be required to be listed as a driver in the household. The Years Licensed in Canada / USA assigned to such an operator would be 0. On Renewal, drivers will progress through the Years Licensed in Canada / USA in accordance with the Years Licensed in Canada / USA criteria, every additional year thereafter. Drivers who have completed a government approved Driver s Training course may be eligible for the Driver s Training Certificate Discount. See Discounts & Surcharges section for eligibility guidelines. LAPSE IN INSURANCE COVERAGE A rateable lapse of insurance coverage for 30 days or more is a lapse that resulted directly or indirectly from: The termination of a policy of automobile insurance as a result of the insured person's failure to pay the premiums due under the policy, or The suspension of the insured person's driver's licence as a result of a conviction for an offence related to the use or operation of an automobile, or An accident or a conviction for an offence related to the use or operation of an automobile, if the insured person did not inform the insurer of the accident or conviction and the accident or conviction would likely have led to the insured person being charge a higher premium, or The insured person operated a motor vehicle or caused or permitted the motor vehicle to be operated without insurance during the lapse in coverage. A lapse due to either of the above will result in the application of a Lapse Of Insurance Surcharge as detailed in the Discounts & Surcharges section. LAPSE IN DRIVER S LICENCE The lapse in insurance coverage resulted from the suspension or lapse of an operator s licence as a result of a driving conviction or an accumulation of Demerit points. A lapse in driver s licence for 90 days or more will result in a maximum 0 Years Licensed in Canada / USA and 0 Years Accident Free being offered on the policy. Renewals: October 1,

29 ELIGIBILITY & RATING RULES Unica will not penalize for suspensions classified as Administrative, such as suspensions for unpaid fines, unpaid child support and medical reasons. Once coverage is resumed, the Years Licensed in Canada / USA and Years Accident Free will be established by the length of time since both the licence was reinstated and insurance coverage is resumed. Example: The Insured reinstated their licence a month ago; YF would assign 0 Years Licensed in Canada / USA and 0 Years Accident Free. 36 ENDORSEMENTS DESCRIPTION OPCF 3 - Drive Government Automobiles Protects the Insured against Liability imposed by law as a result of the use, operation, care, custody or control while operating any private passenger automobile owned by the Government of Canada, or any Province thereof. This endorsement extends the Third Party Liability and Section 7 Loss or Damage Coverage from your own private passenger automobile to the Government owned automobile, where the Insured was acting outside of his or her scope of employment and is found to have been negligent. We will pay up to $50,000 (Canadian Funds) per occurrence, subject to policy deductibles. Eligibility Criteria Must carry Section 7 Loss or Damage Coverage (Collision & Comprehensive/Specified Perils or All Perils). COST $49.00 OPCF 5 - Permission to Rent or Lease Automobiles and Extending Coverage to the Specified Lessee(s) It permits the Insured (Lessor) to rent or lease the described automobile to a specified person (Lessee). The policy is issued jointly, showing the name and address of the Lessor and Lessee. This endorsement is applied to insurance policies covering leased vehicles. It provides the Lessee with the same coverage as if the vehicle were an owned vehicle. Lessor - Leasing Company Lessee - The person/individual(s) listed on the lease agreement. This person/individuals will also be the Named Insured when applying for automobile insurance. Eligibility Criteria The term of the lease must not be less than 2 years. We will require the Lessor & Lessee to provide their full name and mailing address and the Lessee must be the Named Insured. Upon request, the Insured must provide Unica with a copy of the lease agreement when a leased vehicle is over 5 years old. The following wording is to be inserted on the endorsement: To carry passengers for compensation or hire to and from their employment while and only while the Insured is going to and from his/her employment. An example of such use would be you having an agreement with a co-worker or neighbour that every week he/she will ride along with you on your way to work and in turn the co-worker or neighbour pays a weekly fee. Please Note: that permission is automatically granted without additional premium for an Insured who is involved in a cost sharing or reciprocal arrangement with coworkers or neighbours and volunteer drivers. An example of this would be one week your neighbour or co-worker rides in your car and the other week you get a ride in their car, this is considered a reciprocal agreement. The other would be someone volunteering for the Cancer Society to drive patients to their appointments. OPCF 9 Marine Use Excluded (amphibious automobile) This endorsement excludes coverage while the amphibious automobile is used in or upon water or while it is being launched or landed. 38 ENDORSEMENTS DESCRIPTION OPCF 16 - Suspension of Coverage (continued) With this endorsement, the Insured agrees that the following coverages will be cancelled for the use or operation of the described automobile, a newly acquired automobile and a temporary substitute automobile: Section 3, Liability Coverage Section 4, Accident Benefits Coverage Section 5, Uninsured Automobile Coverage and Section 6, Direct Compensation Property Damage Coverage Section 7, Loss or Damage Coverage (Optional) All Perils (collision portion only) and Collision Coverage The suspension of coverage OPCF 16 will maintain Comprehensive/Specified Perils coverage and a portion of the coverages noted above. The vehicle value must be agreed to by the Company. A copy of the vehicle ownership is required. A signed Restricted Usage Declaration is required. No Charge OPCF 20 - Coverage for Transportation Replacement It provides coverage to the Insured when they are required to pay for other means of transportation because of loss or damage to the Insured s automobile caused by a peril insured under the policy. For instance the Insured may choose to rent a car or hire a taxi while the insured vehicle is being repaired due to an insured loss. COST OPCF 23A - Lienholder Protection This endorsement is applied to policies containing vehicles with a lien. This protects the Lienholder s interest in an automobile if the Insured has a claim for a loss covered under Section 6 Direct Compensation-Property Damage and Section 7 of the policy, Loss or Damage Coverage. During a claim settlement if a cash payment is made on an automobile containing this endorsement the payment will be made jointly to the Insured and the lienholder. Eligibility Criteria Must carry Section 7 Loss or Damage Coverage Damage Coverage (Collision & Comprehensive/Specified Perils or All Perils). If Section 7 Loss or Damage Coverage is requested to be reduced or deleted Unica must receive written notice from the Lienholder giving authorization for the Named Insured to request such reduction or deletion. To remove we will require evidence that the Lienholder no longer has financial interest in the vehicle. A release of interest will be acceptable. No Charge OPCF 27 - Liability for Damage to Non-Owned Automobile(s) and Providing Other Coverages When Insured Persons Drive Other Automobiles Extends Section 7 Loss or Damage Coverage to non-owned automobiles for loss or damage resulting from the care, custody or control of that non-owned automobile by the Named Insured, spouse and listed operators. Coverage will be provided up to a maximum of 45 consecutive days. We will pay under the standard coverage up to $45,000 (Canadian Funds) per occurrence, subject to policy deductibles. Additional coverage up to $50,000 may be purchased at the cost of $1.00 /1,000. This endorsement pertains only to private passenger automobiles. Signed Endorsement must accompany application submission or endorsement request; otherwise risk will be declined based on our filed guidelines. Must be signed by the Named Insured and the Excluded Driver. COST OPCF 32 - Use of Recreational Vehicles by Unlicensed Operators This endorsement provides coverage when any person who does not have a driver s licence or is not authorized by law to drive, to operate certain recreational vehicles off Public Highways. Eligibility Criteria Must be attached to all policies containing Snowmobiles and/or All-Terrain Vehicles. No Charge OPCF 38 - Agreed Limit for Automobile Electronic Accessories and Equipment This endorsement limits the amount that will be recovered in the event of an insurable loss to agreed amounts for electronic accessories and equipment, other than factory installed equipment. This change form protects the Insured when the value of the electronic equipment installed in their automobile is in excess of the automatic coverage provided under the OAP1. Eligibility Criteria A full description of the equipment including the year(s), make(s), model(s), serial numbers and values must be provided. 42 ENDORSEMENTS DESCRIPTION OPCF 43 Removing Depreciation Deduction OPCF 43A Removing Depreciation Deduction for Specified Lessee(s) This endorsement waives the cost of depreciation (except to tires and batteries), if the damaged vehicle is repaired or replaced due to an insured loss. For Private Passenger Automobile, the 24 and 60 months durations are available. For Snowmobile, only the 24 months is offered. The coverage is in force for the first 24 months or 60 months (as per the selected duration) from the date the vehicle is delivered to its original Owner/Lessee. Also if the Endorsement ends mid-term, the coverage will continue up to the policy expiry date. Eligibility Criteria: The Insured is the original Owner/Lessee. A demonstrator not exceeding 10,000 km is eligible if purchased from a dealership. Request for addition must be made within 90 days of the delivery date of the vehicle. If coverage is requested beyond 90 days, Unica will require proof of coverage with the previous carrier. Copies of the prior policy (if applicable) and the bill of sale or the lease agreement will need to be kept at the broker office. However, in the event of a claim, Unica will require these documents to confirm eligibility. 43 ENDORSEMENTS DESCRIPTION OPCF 44R - Family Protection Coverage This endorsement provides additional benefits to the Insured, their spouse and certain relatives in the event of bodily injury or death caused by a motorist who is inadequately insured, or should the motorist be unidentified. The limit of this coverage is the difference between the Liability limit carried under the insurance policy and the amount carried by the motorist at fault. COST Annual Charge $500,000=$13.00 $1 Million=$13.00 $2 Million=$25.00 OPCF 47 Agreement Not To Rely On SABS Priority of Payment Rules This endorsement must be attached to any policy where the Insured has purchased one or more Optional Accident Benefits. This endorsement changes the priority of payment rule under SABS. The application of the OPCF 47 will allow the Insured regardless of the priority of payment rules to claim both Statutory Accident Benefits and the Optional Benefits from the carrier providing this coverage. The insured person is limited to only being able to claim from one insurer. Example: The Insured has a policy through one carrier covering optional accident benefits. He/she also has another policy through a different carrier covering a separate vehicle, which does not have optional accident benefits. If the Insured is involved in an accident with the vehicle that does not carry optional accident benefits he/she has the option to collect their accident benefits through the carrier where the optional accident benefits coverage exists provided the optional benefit applicable was purchased. 49 ENDORSEMENTS COLLECTOR CAR COVERAGE EXTENSION ENDORSEMENT 1) Purpose of This Change - This change is part of your automobile policy. It provides coverage for Spare Parts, Overnight Accommodation, and Flatbed Towing Expense. This endorsement applies to all vehicles on your policy which are insured under our Collector Car Program. 2) What We Will Pay a) Spare Parts Coverage - Under Section 7, Loss or Damage Coverages, we will reimburse you for loss or damage to Spare Parts applicable to the vehicle insured on the Collector Car Program as indicated above. The Insurer shall not be liable with respect to loss or damage of these Spare Parts in excess of the Actual Cash Value at the time the loss or damage occurs, up to the limit of 10% of the vehicle value, to a maximum of $5,000 per policy term. This limit is in excess of the limit on your Property Insurance policy. Coverage is on an Actual Cash Value basis. b) Overnight Accommodation - Under Section 7, Loss or Damage Coverages, we will reimburse you for up to $200 per occurrence for overnight accommodation in the event the vehicle insured on the Collector Car Program as indicated above is rendered unfit for driving as the result of an accident or insured peril while attending a collector car hobby function such as a parade or car show. c) Flatbed Towing Expense - Under Section 7, Loss or Damage Coverages, a flatbed towtruck will be provided in the event the vehicle insured on the Collector Car Program as indicated above is rendered unfit for driving as the result of an accident or insured peril while out for a drive or while attending a collector car hobby function such as a parade or car show. The vehicle may be towed to the repair facility of the Insured s choice, whether local to the accident or local to the Insured s residence. 3) What is Not Covered a) Spare Parts Coverage does not cover: i) Supplies, fluids, oil or gasoline; parts that do not pertain to the Collector Car insured under this policy; tools, machinery, equipment or products used to maintain, clean or repair the vehicle. ii) Damage caused by deterioration, defect, freezing, rust or corrosion, wet or dry rot, mould or fungi or spores iii) Damage caused by birds, vermin, raccoons, rodents, insects, domestic or domesticated animals. iv) Scratching, marring, chipping or denting, unless caused by theft or attempted theft. v) Damage caused to the Spare Part(s) while in the process of installing them on the vehicle. b) Overnight Accommodation is not applicable if: i) The vehicle suffers breakdown due to wear and tear, deterioration, defect, mechanical or electrical failure, or damage resulting from your failure to maintain your vehicle in sound operating condition. ii) You have other means of transportation to get you home. iii) You are within 50km of your home. c) Flatbed Towing Expense coverage is not applicable if: i) The vehicle suffers breakdown due to wear and tear, deterioration, defect, mechanical or electrical failure, or damage resulting from your failure to maintain your vehicle in sound operating condition. 4) Deductible - This coverage is subject to the policy deductible. 52 COLLECTOR CAR PROGRAM Unica is prepared to insure Antique and Classic Automobiles. There are 2 categories of vehicles insured under this program. Antiques Classics Collector Car Program automobiles must meet all eligibility requirements. Automobiles not meeting those guidelines will be declined. There are no mileage restrictions or historical licence plate requirements. Vehicles insured under the Collector Car Program are subject to a Restricted Usage Declaration. DETERMINING INSURED VALUE & REQUIREMENTS FOR THE OPCF19A Premiums are based on the appraised value including tax. The appraised value must be stated in Canadian dollars. Should the appraisal not explicitly include taxes, PST & GST will be added to the appraised value. For a vehicle to be insured under the Program, the following information must be provided: An acceptable appraisal no more than 36 months old (for vehicles over $50,000, the appraisal cannot be more than 12 months old) from a credible Ontario appraiser. Please note that Ministry of Finance Tax Evaluation Forms are not acceptable appraisals Five (5) colour photos (right front, left rear, interior, engine compartment and trunk) A copy of the ownership A signed Restricted Usage Declaration Upon receipt of the required information, an OPCF19A - Agreed Value Of Automobile Endorsement will be added. 55 COLLECTOR CAR PROGRAM RULES FOR DECLINING TO ISSUE NEW BUSINESS, TERMINATING OR REFUSING TO RENEW A CONTRACT ARE: APPLICANT VEHICLE 1. Any operator less than 30 years old 2. Any operator licensed in Canada / USA less than 10 years 3. The Applicant or listed operator with a non-administrative license suspension in the past 3 years 4. The Applicant or listed operator has been cancelled or has had a claim denied for material misrepresentation or nondisclosure in the preceding 3 years 5. The Applicant or listed operator has knowingly misrepresented or failed to disclose in the application for insurance or when requesting a change to the existing policy any fact required to be stated, including giving false particulars of the described automobile to the prejudice of the insurer 6. The Applicant or listed operator is the only licensed operator in the household and their driving status is suspended, unrenewable or unlicensed 7. The Applicant or listed operator has wilfully made a false statement in respect to a claim under the contract 8. The Applicant or listed operator has failed to provide all information or documentation required for the purpose of investigating or assessing a claim under a policy 9. The Applicant or listed operator fails to provide the necessary underwriting information as described in the OAF 1 to determine our loss exposure and properly rate the risk 10. The Applicant or listed operator has failed to notify the Insurer within 14 days of any material change (that is within the Insured s knowledge) on the information supplied in the original application for insurance, such as additional drivers, vehicle modifications, or a change in the way the vehicle is used 11. The Applicant refuses to provide a safety certificate or other evidence of mechanical fitness when the safe operation of the vehicle is in question 12. The Applicant or listed operator has been convicted of auto insurance fraud in the preceding 10 years 13. The Applicant or listed operator has permitted someone not authorized by law to drive or allowed an excluded driver to operate a vehicle when excluded under the OPCF 28A, in the preceding 3 years 14. The Applicant and Principal Operator do not have daily/regular use automobiles registered and insured in their own names 15. The Applicant, regular or frequent operator is not a resident of Ontario 16. All regular or frequent operators do not have valid Ontario Driver s licences 17. The Applicant or listed operator owes outstanding automobile premium to Unica Insurance Inc. 18. The behaviour of the Applicant or listed driver is abusive or threatening to the Insurer or Brokerage staff and the appropriate charge has been made with the police 19. The Antique vehicle is less than 30 years of age 20. The Classic vehicle is less than 20 years of age or over 29 years of age 21. The vehicle has not been fully restored or is not in exceptional original condition and / or does not display pride of ownership 22. 69 MOTORHOMES A motorhome is a self-propelled recreational camping and travel vehicle. Some are specifically designed and manufactured as motor homes, where others have been customized after-market to include living quarters, and can store and carry fresh water and sewage. (Type A) (Type B) (Type C) TYPES OF MOTORHOMES Conventional Motorhome (Type A) The living unit has been entirely constructed on a bare, specially designed motor vehicle chassis. Chopped Van (Low Profile) (Type B) This unit is built on an automotive manufactured van frame with an attached cab section having a gross vehicle weight of 2,950kg or more, with an overall height of less than eight feet. The RV manufacturer completes the body section containing the living area and attaches it to the cab section. Chopped Van (Compact) (Type B) This unit is built on an automotive manufactured cab and chassis having a gross vehicle weight of less than 2,950kg. It may provide any or all of the conveniences of the larger units. Chopped Van (Mini) (Type C) This unit is built on an automotive manufactured van frame with an attached cab section of a gross vehicle weight 2,950kg or more, with an overall height of more than eight feet. The RV manufacturer completes the body section containing the living area and attaches to the cab section. Van Camper (Type B) A panel-type truck to which the RV manufacturer adds any two of the following conveniences: sleeping, kitchen and toilet facilities, also 110 volt hook-up, fresh water storage, city water hook-up, and a top extension to provide more head room. 70 MOTORHOMES RULES FOR DECLINING TO ISSUE NEW BUSINESS, TERMINATING OR REFUSING TO RENEW A CONTRACT ARE: APPLICANT MOTOR HOMES 1. Any operator under 25 years old 2. Any operator licensed in Canada / USA less than 5 years or with a G1 or G2 class licence 3. The Applicant or listed operator has been cancelled or has had a claim denied for material misrepresentation or nondisclosure in the preceding 3 years 4. The Applicant or listed operator has knowingly misrepresented or failed to disclose in the application for insurance or when requesting a change to the existing policy any fact required to be stated, including give false particulars of the described automobile to the prejudice of the insurer 5. The Applicant or listed operator is the only licensed operator in the household and their driving status is suspended, unrenewable or unlicensed 6. The Applicant or listed operator has had a license suspension in the preceding 3 years for an alcohol related conviction 7. The Applicant or listed operator has wilfully made a false statement in respect to a claim under the contract 8. The Applicant or listed operator has failed to provide all information or documentation required for the purpose of investigating or assessing a claim under a policy 9. The Applicant or listed operator fails to provide the necessary underwriting information as described in the OAF 1 to determine our loss exposure and properly rate the risk 10. The Applicant or listed operator has failed to notify the Insurer within 14 days of any material change (that is within the Insured s knowledge) on the information supplied in the original application for insurance, such as additional drivers, vehicle modifications, or a change in the way the vehicle is used 11. The Applicant refuses to provide a safety certificate or other evidence of mechanical fitness when the safe operation of the vehicle is in question 12. The Applicant or listed operator has been convicted of auto insurance fraud in the preceding 10 years 13. The Applicant or listed operator has permitted someone not authorized by law to drive or allowed an excluded driver to operate a vehicle when excluded under the OPCF 28A, in the preceding 3 years 14. The Applicant, regular or frequent operator is not a resident of Ontario 15. All regular or frequent operators do not have valid Ontario Driver s licences 16. The Applicant or listed operator owes outstanding automobile premium to Unica Insurance Inc. 17. 80 SNOWMOBILES A snowmobile is a self-propelled motorized vehicle designed to be driven exclusively on snow or ice. Unica requires all Snowmobile policies to carry an OPCF 32 (Use of Recreational Vehicles by Unlicensed Operators). TYPES OF SNOWMOBILES Touring Designed for long, comfortable rides on groomed trails, touring snowmobiles can include a higher windshield, heated hand grips, a rear passenger backrest and other creature comforts. Trail / Sport Designed for trail use, Trail / Sport snowmobiles provide the rider with a versatile mix of handling and comfort. Utility Designed for both on and off trail riding, these vehicles are longer, slightly wider and heavier than other snowmobiles. They also have the capability to haul a work sled or toboggan. Deep Snow / Mountain Designed for use in deep snow, off trail and climbing slopes. The key characteristic of these is that the track is longer than trail purpose snowmobiles, and this enables better maneuverability in deeper snow. Hybrid / Crossover Designed for use on and off trail. These snowmobiles also have a longer track, which enables them to be used in deeper snow. Performance Designed to be nimble and fast on the trail, they usually have a higher output engine and a lighter weight than other snowmobiles. Junior Designed for trail use by younger riders. These snowmobiles are normally equipped with an engine of 120cc or less. Unica does not insure Junior snowmobiles. Monoski These snowmobiles have a single ski on the front, and have seating ergonomics and handling characteristics similar to those of a motorcycle. One such model is the Snow Hawk. Monoskis can be factory built, or can be converted from motorcycles with a ski and track kit. Unica does not insure Monoskis. Renewals: October 1,

81 SNOWMOBILES RULES FOR DECLINING TO ISSUE NEW BUSINESS, TERMINATING OR REFUSING TO RENEW A CONTRACT ARE: APPLICANT 1. The Applicant or listed operator has been cancelled or has had a claim denied for material misrepresentation or nondisclosure in the preceding 3 years 2. The Applicant or listed operator has knowingly misrepresented or failed to disclose in the application for insurance or when requesting a change to the existing policy any fact required to be stated, including give false particulars of the described automobile to the prejudice of the insurer 3. The Applicant or listed operator is the only licensed operator in the household and their driving status is suspended, unrenewable or unlicensed 4. The Applicant or listed operator has had a license suspension in the preceding 3 years for an alcohol related conviction 5. The Applicant or listed operator has wilfully made a false statement in respect to a claim under the contract 6. The Applicant or listed operator has failed to provide all information or documentation required for the purpose of investigating or assessing a claim under a policy 7. The Applicant or listed operator fails to provide the necessary underwriting information as described in the OAF 1 to determine our loss exposure and properly rate the risk 8. The Applicant or listed operator has failed to notify the Insurer within 14 days of any material change (that is within the Insured s knowledge) on the information supplied in the original application for insurance, such as additional drivers, vehicle modifications, or a change in the way the vehicle is used 9. The Applicant refuses to provide a safety certificate or other evidence of mechanical fitness when the safe operation of the vehicle is in question 10. The Applicant or listed operator has been convicted of auto insurance fraud in the preceding 10 years 11. The Applicant or listed operator has permitted someone not authorized by law to drive or allowed an excluded driver to operate a vehicle when excluded under the OPCF 28A, in the preceding 3 years 12. The Principal Operator is under 16 years of age and / or does not have a valid motor vehicle licence 13. The Applicant, regular or frequent operator is not a resident of Ontario 14. All regular or frequent operators do not have valid Ontario Driver s licences 15. The Applicant or listed operator owes outstanding automobile premium to Unica Insurance Inc. 16. Snowmobiles powered by fuel other than gas or diesel 26. A snowmobile that has failed a government inspection for roadworthiness ( Safety Standards Certificate ) 27. A snowmobile that has been branded as Salvage and the Insured refuses to provide a government inspection Safety Standards Certificate, a copy of the Structural Inspection Certificate and current photographs of the vehicle 28. A snowmobile that is deemed unsafe or unfit as determined by a Safety Standards Certificate or other evidence of mechanical fitness. 29. A snowmobile that has unrepaired damage affecting the mechanical fitness and safety, where the Insured refuses to provide a Safety Standards Certificate or other evidence of mechanical fitness within 10 business days 30. Snowmobiles requiring Comprehensive or Specified Perils only (carries no Liability coverage) 31. Snowmobiles written without mandatory road coverage 32. 99 ALL-TERRAIN VEHICLES An acceptable All-Terrain Vehicle (ATV) is a four wheel vehicle designed and manufactured specifically for use on rugged terrain. Unica requires all ATV policies to carry an OPCF 9 (Marine Use Excluded) and an OPCF 32 (Use of Recreational Vehicles by Unlicensed Operators). TYPES OF ALL-TERRAIN VEHICLES Unica rates All-Terrain Vehicles by type. Type is based on the IBC s VICC All-Terrain Vehicle classifications table. Lite Designed for children, Lite ATVs are much smaller than regular ATVs. They typically have engines under 150cc, but there are some ATVs categorized as Lite with engines up to 250cc. Unica does not insure Lite ATVs under 150cc. Recreational Designed for trail use, Recreational ATVs are the most common type of All-Terrain Vehicles. They are small in size, making them agile. They can be equipped with either a manual or automatic transmission, and offer seating for one or 2 people. Utility Designed for work or hunting, these vehicles are longer and heavier than Recreational ATVs. They feature larger engines and automatic transmissions to better support the hauling of cargo. Some Utility ATVs feature side-by-side seating. They can be equipped with racking, trailer hitches, winches or cargo boxes. Recreational / Utility These feature side-by-side seating with sporty looks. They are designed with more robust roll cages for better safety, and can be equipped with small snow plows and winches. Recreational / Utility ATVs can be used for either utility hauling or sport purposes. Heavy Duty Similar to Recreational / Utility ATVs, these vehicles have larger engines and frames to better accommodate even larger payloads. Heavy Duty ATVs are longer and heavier than other ATVs, and can be equipped with larger attachments such as plows, power loaders, dump buckets and tillers. They feature responsive engines, smaller frames/bodies, and longer suspension travel to soak up the bumps, jumps and turns. Sport ATVs are available in either 2 or 4 wheel drive and are often used in competitions. Buggy These ATVs are similar in looks and concept to dune buggies in that they feature longer wheelbases for improved ride and handling, an engine which resides behind the driver, and a seating position that is much lower to the ground than other ATVs. 101 ALL-TERRAIN VEHICLES RULES FOR DECLINING TO ISSUE NEW BUSINESS, TERMINATING OR REFUSING TO RENEW A CONTRACT ARE: APPLICANT 1. Regular and frequent operator is less than 16 years old 2. The Principal Operator must be licensed in Canada / USA a minimum of 1 year, and must have a G2 or G class licence 3. The Applicant or listed operator has been cancelled or has had a claim denied for material misrepresentation or nondisclosure in the preceding 3 years 4. The Applicant or listed operator has knowingly misrepresented or failed to disclose in the application for insurance or when requesting a change to the existing policy any fact required to be stated, including give false particulars of the described automobile to the prejudice of the insurer 5. The Applicant or listed operator is the only licensed operator in the household and their driving status is suspended, unrenewable or unlicensed 6. The Applicant or listed operator has had a licence suspension in the preceding 3 years for an alcohol related conviction 7. The Applicant or listed operator has wilfully made a false statement in respect to a claim under the contract 8. The Applicant or listed operator has failed to provide all information or documentation required for the purpose of investigating or assessing a claim under a policy 9. The Applicant or listed operator has failed to notify the Insurer within 14 days of any material change (that is within the Insured s knowledge) on the information supplied in the original application for insurance, such as additional drivers, vehicle modifications, or a change in the way the vehicle is used 11. The Applicant refuses to provide a safety certificate or other evidence of mechanical fitness when the safe operation of the vehicle is in question 12. The Applicant or listed operator has been convicted of auto insurance fraud in the preceding 10 years 13. The Applicant or listed operator has permitted someone not authorized by law to drive or allowed an excluded driver to operate a vehicle when excluded under the OPCF 28A, in the preceding 3 years 14. 118 TRAILERS A trailer is a vehicle without a motor, designed to be used with and towed behind a private passenger rated vehicle, and has a Gross Vehicle Weight of 4,500kg or less. Trailers are designed to provide temporary living quarters for recreation, camping and travel use. Trailers are written only in conjunction with a Private Passenger automobile. TYPES OF TRAILERS Cabin/House Trailer Constructed with solid walls, it is equipped for living purposes for camping trips and/or vacations. It does not fold down to be towed. This category does not include motor homes. 5 th Wheel Unit Constructed with the raised forward section, allowing a bi-level floor plan, but it can be equipped the same as the conventional travel trailer. The vehicle has an expired Ontario licence plate or is not plated or registered in Ontario 9. Trailers mounted on a permanent foundation 10. A trailer or camper unit that has been branded as Salvage and the Insured refuses to provide a government inspection Safety Standards Certificate, a copy of the Structural Inspection Certificate and current photographs of the vehicle 13. Any trailer or camper unit with unrepaired damage, including trailers / camper units where a cash settlement was taken and the trailer / camper unit has not been repaired 14. Trailers or camper units imported to/purchased outside of Canada without an acceptable current appraisal 15. A trailer or camper unit that is deemed unsafe or unfit as determined by a Safety Standards Certificate or other evidence of mechanical fitness 16. A trailer or camper unit that has unrepaired damage affecting the mechanical fitness and safety, where the insured refuses to provide a Safety Standards Certificate or other evidence of mechanical fitness within 10 business days. 17. Any trailer or camper unit 20 years or older without an acceptable current appraisal and photographs 18. The vehicle was not manufactured for sale or distribution in Canada / the USA 19. A trailer or camper unit used for purposes other than pleasure use only 20. Trailers or camper units used for any business or commercial use 21. Cumulative USA exposure exceeding a period of 6 months in a year 22. Trailer(s) that are not used and/or garaged in the province of Ontario 23. Trailers or camper units permanently located in a trailer park 24. A trailer or camper unit used for residential purposes (other than standard use for vacation) 25.
