1 REQUEST FOR PROPOSAL (RFP) RECYCLING & DISPOSAL OF WHITE GOODS Issued: August 13, 2018 Due: 10 a.m., September 3, 2018 I. INTRODUCTION Metro Waste Authority (MWA) is seeking proposals from experienced, responsible and qualified companies to provide loading, transport, processing, and recovery/disposal services of white goods managed by MWA at the Metro Park East Landfill (MPE), Metro Park West Landfill (MPW), Metro Hazardous Waste Drop-Off (MHWD) and other possible future locations. Metro Park East Landfill Hours: M-F 6:30 a.m. to 4:30 p.m NE University Avenue Saturday 8 a.m. to 1 p.m. Mitchellville, Iowa Metro Park West Landfill Hours: M-F 8 a.m. to 4 p.m th Street Saturday 9 a.m. to Noon. Perry, Iowa Metro Hazardous Waste Drop-Off Hours: T-F 8 a.m. to 5 p.m Prairie Drive SW 1 st & 3 rd Sat. 8 a.m. to Noon. Bondurant, Iowa MWA is also accepting optional bids for the recycling & disposal of scrap metal and batteries at these facilities. This option is not required and the details and scope of the services related to these materials are at the discretion of the bidder. II. PROJECT DESCRIPTION The intent of this program is to provide for the safe removal, management/processing, and recovery/disposal of hazardous and non-hazardous materials from white goods collected regularly by MPE and MPW landfills, MHWD facility and possible future locations. 2 White Goods Definition White goods as described under this proposal may include, but not be limited to refrigerators; freezers; air conditioners; dehumidifiers; clothes washers and dryers; conventional and microwave ovens; ranges and stoves; dishwashers; hot water heater; residential furnaces; garbage disposals; trash compactors; heat pumps; humidifiers; fluorescent light fixtures (excluding bulbs); PCB containing ballasts and capacitors; and commercial and research equipment as designated by MPE, MPW, and MHWD. Exotic commercial/research equipment will be identified and marked appropriately. Generation Estimate Below is a chart showing historical information for white goods collected from previous years at Metro Park East Landfill, Metro Park West Landfill, and Metro Hazardous Waste Drop-Off: Annual Count by Calendar Year Locations MPE 4,380 3,495 2,886 2,442 2,420 MPW MHWD *MHWD did not accept white goods until 2014, therefore there is no data available until that year. MWA provides this data as historic activity only. MWA does not guarantee any minimum or maximum quantities to be available. MWA does not guarantee the condition of the appliances collected. White goods will be kept separate at both the MPE and MPW landfills (or other MWA designated location) in the appliance drop-off area, and in the warehouse at MHWD. The Contractor shall leave all collection areas free and clean of all white goods. Frequency of Collection The Contractor shall collect all white goods from the MPE landfill once a week, from the MHWD every two weeks (or within three working days of a request by MWA), and within three working days of a request by MWA at the MPW. 3 III. VARIATIONS IN FACILITY HOURS AND SCHEDULE Inclement Weather Collection service will be suspended due to inclement weather only upon order of MWA. MWA will notify contractor(s) of any directives regarding delay, modification, or suspension of service as soon as a decision is made. If collection is suspended, Contractor shall, as directed, perform collection on the next regular collection day. MWA will notify the media of any suspension of service and it is also posted on the MWA website: Holidays Holidays shall correspond with nationally recognized schedules. It shall be the Contractor s responsibility to determine and comply with established municipal holiday and holiday closure dates. Holiday hours are listed on the website at IV. SCOPE OF WORK Service Requirements 1. The contractor shall provide any and all equipment, labor, materials and supervision necessary to properly collect, process, transport, recycle and/or dispose of white goods as defined in Section I from the MPE, MPW and MHWD sites. Bidders may submit proposals in which the bidder will provide the service of loading white goods onto the bidder s vehicle, OR may submit proposals in which Metro Waste Authority staff will load white goods onto the bidder s vehicle, OR the bidder may provide two proposals, one for each of the options. 2. At the sole discretion of MWA, the contractor shall provide on-site or off-site processing. 3. The contractor shall provide all services in accordance with the technical and regulatory requirements and reporting and record keeping requirements of Section III. 4. The contractor shall provide all on-site services during the normal operating hours of each facility. The current operating hours are described in Section I. These hours may be changed by MWA without prior notice to the contractor. 5. The contractor shall ensure that the white goods area at each facility will be kept clean and free of debris after every loading and processing event. RFP for White Goods Page 3
4 6. The contractor shall collect all white goods within three (3) working days following contact by phone or from MWA staff. 7. The contractor shall become the owner and generator of the white goods and related materials and waste, once they are loaded into the contractor s collection vehicle. 8. All polychlorinated biphenyl (PCB) containing material equal to or greater than fifty parts per million will be incinerated in a TSCA approved TSDF. Technical and Regulatory Requirements The contractor will remove and recycle, destroy, or properly dispose of polychlorinated biphenyls (PCBs); chloro-fluorocarbon (CFC)/Freon refrigerant gases; free mercury and Mercury switch devices; sulfur dioxide and ammonia refrigerant gases. The contractor will recycle or reuse the scrap metal from white goods collected. The Contractor is expected to comply with national, city and county ordinances, all applicable hours of operation, etc. The Contractor shall be responsible for obtaining all licenses and permits required to provide collection service within each municipality Polk County, Dallas County, Greene County and Jefferson County. 1. The contractor shall comply with all provisions defined in Chapter of the Iowa Administrative Code (IAC) relative to the removal and disposal of polychlorinated biphenyl s (PCBs) from white goods received from MWA for disposal, processing and recycling. a) All white goods shall be inspected in accordance with Subrule 118.3(2) IAC for the presence of capacitors by the contractor s authorized representative and the capacitors and PCBs removed before they are disposed of or processed b) Any party that processes or disposes of white goods shall be registered in accordance with Subrule 118.3(1) IAC and IAC. Processing includes crushing, compacting, smashing and shredding. Registration requirements do not apply to preprocessing storage at MWA sites. c) The contractor shall assure that salvage dealers or processing operators removing white goods from MWA for processing are registered in accordance with Subrule 118.3(1) (IAC). d) The disposal of PCS capacitors shall be handled in accordance with Subrule e) All capacitor and PCB inspection, removal, storage, and management activities shall be conducted in strict compliance with all applicable and current EPA regulations specified in 40 CFR, Part 761. Under no circumstances shall white goods be disposed, processed, or baled without the PCBs and PCB containing items being first removed. RFP for White Goods Page 4
5 2. The contractor shall comply with all applicable and current EPA regulations specified in 40 CFR, Part 82, relative to white goods refrigerant recycling and emissions control, and 40 CFR, Part 273, relative to free mercury and mercury switch devices removal. a) Under no circumstances shall white goods be disposed, processed, or baled without refrigerants and all free mercury and mercury switch devices being first removed and recovered. b) All mercury and mercury switch devices shall be managed as hazardous wastes in accordance with EPA regulations. 3. The contractor shall comply with all applicable and current EPA regulations specified in 40 CFR, Parts and Iowa Department of Transportation regulations found in 49 CFR, Parts , relative to the handling and transport of the materials being managed. Each vehicle used for the collection of white goods must have current valid vehicle registration affixed and be in compliance with all Iowa Department of Transportation vehicle requirements at all times. 4. The contractor shall comply with any and all legal and technical requirements regarding the services being provided. 5. The contractor shall comply with Metro Waste Authority s sanitary landfill permits, see Attachment C. Insurance Requirements The contractor must obtain and maintain at their sole expense the following insurance: 1. Liability insurance for all trucks and motor vehicles used in the performance of such services in at least the following amounts: $1,000,000 for injury to any one person; $1,000,000 for property damage; total of $2,000,000 for any one occurrence. 2. Commercial General Liability insurance of $1,000,000 per occurrence for bodily injury and property damage; with a $2,000,000 Aggregate. 3. Commercial Auto Liability insurance with a combined single limit of $1,000,000 per occurrence for bodily injury and property damage. 4. Environmental Impairment Liability insurance including transportation related pollution events in at least the following amounts: $1,000,000 per incident, $2,000,000 aggregate as applicable. 5. MCS90 endorsement for hazardous waste materials transport in the amount of $5,000,000. Applies to the contractor only if transporting hazardous materials removed from the white goods. The contractor must provide proof of subcontractor s insurance if the transport of hazardous materials is subcontracted. 6. Worker s Compensation insurance which covers all persons employed by the contractor in connection with the services described in this RFP in the amount required by the State of Iowa. 6 7. Commercial Umbrella Coverage with a limit of no less than $5,000,000 per occurrence and in the aggregate. 8. Metro Waste Authority and its officers and employees shall be included as additional insured and Contractor shall waive its right to subrogation of any claims related to this agreement to MWA. The insurance shall not be deemed to waive any of the defenses of governmental immunity available to the MWA under Code of Iowa Section as it exists now and may be amended. The insurance shall not cover any claims subject to the defense of governmental immunity under the Code of Iowa Section as it exists now and may be amended. Performance, Payment, and Other Bonds A. Contractor shall furnish a Performance Bond, in the amount of $10,000 as security for the faithful performance and payment of all contractors obligations under the Contract Documents. These Bond(s) shall remain in effect at least until one year after the date when final payment becomes due, except as provided by Laws or Regulation or the Contract Documents. All Bonds signed by an agent must be accompanied by a certified copy of such agent s authority to act. B. If the surety on any Bond furnished by the contractor is declared as bankrupt or becomes insolvent or its right to do business is terminated in any state where any part of the Project is located or it ceases to meet the requirements of paragraph A (above, contractor shall within ten days thereafter substitute another Bond and surety, both of which must be acceptable to MWA. C. All Bonds and insurance required by the Contract Documents to be purchased and maintained by contractor shall be obtained from surety or insurance companies that are duly licensed or authorized in the jurisdiction in which the Project is located to issue. D. Or insurance policies for the limits and coverage requirements and qualifications as may be provided. Annual Reporting and Record Keeping Requirements The contractor must submit quarterly reports to MWA identifying the following, separated by MWA facility for all white goods processed: a) Total weight of white goods removed. b) Number of appliances, by type, of appliances processed. Contractor will utilize the following categorizing criteria: refrigerators/freezers; air conditioners; dehumidifiers; clothes washers and dryers; microwave ovens; ranges and stoves; dishwashers; water heaters; furnaces; fluorescent light RFP for White Goods Page 6
7 fixtures (excluding bulbs); miscellaneous. c) Pounds and numbers of PCB units and other hazardous wastes removed. d) Pounds of free mercury and the number of mercury switch devices removed. e) The end use or disposal destination for all hazardous materials. f) The Certificate(s) of Recycling or the Certificate(s) of Destruction received in the preceding quarter. g) An updated list of acceptable disposal facilities being utilized and definitions of all waste classification and disposal methods. h) Contractor shall assist MWA in determining the source of inconsistencies between such report and MWA records. Contractor shall provide timely copies of any and all records to MWA upon request by MWA. i) Pounds of CFCs/freon and other refrigerants recovered by type. All proposed services and facilities are subject to inspection, approval, and acceptance by MWA, both during the procurement process and after the execution of a contract with the successful proposer. MWA will give reasonable notice of such inspections. Proposers will not be responsible for normal MWA inspection costs. V. TERM OF AGREEMENT The Initial term of the contract will be two (2) years, with the option for a one (1) year extension at the discretion of MWA. Such renewal will be negotiated upon terms mutually agreeable to MWA and the Contractor. The right of MWA to extend the term as set forth above does not constitute or imply any obligation to do so. 9 Selection Criteria Selection of a contractor will be based upon the following information: The qualifications and experience of the company. The ability to provide services in a timely manner. Proven track record in providing proper documentation with clients. Suitability of equipment and personnel to meet the loading, transport, processing, and recovery/disposal needs. Possession of proper registrations, insurance certifications, licenses and permits. Adherence to applicable state and federal regulations. Recent three year history must show compliance. The cost or value of the contract services. The conciseness and accuracy of the proposal. MWA reserves the right to reject any bid if they determine, in their sole and absolute discretion, that the bidder is not properly qualified. MWA reserves the right to accept the bid which in their sole and absolute judgment is the most responsible and best bid or to reject any and all bids and alternatives and to waive or disregard irregularities or informalities in any bid as they may deem in their best interest. The evaluation process is designed to select a Proposer to negotiate a contract for the loading, transport, processing and recovery/disposal of white goods. The selected Proposer will have submitted the proposal that is in the best interest of the project and MWA. If a proposal does not satisfy the minimum requirements as set forth in the RFP, the proposal may be disqualified from further consideration at the discretion of MWA. Each proposal will be reviewed by an evaluation team and graded relative to other proposals on the basis of the pre-selected evaluation criteria previously presented. Proposers may be contacted during this process to clarify items in their proposals. The evaluation team will weigh the selection criteria on the basis of the needs of the project and in the best interest of MWA. Terms and conditions of a contract must be mutually agreed upon following evaluation, site visit, and selection. Failure of the parties to reach agreement may result in no award to the selected proposer. RFP for White Goods Page 9
