STANDARD TERMS. Information on how to enter forms part of the terms of entry. 2. WHO CAN ENTER? 2. Subject to clause 2.2, entry is open to all residents of Australia 8 years of age or older in New South Wales, Queensland, South Australia, Tasmania, Victoria, Western Australia and the Northern Territory where the Channel Seven and its affiliated networks ( Affiliates ) signals are received. The competition is not open to residents of the ACT. 2.2 Employees and their immediate families of Seven Network (Operations) Limited, Stage and Screen Travel Services, Flight Centre Travel Group Limited, Mnet Mobile Pty Ltd, and their associated agencies and companies are not eligible to enter. 3. HOW TO ENTER 3. The Competition commences on Monday 4 September 205 at 9:00 (AEST) and concludes on Monday 2 September 205 at 23:59 (AEST) ( the Competition Period ). 3.2 For entry details, viewers must watch Home and Away ( the Program ) on the Seven Network ( the Network ) and Affiliates during the Competition Period. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken. 4.3 In accepting the prize, each winner and their nominated travel companion(s) agree to participate in and cooperate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use. 4.4 The prize winners and their nominated travel companions agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation. 4.5 It is a condition of accepting the prize that the prize winners and their nominated travel companion(s) must comply with all the conditions of use of the prize as well as the Promoter s and the Supplier s requirements. 4.6 s cannot be redeemed for cash and are not transferable or exchangeable to another person. The travel companion nominated by the prize winners (as outlined in clause 5.), once nominated is not transferable. 4.7 The prize winners and their nominated travel companions must be residents of Australia and must be 8 years of age or older (unless the Promoter consents at the Promoters absolute discretion) and may need to provide valid identification to the Promoter. 4.8 The prize winners and their travel companions must commence and complete their travel by 3 March 206 and no compensation will be payable if a winner is unable to use the prize as stated. If the prize is not utilised by 3 March 206 it will be forfeited. In addition, the prize must be booked and confirmed within 90 days from prize telephone confirmation with the Promoter. Blackout periods may apply and is at the discretion of the Promoter. 4.9 The prize winners and their traveling companion(s) must travel on the same flight, at the same time, must depart from the winner s nearest capital city and are responsible for transport from their residence to their nearest capital city airport (Adelaide, Brisbane, Melbourne, Perth, Sydney, Hobart, Darwin). There can be no changes made to travel arrangements once itineraries or tickets are issued, including no name changes. The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the connecting flight(s) booked by the winner, either to or from the nominated capital city and their residence. All booking and costs related to obtaining, amending or otherwise concerning the connecting flight(s) to/from their residence and the nominated capital city are the responsibility of the winner. 4.0 Any changes made to the booking by the prize winners or their travel companion(s), including extending the trip, are at the winner s expense and must be arranged by the winner. 4. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the prize winners and their travel companion(s). Subject to the prize stipulated in clause 4.2, prize winners and their travel companion(s) are responsible for all expenses including but not limited to meals, drinks, incidentals, mini-bar, in-room video, laundry, room service, telephone calls, activities, insurance, energy surcharges, gratuities, services charges, passports and all other ancillary costs. A credit card imprint or cash deposit may be required from the prize winners at check-in to the accommodation detailed for all incidental charges. 4 4.2 The prize winners and their travel companions are responsible for obtaining and paying for all relevant passports, visas and other necessary travel documentation required to travel to the destination stipulated in the prize. 4.3 Each prize package must be taken as stated and no compensation will be payable if the winner is unable to use the prize or any element of the prize as stated. 4.4 Travel insurance is not included in the cost of the prize and is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. 4.5 It is a condition in accepting the Draw DUBAI, UAE prize package detailed in clause 4.2, the winner abides by the following terms: b) Travel restrictions and blackout dates apply during Christmas & New Year (December 2, 205 to January 4, 206), Australia Day (23 January 206 to 28 January 206), and Chinese Near Year (3 January February, 206) unless explicitly approved by the Sponsor and Promoter. Embargo restrictions apply during these periods. c) cannot be taken during UAE peak periods unless explicitly approved by the Sponsor and Promoter. d) Flight and Accommodation bookings are subject to conditions and availability (including but not limited to capacity limitations and other restrictions). 4.6 It is a condition in accepting the Draw 2 London, UK prize package detailed in clause 4.2, the winner abides by the following terms: b) Travel restrictions and blackout dates apply during Christmas & New Year (December 2, 205 to January 4, 206), Australia Day (23 January 206 to 28 January 206), and Chinese Near Year (3 January February, 206) unless explicitly approved by the Sponsor and Promoter. Embargo restrictions apply during these periods. c) cannot be taken during UK peak periods unless explicitly approved by the Sponsor and Promoter. d) Flight and Accommodation bookings are subject to conditions and availability (including but not limited to capacity limitations and other restrictions). 4.7 It is a condition in accepting the Draw 3 New York, USA prize package detailed in clause 4.2, the winner abides by the following terms: b) Travel restrictions and blackout dates apply during Christmas & New Year (December 2, 205 to January 4, 206), Australia Day (23 January 206 to 28 January 206), and Chinese Near Year (3 January February, 206) unless explicitly approved by the Sponsor and Promoter. Embargo restrictions apply during these periods. c) cannot be taken during USA peak periods unless explicitly approved by the Sponsor and Promoter. d) Flight and Accommodation bookings are subject to conditions and availability (including but not limited to capacity limitations and other restrictions). e) It is the responsibility of the winner and their travel companion to obtain ESTA travel authorisation for travel to the USA. 4.8 It is a condition in accepting the Draw 4 Niagara Falls, CANADA prize package prize package detailed in clause 4.2, the winner abides by the following terms: b) Travel restrictions and blackout dates apply during Christmas & New Year (December 2, 205 to January 4, 206), Australia Day (23 January 206 to 28 January 206), and Chinese Near Year (3 January February, 206) unless explicitly approved by the Sponsor and Promoter. 5 e) It is the responsibility of the winner and their travel companion to obtain ESTA travel authorisation for travel to the USA as the winner and their companion will fly in to the USA prior to travelling to Niagara Falls, Canada. 4.9 It is a condition in accepting the Draw 5 Cancun, MEXICO prize package detailed in clause 4.2, the winner abides by the following terms: b) Travel restrictions and blackout dates apply during Christmas & New Year (December 2, 205 to January 4, 206), Australia Day (23 January 206 to 28 January 206), and Chinese Near Year (3 January February, 206) unless explicitly approved by the Sponsor and Promoter. Embargo restrictions apply during these periods. c) cannot be taken during Mexican peak periods unless explicitly approved by the Sponsor and Promoter. d) Flight and Accommodation bookings are subject to conditions and availability (including but not limited to capacity limitations and other restrictions) The Promoter may require the prize winners and their nominated travel companions to sign a waiver of liability and indemnity in the form determined by the Promoter in its absolute discretion. 4.2 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation The Promoter reserves the right to request winners to sign a winner s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered The Promoter reserves the right to redraw in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions The Promoter s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel prize or be suited to the type of travel prize that is offered Compliance with local health and government requirements is the responsibility of the prize winner and their nominated traveling companion Full details of prizes can be obtained by telephone the Seven Network in each state on Sydney ; Melbourne ; Adelaide ; Brisbane ; Perth HOW TO WIN 5. There will be five (5) prize winners drawn in total from the national pool of 902 and SMS entrants. The first valid entry drawn from this pool for each draw will be deemed the relevant prize winner and will each receive the prize detailed in Clause 4.2. Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period by either using their smartphone, a mobile phone with a reply path and whose SMS message has passed through the Telco carriers network to Mnet Mobile Pty Ltd database or phoned the 902 number registered all details required by the relevant Competition Registration Period closing date detailed in clause 3.4 ( Qualifying Entrant ) will be entered into the corresponding draw detailed in clause 3.4. Entries that do not comply with any of the terms and conditions, may be deemed invalid and a further draw will be conducted in its place. The draws will take place at Mnet Mobile Pty Ltd, Level, 6 Anster Street, Adelaide, South Australia 5000 on the dates and times specified in clause The winners will be notified by a phone call on the day of the draw. Upon verbal confirmation of the prize with the relevant winner, a letter will also be express posted. The winners entry details will be published in the Public Notes section of The Australian newspaper on Monday 28 September The name of the winner of each prize draw will appear on Sunrise the same day as the draw. 6 5.4 The Promoter s decision is final and the Promoter will not enter into correspondence regarding the result. 5.5 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted. 5.6 It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 5.7 Subject to state government legislation an unclaimed prize draw will take place at Mnet Mobile Pty Ltd, Level, 6 Anster Street, Adelaide, South Australia 5000 on Tuesday 22 December 205 at 0:00 AEDT and winner(s) will be notified by mail and their details published in the Public Notes section of The Australian newspaper on Monday 28 December 205 if required. 6. NO LIABILITY 6. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation. 6.2 Seven Network (Operations) Limited, Stage and Screen Travel Services and Mnet Mobile Pty Ltd, and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.3 Seven Network (Operations) Limited, Mnet Mobile Pty Ltd, and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur: a) during the entry process or the draw; b) in the participation, acceptance or use of any element(s) of the prize; c) as a consequence of late, lost or misdirected mail; d) due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person; e) in relation to failure of an SMS entry message to be received or sent by the Promoter on account of technical problems or traffic congestion; or f) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion. 6.4 Seven Network (Operations) Limited assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation. 6.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation. 7. Mnet Mobile Pty Ltd (in respect of SMS and 902 entries) on behalf of Seven Network (Operations) Limited (ABN ) and its related entities ( Seven ), is collecting your personal information for the purpose of conducting and promoting this Competition, including for the purpose of identifying and notifying winners and understanding our audiences. Seven will otherwise handle your personal information in accordance with Seven s Privacy Policy which is available on our website at (and which contains information regarding how you can access your personal information, correct it and/ or make a complaint about our handling of your personal information). By providing your personal information below, you agree to the terms of the Privacy Policy.
