1 Smart Meter Bingo Long Terms and Conditions These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions and by participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. Who may enter: This promotion ("Promotion") is open to UK residents (England, Scotland, Wales and Northern Ireland) aged 18 years or over. Employees and their immediate families of the Promoter, AMVBBDO and all fulfilment service agencies professionally associated with Promotion are excluded. 2. How to enter: The promotional period starts at 12:55 23/10/2018 and ends at 13:02 27/11/2018 (UK time) ("the Promotional Period"). 3. No purchase or payment to enter is necessary. 4. Internet access, a phone number and a valid address are required. 5. To enter: visit request an on-line bingo card at the specified date/time and play along during the Bingo draw show (as per Bingo Schedule below). Bingo cards contain three monetary values created via a secure, random computer programme. If the entrant s Bingo Card matches the monetary values announced during the Bingo Show it is automatically submitted for verification and the first one received is allocated a prize. Values relate to the amount of energy consumed, in pence, during a series of experiments. Entries are not rolled over to subsequent draws and, if unsuccessful, entrants are required to enter again by requesting a new Bingo card according to the Bingo Schedule for another chance to win. 6. PRIZE DETAIL: Online Instant Win: 6 (six) prizes are available to be won during the Promotional Period. The prize allocated will depend on whether the entrant already owns or has placed an official request for a smart meter. Tier 1 prize Winners who own or who have requested a smart meter for their permanent residential address. Tier 2 prize Winners who do not own and/or have not requested a smart meter. 3 1. Luxury condiments - 6 (six) deliveries over 12 (twelve) months of a selection of condiments from John Lewis (up to the value of 50 per delivery). Includes bi-monthly delivery to UK mainland address. value will be provided if winner lives out of the deliverable area 2. Dry cleaning of dry cleaning at the prize winner s nominated local Johnson Cleaners. Prize equivalent to 50 per month for twelve (12) months. Prize will be delivered in the form of a 600 account at the winners local Johnson Cleaners shop. T&Cs: If winner does not have a local Johnson Cleaners shop an alternative of equivalent value will be provided. 3. Fruit box twelve (12) large Fresh & Fruity Fruit Boxes from Abel & Cole delivered once a month for twelve (12) months. Five seasonal fruits per box. Posh bread 52 (fifty-two) week delivery to the winner s nominated address of one (1) organic loaf of bread of winner s choice every week. Choice of sourdough, rye bread, mixed seed, white bloomer, or wholegrain loaf AND twelve (12) months Bake Your Own Bread Kit subscription providing a monthly new bread recipe and all the dry ingredients to create it. Includes delivery to a UK mainland address. T&Cs: Organic loaf: Once selected the same loaf will be delivered throughout the year. Supplier delivery exclusions apply. 4 7. First delivery of Tier 1 prizes will be within 28 calendar days of win validation and providing valid UK delivery address. Delivery of Tier 2 prizes will be by 2 nd class Royal Mail delivery within 28 days of win notification and providing valid UK delivery address. 8. Winner details and eligibility will be verified prior to prize dispatch as detailed in clause WINNER SELECTION AND NOTIFICATION: 1 x winner per weekly bingo draw. The winner will be the entrant whose 3 (three) Bingo Card monetary values matches the monetary values announced in the weekly show. Completed cards are automatically submitted to the Promoter s security server. The first one received will be awarded the Prize. Winners will be notified on screen if they are a winner. 10. Winners will be required to state if they own or have requested a smart meter, their address and a contact telephone number. Upon provision of a valid address they will then receive an confirmation of their win. Winner details and eligibility will be verified prior to prize dispatch as detailed in clause Although all prizes will be available to be won, there is no guarantee that they all will be won or claimed. Any unallocated prizes will not be reallocated in other draws. 12. The Promoter (or their nominated agent) will attempt to contact winners at least 3 (three) times using the address and/or the telephone number provided. The winners will have 10 (ten) calendar days from initial contact to respond and provide details to enable validation and prize fulfilment. In the case that they do not respond in time or are unable to take up the prize, the Promoter reserves the right to withdraw the prize. 13. HOW TO CLAIM: The Promoter reserves the right to validate winning entries and allocate prizes based on whether the winners have a smart meter or have requested a smart meter from their energy supplier. This verification process may include, but is not limited to, one or more of the following at the discretion of the Promoter: a. Photo of their Smart Meter b. Photo of their In-Home Display 3

5 c. Evidence of registration (letter, text, , screengrab of website could be screen shot, scan or photo) d. Screenshot of online account which outlines that they have a smart meter or have an installation booked. 14. Once verification checks in accordance with these Terms & Conditions have been completed, the winners will receive their prize within 28 (twenty-eight) days of the verification being confirmed and providing a valid UK delivery address. 15. All prizes will be dispatched in line with the supplier s delivery terms which will be provided at time of win notification. The Promoter accepts no responsibility for uncollected prizes. 16. It is the prize winner s responsibility to ensure they check their accounts spam or junk folder to ensure a message from the Promoter regarding their win or their prize was not filtered or deleted. The Promoter accepts no responsibility for failed delivery due to provision of incorrect contact details by entrants. Any prize that is returned undelivered will be assumed unwanted. 17. Prizes are not transferable or exchangeable unless otherwise stated and cannot be redeemed for cash or any other form of compensation. 18. Liability The Promoter is not liable for entrants who are unable to view or participate in the promotion due to telecommunication or internet faults or failure or delays with network incompatibility. 19. Decisions of the Promoter are final in all matters relating to the promotion. No correspondence will be entered into. 20. A list of the major prize winners (first initial, surname and county) will be available by sending a SAE to Smart Energy GB, 1 Alfred Mews, London, W1T 7AA at the end of the promotion, for a period of two months following the end of the Promotion. 21. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete entries, by or via third parties or syndicates, entries by macros or other automated means (including systems which can be programmed to enter), and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of 'script', 'brute force', masking their identity by manipulating IP addresses, using identities other than their own or any other automated 4

6 means in order to increase that participant's entries into the draw in a way that is not consistent with the spirit of the promotion, that person's entries will be disqualified, and any prize award will be void. 22. If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the promotion, choice of prize winner(s) or any entry) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity. 23. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries/claims. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation. 24. Except for liability for fraudulent misrepresentation, the Promoter is not liable for: Any action an entrant may take as a result of replying on any information provided by the Promoter in relation to the promotion or for any loss or damage suffered by an entrant as a result of taking that action; Any liability for losses which are not a foreseeable or likely consequence of: (i) an entrant's use of the website; or (ii) a breach of these terms & conditions. 25. However, nothing in these Terms and Conditions will affect any liability the Promoter may have for death or personal injury arising from the Promoter's negligence or any other liability that cannot be limited or excluded by law. 26. Personal data supplied will be used by the Promoter for the sole purpose of managing the competition. Data will be stored by the Promoter for 2 (two) months after the end of the promotion before deletion with the exception of the winners whose details will be stored for 12 (twelve) months in order to fulfil their prize. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect. 28. No relaxation or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as waiver of that right or remedy or shall affect our ability to subsequently exercise that right or remedy. Any waiver must be agreed by us in writing. 29. Any questions concerning the legal interpretation of these terms will be based on English law and the courts of England and Wales will have exclusive jurisdiction unless you live in another part of the UK, in which case your local courts will have jurisdiction. 6
