3 NO PAYMENT IS REQUIRED WITH YOUR INITIAL VENDOR APPLICATION. Within a week of submitting your application below, we will notify you if it s has been accepted. If accepted, your payment will be due within 7 days to lock in your spot. Checks or money orders are accepted and are to be made payable to: KDI RiverGate Mall, LLC - P.O. Box Atlanta, GA A $30 fee will be charged for returned checks. Location & Arrival Times Each vendor will receive booth location and a schedule for arrival by September 8. Location and Placement of each vendor will be determined at the sole and absolute discretion of the host.

4 Rules and Regulations: I will be open and present at my booth during all advertised hours of Oktoberfest. I agree to follow all rules and regulations set forth by Oktoberfest staff and understand that failure to do so can result in immediate expulsion without refund. I will have no pets, illegal substances or weapons on my person or in my booth during the festival. I also understand and agree that Oktoberfest at RiverGate Mall reserves the absolute right to accept or reject any vendor application for any reason. I am responsible for providing my own equipment, including heavy-duty electrical extension cords, duct tape, clamp lights, kitty litter or similar product (in case of damp ground), and any other supplies. (1 8 ft. Table and 2 Chairs will be provided) I understand that Cancellations more than 60 days before event will result in a 50 Percent Refund Less than 60 days before event No refund. 5 RELEASE OF LIABILITY RiverGate Mall and KDI RiverGate Mall LLC I, the undersigned, desire to voluntarily participate in the following mall use/event/activity: Oktoberfest at RiverGate Mall and/or other related uses/events/activities ( Activities ) at RiverGate Mall on September 22 & 23, I represent that I am familiar with the Activities and the risk of personal injury to myself and/or others and property damage which may result from the Activities. Notwithstanding these risks, I wish to assume them by voluntarily participating in the Activities. I understand and agree that RiverGate Mall and KDI RiverGate Mall LLC, Hendon Properties LLC, and Hendon Property Management LLC, and their respective affiliated companies, and the respective employees, agents, officers and directors of the foregoing companies (collectively, the KDI RiverGate Mall LLC Parties ) shall not be liable for any injuries, property damage or other claims that may result from my participation in the Activities. In consideration of the KDI RiverGate Mall LLC parties providing the opportunity to participate in the Activities, the receipt and sufficiency of such consideration being hereby acknowledged, I HEREBY WAIVE, RELEASE, AND DISCHARGE, AND AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE KDI RIVERGATE MALL LLC PARTIES FROM, ANY AND ALL LIABILITY, CLAIMS AND EXPENSES, WHETHER FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITIES.
