2 WAIVER OF LIABILITY Important: Each volunteer must read and sign the Release and Waiver of Liability before volunteering on a Habitat for Humanity of San Antonio site. Please complete this form and hand it in to a Habitat for Humanity of San Antonio staff member before you volunteer. This Waiver of Liability (the Waiver ) executed on this day of, 20, by (the Volunteer ) in favor of HABITAT FOR HUMANITY OF SAN ANTONIO, INC., a nonprofit corporation organized and existing under the laws of the State of Texas, USA, and a partner with Habitat for Humanity International, Inc. in Americus, GA, and both of their directors, officers, employees, and agents (collectively, Habitat ). I, the Volunteer, desire to work as a volunteer for Habitat for Humanity of San Antonio and engage in the activities related to being a volunteer for a work project. I hereby freely and voluntarily, without duress, execute this Waiver under the following terms: 1. Waiver and Release. I, the Volunteer, release and forever discharge and hold harmless Habitat and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work with Habitat. I understand and acknowledge that this Waiver discharges Habitat from any liability or claim that I, the Volunteer, may have against Habitat with respect to bodily injury, personal injury, illness, death, or property damage that may result from my participation on the Habitat work site. I also understand that Habitat does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage. 2. Insurance. I, the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of Habitat beyond what may be offered freely by the representative of Habitat in the event of such injury or medical expense. 3. Medical Treatment. I hereby release and forever discharge Habitat from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time with Habitat. 4. Assumption of the Risk. I understand that my time with Habitat may include activities that may be hazardous to me, including, but not limited to, construction activities, loading and unloading of heavy equipment and materials, and local transportation to and from the work sites. I hereby expressly and specifically assume the risk of injury or harm in these activities and release Habitat from all liability for injury, illness, death, or property damage resulting from the activities of my time with Habitat. 5. Photographic Release. I grant and convey unto Habitat all right, title, and interest in any and all photographic images and video or audio recordings made by Habitat during my work for Habitat, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings. 6. Other. I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of Texas in the United States of America, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of Texas. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. Waiver of Liability for Minors (ages 14-17) This release and Waiver of Liability (the Release ) executed on this day of, 20, by the minor volunteer and his/her legal guardian in favor of HABITAT FOR HUMANITY OF SAN ANTONIO, INC., a nonprofit corporation organized and existing under the laws of the State of Texas, USA and a partner with Habitat for Humanity International, Inc. in Americus, GA and both of their directors, officers, employees, and agents (collectively, Habitat ). The Minor, desires to work as a volunteer for Habitat for Humanity and engage in the activities related to being a volunteer for a work project. I, the legal guardian, hereby freely and voluntarily, without duress, execute this Release under the following terms: 1. Waiver and Release. 5 Typical Construction Day Sign In starts at 7:30 AM. Volunteers must sign-in each day they volunteer, and complete a waiver of liability each year (volunteers under age 18 need a guardian s signature and must be accompanied by an adult the entire day). Volunteers will be introduced to their house leader, who will provide direction for the day. Safety Briefing begins at 7:45 AM. Safety is more important than the speed of production, and construction work can be hazardous! Since HFHSA crews normally have a high percentage of inexperienced workers, safety is of particular concern. Your house leader will brief you on safety issues that might arise. No one under the age of 14 is allowed on site. Lunch Clean up Please wear Please bring Media Personal Valuables Security Animals/Pets will be provided for all volunteers on Fridays and Saturdays. Lunches are donated -- individuals with special dietary needs should bring their own lunches. is at 3:00 PM (sometimes earlier). Please plan to stay the whole day. The workday will end after the site is clean and tools have been put away. comfortable clothes appropriate for the work and weather. Wear items that can get stained, ripped, muddy, paint-spackled, etc. You must wear closedtoed shoes - do not wear flip flops, backless shoes or Crocs. For safety, do not wear loose, oversized clothing or dangling jewelry. Summer months can be extremely hot and it can get very cold on site in the winter. Dress appropriately. a water bottle (iced water provided on site), hat and sunscreen. in San Antonio are always welcome to cover HFHSA events. If you see media on the site by themselves instantly alert a Habitat staff member. will not be safe on the work site. We accept no responsibility for lost or stolen items. We highly recommend that you do not bring items that you consider valuable to our work sites. We will provide all the tools and materials you will need to participate. must be maintained on the work site. Concealed weapons, drugs, or alcoholic beverages of any kind are absolutely not permitted on an HFHSA work site. Violators will be asked to leave. are not allowed on the work site.
