1 LUMMI NATION, WASHINGTON Lummi Planning Department Request for Qualifications /Proposal For Design and Construction of the Youth Wellness Skate Park July 2013 The Lummi Indian Planning Department is accepting Design-Build Proposals from qualified Skate Park Design and Construction Professionals for the needed improvements at the Lummi Nation East Campus. Proposals submitted are due to Lummi Indian Planning Office prior to 1:00p.m. on August I. Background The Lummi Nation Youth Wellness Program is an important Resource that is authorizing the construction of a Youth Skate Park as part of a larger plan for the Youth Wellness Complex. The goal is to provide a healthy safe and adventurous activity addition for the Lummi Youth and Youth Wellness Program. II. Scope of Services: Lummi will provide survey and topographical for the entire site related to the project for determination of proper drainage specifications. Provide Construction Survey. Provide a SWPPP for the project. Provide all necessary Design Documents and Plans leading to necessary drainage improvements and Complete Skate Park Construction. Provide Contract Administration Communicate and Coordinate with third party Testing during Investigation and Construction (Lummi will provide) Include fee for Potholing. ( Possible potholing for Storm Water and Power location (see Map) Provide a detailed Construction Cost Estimate along with proposal. Provide all Construction, labor and materials necessary for the determined Skate Park Completion.

2 Provide Shotcrete or Concrete type of construction not less than 4000 psi. The general contractor will be responsible for supplying the aggregate base under all concrete skate surfaces and that all compaction requirements are met per the standards and specifications. Shop drawings reinforcing steel and miscellaneous metals will be required to be submitted for review prior to order and placement. Contractor shall submit for approval design documents at intervals of schematic design, design development and 70% Construction docs and a final review and comment at 95%. Submittals of concrete mix designs and placement plan for all concrete will be required. The Contractor will be responsible for the supply and installation of all concrete and miscellaneous metals noted on the skate board plans and design. Concrete finish and smoothness is of the utmost importance. All expansion joints, concrete cuts shall be placed in a manner as to not interfere with the smoothness and riding surface. Contractor shall warrant that any and all defects, imperfections and any sub standard construction work will be covered under a one year warranty. Shall Provide a Product that complies with Nationally Accredited and Accepted Safety Standards and Construction Standards for Skate Parks Fed, State, Local governments or Private Organizations associated with any and all Design and Construction for this Project. Provide Necessary Value Engineering in order to make the project viable Provide as-builds in plan form and electronically on a thumb drive ( Lummi Nation will own all Plan and Designs of all LIBC structures and Facilities Provide the number of Calendar Days needed for your Design and construction in your submitted Proposal General Contractor and all of his Subcontracts are subject to Lummi Nation TERO regulations. All Permitting will be handled by Lummi Planning. Contractor shall comply with all laws, ordinances, rules and regulations federal, state and local and OSHA authorities and departments affecting the work. Vender is responsible for removing and the legal disposal of all construction debris from the site at the contractors cost. III. Selection Criteria and Proposal: Lummi Nation Planning and Public Works will make their selection via Review Panel and based upon evidence of: A. The most Qualified Applicant 25 total points possible. B. Fee Schedule / Construction Cost according to and associated with allotted RFQ Parameters(see below) 25 total points possible.

3 RFQ Parameters: We would like Contractors to provide a conceptual 1 page plan layout. In addition a model could be submitted as well, but not required, at no cost initially but can be recouped upon winning and entering into a contract with Lummi Nation. This should be a line item in your Schedule of Values for cost of construction. Conceptual for proposal should be based on a 100ft x70ft dimension and $220, dollar Construction Budget not including Design or CA. These numbers are for competitive submittal purposes only. Dimension may be reduced during the RFQ/RFP process according to Budget given. C. Best Conceptual Design 25pts total points possible. D. Construction Method 25pts total points possible. Lummi Planning and Public works reserves the right to approve and reject any and all proposals. IV. Required Insurance, Bonding and Prevailing Wage: 1. Worker s compensation insurance in accordance with the statutory coverage s required by the State of Washington and Employers Liability insurance with limits not less than $1,000,000 and where applicable, insurance in compliance with any other statutory obligations, whether State or Federal, pertaining to the compensation to injured employees assigned to work, including but not limited to Voluntary Compensation, Federal Longshoreman and Harbor Workers Act, Maritime and the Outer Continental Shelf s land Act. 2. Commercial General Liability with the limits not less than $1,000,000 per Occurrence and $2,000,000 Aggregate for Bodily Injury and Property Damage, including coverage for Premises and Operations Liability, Board Form Property Damage Liability and Personal Injury Liability. 3. Commercial Automobile Liability on all owned, non-owned, hired and rented vehicles with limits of Liability of not less than $1,00,000 Combined Single Limit for Bodily Injury and Property Damage per each accident or loss. 4. Umbrella/Excess Liability insurance coverage of not less than $1,000,000 per Occurrence and annual Aggregate providing coverage in excess of General Liability, Auto Liability and Employers Liability. 5. Professional Liability insurance with the limits of not less than $1,000,000 per claim and $1,000,000 Aggregate, subject to a maximum deductible of $10,000 per claim.

4 The Lummi Indian Business Council has the right to negotiate increase of deductibles subject to acceptable financial information of the policyholder. Each policy of Insurance required by the section shall provide for no less than 30-days advance notice to Lummi Indian Business Council prior to cancellation. In addition, the Lummi Indian Business Counsel, its officers, employees and volunteers shall be named, as Additional Insured by all contractors and subcontractors and a Waiver of Subrogation shall be included in favor of the Lummi Indian Business Counsel The insurance shall be with insurers with a Best s rating of at least VII. Certificates of insurance, including all of these requirements, are required prior to signature of the contract. Contractor will secure at the time of Contract a Performance and Payment Bond for the Project. A limited waiver of Sovereign Immunity ( Job specific) can be granted if necessary for the Surety. Wage structure will be determined by Whatcom County Prevailing Wage scale. VI. Submittal: Five (5) copies of the proposal are due to the Lummi Indian Business Council, Planning Office prior to 1:00p.m. on August Proposals must be received and time stamped by our office no later than 1:00 PM as noted above. Faxed proposals will not be accepted. Starting at 1:05 on August 26, 2013 Design-build/Contractors will be allowed up to 7 minutes each to verbally introduce or present there Proposal (This is not mandatory but could prove useful in our eventual decision- Contractors must request to be put on a list for this accompanying verbal proposal by 3:30pm August 23, 2013 ).
