CIRCULAR CF Commercial Fire Washington CLM Division 5 Jurisdiction Definition Revision WSRB FILING DESIGNATION NUMBER: CF-2013-RR02 EFFECTIVE DATE: These changes are applicable to all policies effective on or after July 1, 2013 CHANGES: We have revised the CLM Division 5 Exception Pages for Washington to clarify our jurisdiction. These revisions ensure all federal installations are treated alike, and include all properties whose address reflects a federal installation, in lieu of maintaining a list. COMPANY ACTION: If you have authorized us to file on your behalf and decide: To use our revision and effective date, you are NOT required to file anything with the Insurance Department. To use our revision with a different effective date, to use our revision with modification, or to NOT use our revision, you must make an appropriate submission with the Insurance Department. In all correspondence with the Insurance Department regarding this revision, include the WSRB Filing Designation Number shown in the left column, not this circular number. 4 A1. JURISDICTION The State of Washington has unique statutory requirements with respect to the writing and rating of fire and allied lines insurance. RCW provides, in part, as follows: "(2) Any rating organization proposing to act as such as to insurance under standard form fire policies, shall be licensed only if all the following conditions are complied with: (a) The applicant and the operators of such rating organization shall be domiciled in and shall actually reside in this state. (b) The ownership of such rating organization shall be vested in trustees for all its subscribers under such trust agreement as is approved by the commissioner, and the rating organization shall be and shall be conducted as a nonprofit public service institution. (c) Such rating organization shall not be connected with any insurer or insurers except to the extent that any such insurer may be a subscriber to its services". The Washington Surveying and Rating Bureau is the only bureau which has ever qualified and been licensed under these provisions. Accordingly, all filing and rating services as provided for in this Manual with respect to the basic fire insurance contract and appurtenant coverages will be performed exclusively by the Washington Surveying and Rating Bureau and wherever therein the terms "Insurance Services Office, Inc." or "ISO", are used, there shall be substituted therefor "Washington Surveying and Rating Bureau". With respect to the State of Washington, all filings relating to fire and appurtenant coverages as contained in this Manual, including Classification Table, Farm Division, Fire And Allied Lines Division, Multiple Line Division, and Washington state pages as to those coverages will be made by the Washington Surveying and Rating Bureau and upon acceptance by the Washington Office of the Insurance Commissioner, such filings shall supplant and replace filings previously made by the Washington Surveying and Rating Bureau. All of the services, rules and filings as set forth in this Manual except those pertaining to fire and appurtenant coverages will be made and performed by the Insurance Services Office, Inc. Duplicate filings by Insurance Services Office, Inc. and the Washington Surveying and Rating Bureau will be made as to the Classification Table and other portions of this Manual relating to the functions of both bureaus. The Washington Surveying and Rating Bureau will continue to maintain separate and apart from this Manual, a filing entitled "Washington Surveying and Rating Bureau Rules and Regulations" in which will be included among other things the rules for subscribership to the Bureau and its method of assessment and charges for services. Properties located within Washington State whose address reflects a federal installation, fall outside of the general provisions of the Washington Insurance Code. Therefore, loss costs, rules, and forms of the Washington Surveying and Rating Bureau do not apply. Loss costs, rules, and forms developed by Washington Surveying and Rating Bureau for federal installations are informational only. A2. EXAMINATION (AUDITING) REQUIREMENTS Under Washington law, the Washington Surveying and Rating Bureau is prohibited from engaging in examination or auditing, and that function in Washington is performed by the Washington Insurance Examining Bureau, Inc. Attention is directed to WAC of the Washington Administrative Code for regulations pertaining to examination.
