2 RICHARDSON INDEPENDENT SCHOOL DISTRICT PURCHASING DEPARTMENT 970 SECURITY ROW RICHARDSON, TEXAS REQUEST FOR QUALIFICATIONS NUMBER 1470 GENERAL CONSTRUCTION SERVICES The Richardson Independent School District (RISD) is soliciting qualifications for general contractors as per specifications stated in this solicitation document. Sealed Requests for Qualifications shall be submitted in sealed packaging marked on the outside with your company name, address and RFQ number (RFQ1470) and title (General Construction Services) to: Richardson Independent School District Purchasing Department 970 Security Row Richardson, Texas Qualifications will be received at the above address until 10:30 AM CDT, Friday, May 12, Qualifications must be submitted in sufficient time to be received and time-stamped at the above location on or before the published due date and time shown on the RFQ. Richardson Independent School District will not be responsible for delivering mail from the post office. Qualifications received after the published time and date will not be considered. Facsimile or submittals will not be accepted. When downloading from the web page, it is necessary to open and download any addendum or other posted document applicable to this solicitation. All RFQ documents must be filled out, signed and returned with the complete qualifications package. Contractors must submit the original plus one (1) complete copy of the Request for Qualifications package that includes all signed RISD documents, the Respondent s Data and associated responses, and any material required by any addendum. This Request for Qualifications will establish a roster of prequalified contractors who can be called upon as appropriate projects become available. Awarded contractors will remain on the roster for a period of one year with annual renewals for up to three (3) consecutive years at the discretion of the District. 3 RICHARDSON ISD REQUEST FOR QUALIFICATIONS NO GENERAL CONSTRUCTION SERVICES QUALIFICATIONS AWARD AND EVALUATION I. QUALIFICATIONS AWARD: This RFQ will be awarded, in the best interest of Richardson ISD, to the contractors who provide best overall value. II. QUALIFICATION EVALUATION: As provided in the Texas Government Code, Chapter (b), qualifications will be evaluated on the basis of the following criteria: Section CRITERIA TO CONSIDER. (a) In determining the award of a contract under this chapter, the governmental entity may consider: (1) the price; (2) the offeror s experience and reputation; (3) the quality of the offeror s goods or services; (4) the impact on the ability of the governmental entity to comply with rules relating to historically underutilized businesses; (5) the offeror s safety record; (6) the offeror s proposed personnel; (7) whether the offeror s financial capability is appropriate to the size and scope of the project; and (8) any other relevant factor specifically listed in the request for bids, proposals, or qualifications. (b) In determining the award of a contract under this chapter, the governmental entity shall: (1) consider and apply any existing laws, including any criteria, related to historically underutilized businesses; and (2) consider and apply any existing laws, rules, or applicable municipal charters, including laws applicable to local governments, related to the use of women, minority, small, or disadvantaged businesses. Considering the above criteria, a one-step weighted scoring system will be utilized to rank the submittals in order to identify contractors that best meet the qualifications requirements and offer the capabilities that will provide the best overall value to Richardson ISD. The selection matrix will consist of the following categories and weights: Experience with RISD or similar entities 40% Services meet the District needs 25% Proposed Personnel 15% Method of Approach 15% Quality and Completeness of Qualifications Submittal 5% ~ 3 ~

4 RICHARDSON ISD REQUEST FOR QUALIFICATIONS NO GENERAL CONSTRUCTION SERVICES INFORMATION FOR CONTRACTORS Scope of Interest: The District is interested in securing a roster of qualified sources for general construction services that are typically offered by general contractors. Awarded firms would be expected to provide project quotes on an as-needed basis. Though unable to project future project needs, the expectation is that most jobs will be in the $100M to $500M range. From among the respondents, the District will select for award the number of contractors judged sufficient to meet its needs during the term of the agreement. Qualifications Criteria: Contractors should review the award criteria/scoring system and submit a qualifications package that addresses the subjects noted and includes a comprehensive response to the requested details in Section 3 (below). Qualifications submittals lacking the requested details will be judged accordingly. The submittal should be designed to demonstrate the qualifications, competence and capacity of the contractor. Qualifications Format: Firms must submit one (1) original and one (1) complete copy. Delivery should be in a sealed envelope or package with RFQ-1470 specified on the outside. The content should be as follows: 1. Cover letter: State the eligibility of your firm to respond to this RFQ, a brief description of your services and a statement of interest. 2. Table of Contents: Include section titles and page numbers to identify the respondent s data in the same order as listed below. 3. Respondent s Data: Address the following subjects by section and identify each one individually using the stated Table of Contents format. A. Description of Firm: Qualifications for your trade; annual revenue; location of primary office; years in business; number of employees. B. Personnel and Staffing: Provide affirmative statement that all key personnel are licensed to perform the specified services and note any specifics related to educational facilities; name those individuals in the following positions who may be assigned to projects solicited by the District: Estimator, Project Manager, Project Superintendent, Safety Manager. Experience and References: Description of significant projects completed within the past five years related to renovations and construction not exceeding $1,000, Include primary scope of work, duration and date of completion, client s name and address. Provide a list of three references for whom projects have recently been completed. Include organization name and address, contact name and number. D. Accountability and Service: Briefly comment on your commitment to quality project management and overall customer service dedication. Upon receiving a notice to proceed, describe the time necessary for mobilizing forces and starting construction. E. Additional Information (optional): Relevant details describing any unique qualifications that might pertain to RISD projects, not addressed in the Respondent s Data, that you feel may be pertinent. F. Insurance and Bonding: Provide your current Certificate of Liability Insurance (Acord form) and confirmation of bonding capabilities. ~ 5 ~

7 CERTIFICATION REGARDING DEBARMENT, SUSPENSION, AND OTHER RESPONSIBILITY MATTERS (a) (b) I. DEBARMENT, SUSPENSION, INELIGIBILITY AND VOLUNTARY EXCLUSION In accordance with the provisions of Appendix A to 49 CFR (Code of Federal Regulations), Part 29, the offeror certifies to the best of the offeror s knowledge and belief, that it and its principals: (1) are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any Federal, State or Local Government department or agency; (2) have not within a three (3) year period preceding this offer been convicted of or had a civil judgment rendered against them for the commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) transaction or contract under a public transaction; violation of Federal or State antitrust statutes, or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, or receiving stolen property; (3) are not presently indicted for or otherwise criminally or civilly charged by a governmental entity (Federal, State, or local with commission of any of the offenses enumerated in (a)(2) above; and (4) have not within a three (3) year period preceding this offer had one or more public transactions (Federal, State, or local) terminated for cause or default. Where the offeror is unable to certify to any of the statements above, the offeror shall attach a full explanation to this offer. (c) For any subcontract at any tier expected to equal or exceed $25,000: (1) In accordance with the provisions of Appendix B to 49 CFR, Part 29, the prospective lower tier subcontractor certifies, by submission of this offer, that neither it nor its principals is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency. (2) Where the prospective lower tier participant is unable to certify to the statement, above, an explanation shall be attached to the offer. (3) This certification (specified in paragraphs (c)(1) and (c) (2), above, shall be included in all applicable subcontracts and a copy kept on file by the prime contractor. FELONY CONVICTION NOTIFICATION AND CRIMINAL BACKGROUND CHECK (a) Offeror must give advance notice to the Owner if the person or an owner or operator of the business entity has been convicted of a felony. The notice must include a general description of the conduct resulting in the conviction of a felony. The District may terminate any Agreement or if the Owner determines that the person or business entity failed to give notice as required by this paragraph or misrepresented the conduct resulting in the conviction. This paragraph requiring advance notice does not apply to a publicly held corporation. : (b) Offeror will obtain criminal history record information that relates to an employee, applicant for employment, or agent of the Offeror if the employee, applicant, or agent has or will have continuing duties related to the contracted services; and the duties are or will be performed on school property or at another location where students are regularly present. The Offeror certifies to the Owner before beginning work and at no less than an annual basis thereafter that criminal history record information has been obtained. Offeror shall assume all expenses associated with the background checks, and shall immediately remove any employee or agent who was convicted of a felony, or misdemeanor involving moral turpitude, as defined by Texas law, from Owner property or other location where students are regularly present. District shall be the final decider of what constitutes a location where students are regularly present. Offeror s violation of this section shall constitute a substantial failure. (c) If the Offeror is the person or owner or operator of the business entity, that individual may not self-certify regarding the criminal history record information and its review, and must submit original evidence acceptable to the District with this Agreement showing compliance. 9 CRIMINAL HISTORY CONTRACTOR CERTIFICATION - CONTRACTOR EMPLOYEES Texas Education Code Chapter 22 requires entities that contract with school districts to provide services to obtain criminal history record information regarding covered employees. Contractors and Subcontractors must certify to the district that they have complied. Covered employees with disqualifying criminal histories are prohibited from serving at a school district. DEFINITIONS: Covered employees - Employees of a contractor or subcontractor who have or will have continuing duties related to the service to be performed at the District and have or will have direct contact with students. The District will be the final arbiter of what constitut es direct contact with students. Disqualifying criminal history - Any conviction or other criminal history information designated by the District, or one of the following offenses, if at the time of the offense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state. (3) Upon request, Contractor will provide the District with the name and any other requested information of covered employees so that the District may obtain criminal history record information on the covered employees. (4) If the District objects to the assignment of a covered employee on the basis of the covered employee s criminal history record information, Contractor agrees to discontinue using that covered employee to provide services at the District. We request RISD ID badges for the attached list of employees. Noncompliance or misrepresentation regarding this certification may be grounds for contract termination. 10 RICHARDSON INDEPENDENT SCHOOL DISTRICT PURCHASING DEPARTMENT Notice to Vendors: Conflict of Interest Questionnaire Required by Chapter 176 of the Texas Local Government Code Effective January 1, 2006, any person or entity who contracts or seeks to contract with RISD for the sale or purchase of property, goods, or services (as well as agents of such persons) (hereafter referred to as Vendors) are required to file a Conflict of Interest Questionnaire with the District. Each covered person or entity who seeks to or who contracts with RISD is responsible for complying with any applicable disclosure requirements. RISD will post the completed questionnaires on its website. The Conflict of Interest Questionnaire must be filed: No later than the seventh business day after the date that the Vendor begins contract discussions or negotiations with the government entity, or submits to the entity an application, response to a request for proposal or bid, correspondence, or other writing related to a potential agreement with the entity. The Vendor also shall file an updated questionnaire not later than September 1 of each year in which a covered transaction is pending, and the seventh business day after the date of an event that would make a statement in the questionnaire incomplete or inaccurate. Note: A Vendor is not required to file an updated questionnaire if the person had filed an updated statement on or after June 1, but before September 1 of the year.
