2 Outline Key decisions made at the 49 th and 50 th Meetings of the Executive Committee; and Key decisions made at the 18 th Meeting of the Parties to the Montreal Protocol.

3 49 th and 50 th Meetings of ExCom Model rolling three-year phase-out plan: (decision 50/5) Some 40,260 ODP tonnes of ODS consumption and 54,500 ODP tonnes of ODS production had yet to be phased out in approved phase-out plans Some 38,000 ODP tonnes of ODS consumption and 41,000 ODP tonnes of ODS production had yet to be phased out in approved individual project 64 RMPs for LVC countries; 32 TPMPs for LVC countries; and 35 national ODS phase-out plans for non-lvc countries under current implementation

4 Status/prospects of countries in achieving compliance (decisions 49/5, 50/4) (1) The ExCom constantly monitors the status of countries in achieving compliance; Countries submitted their country programme data reports; Reports were submitted using either the new or the old format; and Many reports were incomplete.

5 Status/prospects of countries in achieving compliance (decisions 49/5, 50/4) (2) Thus, the ExCom requested: Countries to submit complete country programme data using the new format; IAs to provide assistance to countries to enable full data reporting; and UNEP to include an agenda item on data reporting using the new format in network meetings; The Secretariat was urged to provide a means of entering country programme data on its website to improve consistency in reporting.

6 Business plans for (decisions 49/4, 50/3) IAs were urged to submit activities required for compliance to the 50th Meeting, including projects for countries that have been subject to non-compliance decisions and for which actions have not been taken; IAs were requested to submit reasons why projects required for compliance included in business plans had not been submitted; Projects required for compliance included in business plans, but not submitted, be given highest priority for submission in the subsequent calendar year. Parties and IAs make every effort to remove obstacles to their submission; and Modified existing performance indicators for IAs for better monitoring

7 Submissions that do not conform to ExCom requirements (decision 50/14) Not to include in meeting documentation project proposals that by the submission deadline did not contain all the information or components required for their submission; and The Secretariat will provide the ExCom with a list of all the proposals that were received but not included in meeting documentation, together with the reasons for non-inclusion.

8 Institutional strengthening project renewals (decision 49/32) The ExCom requested the Secretariat to prepare a paper to assess the merits of developing a simplified format for the request for renewals of IS projects (decision 47/49(g)); The ExCom decided to maintain the current arrangements for the submission and consideration of requests for renewal of IS projects; and The Secretariat will continue to examine opportunities to fine-tune the IS renewal process, in the context of the review of IS funding post-2010 due at the end of 2007.

9 Policy and regulatory activities (decision 49/4 (d)) Percentage of policy/regulatory assistance performance indicator: Ratification of all amendments to the Protocol, when applicable; Enactment of licensing/quota systems for all ODS (not limited to CFCs only) and informing the Ozone Secretariat accordingly; Establishment of bans on the import of ODS and ODS-based equipment Legislation to combat illegal trade in ODS; Enactment of legislation/regulation for the certification of refrigeration service technicians, when applicable; and Addressing relevant decisions taken by the Parties in regard to specific compliance issues.

10 Recommendations relevant to RMPs and phase-out plans in non-lvcs (decision 49/6) Update and complement ODS-related legislation; Upgrade the curriculum for technical training in refrigeration; Take into consideration decision 41/100 for the recovery/recycling part of phase-out plans; Base the training of technicians on a strategy combining theoretical training with practical exercises ; Select carefully the type of refrigerant identifiers to be purchased; Pay attention to safety aspects where training in the use of HC and particularly retrofitting are carried out; and Develop appropriate reporting formats for the tracking of cumulative progress achieved in work programs.

11 Other relevant decisions Priorities for the triennium taking into account US$40 million in unallocated funds (decision 50/6) The Secretariat will prepare a report addressing priorities listed in document ExCom/50/8; projects for CTC phase-out; activities related to ODS legislation development and enforcement; activities that had been eliminated from business plans and those proposed at the 50th Meeting. It should indicate the overall cost and cost-effectiveness of projects. Options for addressing the situation of countries referred to in decision XVII/14 (i.e., MDIs) (decision 49/33) TOR for a study regarding collection, recovery, recycling, reclamation, transportation and destruction of unwanted ODS (decisions 49/36 and 50/42) Preparation of a discussion paper on the issues raised at the 26 th Meeting of the Open-Ended Working Group with regard to the future of the Montreal Protocol, as they related to the Multilateral Fund (decision 49/38)

13 Membership of Implementation and Executive Committees Implementation Committee Argentina, Lebanon, New Zealand (President), Nigeria and Poland for one further year; Bolivia, Georgia, India, Tunisia (Vice President and Rapporteur) and the Netherlands for two years; Executive Committee Canada (Chair), Sweden, Czech Republic, Japan, USA, Sudan, Guinea (Vice-Chair), Mexico, Saint Lucia, Uruguay, Jordan, and China.

14 Essential-Use Exemptions To authorize CFC production and consumption exemption of 535 MT for European Community in 2007 and 385 MT for the United States in 2008 for the production of MDIs; and To authorize production and consumption of 150 MT of CFC-113 for the aerospace industry of the Russian Federation in 2007.

15 Environmentally Sound Destruction of ODSs To request the ExCom to develop consolidated TORs taking into account elements referred to in both the draft TORs submitted to the 18 th MOP by TEAP and TORs developed by the MLF Secretariat on the collection, recovery, recycling, reclamation, transportation, and destruction of unwanted ODSs; and To provide a progress report of the study to the 19 th MOP and a final report to the OEWG in 2008.

16 Critical-Use Exemptions for Methyl Bromide To permit production and consumption of 1,695 MT of methyl bromide in 2007 to satisfy critical uses in 11 countries. This represents the quantity in addition to the quantity approved at the 17 th MOP; To permit production and consumption of 5,123 MT of methyl bromide in 2008 to satisfy critical uses in 4 countries, with an understanding that additional levels of production and consumption and categories of uses may be approved in the 19 th MOP.

17 Difficulties faced by some Art. 5 Parties Manufacturing MDIs with CFC To request the ExCom to consider as a matter of urgency the funding of prjects in relation to those A5 Parties that experience difficulties due to high consumption of CFCs for manufacturing MDI; To review the decision regarding the existing cut-off date for consideration of MDI conversion projects; and To request the Imp. Com. to consider possible options on how to address potential non-compliance difficulties of these Parties.

18 Treatment of Stockpiled ODS Relative to Compliance (1) Scenarios covered by decision XVIII/17: ODS production in the year which had been stockpiled for domestic destruction or export for destruction in a future year; ODS production in that year which had been stockpiled for domestic feedstock use or export for that use in a future year; ODS production in that year which had been stockpiled for export to meet BDN of developing countries in the future year; and ODS imported in that year which had been stockpiled for domestic feedstock use in the future year.

19 Treatment of Stockpiled ODS Relative to Compliance (2) To recall that the last scenario was in conformity with the provisions of the MP and decisions of MOP; To request the Ozone Secretariat to maintain a consolidated report of the cases in which the Parties have explained that the situations are the consequences of the first three scenarios to present to the Imp Com for information; and To recognize that any other scenarios will be addressed by the Imp Com in accordance with the non-compliance procedure of the Protocol and the established practice.

20 Preventing Illegal Trade in ODS To urge all Parties to implement fully Article 4B; To encourage all Parties to improve monitoring of transboundary movement of ODS including a better utilization of existing systems under other MEAs for tracking trade in chemicals; To encourage Parties to provide information on the suitability and costs of implementing UNComtrade and egrid and make it available to the 27 th Meeting of OEWG and subsequently the 19 th MOP in 2007; To encourage UNEP s CAP to continue its effort to train ODS Officers and customs office on best practices and to raise awareness and to disseminate examples of best practices for national licensing systems and regional cooperation to combat illegal practices.

21 Proposal by Canada for adjustment of the Montreal Protocol The proposal from Canada was not submitted for consideration of the Parties; and To urge non-a5 countries to ensure an accelerated phase-out of their production for BDN. Through voluntary initiatives, total annual production of CFC to meet BDN of A5 Parties was estimated to be approximately 2,000 ODP tons in 2007 and 1,500 ODP tons in 2008 and 2009.
