3 Tor for evaluation of the financial mechanism of the Protocol TOR approved Steering panel of 8 (Austria, Canada, Colombia, India, Japan, Nigeria, the former Yugoslav Republic of Macedonia and the USA to supervise the evaluation process, select evaluator to carry out the evaluation & act as a point of contact for evaluator request Ozone Sec. to finalize procedure for selection of the qualified external and independent evaluator Approve budget of $200K Ensure final report and recommendations of the evaluator are made available to parties for consideration at the Twenty-Fourth Meeting of the Parties

4 XXII/3: Tor for study on replenishment of the MlFund request TEAP to prepare report for 23rd MOP, and to present it through the OEWG mtg, to enable the MOP to take a decision on the appropriate level of the replenishment of the MLF; TEAP should take into account, among other things: (a) All control measures and relevant decisions agreed upon by the Parties and ExCom, in particular those related to the special needs of LVs and VLVCs, and decisions agreed upon by the 22 nd MOP & ExCom at its 61 st & 62 nd mtgs insofar as those decisions will necessitate expenditure by the Multilateral Fund during the period ; (b) The need to allocate resources to enable all parties operating under Article 5 of the MP to maintain compliance with Articles 2A 2E, 2G and 2I of the Protocol; (c) The need to allocate resources to enable all parties operating under Article 5 to meet 2013 and 2015 compliance obligations in respect of Articles 2F and 2H of the Protocol;

5 XXII/3: Tor for study on replenishment of the MLF (d) Rules and guidelines agreed upon by the ExCom at all meetings, up to and including its sixty-second meeting, for determining eligibility for the funding of investment projects, non-investment projects, including institutional strengthening, measures to combat illegal trade and sectoral or national phaseout plans, including HCFC phase-out management plans, measures to manage banks of ODS & ODS destruction projects; (e) The impact that the international market, ODS control measures & country phase-out activities are likely to have on the supply of and demand for ODS, the corresponding effects on the price of ODS and the resulting incremental costs of investment projects during the period under review 3. In preparing TEAP should consult widely all relevant persons and institutions and other relevant sources of information deemed useful; 4. The Panel shall strive to complete the report referred to above in time to be distributed to all parties two months before the thirty-first meeting of the OEWG; 5. The Panel should provide indicative figures for the periods and to support a stable and sufficient level of funding, on the understanding that those figureswill be updated in subsequent replenishment studies;

6 XXII/9: Hydrochlorofluorocarbons preblended in polyols Noted how ExCom addressed this issue at the Committee s 61 st mtg through decision 61/47, by agreeing on a framework on eligible incremental costs for parties operating under paragraph 1 of Article 5 of the Montreal Protocol in their transition from the use of HCFCs in preblended polyols; To affirm that the issue of the use of HCFCs in preblended polyols has been addressed to the satisfaction of the Parties;
