1 State Legislative Update February 2012 The Legislature opened its 2012 legislative session on January 4, the second year of the two-year legislative cycle. All bills pending from the 2011 session must have passed their house of origin by January 31, 2012 to remain active in this session. The Legislature has taken action on a few key higher education two-year bills this year. The Senate approved SB 721 (Lowenthal), a measure that would establish a Higher Education Accountability framework. The author has acknowledged that the measure is still being refined, and expressed strong interest in working with the higher education segments to further develop the details. The bill moves next to the Assembly Higher Education Committee and has not yet been set for hearing. The Assembly took action in January to hold two education bond measures that would have appeared on the November 2012 ballot, even though both the Assembly Higher Education and Assembly Education Committees handily approved these bills. There was overall pressure to not add further bond debt to the state treasury at this time. The Legislature has until February 24 to introduce new legislation this year. So far, new bill introductions have been trickling in. Many more bills can be expected to be introduced as we approach the bill introduction deadline. New Legislation Assembly Speaker John Pérez recently introduced two new bills AB 1500 and AB Together, these bills would make changes that increase college affordability for middle class students. AB 1500 proposes to amend the single sales factor and use the revenues to fund the Middle Class Scholarship Fund. Assembly Bill 1501 would create the Middle Class Scholarship program that would reduce fees for UC and CSU students by two-thirds if they come from families that earn up to $150,000 a year. The measure would also provide $150 million to community colleges to increase student affordability, giving local districts the discretion to allocate the funds to best meet their individual needs, such as expanding the use of fee waivers or providing grants to cover the costs of books, transportation, or other educational expenses. For more information, please visit: Senate President pro Tem Darrell Steinberg just introduced two pieces of legislation to address the issue of textbook affordability. Senate Bill 1052 would establish the California Open Education Resources Council (composed of 3 faculty senate members from each of the segments), which would determine a list of the 50 most popular courses. It would also require the Council to review and approve open source materials and promote strategies for their use. Senate Bill 1053 would establish the California Digital Open Source Library (under the joint administration of the three segments) to house open source materials and provide free or low-cost online access to these materials for students, faculty and staff. 2 February 16, 2012 State Legislative Update Page 2 Student Success Task Force On February 1 the Board of Governors submitted the recommendations of the Student Success Task Force to the State Legislature, as required by Senate Bill 1143 (Liu). To receive the recommendations, the Legislature convened a joint hearing of the Assembly Higher Education Committee and the Senate Education Committee. Chancellor Jack Scott and board member and task force member Peter MacDougall presented an overview of the recommendations, followed by a panel of six members of the Task Force. Key messages delivered at the hearing were: The California Community Colleges are the gateway to opportunity for millions of Californians each year; The Task Force recommendations are aimed at promoting successful completion for all students; The Task Force recommendations are not a substitute for more funding; Implementation is key. The Board of Governors will be sponsoring two bills that would implement a subset of recommendations from the Student Success Task Force report. Senator Alan Lowenthal will author the Student Success Act of This measure would bolster counseling and advisement for community college students, require colleges to use a common assessment and post a student success score card when those systems are developed, and establish new requirements for receiving a BOG fee waiver. A second bill will be authored by Senator Carol Liu to strengthen the leadership capacity of the California Community Colleges Chancellor s Office. This bill would authorize the Chancellor to appoint new Vice Chancellors and would streamline the Department of Finance s oversight of the community college regulatory process. There will be ample opportunity to provide legislative input on both bills through work groups, monthly Consultation Council meetings, and throughout the legislative process. Both bills will be introduced prior to the February 24 deadline. Economic and Workforce Development (EWD) The Board of Governors is sponsoring a bill to reauthorize the Economic and Workforce Development (EWD) Program, which is set to sunset on January 1, Senator Ted Lieu, Chairman of the Senate Labor and Industrial Relations Committee, will author the measure. The reauthorization bill sharpens the focus of the program to reflect current workforce and economic needs and proposes changes that make the program more nimble and better able to respond to changing economic conditions. These changes do not alter the structure of current programs, but clarify the focus and goals of the EWD program. Overview of the February 1, 2012 Joint Legislative Audit Committee (JLAC) Hearing on Textbook Affordability On February 1 the Joint Legislative Audit Committee (JLAC), held a hearing on textbook affordability chaired by Assemblymember Ricardo Lara. The purpose of the hearing was to discuss factors contributing to the rising cost of college textbooks, as noted in a 2008 audit titled Affordability of College Textbooks, as well as efforts taken by the segments of higher education to reduce costs. Presentations were made by the State Auditor as well as three different panels. 3 February 16, 2012 State Legislative Update Page 3 from the Chancellor s Office and the California Community College Academic Senate discussed the system s efforts to reduce textbook costs. A panel representing organizations promoting technologybased course materials such as online textbooks and other Open Educational Resources (OER) also made a presentation. The hearing provided a good discussion of advancements in the development of online course materials and their use by the segments. Upcoming Informational Hearing On February 28 the Assembly Committee on Higher Education and the Assembly Committee on Veterans Affairs will hold a joint informational hearing on issues concerning student veterans.
