5 REGULAR CITY COUNCIL MEETING MINUTES MONDAY, FEBRUARY 3, 2014 CALL MEETING TO ORDER: The Regular Meeting of the Bowie City Council was held on Monday, February 3, 2014 in the Council Chambers at City Hall. Mayor Robinson called the meeting to order at 8:00 p.m. PLEDGE OF ALLEGIANCE TO THE FLAG: QUORUM: Mayor Robinson led the Pledge of Allegiance to the Flag. In attendance were Mayor Robinson, Mayor Pro Tem Trouth, Councilmembers Brady, Marcos, and Turner; City Manager Deutsch, Assistant City Manager Fitzwater, City Attorney Levan, City Clerk Hernandez, Staff, and the Public. CITIZEN PARTICIPATION: Mr. Gary Allen, Chairman of the Environmental Advisory Committee, highlighted one of the city s current environmental programs; the Energy Audit program for seniors which offers a $100 rebate for seniors to cover the cost of completing a BGE Home Performance with Energy Star Audit. PRESENTATIONS: A. Teacher of the Month Award (January, February) Ms. Nikita Thelwell of the Bowie Education Committee presented the Teacher of the Month Award to Adebisi Babayemi from High Bridge Elementary School for the month of January and Angela Grooms from Whitehall Elementary School for the month of February. All teachers will receive a dinner for two voucher from Texas Roadhouse in Bowie and from the City of Bowie a Certificate of Recognition. 6 February 3, NEW BUSINESS: A. Sheriff s Briefing Prince George s County Sheriff Melvin High briefed Council on improved security measures in the courthouses, reduction in backlogs of warrants and partnership with the State Office of Child Support Enforcement in the collection of child support. A copy of the power point presentation is on file in the City Clerk s office at City Hall. Following comments from Council, Mayor Robinson thanked Sheriff High for taking the time to update Council. B. Auditor s Presentation Mr. Dan Kenney with audit firm CohnReznick LLP presented a review of the City s finances for Fiscal Year 2013; a copy of the reports is on file in the City Clerk s office at City Hall. In the opinion of the audit firm, the City s financial statements present fairly, and are in accordance with generally accepted accounting principles. Mayor Robinson thanked Mr. Kenney for his report and City staff for its work. C. Cell Tower at Benjamin Tasker Middle School Ms. Maureen Smith, with Milestone Communications, briefed Council on a proposed cell tower installation at Benjamin Tasker Middle School for Verizon Wireless LLC. Mayor Robinson asked if the additional locations in Bowie are also in the process of having towers installed. Ms. Smith responded that they are not; they are on the available list if any carriers see the need to increase their frequencies in those areas. Councilmember Turner would like to know how Milestone sends their notifications to citizens about the installations of the towers. Ms. Smith replied that they send out mailers to HOAs, post on their website and social media and also hold a briefing meeting. Councilmember Trouth asked why elementary schools are not sought for installation of the towers. Ms. Smith responded that elementary schools are generally in smaller parcels and makes it difficult to meet the setback requirements. Mayor Robinson thanked Ms. Smith for her presentation. ADJOURNMENT: Mayor Pro Tem Trouth moved to adjourn the City Council meeting and move into Closed Session under State Government Article (a)(3): To consider the acquisition of real property for a public purpose and matters directly related thereto and Article (a)(9): To conduct collective bargaining negotiations or consider matters that relate to the negotiations. Deutsch City Manager Upgrade of Electrical System Pump Station # Safety Turn R-8-14 DATE: February 5, 2014 Legal notices were placed and bid packages were sent to selected firms for the upgrade of the electrical system at pump station #5, located at Safety Turn. At the close of bidding at 11:00 a.m., Tuesday, February 4, 2014, two bid proposals had been received. Below is a tabulation of the bid proposals received: Urban Francis, LLC Baltimore, Maryland $54,440 Kroeger Electric Company Glen Burnie, Maryland $54,900 This work is being performed in accordance with the Capital Improvement Program for the Wastewater Treatment Plant. The budget for this work is $55,000. The Public Works Department recommends that the bid proposal from Urban Francis, LLC, in the amount of $54,440, be accepted. 9 R-8-14 R E S O L U T I O N OF THE COUNCIL OF THE CITY OF BOWIE, MARYLAND ACCEPTING BID FOR THE UPGRADE OF THE ELECTRICAL SYSTEM AT PUMP STATION #5, LOCATED AT SAFETY TURN WHEREAS, advertisements were placed in local newspapers and requests for bid proposals were sent to selected firms for the upgrade of the electrical system at pump station #5, located at Safety Turn; and WHEREAS, at the close of bidding at 11:00 a.m., Tuesday, February 4, 2014, the City received two (2) bid proposals; and WHEREAS, after a careful review of the bid proposal submitted, it was determined that Urban Francis, LLC had submitted a responsible and responsive bid proposal of $54,440. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bowie, Maryland, that the Council hereby accepts the bid proposal of Urban Francis, LLC for a total amount of $54,440 and hereby directs the City Manager to sign a contract with Urban Francis, LLC. Deutsch City Manager Purchase of Three (3) Refuse Trucks R-9-14 DATE: February 12, 2014 Legal notices were placed and bid packages were sent to selected firms for the purchase of three (3) refuse trucks. At the close of bidding at 11:15 a.m., Tuesday, February 4, 2014, eight (8) bid proposals were received. Below is a tabulation of the bid proposals: Waste Equipment Sales & Service, LLC Halethorpe, Maryland $436, GranTurk Equipment Company, Inc. Baltimore, Maryland $448, Central Truck Center, Inc. Landover, Maryland $449, Western Star Trucks of Delmarva, LLC Mardela Springs, Maryland $470, TCH Enterprises, Inc. t/a Mid Atlantic Waste Systems Baltimore, Maryland $498, K. Neal International Trucks, Inc. Hyattsville, Maryland $500, Two of the refuse trucks are being purchased in accordance with the Equipment Acquisition and Replacement Schedule for FY14. The third is replacing a truck that was totaled by a fire.

11 Refuse Trucks February 12, 2014 R-9-14 Page 2 of 2 The Public Works Department recommends that the bid proposal from GranTurk Equipment Co., Inc., in the amount of $448,425, be accepted. This amounts to $149, per truck for three trucks. Each of the two trucks shown in the budget was estimated to cost $145,000. We received approximately $103,000 in insurance reimbursement for the third truck, which was totaled by fire. This was the prorated value of that truck. There are sufficient funds in the Equipment Acquisition and Replacement Fund to cover the additional costs for these three trucks. The bid proposal from Waste Equipment Sales & Service, LLC is not being recommended for award as the truck they bid does not meet minimum specifications. In addition, the references they provided were from jurisdictions that have never had the type of truck body that was bid. I concur with the above recommendation to award to GranTurk Equipment Co., Inc., in the amount of $448,425, and request your approval of R DJD:RJH:jt

Deutsch City Manager Professional Services Belair Drive Tank R DATE: February 12, 2014 On October 21, 2013 Council awarded a contract to Titan Industrial Services, Inc. in the amount of $269,550 for the complete cleaning and repainting of the interior surfaces, and the spot cleaning and topcoating of the exterior surfaces with containment, to the 600,000 gallon steel elevated water tank located at 3107 Belair Drive. The work is scheduled to begin on March 1, Professional inspection services will be needed for this project. Per Section 61(b)(4) of the City Charter, the Public Works Department advertised a Notice of Intent to Negotiate for the professional inspection services. Tank Industry Consultants (TIC) submitted a responsive and responsible proposal. TIC is familiar with the project as they prepared the construction specifications. In accordance with City Charter Section 61(b)(4), we are requesting that Council authorize the City Manager to issue a purchase order to Tank Industry Consultants for professional services in the amount of $27,000. This work is being done in accordance with the Capital Improvement Program for the repainting of water storage tanks. I concur with the above recommendation and request your approval of R

15 City of Bowie Excalibur Road Bowie, Maryland MEMORANDUM TO: FROM: SUBJECT: City Council David J. Deutsch City Manager Ordinance Supplemental Appropriations for the Annual Budget for the Fiscal Year ending June 30, 2014 DATE: January 17, 2014 Ordinance provides supplemental appropriations for the fiscal year ending June 30, 2014 for the following purposes: 1. Estimated cost of $147,200 is needed to complete the replacement of the HVAC system at Belair Mansion. This contract was awarded to the low bidder whose work was terminated because it was unacceptable. An independent third party engineer Consolidated Engineering (CE) was retained to assess the project and make recommendations of corrective actions that could be taken to complete the work. The immediate corrective measures needed to replace the HVAC are as follows. (a) Removal and replacement of two (2) hot water recirculation pumps. (b) Removal and replacement of incorrect heating and re-heating piping to all air handlers. (c) Installation of new Carrier controls; to allow the new equipment to operate as efficiently as possible and to properly maintain interior air temperature and humidity levels. (d) Replacement of antiquated, inefficient, boiler with a high efficiency boiler system 2. Estimated cost of $259,000 is needed to reimburse the Bowie Volunteer Fire Department (BVFD) for expenditures the organization incurred for purchasing, outfitting, and placing into service two new pumping trucks. City Resolution R provides for the reimbursement of thirty percent (30%) of the total purchase price of each vehicle subject to certain conditions. The BVFD has met the conditions imposed upon them by the resolution. Reimbursable funds will come from the Equipment Acquisition and Replacement Fund reserve of $381,700 and will maintain a remaining balance of $122,700 for future approved contributions. MAYOR G. 20 L f i J la Ii Ercaiibur Road 3owie lar land MEMORANDUM TO City Council FROM David J Deutsch ity Manager SUBJECT Urban Greening Cost Share Program DATE February I Introduction On July the Bowie City Council passed ResolutionR56 12 recognizing the importance of trees to the City The cunent tree canopy of the City is 42 R56 12 established a new tree canopy goal of45 for the City Trees serve numerous valuable purposes in an urban environment They reduce stormwater runoff improve air quality create habitat for wildlife prevent stream channel erosion decrease building energy use buffer noise supply shade and increase property values In November 2011 prior to the resolution the City hired Applied Ecological Services to prepare a comprehensive Urban Greening Strategy Report Also in 2009 the University of Vermont examined the City s existing and possible urban tree canopy and issued a report Results of both reports stressed that the greatest opportunity for planting trees exists on residential parcels Thus in order to achieve a 45 tree canopy the City must focus on encouraging residents to plant trees on their own properties For FY14 the City approved to assist homeowners with tree planting and to develop an Urban Greening Cost Share Program In response staff has drafted the following proposed residential tree rebate program that will reimburse 100 to the first 100 residents that plant a tree on their property between March l 2014 May II Project Timeline Tree planting rebates will be available from March 1 to May 31 S 2014 or until funds are exhausted Funds will be distributed during this time because trees can be successfully planted during these months local nurseries have more trees in stock during spring months and the month of April coincides with Earth Day which will help bring attention i i e iz i i si fit

21 r Urban Greening 2 to the program Marketing through local news sources for the program will begin in March and continue for the duration of the program III Rebate Structure The program in olves a partnership with Patuxent Nursery They will be able to distribute 100 rebates to customers Patuxent Nursery is accessible to Bowie residents and has the size and types of native canopy trees that support the proposed program s goals There will be twelve ypes of trees that will be eligible for the rebate and for certain tree species cultivars are acceptable A description of each of these tree species is included in an attachment These species were selected because they are native have a large canopy are medium fast growing are not prone to disease or have cultivars not prone to disease and are known to adapt well in urban or lawn environments The rebate will be 100 and only one rebate per household will be allowed The tree purchased must be at least 2 caliper inch the trunk of the tree at 6 inches above the soil must be at least 2 inch thick The rebate will apply towards the tree itself or the delivery planting costs of a tree purchased as long as combined costs amount to at least 100 after other rebates and coupons are applied The City tree rebate can be used in conjunction with the State of Maryland s Marylanders Plant Trees coupon program However the State of Maryland program requires that the rebate does not bring the total cost of the tree below 50 To help further clarify if a tree itself costs 130 and 70 to deliver the tree and plant it at a resident s house the total cost is 200 The resident could get 100 rebate from the City of Bowie and a 25 rebate from the State of Maryland The total out of pocket cost for the resident would be 75 Another example if a trees costs 100 and the homeowner is planting the tree the resident could get a 100 rebate from the City but not the 25 rebate from the State The total out pocket cost for the resident is 0 of In order to track distributed rebates at the nursery Patuxent Nusery will be given 100 rebate application forms to be distributed to City of Bowie residents that request to apply for the rebate Applications distributed will be given on a first come first serve basis The application form will ask for contact information permission to post the resident s name in City media sources and a signature saying they pledge to maintain the tree After completion of the application form a tree rebate checklist will be provided to the resident from the nursery that outlines steps to get their rebate and provides where to find resources for tree planting tree maintenance and calculating the environmental benefit of their tree The nursery will be required to maintain a copy of the tree purchase delivery receipt and keep a duplicate copy of the application form Those documents will either be mailed or picked up by City staff every week during the duration of the rebate program To complete the application and in order to verify the tree was planted the resident will have to take a photo of the tree planted on their property and send it in to klarson or Ms Kristin Larson City Hall Planning Department or cityofbowie Excalibur Road Bowie MD by June Once a copy of the application the purchase receipts and photo are all received City staff will verify that the applicant is a resident within the incorporated limits of the City and a check will be mailed to the resident within 2 4 weeks If the verification photo is not sent to the City by specified date the resident forfeits their rebate

29 COMMUNITY SERVICE UNIT OVERVIEW Community Service Unit attended 18 Homeowners Association meetings. The City of Bowie Police Department has added 2 additional Neighborhood Watch groups for a total of 63. We are actively recruiting new businesses to participate in our Business Watch Program. We have our Business Information Network up and running with a total of 15 businesses signed up. We hosted 8 RAD courses in 2013; as well as 1 Advanced RAD course. There are 2 upcoming classes in Feb/Mar We have presented at the Bowie Senior Center on Senior Safety and plan to offer a Senior Workshop at Pin Oak Senior Community We have participated in a Bullying Summit offered by County Councilwoman Ingrid Turner (Bowie High). We partnered with the Drug Enforcement Agency Baltimore Field office to host a Drug Take Back initiative April 28, 2013 and collected approximately 265 pounds of prescription drugs. We have an upcoming Take Back initiative scheduled for April 26, Our 2013 National Night Out event was held in August and was attended by approximately 2500 people. School Resource Officer (SRO) Program SRO Mentoring Program (Helps Bowie High School students deal with challenging issues such as anger, bullying, teen violence, life without gangs) We are working on a Teen Summit (partnering with school and Bowie studio) SRO speaks with 10 th -12 th grade classes about gangs and bullying SRO attends Parent Teacher Association meetings to educate parents and staff about important issues such as recognizing signs of bullying and truancy. 30 TRAFFIC DIVISION 2013 OVERVIEW Right Turn on Red Enforcement 23 citations 64 warnings Pedestrian Crossing Violations Plainclothes officers were used to legally cross at marked crosswalks. Vehicles that did not yield for the pedestrian were stopped by waiting uniformed officers and issued violations. We ve done this once in 2013 and a second time in January 2014 with the following results. 10 citations (November 2013) 12 citations (January 2014) Stop Sign on 11 th Street 22 citations 500 educational fliers distributed Variable message board deployed for 14 days Tow Truck Enforcement Midnight Commercial Motor Vehicle (CMV) enforcement led to 2 unregistered tow truck operators claiming to be contracted repo men. Both vehicles were unlicensed to operate in the County and one was registered out of New York. Neither of the operators had bank repo paperwork, the drivers were issued citations for their violation and the vehicles were taken out of service. The information was requested by a task force and the County police tow truck enforcement unit. Commercial Motor Vehicle (CMV) Enforcement We participated in 2 CMV task force operations working with Maryland State Police, Prince George s County, Montgomery County, Howard County and the State Highway Administration. During these enforcement waves, tractor trailers and other commercial vehicles were stopped and inspected for safety violations. BPD Traffic Unit officers were responsible for 64 CMV inspections for the 2013 calendar year. Fatal Crash Investigations Traffic Unit investigated 2 fatal crashes in 2013; one was a single vehicle crash on Central Ave. and Devonwood Dr. The cause was determined to be a medical emergency. The second fatal crash was in front of Benjamin Tasker Middle school involving 5 vehicles. This accident is still under investigation, but all indications are leading to a medical emergency. The report covers all City funds, and contains financial summaries as well as reports concerning the status of the objectives committed to in the Budget. We tend to focus on the General Fund, since this represents the bulk of our operations and it is the fund that determines the real estate property tax rate. By June 30, 2014, General Fund revenues are projected to be approximately $0.20 l million under budget and expenditures approximately $1.4 million under budget. The City has a history of strong financial performance and continues to be in a strong financial position. This report also indicates the status of each department' s objectives.
