7 REPUBLIC OF TUNISIA SECON NATURAL RESOURCES MANAGEMENT PROJECT (NRMP2) A. SUMMARY RESTRUCTURING PAPER 1. This restructuring paper proposes to restructure the Tunisia Second Natural Resource Management Project (NRMP2) through changes to : (i) the Project evelopment Objective (PO) and the Global Environmental Objective (GEO); (ii) the Results Framework and Monitoring; (iii) the project components, including cancellation of Component 2 and modifications of the project activities; (iv) the project implementation arrangements; and (v) the project financing (costs, financing plan, and reallocation of proceeds). This would be a level 1 restructuring, as it involves changes in the PO. 2. The NRMP2 (US$ million) is a fully blended operation financed in part by the IBR Loan No TN in the amount of US$36.10 million and the GEF Grant No. TF in the amount of US$9.73 million. The project was approved by the Board of Executive irectors on June 17, 2010, declared effective on February 19, 2011, and its implementation was launched in late May The mid-term review is planned for the second semester of 2013 and the Closing ate is ecember 31, The project consists of the following components: (1) Financing for Execution of Investments Selected under the Participatory evelopment Plans (PP) Framework; (2) evelopment and Promotion of Use of Treated Wastewater in Agriculture; and (3) Institutional Strengthening and Sensitization to Environmental Issues and Integrated Participatory Approach (IPA) Methodology. The Ministry of Agriculture is responsible for the project coordination through the Project Central Coordination Unit (CCU) of the irectorate of Finance, Investments, and Professional Organizations (FIPO), as well as the implementation of project activities at the level of the three targeted governorates (Jendouba, Kasserine, and Médenine) through its Regional Commissariats for Agricultural evelopment (RCAs). The Ministry of the Environment through the General irectorate of the Environment and the Quality of Life (EQL) is responsible for the implementation of various activities linked to environmental aspects. 4. Since the launch of its implementation in the aftermath of the January 2011 Tunisian Revolution, the NRMP2 has been experiencing severe and persistent startup delays, with very limited progress and results achieved on the ground to this date. The proposed restructuring stems from the agreement reached between the Tunisian authorities and the World Bank on the need to simplify the project design, approach, methodology, and operational procedures in order to facilitate and to accelerate the pace of its implementation with the aim of achieving in a timely fashion meaningful results on the ground to benefit the poor population of the lagging regions targeted by the project. All elements of the restructuring have been discussed in detail during the restructuring mission (August 31 to September 12, 2012) and presented in the correspondent Aide-Memoire. The Government of Tunisia (GoT) has requested this restructuring in its letter dated November 22, This will be the first restructuring of the NRMP2. 1
8 PROJECT STATUS 5. More than a year and a half after effectiveness, the implementation of the NRMP2 remains at a very incipient stage. Implementation progress and results are very limited and well below the expected targets. A critical mass of project staff at the regional level (field and outreach workers in particular) has only been appointed recently (September 2012). As a result, progress is limited, as reflected by the monitoring indicators, and the actual commitments and disbursements to this date can be illustrated as follows: (i) the number of PP prepared and validated stands at 13 and three respectively (instead of a cumulative total of 56 planned for the first two years of the project); (ii) the number of signed annual contracts (ACs) to implement the corresponding PP is limited at three (instead of 56 for the same period); (iii) the actual levels of cumulative commitments and disbursements under the project remain low at about US$2,110,000 and US$930,000 respectively (the initial estimates of cumulative disbursements for the period was US$14.9 million: US$10.26 million for the loan and US$4.64 million for the GEF grant). Moreover, achievement of meaningful results on the ground is lacking. To date, no construction works associated with PP investments are underway in the targeted regions; no farmer has benefited from agricultural advice and vulgarization, which could limit the impact of the project on improving agricultural production and access to basic infrastructure in the medium term. Income generating activities (IGA) have yet to be initiated. 6. Key factors that contributed to the excessive startup delays and to the poor implementation performance of the project include: (i) the disturbances and, at times, security concerns associated with the ongoing socio-political transition following the early-2011 Tunisian Revolution; (ii) the weakening or dissolution of several local and regional organizations (AGs, RCs, and LCs) representing key institutional actors or stakeholders involved in the project; (iii) the new challenges of involving the local population in the participatory process, stemming from security concerns in the field for the local staff of the Ministry of Agriculture combined with their lack of experience in dealing with social tensions and conflicts; (iv) the frequent turnover of staff of the RCAs and other partner institutions at the local or regional levels; (v) the inadequate staffing of the project units and excessive delays in the appointment or recruitment of personnel dedicated to project implementation at the regional level; (vi) the relative complexity of the project design and the need for adjustments to the post-revolution environment; and (vii) the weaknesses in the overall administration of the project and insufficient capacities and mastering of project operational procedures, notably in procurement. 7. Currently progress towards achievement of the development objective (O) and the overall implementation progress (IP) are both rated unsatisfactory. Yet in spite of its implementation shortcomings, the NRMP2 remains very relevant in the current sociopolitical context, and the project continues to represent an important instrument for the GoT to respond to the needs and demands of the rural population in lagging regions targeted by the project. In the context of the post-revolution Tunisia, there has been an increase in social demands for prompt remedial actions to increase voice and participation, to improve rural livelihoods, and to generate new opportunities for income generation. The Integrated Participatory Approach (IPA) for rural development promoted by the NRMP2 thus remains of particular relevance in the present context. Both the Client and the World Bank are addressing the above-mentioned challenges to improve the project implementation performances. 2
9 8. The Borrower is in compliance with the Loan and Grant covenants. There are no overdue audits reports. The Borrower has prepared an updated action plan (as reflected in the Cost and isbursement Projections Table summarized in Annex 2) together with a revised procurement plan. It should also be highlighted that in addition to these changes described below, other changes and simplifications introduced also in the operational procedures of the project are recorded at the level of the Project Operational Procedures Manual (POPM). B. PROPOSE CHANGES 9. Project evelopment Objective: The proposed changes entail the reformulation of the PO and GEO to ensure that it is more realistic and better in line with the modifications proposed in the project description, activities, and expected results. This will also provide an opportunity to correct the slight discrepancy noted between the original PO as stated in the Project Appraisal ocument (PA) and in the legal agreements (See Table 1 below). The proposed changes, which require also a modification and adaptation of the project indicators and target values listed in the result framework, will have to be reflected as well in amendments to the corresponding Loan and Grant agreements (Schedule 1, Project description). Results/ Indicators: The proposed changes include: a) In general - (i) the removal and addition of indicators to ensure they are fully aligned and consistent with the revised PO while reducing where warranted the number of indicators to simplify project monitoring; (ii) the reformulation of certain indicators to clarify their definition, and to take into account the proposed changes in the institutional arrangements; and (iii) the inclusion of core indicators. 3
10 b) At the level of Component 2 (evelopment and Promotion of Use of Treated Wastewater in Agriculture) As an adjustment to the proposed cancellation of all treated wastewater use activities under this Component, the two related indicators have been removed. c) Target values These values corresponding to the revised indicators have been set or adjusted as to reflect the current implementation status, and the revised projections for the remaining duration of the project. The revised arrangements for results monitoring, indicators, and target values are presented in Annex Components: The main change proposed in the project components is the cancellation of the initial Component 2 (evelopment and Promotion of Use of Treated Wastewater in Agriculture), following a change in the Government s priorities in this area and the challenges (technical, environmental, and institutional) encountered in targeted pilot sites that are no longer compatible with the remaining implementation period of the project. This change will also allow a better focus of implementation efforts on the core activities of the project while simplifying the institutional arrangements for implementation by reducing the number of entities involved in project execution. This cancellation implies: (i) a modification of the project description in accordance with the cancellation of Component 2, the renumbering of Component 3 to now Component 2, and the corresponding amendment to the Loan and Grant agreements (Schedule 1, Project description); and (ii) the reallocation of corresponding proceeds of the GEF grant to Component 1 to increase support for eligible environmental activities prioritized by the beneficiary population, and to enhance environmental knowledge management, communication, and training activities under Component Institutional Arrangements: While no change is proposed for the implementing entities, some stakeholders are no longer involved in the institutional arrangements. The Loan and Grant agreements will be amended to specify the existing role of the RCAs as implementing entities responsible for project implementation at the local level, and to ensure that they are adequately staffed for this purpose. 13. Furthermore, the following changes are also proposed with reference to some stakeholders involved in the institutional arrangements, and they will be reflected in the revised POPM. a) At the national level With the elimination of Component 2 (evelopment and Promotion of Use of Treated Wastewater in Agriculture): (i) the National Sanitation Utility (NSU) initially responsible to carry out treated wastewater use activities no longer plays a role in the implementation of the NRMP2 due to the annulment of the related study; and (ii) the Ministry of Environment through the irectorate of Environment and Quality of Life (EQL) will now only be responsible for the implementation of activities under what is to become sub-component 2.3 (Environmental Knowledge Management). b) At the regional level and local level With the Regional evelopment Council (RC) and Local evelopment Council (LC) no longer in existence since the Revolution, the validation and/or signing of the PP and AC with these entities is no longer feasible. Instead, the RCAs shall validate the ACs and PPs with the legally constituted beneficiaries Agricultural evelopment Groups (AG) where feasible or with informal community organizations such as the Extended evelopment Committee of the Imada (ECI) to be established by the project. 4

Financing: The proposed changes include: a) Project Costs The project costs will be reduced by US$4.58 million as a result of the corresponding reduction in the Government s contributions due to the proposed increase to 100 percent of the percentage of expenditures to be financed (exclusive of tax) for all categories of expenditures under the loan and the grant. This is in response to the Government s request to the World Bank to increase the financing percentage of projects supported by the World Bank in Tunisia in order to reduce the pressure on the national budget in the post-revolution context. Accordingly, the percentage of financing under the only category of the loan not financed at 100 percent (category (1) for works) will increase from 70 percent to 100 percent exclusive of taxes. The table in Section IV.A.2 of Schedule 2 (Project Execution) to the Loan Agreement will be amended accordingly. Furthermore, the cost of Component 2 (evelopment and Promotion of Use of Treated Wastewater in Agriculture) proposed for cancellation will be redistributed among the remaining components (see Table 2 below for details). 13 15. Procurement: The proposed change entails the introduction of a new procurement method named Community Participation. Procedures will be described in the POPM, satisfactory to the Bank. This method will be used for procurement of goods and works to allow more operational flexibility as well as the greater participation of targeted populations in the implementation of community investments prioritized in the PP. C. APPRAISAL SUMMARY 16. Risks: espite the simplifications introduced by the restructuring, project implementation risks remain high due to the relative instability associated with the ongoing political transition in Tunisia. More specifically, risks that could further jeopardize project implementation include: (i) a persistent general lack of adequate know-how in the application of procurement procedures; (ii) a persistence to apply national procedures even when the World Bank procedures prevail; (iii) problems of information flow between the regional and central levels; and (iv) the insufficient and inadequate staffing of the project. Moreover, the current transition context results in uncertainty at the institutional, administrative, operational, and security levels that can in principle adversely impact project implementation and associated efforts in the institutionalization of the Integrated Participatory Approach (IPA) beyond the duration of the project. Mitigation measures identified for the project implementation risks mentioned above include: (i) the additional training provided by the World Bank on fiduciary aspects; (ii) the increased support and closer monitoring of the project unit at the central level to the local units, and for which adequate funding has been budgeted; and (iii) the allocation of adequate budget to access external expertise through consultants to support the project units. 7
