1 Final Update and Tobacco Vote Record 2016 California Legislative Session During the 2016 regular legislative session of the California Legislature, nine tobacco-related bills were introduced. Of these bills, eight received votes on either the Assembly or Senate floor or both. Six of those bills made it to the Governor s desk for signature, and four of them were signed into law by Governor Jerry Brown. The four tobaccorelated bills signed into law will: (1) Ensure that Medi-Cal recipients receive comprehensive cessation services including a minimum of four medically-necessary quit attempts, with limited barriers to access for cessation medications ( 1696); (2) Expand the scope of laws regulating cigarette tax stamps to include unaffixed stamps and extends penalties ( 1901); (3) Require the Board of Equalization to report on whether fee established for tobacco retailers is sufficient ( 2770); and (4) Prohibit the use of tobacco products within 250 feet of a youth sports event ( 977). These new laws went into effect on January 1, The American Lung Association in California s Center for Tobacco Policy & Organizing analyzes and monitors the progress of tobacco-related bills that are introduced in the California Legislature. Throughout the year, the Center sends out regular updates about this legislation to keep local advocates informed about the tobacco-related activity that is occurring at the State Capitol. At the end of each legislative session, the Center produces an annual vote record that summarizes the outcome of each bill and how each member of the legislature voted. For all nine tobacco-related bills that were introducted, this final update contains summaries, legislative histories and the position on the bills taken by the major voluntary health organizations American Lung Association in California, American Cancer Society Cancer Action Network and American Heart Association. 2 THE CENTER FOR TOBACCO POLICY & ORGANIZING PAGE 2 OF 6 Key for tobacco control position: ALA in CA - American Lung Association in California; ACSCAN - American Cancer Society Cancer Action Network; AHA - American Heart Association BILLS SIGNED BY THE GOVERNOR 1696 Medi-Cal: Tobacco Cessation Services (Holden D, Pasadena) This bill ensures that Medi-Cal recipients receive comprehensive cessation services including quit attempts based on medical necessity, with limited barriers to access for cessation medications. It ensures Medi-Cal s cessation coverage aligns with the recommendations of the United States Preventive Services Task Force. History: The bill passed the Assembly (63-14 with 3 members absent/did not vote on June 2, 2016) and the Senate (29-8 with 2 members absent/did not vote on August 16, 2016). It was then sent back to the full Assembly for approval of amendments, where it again passed (62-17 with 1 absent/did not vote on August 23, 2016). Signed by the Governor on September 25, Cosponsor/ 1901 Taxation: cigarettes: unaffixed stamps (Quirk D, Hayward) This bill clarifies the definition of unaffixed stamps as it relates to the tax stamps used to collect tobacco taxes. By doing so, this bill empowers the Board of Equalization to seize cigarette tax stamps when necessary. History: The bill passed the Assembly (79-0 with 1 member absent/did not vote on May 5, 2016) and the Senate (36-0 with 3 members absent/did not vote on August 18, 2016). It was then sent back to the full Assembly for approval of amendments, where it again passed (80-0). Signed by the Governor on September 26, Tobacco Control Position: ALA in CA/ACSCAN, AHA Neutral 2770 Cigarette and tobacco product licensing: fees and funding (Nazarian D, Sherman Oaks) This bill requires the BOE to conduct a report to determine if the fee established for tobacco retailers is sufficient to cover those costs. Amendments made to the bill on May 12, 2016 require that the Board of Equalization report on the excess balance in the Cigarette and Tobacco Tax Compliance Fund. History: The bill passed the Assembly (44-26 with 10 members absent/did not vote on May 27, 2016) and the Senate (27-11 with 1 member absent/did not vote on August 17, 2016). It was then sent back to the full Assembly for approval of amendments, where it again passed (50-28 with 2 members absent/did not vote on August 31, 2016). Signed by the Governor on September 27, Tobacco Control Position: ALA in CA/ASCAN/AHA 977 Tobacco: youth sports events (Pan D, Sacramento) This bill prohibits the use of tobacco products within 250 feet of a youth sports event. Violators are guilty of an infraction and subject to a $250 fine. History: The bill passed the Senate (33-5 with 2 members absent/did not vote on May 26, 2016) and the Assembly (61-18 with 1 member absent/did not vote on August 18, 2016). It was then sent back to the full Senate for approval of amendments, where it again passed (32-6 with 1 member absent/did not vote on August 25, 2016). Signed by the Governor on September 23, BILLS VETOED BY THE GOVERNOR 1594 Public postsecondary education: prohibitions of using tobacco and smoking on campuses (McCarty D, Sacramento) This bill sought to expand the smoke free policy adopted by the University of California system and apply it to the California State University System and the community college system. This bill included electronic cigarettes. History: The bill passed the Assembly (48-24 with 8 members absent/did not vote on April 25, 2016) and the Senate (26-12 with 1 member absent/did not vote on August 23, 2016). It was then sent back to the full Assembly for approval of amendments, where it again passed (52-27 with 1 absent/did not vote). Vetoed by the Governor on September 26, 2016.

3 THE CENTER FOR TOBACCO POLICY & ORGANIZING PAGE 3 OF State beaches and parks: smoking ban (Block D, San Diego) This bill sought to prohibit smoking, including electronic cigarettes, at state beaches and state parks. Violators would have been guilty of an infraction and a fine of no more than $250. Required signs to be posted on state beaches and state parks. History: The bill passed the Senate (28-11 with 1 member absent/did not vote on May 31, 2016) and the Assembly approved amendments to the bill and approved the bill (50-26 with 4 members absent/did not vote on August 25, 2016). It was then sent back to the full Senate for approval of amendments, where it again passed (26-10 with 3 members absent/did not vote on August 30, 2016). Vetoed by the Governor on September 28, BILLS THAT RECEIVED FLOOR VOTE IN ONE HOUSE 1400 Retail tobacco licenses (Wieckowski D, Hayward) This bill sought to limit the sale of tobacco products to tobacco-only stores. The bill defined tobacco-only stores as stores that primarily sell tobacco, generate more that 60% of their revenue from that sale, and prohibit the entrance of minors under the age of 21. History: The bill passed the Senate (21-16 with 3 members absent/did not vote on June 2, 2016). The bill then failed the Assembly Committee on Business and Professions on June 28, Tobacco store definition (Wieckowski D, Hayward) This bill would make technical changes to the definition of tobacco store to include the sale of tobacco paraphernalia. It is possible that this bill is a spot bill meaning that it was introduced containing minimal detail or non-substantive changes to existing law. This is done in order to meet the deadline to introduce legislation, and allows the author to amend the bill once language and/or policy has been decided upon. History: The bill passed the Senate (25-10 with 5 members absent/did not vote on April 28, 2016). The bill then failed to receive a hearing by the Assembly Committee on Business and Professions and missed the June 1st deadline. Tobacco Control Position: ALA in CA/ACSCAN Neutral, AHA BILLS THAT DID NOT RECEIVE FLOOR VOTES 2169 Drug Paraphernalia Retailers (Allen R, Huntington Beach) This bill sought to prohibit the sale of illegal drug paraphernalia. Current law allows for drug paraphernalia to be displayed in stores as long as it is kept separate from the rest of the store. This bill would remove that law. History: The bill failed to pass (1-5 with 1 member absent/ did not vote) at the Assembly Public Safety Committee hearing on April 20, Neutral 2016 TOBACCO VOTE RECORD Below is the Tobacco Vote Record for the California Legislature during the 2015 legislative session. The vote record shows how every Assembly Member and Senator voted on the four tobacco-related bills that received a floor vote in both houses. Key: Y voted yes on the bill; N voted no on the bill; NV absent or did not vote on the bill The Assembly and Senate held floor votes on certain bills more than once, to concur with amendments made in the other house or because the bill failed to pass on the first vote. In some instances, member s votes differed when a bill was voted on more than once. If a member was absent or did not vote on the bill during one of the votes but voted during the other vote, then the vote record displays the time they actually voted. If a member voted no on a bill one time, and yes on a bill another time, then the vote record displays both votes. The Y and N refer to how the legislator actually voted on the legislation, not how the legislator voted in relation to the tobacco control position on the bill. To understand exactly what a yes or no vote means in relation to the tobacco control position, it is important to refer to the tobacco control positions that are included with each bill summary on the previous pages.
