ITEMS FOR ACTION 7.Approval of 2018/19 BCAG Overall Work Program & Budget Staff presented to the Board the final 2018/19 Overall Work Program & Budget to the BCAG Board of Directors for review, comments and approval. The OWP & Budget identifies twenty-seven specific work elements that address state and federal planning requirements, regional transportation planning needs, capital projects and construction, and public transit administration, operations and planning. There was general discussion by the Board and Staff in regards to the agenda item. On motion by Board Member Jones and seconded by Board Member Dahlmeier, the BCAG 2018/19 Overall Work Program & Budget was unanimously approved. 8.Approval of 2018/19 Butte Regional Transit (B-Line) Service Plan and Budget Staff presented to the BCAG Board the final 2018/19 B-Line Annual Service Plan & Budget. There were minor changes to the draft budget presented to the Transit Administrative Oversight Committee (TAOC) on March 9, The changes that have been made to reflect a reduction of expected federal transit administration funding for the fiscal year. The final budget identifies a total operating budget of $10,206,238. The 2018/19 budget is $90,751 higher than prior year in total dollars, an increase of 0.89%.

8 BCAG Board of Directors Meeting May 24, 2018 Agenda Item #3 Board Member Teeter commented on how much was being subsidized by BCAG; Staff gave an answer of approximately 50%. There was general discussion by the Board and Staff in regards to the agenda item. On motion by Board Member Kirk and seconded by Board Member Wilkinson, the 2018/19 Butte Regional Transit (B-Line) Service Plan and Budget was unanimously approved. 9.Approval of 2018/19 Unmet Transit Needs Assessment & Finding Staff requested the approval of the 2018/19 Unmet Transit Needs Assessment & Findings. There was general discussion by the Board and Staff in regards to the agenda item. On motion by Board Member Kirk and seconded by Board Member Jones, the 2018/19 Unmet Transit Needs Assessment & Finding was unanimously approved. 10.Butte Plug-In Electric Vehicle (PEV) Readiness Plan Update Staff requested the BCAG Board acceptance of the Final Plan for the Butte Plug In- Electric Vehicle (PEV) Readiness Plan. The purpose of the Butte PEV Readiness Plan is primarily to serve as a voluntary toolbox for the cities and county to improve their PEV readiness. It includes numerous components including a regional siting plan that was developed using geographical information system (GIS) software to identify preferred locations throughout the region for future installation of PEV charging stations. On motion by Board Member Kirk and seconded by Board Member Jones, the Butte Plug- In Electric Vehicle (PEV) Readiness Plan Update was unanimously approved. 11.Support of Proposition 69 Staff requested the BCAG Board to support proposition 69 by approving 2017/ Proposition 69 will prohibit the state Legislature from borrowing or diverting these revenues for non-transportation purposes. This will ensure that all revenues from SB1 can only be used for transportation improvement purposes. There was general discussion by the Board and Staff in regards to the agenda item. On motion by Board Member Teeter and seconded by Board Member Dahlmeier the support on Proposition 69 was approved by the majority of the Board Members by a 7-3 vote. Those members voting yes were: Board Members Connelly, Kirk, Lambert, Teeter, Wilkinson, Dahlmeier and Jones; Board Members Wahl, Coolidge and Borges voted no.

9 BCAG Board of Directors Meeting May 24, 2018 Agenda Item #3 ITEMS FOR INFORMATION 12.Senate Bill 1/Gas Tax Funding Overview for Cities & County Staff informed the Board on Senate Bill 1/ Gas Tax funding Overview for Cities & County. Staff prepared a table and summary highlighting the specific projects that are underway as a result of the gas tax to local Butte County Projects. SB 1 essentially doubled available funding for the Active Transportation Program (ATP), Local Streets and Roads, State highway Operations and Protection Program (SHOPP) and the Trade Corridor Enhancement Program. There was general discussion by the Board and staff in regards to the agenda item. 13.Butte Regional Transit 3 rd Quarter Report for 2017/18 Staff informed the Board on the Butte Regional Transit 3 rd Quarter Report for 2017/18. The tables that were included with the item presented a summary of key financial and operations results for Butte Regional Transit. Financial data presentation compares first quarter results to the prior year to date. Operations tables represent a performance-based assessment in comparison to the same quarter of the prior fiscal year. The measures of revenue, expense, ridership, vehicle revenue hours and passengers per vehicle revenue hour is broken down by the four types of service fixed route and paratransit; urban and rural. This separation helps to define where improvements and/or issues are taking place. Accidents and complaints, gauging safety and customer satisfaction, are analyzed for the system as a whole. There was general discussion by the Board and staff in regards to the agenda item. ITEMS FROM THE FLOOR 14. 11 BCAG BOARD OF DIRECTORS Item #4 Consent August 23, 2018 APPROVAL OF RESOLUTION 2018/19-01 AUTHORIZING BCAG TO SUBMIT AN APPLICATION FOR FEDERAL TRANSIT ADMINISTRATION (FTA) SECTION 5311 FUNDING FOR FY 2018/19 TO THE CALIFORNIA DEPARTMENT OF TRANSPORTATION PREPARED BY: Michael Rosson, Transit Manager ISSUE: The Federal Transit Administration (FTA) Section 5311 Intercity Bus Program in California is designed to address the intercity bus transportation needs of the entire state by supporting projects that provide transportation between non-urbanized areas and urbanized areas that result in connections of greater regional, statewide, and national significance. Under FTA Section 5311, project funds are available to provide supplemental financial support to transit operators and to facilitate the most efficient and effective use of available Federal funds in support of providing rural intercity transportation services. DISCUSSION: Staff has utilized prior Section 5311 grants to fund the Operating expenses for public transportation services that are in the Rural Areas of Butte County. These funds, if awarded, will apply to Butte Regional Transit s Operating Budget Fiscal Years. Part of the goal of the FTA Section 5311 funding is to provide financial assistance to help carry out national goals related to mobility for all, including seniors, individuals with disabilities, and low-income individuals. The funding will enhance the access of people in non-urbanized areas to health care, shopping, education, employment, public services, and recreation. If funded, this project will be included in the Federal Transportation Improvement Program (FTIP) for Butte County. The 5311-grant application requires a Board Resolution be included. STAFF RECOMMENDATION: Staff is requesting that the Board of Directors approve Resolution No. 2018/ ; Authority for BCAG to file and execute applications to aid in the financing of capital/operating assistance projects pursuant to Section 5311 of the Federal Transit Act (FTA C F and FTA C ). 12 BUTTE COUNTY ASSOCIATION OF GOVERNMENTS RESOLUTION NO 2018/ RESOLUTION AUTHORIZING BUTTE COUNTY ASSOCIATION OF GOVERNMENTS (BCAG) AUTHORITY TO SUBMIT AN APPLICATION FOR THE FEDERAL FUNDING UNDER FTA FFY2018/2019 SECTION 5311 (49 U.S.C. SECTION 5311) WITH CALIFORNIA DEPARTMENT OF TRANSPORTATION WHEREAS, the U. S. Department of Transportation is authorized to make grants to states through the Federal Transit Administration to support capital/operating assistance projects for non-urbanized public transportation systems under Section 5311 of the Federal Transit Act (FTA C F and FTA C ); and WHEREAS, the California Department of Transportation (Department) has been designated by the Governor of the State of California to administer Section 5311 grants for transportation projects for the general public for the rural transit and intercity bus; and WHEREAS, Butte County Association of Governments desires to apply for said financial assistance to permit operation of service/purchase of capital equipment in Butte County; and WHEREAS, the Butte County Association of Governments has, to the maximum extent feasible, coordinated with other transportation providers and users in the region (including Non-Profit and Social Service Agencies). NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the Butte County Association of Governments (BCAG) Board of Directors does hereby Authorize the Executive Director, Deputy Director, and Transit Manager, to file and execute applications on behalf of the Department to aid in the financing of capital/operating assistance projects pursuant to Section 5311 of the Federal Transit Act (FTA C F and FTA C ), as amended. That the Executive Director, Deputy Director, and Transit Manager is authorized to execute and file all certification of assurances, contracts or agreements or any other document required by the Department. That the Executive Director, Deputy Director, and Transit Manager is authorized to provide additional information as the Department may require in connection with the application for the Section 5311 projects.

15 BCAG BOARD OF DIRECTORS Item #5 Consent August 23, 2018 RESOLUTION 2018/19-02 APPROVING AND ADOPTING TRANSDEV S ZERO TOLERANCE DRUG AND ALCOHOL POLICY FOR EMPLOYEES IN SAFETY- SENSITIVE JOB FUNCTIONS OF THE BUTTE REGIONAL TRANSIT/B-LINE BUS SERVICE PREPARED BY: Michael Rosson, Transit Manager ISSUE: The United States Department of Transportation, Federal Transit Administration (FTA), and the Caltrans Division of Rail and Mass Transportation (DRMT) require FTA 5311 subrecipients to have an FTA-approved Drug & Alcohol (D&A) Policy and be in compliance with that Policy. The requested action involves adoption of an updated Zero Tolerance Drug & Alcohol Policy for Butte County Association of Governments (BCAG) as an FTA 5311 subrecipient and as the administering entity for the Butte Regional Transit/B-Line. Effective January 1, 2018, the United States Department of Transportation (DOT) updated its drug and alcohol testing requirements to include additional testing requirements for four semi-synthetic opioids (hydrocodone, oxycodone, hydromorphone, and oxymorphone). Other changes to the DOT regulations included clarifications regarding several definitions and a number of procedural changes to the sample collection and testing requirements. A full list of the changes, clarifications, and best practices is provided in Attachment A: Summary of Drug & Alcohol Policy Changes. DISCUSSION: Transdev, as the current contracted operator of Butte Regional Transit bus services, has updated its Zero Tolerance Drug & Alcohol Policy to reflect the required Federal, State, and local requirements. Transdev s policy was updated to reflect the reported changes. A copy of Transdev s Policy is provided for reference purposes as Attachment B to this Staff report. As it relates to the proposed Policy, BCAG has no directly employed safety-sensitive employees. Transdev currently has 100 safety-sensitive employees to whom this policy would apply. Transdev is solely responsible for the monitoring and reporting of safetysensitive employees under the contract with BCAG. Transdev s Zero Tolerance Drug and Alcohol Policy For Employees In Safety-Sensitive Job Functions is compliant with the FTA.

However, doing so would result in the loss of future FTA Transit funding and State transit funding upon which the Butte Regional Transit bus service relies for Operation and Capital funding support. Transdev has updated its FTA Drug & Alcohol Policy to reflect the most current FTA requirements; and WHEREAS, failure to adopt the proposed Transdev Zero Tolerance Drug and Alcohol Policy For Employees In Safety-Sensitive Job Functions policy could result in a negative finding in BCAG s future FTA and/or TDA Triennial Performance Audits and jeopardize Federal & State transportation funding for the operation of the Butte Regional Transit bus services. 46 BCAG BOARD OF DIRECTORS Item #6 Consent August 23, 2018 APPROVAL OF 2018/19 PRELIMINARY TRANSPORTATION DEVELOPMENT ACT (TDA) CLAIMS FOR THE CITIES, TOWN, COUNTY, BRT AND BCAG PREPARED BY: Ivan Garcia, Transportation Programming Specialist ISSUE: Transportation Development Act (TDA) regulation requires the governing board of the regional entity approve by resolution all claims filed for the allocation of TDA funds. DISCUSSION: The TDA has been apportioned to each jurisdiction with the Findings of Apportionment approved by the Board in May. The jurisdictions have now filed an expenditure plan to claim those funds. Use of the funds is prioritized by the TDA regulations. STA provides funding solely for public transportation services while LTF allocation priorities are as follows: 1. TDA Administration 2. Planning and Programming 3. Pedestrian and Bicycle projects 4. Rail passenger and Transit services 5. Other transportation purposes including additional transit, bicycle and streets and roads. These claims may only be apportioned when all other uses of the funds have been exhausted. Each of the attached Preliminary Expenditure Plan identifies the specific breakdown on how the jurisdiction intends to provide local transit service in accordance with the requirements of the TDA. The attached resolution identifies the summary total of Local Transportation Fund (LTF) and State Transit Assistance (STA) expenditures and allows for flexibility should minor adjustments be necessary. Staff has reviewed the attached claims and found them to be in accordance with the TDA guidelines and within the apportionments approved by this Board. The 18/19 Preliminary Expenditure Plans will be revised after the 17/18 Jurisdiction TDA audits are complete and B-line carryover amounts are calculated. The Final Expenditure Plans will be brought to the Board for approval and utilized for the 18/19 TDA audits. Expenditure Plans may be revised as necessary to reflect corrections in the form.

48 BUTTE COUNTY ASSOCIATION OF GOVERNMENTS RESOLUTION NO 2018/ RESOLUTION OF THE PRELIMINARY ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT (TDA) FUNDS TO THE BUTTE COUNTY JURISDICTIONS FOR FISCAL YEAR 2018/19 WHEREAS, the Butte County Association of Governments has been designated by the Secretary of the State of California, Business and Transportation Agency, as the Regional Transportation Planning Agency (RTPA) for Butte County, pursuant to the provisions of the Transportation Development Act of 1971, as amended; and WHEREAS, it is the responsibility of the Butte County Association of Governments, under the provision of the Transportation Development Act, to review transportation claims and make allocations of funds from the Local Transportation Fund and the State Transit Assistance fund based on the claims; and WHEREAS, the Auditor of Butte County is required to pay monies in the fund to the claimants pursuant to allocation instructions received by him/her from the Butte County Association of Governments; and WHEREAS, the Butte County Association of Governments has reviewed this claim for Transportation Development Act funds and has made the following findings and allocations: 1. The claimants proposed expenditures are in conformity with the Regional Transportation Plan. 2. The level of passenger fares and charges is sufficient to enable the operator or transit service claimant to meet the fare revenue requirements of Public Utilities Code Sections , , , and , as they may be applicable to the claimant. 3. The claimant is making full use of federal funds available under the Federal Transit Act, as amended. 4. The claimant has prepared and submitted the Local Transportation Fund (LTF) and State Transit Assistance (STA) Fund Annual Project and Expenditure Plan. 5. The sum of the claimant's allocation from the State Transit Assistance Fund and the Local Transportation Fund does not exceed the amount the claimant is eligible to receive during the fiscal year. 6. Priority consideration has been given to claims to offset reductions in federal operating assistance and the unanticipated increase in the cost of fuel, to enhance existing public transportation services, and to meet high priority regional, countywide, or area wide public transportation needs. 7. The regional entity may allocate funds to an operator for the purposes specified in Section 6730 of the California Code of Regulations only if, in the resolution allocating the funds, it also finds the following:

BCAG s approved Amendment #09 is required to be revised to incorporate the new requirement. The projects approved as part of Amendment #09 have not changed. PERFORMANCE MEASURES LANGUAGE FOR 2017 FTIP AMENDMENTS (new) The 2012 federal transportation authorization legislation, Moving Ahead for Progress in the 21st Century (MAP-21) established new requirements for performance management and reporting to ensure the most efficient investment of Federal transportation funds. To incorporate the new federal performance requirements into the Federal Transportation Improvement Program (FTIP), BCAG is required to show (1) that the FTIP makes progress towards achieving [the region s] performance targets and (2) that the FTIP includes, to the maximum extent practicable, a description of the anticipated effect of the FTIP towards achieving the performance targets. The projects contained within Amendment No.09 have been developed in accordance with the applicable provisions and requirements of 23 CFR Part 450 and are expected to support the achievement of these targets. These targets will be achieved through the implementation of investment priorities through the programming of transportation projects in the 2017 FTIP, this FTIP Amendment, and subsequent FTIP Amendments and Administrative Modifications. AMENDMENT #09 PREVSIOUSLY APPROVED BY BCAG The purpose of this amendment is to make the following changes described below. The changes reflect the programming of new State Transportation Improvement Program (STIP) funding approved by the California Transportation Commission for projects on the State Route 70 Corridor. 70 BCAG BOARD OF DIRECTORS Item #8 August 23, 2018 Consent APPROVAL OF RESOLUTION 2018/19-04 ACCEPTING U.S. FISH & WILDLIFE SERVICE SECTION SIX GRANT FOR BUTTE REGIONAL CONSERVATION PLAN PREPARED BY: Chris Devine, Planning Manager ISSUE: BCAG is facilitating the development of the Butte Regional Conservation Plan (BRCP) on behalf of the Cities of Biggs, Chico, Gridley, and Oroville, the County of Butte, Caltrans District 3, Western Canal Water District, Richvale Irrigation District, Biggs West Gridley Water District, and Butte Water District. BCAG was recently awarded a U.S. Fish and Wildlife Service (USFWS) Section 6 Planning Assistance Grant, requiring a resolution be approved by BCAG Board of Directors. DISCUSSION: BCAG was recently awarded a USFWS Section Six Planning Assistance Grant to complete the development of the final Butte Regional Conservation Plan (BRCP) and required environmental document (joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR)). A grant contract must be in place with the California Department of Fish and Wildlife (DFW) in order to spend these federal funds. This grant contract must include a resolution approved by the BCAG Board of Directors acknowledging acceptance of the grant award and commitment to the 25% non-federal match required for the grant. The Section Six Grant program is a nationally competitive grant program and BCAG was one of two California plans to be awarded the funding (the other was the Upper Santa Ana River Watershed HCP in southern California). The funding will be used to develop final BRCP and EIS/EIR documents that incorporate comments received during the formal public review period held in 2015/16. Separate funding through an agreement with Caltrans will allow for continued work on developing a Regional General Permit and In-Lieu-Fee Program to streamline the Army Corp of Engineers Section 404 permitting process. STAFF RECOMMENDATION: BCAG staff recommends that the BCAG Board of Directors approve Resolution No. 2018/19-04 acknowledging acceptance of the grant award and commitment to the 25% non-federal match required for the grant. 71 BUTTE COUNTY ASSOCIATION OF GOVERNMENTS RESOLUTION NO 2018/ RESOLUTION OF THE BUTTE COUNTY ASSOCIATION OF GOVERNMENTS ACCEPTING FEDERAL SECTION SIX GRANT FUNDING FOR DEVELOPMENT OF BUTTE REGIONAL CONSERVATION PLAN (BRCP) AND COMMITTING A REQUIRED 25% NON-FEDERAL MATCH WHEREAS, the Butte County Association of Governments (BCAG) is the designated Metropolitan Planning Organization in accordance with 23 USC 134(b)(6); and Section of the Metropolitan and Statewide Planning Rule; and the State designated Regional Transportation Planning Agency (RTPA) for Butte County; WHEREAS, BCAG is a Joint Powers Authority consisting of the Cities of Biggs, Chico, Gridley, Oroville, the Town of Paradise, and the County of Butte (Local Agencies); WHEREAS, BCAG will manage and coordinate funding for the development of a joint Habitat Conservation Plan and Natural Community Conservation Plan (HCP/NCCP) for submission to the governing boards of the Local Agencies and the U.S. Fish and Wildlife Service, National Marine Fisheries Service and Department of Fish and Game; WHEREAS, in March 2018, BCAG was awarded a federal Section Six Planning Assistance Grant award from the U.S. Fish and Wildlife Service in the amount of $409,614; WHEREAS, BCAG applied for the Federal Section Six Grant for development of the Butte Regional Conservation Plan, a Habitat Conservation Plan/Natural Community Conservation Plan; WHEREAS, BCAG will work with the California Department of Fish and Wildlife (CDFW) to receive these funds through a contract with CDFW who is the State recipient of the federal funds and manager of these funds; NOW THEREFORE BE IT RESOLOVED that the Butte County Association of Governments acknowledges receipt of the Federal Section Six Grant funding and is able to receive these funds in the amount of $409,614 and will assure the commitment and obligation of a 25% non-federal funding match amount of $132,500.

74 BCAG BOARD OF DIRECTORS Item #9 Consent August 23, 2018 APPROVAL OF SOCIAL SERVICES TRANSPORTATION ADVISORY COUNCIL (SSTAC) APPOINTMENTS PREPARED BY: Cheryl Massae, Human Resources Manager ISSUE: Appointments to the BCAG Social Services Transportation Advisory Council (SSTAC) are required to be approved by the BCAG Board of Directors. DISCUSSION: The attached roster identifies all members of the SSTAC and lists the categories that are required by the Transportation Development Act, Section PUC The SSTAC is required under the Transportation Development Act (TDA) to work with staff during the annual unmet transit needs process. The purpose of the SSTAC is to review testimony obtained through public workshops conducted during the annual unmet transit needs process, and to provide the BCAG Board of Directors with an unmet transit needs finding. The SSTAC also provides a forum to address other issues facing transportations disabled citizens. The BCAG Board may make at large appointments at any time. A call for applicants was advertised in local newspapers in June 2018 as well as on the BCAG website and B-Line buses. 77 BCAG BOARD OF DIRECTORS Item #10 Information August 23, 2018 DRAFT 2019 FEDERAL TRANSPORTATION IMPROVEMENT PROGRAM (FTIP) AND AIR QUALITY DETERMINATION PREPARED BY: Ivan Garcia, Programming Manager ISSUE: The Draft 2019 Federal Transportation Improvement Program (FTIP) and Air Quality Conformity Determination have been prepared and are available for review and comment. DISCUSSION: As the Metropolitan Planning Organization for Butte County, BCAG is required to prepare and update a FTIP document every two years. The purpose of the FTIP is to identify all transportation-related projects that require federal funding and approval by the Federal Highway Administration (FHWA) or the Federal Transit Administration (FTA). The FTIP also identifies all non-federal, regionally significant projects for information and air quality emissions modeling purposes. The FTIP indicates the area's short-term plan for use of federal dollars and other resources for the maintenance, operation, and improvement of the transportation system and the achievement of federal air quality standards over the next four federal fiscal years. The draft 2019 FTIP identifies approximately $375 million in funding for 37 projects over the next four federal fiscal years beginning October 1, The attached Table FTIP Summary identifies the projects by agency, fiscal year and fund source. The 2019 FTIP was developed in consultation with required state and federal agencies, and BCAG s transportation advisory committee. Development of the FTIP has been posted at BCAG s web page and noticed in the local newspapers indicating its availability and scheduled adoption for the September 27, 2018 Board meeting. Once adopted, the BCAG Board may amend the FTIP at any time. In addition, staff distributed the Draft Air Quality Conformity Determination to the Interagency Consultation Review (ICR) group which included representatives from the Federal Highway Administration, Environmental Protection Agency, Caltrans, Butte County Air Quality Management District and the Air Resources Board to review BCAG s Air Quality Analysis and Determination projects and process. BCAG has received concurrence from the required group. A complete FTIP Document will be available at the Board meeting.

78 BCAG Board of Directors Item #10 August 23, 2018 Page 2 While most of the projects in the 2019 FTIP are existing projects from the 2017 FTIP, staff has incorporated new Congestion Mitigation and Air Quality Projects (CMAQ) to be approved by the Board as part of the adoption of the new FTIP. The new CMAQ projects are summarized as a separate table. Each project proposed has utilized BCAG s CMAQ funds as funding leverage for potential Active Transportation Programming funds. Each project meets both program eligibility criteria for the CMAQ and ATP programs. The City of Chico has requested that its programming request for the Hagen/Midway Corridor Congestion Relief Project in south Chico be considered in the next FTIP cycle. The City has indicated that a request for approximately $6.2 million in CMAQ funds will be made at that time. In doing so, the rest of the local jurisdictions are able to request CMAQ funds at this time to further their ATP grant efforts. A final public workshop for final comments on the draft FTIP has been scheduled for Thursday September 13, 2018 from 3 to 5:30 p.m. at the BCAG offices. 85 BCAG BOARD OF DIRECTORS Item #11 August 23, 2018 STATE ROUTE 70 CORRIDOR PROJECT UPDATE PREPARED BY: Andy Newsum, Project Manager ISSUE: As the lead CEQA agency, BCAG is hosting a public open house prior to adoption of the project CEQA environmental document. DISCUSSION: Staff has been working with a consultant and Caltrans District 3 to deliver a CEQA/NEPA environmental document. Caltrans is assuming the NEPA lead agency role. The draft CEQA document prepared is an Initial Study in support of a Negative Declaration for which mitigations have been proposed. The required Notice of Intent (NOI) to adopt a CEQA Mitigated Negative Declaration (MND) has been posted on the BCAG and Caltrans websites, published in the local newspapers and is also on file with the State Clearinghouse in Sacramento. The Draft NEPA document is an Environmental Assessment in support of a Finding of no Significant Impact (FONSI). An open house presentation was held on August 22, 2018 from 4pm 8pm at the Southside Oroville Community Center located at 2959 Lower Wyandotte Road in Oroville, CA. Contained within the presentation were a short slideshow and white board mounted exhibits together with handouts. The remainder of the open house was allotted for the answering of public questions by Caltrans, BCAG and consultant staff. The public review period will run from August 7 th, 2018 to September 5 th, Following completion of the review period and production of the final MND, the BCAG Board will adopt the CEQA MND at the next scheduled BCAG Board Meeting. 87 BCAG BOARD OF DIRECTORS Item #12 Information August 23, 2018 BUTTE REGIONAL CONSERVATION PLAN (BRCP) UPDATE PREPARED BY: Chris Devine, Planning Manager ISSUE: BCAG is facilitating the development of the Butte Regional Conservation Plan (BRCP) on behalf of the Cities of Biggs, Chico, Gridley, and Oroville, the County of Butte, Caltrans District 3, Western Canal Water District, Richvale Irrigation District, Biggs West Gridley Water District, and Butte Water District (BRCP permit applicants). DISCUSSION: BCAG was recently awarded a USFWS Section Six Planning Assistance grant to complete the development of the final Butte Regional Conservation Plan (BRCP) and required environmental document (joint Environmental Impact Statement/Environmental Impact Report (EIS/EIR)). The development of the final BRCP and EIS/EIR will include revising the BRCP and EIS/EIR documents based on comments received during the 204-day public review period held from November 2015 to June The process of revising the documents was initiated in late 2016, but was put on hold in March 2017 when funding ran out. These new grant funds will allow the finalization of these revisions, and will include coordinating with BRCP permit applicants, state and federal wildlife agencies, and key stakeholders to complete the final documents. BCAG staff and the BRCP permit applicants previously discussed using the grant funding to complete a second public draft BRCP and EIS/EIR. However, this is no longer feasible due to the issuance of Secretarial Order 3355 by the Secretary of the Interior in Washington DC on April 27, This order requires that an outstanding EIS with a Notice of Intent (NOI) published on or before August 31, 2017 must be completed with the Record of Decision (ROD) filed no later than April 27, Because the BRCP EIS/EIR NOI was published back in November 2016 (before the start of the formal public review period), the ROD must be filed by the April 27, 2019 deadline. BCAG staff has discussed this with USFWS who has indicated that the April 27, 2019 deadline is a firm deadline, and requests for a timeliness waiver to extend the program is unlikely to be granted by the Secretary of the Interior. BCAG staff has also discussed this with the BRCP permit applicants, who concur with moving forward according to this revised approach and schedule. A tentative schedule for meeting the April 27, 2019 deadline is provided below:

Coordinate revisions with wildlife agencies (USFWS, National Marine Fisheries Service (NMFS), California Department of Wildlife (CDFW)), Corp, BRCP permit applicants and key stakeholders; January mid-february 2019: Final review of BRCP, EIS/EIR, RGP and In-Lieu Fee Program by BRCP permit applicants, wildlife agencies and Corp; February 2019: Final BRCP submitted to wildlife agencies; Final RGP and In- Lieu-Fee Program submitted to Corp; March 2019: Public release of Final BRCP, EIS/EIR, RGP and In-Lieu Fee Program for 30-day NEPA review; April 2019: Close of 30-day NEPA review; April 27, 2019: USFWS completes NEPA decision documents: 1) Section 7 Biological Opinion; 2) ESA Findings and Recommendations, and NEPA Record of Decision; and 3) ESA Section 10 Permit (including Terms and Conditions). May, June, July 2019: BRCP permit applicants boards and city councils meet for final approval of BRCP, EIR, Implementing Agreement, RGP and In-Lieu-Fee Program, and local ordinances. May, June, July 2019: USFWS, NMFS, CDFW, Corp issue permits As the Board is aware, significant coordination has occurred since development of the BRCP began in February This has included numerous meetings with the BRCP permit applicants, state and federal wildlife agencies, and key stakeholders to ensure all parties interests and concerns are reflected in the plan. To date, public input on the BRCP and associated components has met and significantly exceeded the requirements of an HCP/NCCP. Attachment 1 summarizes BRCP public outreach efforts over the last 11 years. BCAG staff will continue to keep the Board informed as the program moves forward. 89 BRCP PUBLIC OUTREACH SUMMARY BACKGROUND The development of the Butte Regional Conservation Plan (BRCP) has included multiple avenues of public outreach, and has met and exceeded such requirements for regional multi-species conservation plans. Public outreach over the past 11 years has included: BRCP Stakeholder Committee meetings Additional outreach to interest groups and individuals Three rounds of public workshops Press releases BRCP website Newsletters & brochures distribution list and mailing list BCAG Board of Directors meetings BRCP STAKEHOLDER COMMITTEE MEETINGS The first BRCP Stakeholder Committee meeting was held in February 2007 and to date, 47 publicly-noticed meetings have been held. The Committee includes representatives from a diverse array of interest groups, including environmental, agriculture, land owners, hunting clubs, educational institutions, federal and state agencies, and others. Members of the committee have reviewed and provided input on every section of every chapter of the BRCP during the 11-year period of Plan development, resulting in a balanced plan that is reflective of the many diverse interests in the Plan Area. ADDITIONAL OUTREACH TO INTEREST GROUPS AND INDIVIDUALS BCAG staff has conducted many meetings with interest groups and individuals that are unable or do not wish to attend Stakeholder Meetings. This has included a myriad of different groups, entities and individuals, from Rotary Clubs and Chambers of Commerce to Butte County Rice Growers Association and cattle ranchers; from Friends of Butte Creek and River Partners to Chico Building Industry Association and various land owners. These meetings have resulted in changes to the BRCP that further reflect the diverse interests of the Plan Area. THREE ROUNDS OF BRCP PUBLIC WORKSHOPS BCAG has conducted three different rounds of public workshops since 2007 to solicit public input in the development of the Plan. Workshops were held each time in Chico, Gridley and Oroville. The first public workshops were held in 2007, and the purpose of was to inform the public that the development of the BRCP was getting underway, and to communicate the various avenues for participating in Plan development.
