Public Meetings: A COMPREHENSIVE PLAN AMENDMENTS DOCKET PUBLIC HEARING In accordance with OHMC Section , the City is initiating its annual Comprehensive Plan amendment process. Staff will present the draft 2019 docket to the Planning Commission. The 2019 docket will include continued work on the park, recreation, open space, housing, and economic development elements. The Capital Improvements Plan will also be reviewed for annual updates. The Commission is expected to make a recommendation to the City Council. B PLANNING COMMISSION ANNUAL REPORT TO CITY COUNCIL Public Meeting The Planning Commission will review the draft annual report to the City Council. Approval of Minutes October 23, 2018 Motion: Commissioner Hovey moved to approve the October 23, 2018 minutes as presented. Second: Commissioner Schaub seconded the motion. Commissioners Freeman, Phillip, and Waters abstained as they had been absent. With all in favor, the motion carried unanimously. 3. Public Comment: There were no general comments from the public. 4. Public Meetings A COMPREHENSIVE PLAN AMENDEMENTS PUBLIC HEARING This is a continuation of the Public Hearing that began at the on 10/23/2018. The Planning Commission held a public hearing on the 2018 Comprehensive Plan amendments and forwarded a recommendation to City Council. Staff Presentation Cac Kamak, Senior Planner, continued with his presentation of the Comprehensive Plan moving forward for amendment in 2018 in the Capital Improvements Plan (CIP). Mr. Kamak completed presentation of materials and opened for questions, moving toward a possible motion if the Commission is ready to recommend. Commissioner Questions Commissioner Schaub asked clarifying questions about the implementation of the Comprehensive Plan and how or if any design guidelines are included in this plan. Staff discussed design guidelines that are applied differently dependent on the type of project. Commissioner McPheeters commented on possibly including more context on the projects in this document that could include things like the reason for the project, any changes in scope of work, updates from one annual revision to the next, or referencing documents that contain this information. He also asked about the possibility of including more information about the level of priority per project. Commissioner Hovey shared thoughts on project timelines and documents that are available to the public possibly containing more information about project details and their expenses. Staff discussed the challenges associated with including this level of detail and will consider how to address these comments in future reporting documents. 9 Public Hearing Chairman Wasinger opened the public hearing at 6:30 PM. There were no comments from the public. Chairman Wasinger closed the public hearing at 7:35 PM. Motion Motion: Commissioner McPheeters recommended forwarding of Ordinance No to City Council, adopting the Capital Improvements Plan , which constitutes the 2018 Comprehensive Plan Amendments. Second: Commissioner Schaub seconded. The motion passed with Commissioners Wasinger, McPheeters, and Schaub in favor, Commissioner Hovey opposed. 5. The next regular business meeting is January 22, Chairman Wasinger adjourned the meeting at 7:36 PM. 11 City of Oak Harbor Planning Commission Report Date: January 22, 2019 Subject: 2019 Comprehensive Plan Amendments Docket FROM: Cac Kamak, AICP, Senior Planner, Development Services Department PURPOSE This memo presents the 2019 Comprehensive Plan Amendments Docket. The Planning Commission is required to conduct a public hearing on this item and make a recommendation to the City Council. BACKGROUND / SUMMARY INFORMATION Since the State limits amendments to the comprehensive plan to no more frequently than once a year 1, the City has codified the process to amend the Comprehensive Plan in Oak Harbor Municipal Code Chapter The process is initiated in October every year with a notice to the public as the preliminary docket is compiled. Docket items are discussed with the Planning Commission and the City Council between December and February prior to it being finalized in March. Docket items are categorized based on whether they are mandatory or discretionary updates. Although most docket items are State mandated items, many of the amendments are issues that the City Council, Planning Commission, or the community have identified during the year. For example, the Parks, Recreation, and Open Space Plan can be considered a mandated item since the Recreation and Conservation Office (RCO), which is a source of grant funds, requires the plans to be updated every six years. Amendments such as the Economic Development Element, Housing Element, are issues generally identified by the Council, or Commission, or the community during the course of the year. The docket for the 2019 Comprehensive Plan Amendments are primarily items that are continuing to be worked on from the 2018 docket. Amendments that will continue into the 2019 Docket: Parks, Recreation, and Open Space Plan (Parks Plan) Most of the discussion related to the Plan s goals, policies, and projects have already been discussed by the City Council and the Planning Commission. A draft of the Plan is in work and will soon be available for review. Staff is working to get the Plan into the adoption process early in the year. Economic Development Element This is a discretionary item that was kept open in 2018 so that the City could consider amendments as necessary. 12 involvement with Mainstreet Association and Chamber of Commerce, it is prudent to leave this item open for Capital Improvements Plan (CIP) The City has traditionally updated the Capital Improvements Plan annually with other Comprehensive Plan amendments. New tools were incorporated into the planning process in 2018 and is anticipated to improve in Amending the CIP annually allows for more refinement and coordination in the planning and implementation process. Housing Element This Element was added to the 2018 docket because of concerns over housing land availability as well as affordability. In reviewing the Element with the Planning Commission at the September 2018 meeting, staff indicated that there are several policies and goals that address the concerns raised by the community. What may be needed here is an implementation strategy for some of the existing goals and policies. OHMC Section establishes the criteria to review the Comprehensive Plan Amendment Docket. The table below provides the applicability of the criteria to the proposed preliminary docket items. The items on the proposed preliminary docket are in general conformance with the established criteria in OHMC Section where applicable. 2 01/22/2019 Master Page 12 of 31

13 Criteria provided in OHMC Section (2) (a) The proposed amendments are consistent with Growth Management Act (GMA) and the Countywide Planning Policies (CPP). (b) The proposal does not appear to contradict other elements, goals and policies within the Comprehensive Plan. (c) The proposal will implement or further existing goals and policies in the Comprehensive Plan. (d) The proposal would correct an inconsistency within or make a clarification to a provision of the Comprehensive Plan. (e) The proposed amendments have been clearly defined to determine a fairly accurate scope of work. (f) The proposed amendments respond to an expressed desire by the community. (g) The public interest would be best served by considering the proposal in the current year. BACKGROUND / SUMMARY INFORMATION Staff has drafted the report for 2018; the work program for 2019; and prepared the action details based on approved meeting minutes. RECOMMENDED ACTION Staff requests that the Commission review the report and work program for 2019, and consider any recommendations that they would like to forward to City Council. 23 Description of 2019 Proposed Work Program Items 2019 Comprehensive Plan Amendments Docket In accordance with OHMC Section , the City must annually update its Comprehensive Plan and present a docket of proposed items to the public and the Planning Commission. Docketed items will be worked on throughout the year, culminating in the 2019 Comprehensive Plan Amendments in the fall Comprehensive Plan Amendments Once the Planning Commission has undertaken work on the 2019 docketed Comprehensive Plan Amendments, the items moving forward as formal amendments will come before the Planning Commission in the fall. Parks, Recreation and Open Space Plan Update It is necessary to update the Parks, Recreation and Open Space Plan to reflect current community conditions and to maintain funding agency (grants) eligibility. Main Street Design Guidelines The Oak Harbor Main Street Association (OHMSA) has proposed design guidelines to be built into the review process for projects in the Central Business District. Staff will review and work through this proposal. Critical Areas Ordinance, Wetlands Revisions Potential amendments may be recommended to OHMC Chapter (Wetlands) in response to comments received at the August 2018 City Council public hearing. These comments were reiterated in a document dated November 15, 2018 and provided to the city. Any code amendment will come before the Planning Commission. Shoreline Master Program 2020 Update RCW (4)(a) requires local governments to conduct a review of their Shoreline Master Program (SMP) and, if necessary, revise the SMP. This review is to ensure the updated SMP complies with applicable laws and guidelines and is consistent with our Comprehensive Plan and development regulations. The Planning Commission will be instrumental in this review and update which is due June 30, Small Cell Deployment Ordinance Revisions Staff will present a code amendment to reflect recent FCC decisions. Staff presented the draft code amendment at this meeting. As an outgrowth of the Oak Harbor Transportation Plan (August 2016), staff is seeking to update the transportation concurrency ordinance (OHMC Chapter 11.32) to parallel the Plan s concepts while remaining in conformance with the GMA. ACTION: Commissioner Freeman moved to recommend adoption of Ordinance No to the City Council, repealing and replacing Chapter Transportation Concurrency to Title 11 of the Oak Harbor Municipal Code. Commissioner McPheeters seconded. With all in favor, the motion carried unanimously. SMALL CELL DEPLOYMENT Public Meeting City Council passed interim ordinances regarding the process and regulations for citing of small cells in the City s public right of way. Staff briefed the Commission on the interim ordinances and the proposed code amendments. GARRY OAK TREE PROTECTION ORDINANCE Public Meeting While working on an Ordinance regarding variances last year, Planning Commission and City Council expressed interest in considering regulations that would be more specific with Garry Oak Tree protection standards. Staff briefed the Commission on the proposed code amendments at this meeting COMPREHENSIVE PLAN AMENDMENT: PARK PLAN UPDATE Public Meeting An update to the Park Plan is part of the 2018 Annual Comprehensive Plan Amendments docket. Staff continued the update process at this meeting. JUNE 26, 2018 No Meeting JULY 24, 2018 SIX-YEAR TRANSPORTATION IMPROVEMENT PROGRAM Public Hearing The Transportation Improvement Program (TIP) 2019 to 2024 is a document that briefly describes future Oak Harbor transportation projects. It is a basic planning document that is required by State law and facilitates use of Federal transportation funds awarded to the City. The Transportation Improvement Program also helps coordinate City transportation projects with other agencies and utility companies. The Planning Commission will conduct a public hearing to consider the updates to the Six-Year Transportation Improvement Program. ACTION: Commissioner Hovey moved to recommend that the City Council adopt the Six-Year Transportation Improvement Program. Commissioner Freeman seconded. 30 GARRY OAK TREE PROTECTION ORDINANCE PUBLIC HEARING The Planning Commission will conduct a public hearing on proposed amendments to OHMC Chapter 20.16, Oak Tree Protection. The amendments are intended to strengthen the protection measures used when construction occurs near Garry oak trees. ACTION: Commissioner Freeman moved that the amendments to OHMC Chapter in Ordinance No be forwarded to the City Council with a recommendation for approval. Commissioner Hovey seconded. With all in favor, the motion carried unanimously COMPREHENSIVE PLAN AMENDMENT: PARK PLAN UPDATE Public Meeting An update to the Park Plan is part of the 2018 Annual Comprehensive Plan Amendments docket. Staff continued the update process at this meeting. AUGUST 28, 2018 SMALL CELL DEPLOYMENT PUBLIC HEARING City Council passed interim ordinances regarding the process and regulations for citing of small cells in the City s public right of way. Staff presented the permanent ordinances at this meeting. ACTION: Commissioner McPheeters moved to recommend adoption of Ordinance No with additional housekeeping updates as suggested by staff, to the City Council establishing procedures for small cell deployment. Commissioner Philipp seconded. With all in favor, the motion carried unanimously. SEPTEMBER 25, COMPREHENSIVE PLAN AMENDEMENTS Public Meeting Staff continued the discussion on general updates to the 2018 Comprehensive Plan. 31 OCTOBER 23, COMPREHENSIVE PLAN AMENDEMENTS PUBLIC HEARING The Planning Commission will hold a public hearing on the 2018 Comprehensive Plan amendments. ACTION: Vice Chairman Freeman moved to continue the public hearing on the 2018 Comprehensive Plan Amendments to the November 27, 2018 Planning Commission Meeting. Commissioner Hovey seconded. With all in favor, the motion carried unanimously COMPREHENSIVE PLAN AMENDMENTS DOCKET Public Meeting In accordance with OHMC Section , the City is initiating its annual Comprehensive Plan amendment process. Staff initiated a discussion with the Planning Commission on items to consider for the 2019 amendments. NOVEMBER 27, COMPREHENSIVE PLAN AMENDMENTS PUBLIC HEARING (CONT.) This is a continuation of the Public Hearing that began at the on 10/23/2018. The Planning Commission held a public hearing on the 2018 Comprehensive Plan amendments and forwarded a recommendation to City Council. ACTION: Commissioner McPheeters recommended forwarding of Ordinance No to City Council, adopting the Capital Improvements Plan , which constitutes the 2018 Comprehensive Plan Amendments. Commissioner Schaub seconded. The motion passed with Commissioners Wasinger, McPheeters, and Schaub in favor, Commissioner Hovey opposed.
