1 STANDARD SUMMARY PROJECT FICHE 1. Basic Information 1.1 Desirée Number CZ 2003/ Twinning Number CZ03/IB/EN/ Title Integrated and Planned Enforcement of Environmental Law 1.4 Sector Environment 1.4. Location Czech Republic 2. Objectives 2.1 Overall objectives Ability to take on the obligations of membership of the European Union including adherence to the aims of the political, economic and monetary union, and the acquis communautaire. 2.2 Project purpose Strengthening environmental protection through integrated and planned approach to enforcement of environmental laws at central enforcement institution level and also regional level of state administration. 2.3 Accession Partnership and NPAA Priority Accession Partnership 2001 to continue strengthening the administrative, monitoring, and enforcement capacity at national, regional and local level. Particular attention needs to be paid to clear distribution of competencies, to improve co-operation between responsible authorities, to training and to strengthening the investment planning capacity to continue integration of environmental protection requirements into the definition and implementation of all other sectoral policies with a view to promoting sustainable development. This project will support the fulfilment of both targets. NPAA The National Programme for the Preparation of Czech Republic for Membership of the EU, and Approximation Strategy which forms part of this programme, both refer to the importance of improving environmental legislation and its implementation. In the medium terms the position of the Czech Environmental Inspectorate should be strengthened (point to point 3.5 p.6). Action plan for reinforcing the Czech Republic s administrative and judicial capacity Priority 1 : strengthening administrative, monitoring and enforcement capacity (all levels) : - clear distribution of competencies - co-operation - training - strengthening the investment planning capacity 2.4 Contribution to the National Development Plan Czech Republic National Development Plan for includes basic principles, which this project will help to fill: preventive measures on the basis of support for ecological technologies, prevention principle, principle of best available techniques (BATs), integration principle and polluter pay principle. 2 Strengthening the institutional and instrumental capacity in the field of environment significantly contributes to tackle the important problems concerning the effective implementation and enforcement of the EC environmental legislation. 2.5 Cross Border Impact n.a. 3. Description 3.1 Background and justification Improvement of environmental protection requires consequent enforcement of law and full compliance with the acquis. This project is focused on strengthening environmental protection in the Czech Republic by better enforcement of environmental laws. It is necessary to achieve full compliance of the Czech legislation with the acquis. Next step will be improvement of enforcement techniques including planning, monitoring, performance, reporting of inspections in accordance with Minimum criteria for environmental inspection defined in Recommendation of the European Parliament and of the Council providing for minimum criteria for environmental inspections in the MS (2001/331/EC). An integrated approach implemented by IPPC Directive, Seveso II Directive on the major-accident hazards of certain industrial activities will be important for effective enforcement and coordination of different organizations at central and regional level. It is important to enhance monitoring capacity of inspection bodies for better enforcement. It is necessary to enhance technical capacity by training of inspectors and better access to information sources through better information technology. Czech Environmental Inspectorate benefited from Phare Twinning project "Strengthening the institutional/regulatory capacity in the environmental sector in the Czech Republic (CZ 98F-01). Objectives of the project have been met in a different extent: Development of comprehensive enforcement and inspection strategy was only partial, focused mostly on CEI reorganisation (via draft organic law). Therefore, it is strong need for training in strategic planning and for preparation of a new CEI strategic plan in accordance with Ministry strategic plans. Adaptation of CEI to new licensing, enforcement and inspection duties was much more successful, with improved knowledge, experiences, supporting materials and training. Developed training scheme for inspectors can serve also to other institutions (as important part of proposed new project). Failure of the one lot of the tender for basic technical equipment (part inter-institutional communication ) led to problems in carying out activities to improve system of information and data transfer (local network was not created, reporting scheme and practical exercise in information flow were not realised). Therefore it is necessary to improve inter-institutional cooperation and communication via better information technology in this new project. In order to achieve stated goals and fulfil desired functions of CEI, it is necessary to combine twinning project focused on planning and integrated approach to enforcement with supportive investment project, bringing better measure instruments and information technology to inspectors in the field. Explanation on the investment part: The Czech Hydrometeorological Institute was the Beneficiary of two investment projects from Phare 2000 and 2001 programme for support of measuring immissions and other necessities (PM 10, PM2,5, PAH analysers, etc.). CEI is competent in different area: the measuring of emissions from large and medium sources of pollution, see e.g. Council Directives 84/360/EEC, 88/609/EEC, 89/369/EEC etc. in accordance with Czech laws No. 86/2002 on protection of air and No. 85/2002 IPPC Act, etc., which equipment proposed in the project will be used for. Therefore these supply projects do not overlap. Need for mobile laboratories: CZ doc 2

3 CEI learned a lesson from floods in August Flooded chemical factory was dangerous for human health of inhabitants in the area but it was also a threat for neighbouring countries (i.e. Germany through Elbe river). In this situation CEI was not able to measure dangerous chemical substances, because contracting laboratories were not on sufficient level. Therefore there is a strong need for mobile laboratories, which will not depend on quality and availability of contracting laboratories. They will be very useful for measurements in cases of accidents and for solving of complaints as well. Need for capable information technologies : In accordance with Aarhus Convention and Directive 90/313/EEC and other Directives, CEI needs new IT for networking and access to appropriate SW, and databases (see Annex 6, explanations). Because CEI will be an important provider of data for registers of pollution, it needs adequate IT. CEI will be one of the main sources for Geographical Informational System (GIS) of MoE and public administration in environmental protection (e.g. for collection of input data for area loads which will be created by GIS ) and therefor it needs efficient IT. New IT will ensure the link of CEI with other public administration bodies ( municipalities, regional offices, Police of Czech republic, Custom offices, Fire brigades etc.). Using portable equipment will enable inspectors the access to databases during field inspections. The planned IT will significantly improve the relation between desk and field inspection and CEI will be able to perform better and deeper control. The proposed IT will serve for CEI directorate and 10 regional offices (all without efficient servers); it means for app. 550 inspectors and 150 service staff) and planned in country network of environmental enforcement bodies on central, regional and local level (in the beginning proposed tens of institutions and hundreds of inspectors and officers). 3.2 Linked activities Within a few last years following projects were implemented in the Czech Republic: CZ Strengthening the Institutional/Regulatory Capacity in the Environment Sector in the Czech Republic. Phare CR 108 project of Assessment of Czech environmental administration Cooperative projects, realized with separate EU countries were: British -Czech project of inspectors (training of trainers for acquis communautaire, IPPC Directive, Seveso II Directive, GMO Directives and Public Relations) Dutch pilot project Czech Environmental Inspectorate Institutional Strengthening Implementation of the EU IPPC Directive. Ongoing Projects Centre for Waste Management (CZ ) the aims of this Phare 2000 twinning project (started in 2002) are to: establish the Centre for Waste Management (CWM); prepare a detailed implementation Action Plan for the establishment of the CWM; provide training for CWM staff; establish operational Waste Information System available for related institutions. The waste information system will be relevant to this project as a source of data. Institutions for Permitting and Monitoring in Air Protection (CZ ) this project, which started in 2002, aims to support the establishment of institutions for air protection and their responsibilities (especially the regional authorities), and to improve the air quality information system (through supply of PM10 monitoring equipment). Lead Twinning partner is Germany. In this project relevant especially in the context of investments in air protection. Implementation Structures for IPPC (Integrated Pollution Prevention and Control) and Register IRZ (Integrated Pollution Register) (CZ ) relevant to the extent that the investment needs associated with improved environmental performance at selected large industrial facilities will be identified. Lead Twinning partner is Germany, with short-term experts from Denmark; project started in CZ doc 3

4 Regional Waste Management Strategies funded by the State Environment Fund and RAs. These projects began in 2001 and were completed in They aim to provide the RAs with a detailed understanding of waste management issues in their respective regions, as the basis for the Regional Waste Management Plans that the RAs will by law have to develop over a 12- month period following publication of the National Waste Management Plan (expected in early 2003). They should provide extremely useful information for project planning in the waste sector. Implementation of the Acquis at Regional Level (CZ ) this project aims to support the environmental departments of the 14 RAs in the implementation of EC legislation (including water, waste and air). Expected start at the beginning of Environmental Impact Assessment (CZ ) this project aims to ensure effective implementation of the EIA (85/337/EEC as amended by 97/11/EC)and SEA Directives (2001/42/EC). The project is of some relevance since major investment projects will generally be subject to EIA; it also involves working closely with the RAs. Expected strart at the beginning of Reinforcement of IPPC implementation (CZ ) The project aims to ensure full compliance with the acquis as concerns Integrated Pollution Prevention and Control (IPPC). The project should result in the setting up of an integrated permitting mechanism and permitting review procedures, the establishment of the practical interrelation of Environmental Management System (EMS) with IPPC permitting and enforcement, improvement in the information exchange on BAT (Best Available Techniques) in accordance with the IPPC acquis, an assessment of the practical application of advanced integrated procedures, the development of an integrated charging system for IPPC and adequate skills for all relevant staff involved in the application of IPPC procedures, BAT application and related responsibilities. 3.3 Results These results of twinning and supplies project will be done: 1. EU Minimum Criteria for environmental inspections are fulfilled at central, regional and local level 2. New strategic plan for Czech Environmental Inspectorate and trained staff for strategic planning implemented. 3. New network of different state administration institutions for environmental enforcement established. 4. Better equipment for monitoring in relation to inspections and accident prevention (stabile and mobile labs and trained staff ) resulting in better CEI capability of action. Providing for better information of public and state administration inspectors by means of up to date IT (see Annex 6 - explanations). 5. Integrated approach of different state administration institutions (Seveso II, III Directives, GMO Directives, Water Framework Directive) and at different levels (esp. CITES, Seveso, IPPC) 6. Common training and methodic center for training of CEI inspectors as trainers and regional/local officers at CEI and training of inspectors from different institutions for enforcement of Seveso Directives, GMO Directives, IPPC Directives, CITES and Directive 2000/60/EC the European Parliament and of the Council establishing framework for Community action in the field of water policy. Inspectorate will use experiences for British-Czech Project which was focused on first training of CEI inspectors. This project will enlarge training of trainers from another bodies (regional and local offices) and other cooperating institutions together with CEI inspectors. The aim is spreading of cooperative spirit and also trainers will be trained in implemented Directives. The presumption is that during the course of this project aquis communautaire will be fully implemented in CR. After training inspectors will be qualified enough and will gain good practice in implemented directives from their trainers from EU countries for utilization in their organization. The most discussed and the most difficult Directives at the moment are IPPC, GMO and SEVESO. The project will enable the CEI to ensure integrated and planned enforcement of environmental law in respect of these Directives. CZ doc 4

5 3.4 Activities Twinning ( 0,4 M ): The twinning part of project will consist from: 1. Preparation of strategic plan for CEI, training of trainers in strategic planning and managers of enforcement bodies. 2. Building of new network for environmental enforcement (drawing of experience from 1998 twinning project) 3. Monitoring in relation to inspections and accident prevention (according to AP priority: improving admin., monitoring and enforcement capacities). Building of informational network between regional offices and inspectors in the field. 4. Application of integrated approach in environmental sector enforcement (IPPC Directive) and in different state administrative offices at different levels through common trainings and inspections based on Integrated Pollution Prevention and Control, Seveso Directive and GMOs Directives. 5. Establishment of a common training and methodic center for environmental enforcement ( for CEI inspectors and regional/local officers) at CEI 6. Training of staff from participating organizations in inspection planning and performance, training of trainers as the first step. Training will be focused on training of inspectors from newly authorised municipalities, CEI inspectors will be trainers and every regional inspectorate will serve as training centre for training of local inspectors. Long-term sustainability will be ensured by permanent technical support of trainers from professional training centre at CEI headquarters, building of network among enforcement bodies and better planning process due to training in strategic planning. Training of technical staff for mobile laboratories will be very important, especially if it will be accompanied by certification process leading to certified laboratories. Twinning Covenant will include: 1 PAA expert - senior officer with long term experience in integration issues and/or strategic planning from EU Member State with similar body to the Czech Environment Inspectorate. Long term expert will work as preaccession advisor (PAA) for entire duration of project (18 months - approx. 0,270 M ). PAA will be supported by short time experts from Member States, these ones will train Czech trainers/inspectors in integration, planning, using new IT and monitoring (approx. 44 men/days - 0,066 M ). Study tours/exchange programs to Member States (approx 0,025 M ). Trainings and seminars will be prepared; this item will include also manuals, translations, interpreting (approx. 0,039 M ) Supply of Equipment (Phare budget: 1,400 M, Czech state budget 0,485 M ): The equipment written in the table below will help 10 regional inspectorates and the headquarters in Prague. They will fulfill information and monitoring needs of CEI on central and regional level (More detailed information on investment see in 3.1-Background and justification and Annex 1 and 6). CEI will be responsible for technical specification of equipment. CEI will consult these technical questions with competent departments of MoE - Air Protection Dep., Water Protection Dep., Waste Management Dep. and Dep. of Informatics and Ministry of Agriculture ( Water Management Department). Independent control of the needs, convenience and technical specification of equipment will be supervised by PAA, who will ensure an independent point of view. 3.5 Lessons learned CZ doc 5

6 This project will focus more on training in skills, which will be substantial for success of project (for example: before preparing a new strategic plan, there will be training in strategic planning. Therefore the plan will be prepared step by step approach with feed back from inspectors, managers, Ministry and experts. Moreover, the tender for IT and laboratory equipment will be carefully prepared with strict timetable and personal responsibilities of involved staff. This project will be very useful for the implementation of the acquis, integrated appproach, activities of CEI in the field of staff training, for strategic planning and fulfilling of minimum criteria for environmental inspections (which are as Recommendation of EP and EC) and generally for transfer of MS experiences. All recommendation from previous projects have been taken into account. 4. Institutional Framework Czech Environmental Inspectorate (CEI) has new duties in enforcement of Seveso II Directive, IPPC Directive, Directives on GMO and in the near future it will enforce the new Seveso III Directive. In these cases CEI is playing co-ordinating role in enforcement, co-operation with many different sectors, institutions and regional offices. Strategic planning and integrated approach are crucial preconditions for successful fulfilment of enforcement tasks. Moreover CEI is authorized as supervision body to control conditions of environment in air protection, water quality, waste management, chemical substances, and forest protection. The Czech Environmental Inspectorate is responsible body for this project, with support and supervision from Ministry of the Environment. The Regional Authorities, Dept. of Environment will be second target groups for trainings and also determined authorized municipal offices. Clear competencies in environmental enforcement will be established from January 2003 as the result of distribution of competencies among central, regional and local offices as part of the administrative reform. We can expect new functioning of the whole new system after one/two years. This project can help with establishment of clear competencies by common workshops and training, building new network of enforcement bodies and by better exchange of information due to newly received information technology. 5. 7 The Czech Republic will establish a Steering Commitee for the management of the project. The Committee will include representatives of all responsible Ministries and relevant institutions (eg regional and municipal bodies). Project Working Groups will be established for each component of the project. Preconditions: Means Twinning: one PAA at about 18 months, short-term experts (0,4 mil. ) see the PF Courses based on Recommendation of the EP and EC providing for Minimum Criteria. Criteria for environmental inspections in the MS, 4/4/2001. Training in using adequate SW (DTB s of sources, pollution, tackled cases, instructions how to tackle typical cases), drawing-up the plans, reports. Preparation of handbooks and guidelines. CEI prepares the joint training of trainers (senior inspectors, specialists) from environmental inspectorates within IMPEL and AC-IMPEL in special areas-eg EIA, IPPC, dealing with public, which are common obligations in environmental inspections within EU. The trained trainers will be assigned for trainings at other environmental bodies and other ones of public administration bodies. Training in strategic planning and workshops for preparation of strategic plan for CEI Workshops on enforcement problems in the CR, improvement of connection and information flows among enforcement offices by new IT and also workshops on integrated inspections.supply see the list of required equipment in fiche point 5 detailed budget (1,885 M EUR). Phare contribution is required 1,400 M, the rest of the equipment will be financed from the cofinancing part of the budget Delivery of stabile and mobile laboratories and training, exchange of inspectors, experts and information on monitoring Equipment for water quality measurement. 18 CEI is connected via high-speed WAN to map server Ministry of Environment. The data describing environmental situation in Czech Republic are collected on this server. Inspector equipped with handheld or other mobile computer (notebook) with module GPS (for finding current position) and GPRS (system for high-speed data connection in cellular phones network) will have always current information of place of inspection at hand and if necessity occurs will have current data from integrated registry of pollution and so will be capable of sending a message to CEI server when administration procedure begins. For all this we need means of mobile equipment on the basis of client-server technology. There also has to be appropriate software on the server side. Servers and SW for office management applications, 120 workstations for data processing Data collected during inspection activities, human resources management and from connecting on data sources of government needs high quality servers placed on each of regional inspectorates. The main server at the directorate will co-ordinate the data distribution and take care of all office management applications. There will be 120 workstations for this data management, filling data into Geographic Information System and processing of image information. Electronic mail rooms and voice mail 11 computers with reader for most popular data carrier, SW for telephonics exchange Inspectorate will have to be able of processing of citizen's and organisations suggestions via usual channels. The most important and most widely used are telephone calls. There are answering machines integrated in exchange and connected with information system for purpose of transmission of information from telephone calls to inspector s computers. To get information which has some part of electronic information such as photos, videorecords, computer manuscript) is necessary to have places equiped with computers capable of connecting to all kinds of used information media like: CD, Zip, Jaz, USB, Firewire, DV, Video, DVD, floppy disk, scanner and serial port. In this way we can deal with every suggestion immediately and public will not have to make the conversions to formats used by CEI. Internet/intranet portal (server with intranet SW) There will be an internet information server of CEI for public information (as requested by Aarhus Convention) which will be capable of providing service to increasing number of accesses especially with regard to wide range of information which CEI will provide thanks to development of information system.
