The next document is a set of Frequently Asked Questions that will help acquaint you with this program. Lastly, I have enclosed a copy of the Broker s Direction Clause which will also be provided to your Real Estate Agent/Broker as an addendum to the listing agreement, in order to allow the broker to communicate freely with Cartus. Note that this last document is not necessary if you already have a fully signed contract to sell your home. 4 Frequently Asked Questions This document is meant to help answer some of the questions you may have about the Short Sale program and to help you better understand the relationship between your loan servicer and Cartus. Q. Who is Cartus Asset Recovery? A. Cartus Asset Recovery Corporation ( CARC ) is a subsidiary of Cartus Corporation, the world s leader in global relocation services and national homesale assistance. We work with brokers and other real estate professionals in the sale of residential properties. Over the last 50 years, we have sold more than 500,000 homes valued at more than $100 billion and we are confident that our role in assisting in your short sale process will be of significant value to you. You can find CARC s privacy policies at Q. Does my Cartus Asset Recovery Consultant work for my loan servicer? A. No. Your Consultant is not an employee of your mortgage lender. He or she works for CARC. Q. How did Cartus Asset Recovery obtain information regarding my mortgage? A. Your mortgage lender provided Cartus Asset Recovery with your contact information. Q. What exactly is a short sale? A. A short sale is the sale of a home at a price that is less than the loan balance. Q. How long does the program take? A. The Short Sale program is designed to result in a quick sale of your home and our goal is that the sale takes place no more than 60 days from the time you list your home for sale. Q. What is the cost to me? A. There are no out of pocket costs to you to participate in the Short Sale program. However, until title is conveyed to a new owner, you will be responsible for all necessary upkeep to the property, such as insurance, maintenance, utilities, etc. Q. Do I get to approve the final sale price? A. Yes, however, the lender of your loan must also approve the final price. Q. Will participation in this program stop foreclosure proceeding? A. No. However, our goal is to obtain a successful Short Sale before a foreclosure is concluded. Q. If this is not a foreclosure, what happens to my credit? A. The impact on your credit depends upon your mortgage lender. You will need to contact them. Q. Will I owe any amount on my mortgage after the short sale takes place? A. Maybe. In some cases, your lender will require you to sign a note for the remaining balance of the mortgage. This does not happen on every transaction. But, you should be aware that this may be requested of you. Q. What role do I play in the sale of my home? A. Cartus Asset Recovery will work with you throughout the process; it is still your house. Cartus Asset Recovery will confer with you about pricing strategies, negotiation strategies and similar issues. Q. Are there any tax implications to this transaction? A. Possibly. Current Status and Assistance Requested (check all that apply) We currently occupy the Property. We want to sell our Property, but we believe that the sale proceeds may not be sufficient to pay off our Loan, because the value of the Property has declined since the origination of our Loan. We are ready to leave our Property. We would like to remain in the Property as a tenant for months (no more than 12 months). Our Property is currently listed for sale with a real estate broker. 3. 6 purchase the Property Section 2 Terms and Conditions We acknowledge the following terms and conditions of any assistance that we may receive: 1. Other Liens on Property. SunTrust Mortgage has engaged a contractor (the Contractor ) to negotiate terms of release with other holders of liens on the Property. The Contractor will contact us regarding certain information to be provided to such parties and the terms of any release of lien that the contractor is able to negotiate. Our execution of a Request for Assistance authorizes the Contractor to discuss our Loan, a Short Sale or Deed-in- Lieu of Foreclosure ( DIL ) and any other liens or encumbrances on Property with the holder of such lien in order to negotiate the release of the lien. 2. Borrower Relocation Assistance. We may be entitled to an incentive payment to assist with relocation expenses. Any relocation assistance will be specified in the Notice of Decision. 3. Property Maintenance and Expenses. We are responsible for all maintenance and expenses of the Property until the transfer of title to the Property including utilities, assessments, association dues, and costs for interior and exterior maintenance. Additionally, we must report any and all property damage to the Servicer and file a hazard insurance claim for covered damage. Unless insurance proceeds are used to pay for repairs or personal property losses, the Servicer may require that they be applied to reduce the balance of the Loan. 4. Marketing of the Property. We will cooperate with the Contractor and the Broker with marketing the Property for sale, including keeping the Property clean and orderly to facilitate showings to prospective purchasers and other real estate professionals, allowing Broker to install a lock box on the Property and allowing showings of the Property upon hours notice from the Broker, which notice will be provided by phone, or text messaging to the phone number or address that I provide to Broker. 5. Foreclosure Sale Suspension. During the period before a Deed-in-Lieu is accepted, the Servicer may initiate or continue the foreclosure process as permitted by the Loan documents. If a Short Sale is approved and a Sales Contract acceptable to Servicer has been executed, the Servicer may suspend any foreclosure sale date scheduled to occur before the Closing Date of the Sales Contract until the anticipated Closing Date, provided that we comply with the terms and conditions of the Deed-in-Lieu Agreement (the DIL Agreement or the Agreement ). 6. DIL. As a condition to participation in the Deed-in-Lieu Program, and subject to applicable law, we will execute and deliver a DIL in form and substance satisfactory to SunTrust Mortgage, which DIL will be accepted and recorded by Contractor after all material title exceptions and encumbrances have been resolved. 7. Release of Liability. The DIL Agreement will indicate whether SunTrust Mortgage will forgive our liability for all or a portion of the Loan. 8. Mortgage Insurer Approval. The terms and conditions of any assistance approved by the Servicer may be subject to the written approval of a mortgage insurer. The Contractor will negotiate terms of such assistance with any mortgage insurer. The Contractor will contact us regarding certain information to be provided to the Mortgage Insurer and the terms of the mortgage insurer approval. 9. Termination of Approval. Unless otherwise agreed by the parties, an approval of assistance will terminate if all actions required to be completed by us are not completed in compliance with the terms of the DIL Agreement within the time frame specified therein. Contractor may terminate the DIL Agreement earlier if: a. We fail to provide all the required documents listed above and other information that may be requested by Contractor in connection with the Program. b. Our financial situation improves significantly, we qualify for a modification, we bring the Loan current or we pay the Loan in full. c. We fail to act in good faith in closing on a sale of the Property or otherwise fails to abide by the terms of the Agreement. d. A significant change occurs to the Property condition or value. e. Contractor identifies evidence of fraud or misrepresentation in any information or documentation related to the Program. f. 7 g. Litigation is initiated or threatened that could affect title to the Property or interfere with a valid conveyance of the Property. Section 2 Terms and Conditions (continued) 10. Settlement of a Debt. The proposed transaction represents an attempt to reach a settlement of the delinquent Loan. There is no guarantee that any program described in this document will be approved or successfully completed. In the event no program is successfully completed, all remedies under the Loan may be exercised, including foreclosure.
