1 AMENDMENT TO THE CODXFIED CODES OF THE TOWN OF MONONGAH, WEST VIRGINIA WITH REGARD TO WATER SERVICE RATES BE IT ORDAINED by the Town Council of the be AMENDED as follows: Water Service Rates WATER SERVICE RATES For the payment of the proper and reasonable expense of operation, repair, replacements, improvements, additions, betterments, extension, and maintenance of the water system and for the payment of the sums required to pay the principal and interest on all water revenue bonds as the same become due, there is hereby established a schedule of just and equitable rates, charges and penalties for the use of and services rendered by the municipal water system and works of the Town of Monongah, West Virginia, which schedule, based upon the metered amount of water supplied to the premises shall be as follows: RATES, RULES AND REGULATIONS FOR FURNISHING WATER AND SEWAGWWASTE SERVICES At the Town of Monongah, Marion County, West Virginia APPLICABILITY Applicable within the entire territory served AVAILABILITY Available for general, domestic, commercial and industrial service RATES (for all customers with metered water supply) First Next Next All Over 2,000 gallons used per month 13,000 gallons used per month 35,000 gallons used per month 50,000 gallons used per month $ per 1,000 gallons $ 8.01 per 1,000 gallons $ 5.24 per 1,000 gallons $ 3.35 per 1,000 gallons MINIMUM CHARGE No monthly bill will be rendered for less than the following amounts, according to the size of meter &stalled (based on 2,000 gallon minimum usage.j 518" 314' 1" 1%" 2" 3" 4" 6" per month per month per month per month per month per month per month L per month 1

2 8 inchmeter RESALE RATE All water for resale to the Town of Farmington, the Town of Worthington and Coon s Run Public Service District will be billed at the rate of $2.57 per 1,000 gallons used per month. DELAYED PAYMENT PENALTY The above schedule is net. On all accounts not paid in full when due, ten percent (10Y0) will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to only be collected once for each bill where it is appropriate. TAP FEE The following charge is to be made whenever the utility installs a new tap to serve an applicant. A tap fee of $ will be charged to all customers who apply for service outside of a certificate proceeding before the Commission for each new tap to the system. RECONNECTION FEE $25.00-T0 be charged whenever the supply of water is turned off for violations of rules, nonpayment of bills, or fmdulent use of water. WATER SERVICE DISCONNECT/RECONNECT/ADMINISTRATION FEES For the payment of the fees related to the disconnection of water service for nonpayment of sewer bills, pursuant to an agreement with the Greater Marion Public Service District, the schedule of rates, charges and penalties for the use of and services rendered by the Town of Monongah shall be as follows: DISCONNECT/REC@NNECT/ADMINISTlUTION FEES Whenever water service has been disconnected for non-payment of sewer bills in conjunction with a water service termination agreement with the Greater Marion County Public Service District, a disconnection fee of twenty-five dollars ($25.00) shall be charged. In the event the dehquent sewer bill is collected by the Town of Monongah, an administrative fee of twenty-five dollars ($25.00) shall be charged. Whenever water service, which has been previously disconnected or otherwise withheld, for non-payment of a sewer bills in conjunction with a water service termination agreement with the Greater Marion County Public Service District, is reconnected, a reconnection fee of twenty-five dollars ($25.00) shall be charged. RETURNED CHECK CHARGE 2

A service charge equal to the actual bank fee assessed to the Town or a maximum of $25.00 will be imposed upon any customer whose check for payments of charges is returned bv their bank due to insufficient funds. LEAK ADJ&TMENT $1.16 per 1,000 gallons is to be used when the bill reflects unusual consumption which-can be a&buted to eligible water leakage on the customer s side 01 the meter. This rate shall be applied to all such consumption above the customer s historical average usage. SECURITY DEPOSIT Not to exceed two/twelfths (2/12) of the average annual usage of the applicant s specific customer class, or fkty dollars ($50.06), whicheveris greater. -%s fee may be changed by applicable statutory provisions. 7 SURFACE OR GRObNI WATER SLXCHARGE An additional mount shall be charged where surface or ground water is induced into the sanitary system where evidence of a violation exists. Surcharge foimula IO be applied in cases where surface dramage is connected to the utilities sewer system. Said surcharge shall be calculated and imposed for each month tha~ said condition continues to exist. Failure to pay the surcharge and/or correct the situation shall give rise to the possible termination of water service in accordance with the Rules and Regulations of the Public Service Commission of West Virginia. The Town shall nor impose the surcharge unless, and until,the customer has been notified by certified mail, return receipt requested, or by hand delivery, that it has been established by smoke t ee, dye tesdng, or on-site inspection that rain or other surface water is being introduced into the sanitary sewer system BI the cwmer s location, and thar the cmmer has nor acted within thirq (30) days from receipt of such notice to divert the water from the sanitary sewer system. Ordinance for sewer was made to increase leak adjustment, increase the return check charge, reconnection and update the security deposit to match the water ordinance. This is not an increase in income. The return check fee is to offset the amount we get charged for the fees.
