Payment Plan: New Payment Plan for is available for any Season (valued at $100 or more) purchased by August 17, Pay 25% down at the time of purchase, and your next three payments will be automatically charged to the credit card used for the down payment. Automatic payments are charged on the 15th of each month following your down payment. There are NO additional fees for using our Payment Plan. Your credit card must have an expiration date after your final payment is due. You will be responsible for the full payment of your Season once the down payment is made. Should your credit card decline or be cancelled during the financing period, the purchaser is responsible for updating the Belleayre ticket office with a valid form of payment, or will forfeit all previous investments in the season pass. Resort Charge: You don't need to bring both a credit card and your pass to the slopes anymore; you can link the two together and take care of any on-mountain purchase with a swipe of your adult season pass! For passes of those ages 19 and under (and adult passes too, if that option is preferred) they can be pre-loaded with any dollar amount you'd like, so you know your family is set for lunches, lessons, or anything else they may need for their day. 3 Resort Charge Option (ORDA Winter es/season es) Charge it to my account ORDA offers convenient options for season pass holders to pay for products and services around Whiteface, GORE or Belleayre Mountains (the Mountain ) plus activities at many of the Olympic Venues in Lake Placid using their pass rather than carrying a credit card or cash. This agreement sets forth the terms and conditions for participating in the program. This agreement is separate from, and does not constitute an amendment to or modification of, the terms and conditions which apply to the use of your pass, including, without limitation, the terms and conditions set forth in any agreement you executed in connection with obtaining and using your pass. Resort CHARGE allows you to attach a credit card to your season pass, allowing you to use your pass to purchase items and have the charge automatically debit your attached credit card. Resort Charge can be added to passes/cards during the checkout process using our online store, in the My Account section of our online store, or in person at any ticketing or guest services location. This program also allows you to pre-load a certain amount of money to your season pass or, allowing you to use your pass to purchase items and have the amount automatically deducted from your account. DETAILS: Resort Charge can be used at many resort points of sale at Whiteface Mountain, Gore Mountain, and Belleayre Ski Center If your pass is lost or stolen, you should report it to the season pass office IMMEDIATELY so we can inactivate your pass to prevent charges being made. Any remaining credit will be transferred to your new pass once it is issued. We are not responsible for and therefore will not issue refunds for any charges made prior to you reporting the pass lost or stolen. Families may attach one credit card to a primary pass holder and then link other family members to the primary to use one credit card for Resort Charge. You may check your Resort Charge balance and add funds using the My Account section of our online store or by contacting the season pass office. There is no minimum or maximum amount that must be added. Resort Charge users are responsible for monitoring their remaining balance to ensure they have enough funds for each purchase made. Transactions will be declined for insufficient funds. You may tip using Resort Charge just like you would on a credit card. Resort Charge holders are responsible for updating their credit card information with the season pass office if their credit card number changes or expires. Declined transactions will need to be paid for using another form of payment. If adding Resort Charge to your pass, you will need to agree to ORDA s Automatic Credit Card Billing Agreement Terms & Conditions. If adding Resort Charge online you will be prompted to agree to this document as part of the process to add Resort Charge and there is no need to complete a paper version. Resort CHARGE BILLING AGREEMENT: The undersigned Applicant (hereinafter referred to as Applicant) has purchased a ORDA season pass product, and hereby grants ORDA permission to charge the Applicant's credit card (the information for which has been/is being given as part of this Billing Agreement) for purchases at the ORDA facilities where Applicant uses the pass connected to the credit card enrolled in the ORDA Resort Charge Program as described herein. The Applicant hereby acknowledges and accepts full responsibility for, and guarantees payment of all amounts charged to the credit card account provided by Applicant to ORDA for use with the ORDA Resort Charge Program whether or not such use is authorized by Applicant. Each pass holder is solely responsible for his or her nontransferable pass. Applicant agrees that he/she will be liable for all charges incurred by any person who uses the pass whether with or without permission, unless ORDA receives written notice that the pass is lost or stolen as provided below. Termination: The Applicant shall be entitled to terminate this Agreement by delivering written notice of such termination to ORDA, either personally, or by certified mail addressed to: NYS Olympic Regional Development Authority Olympic Center 2634 Main St. Lake Placid, NY ATTN: Mountain Charge Program Administrator Such termination shall take effect upon actual receipt by ORDA of the termination notice; provided, however, that such termination shall not, in any manner whatsoever, release the Applicant from liability and responsibility for any amounts charged to the ORDA Charge Program prior to the effective date of such termination. Applicant agrees to return to ORDA any pass enrolled in the Mountain Charge Program covered by this Agreement upon request of ORDA. Change in Credit Card Status: The Applicant also acknowledges that it is Applicant's responsibility to notify ORDA at the above address of any changes to Applicant's credit card information he/she has provided to ORDA, including any changes to the credit card number or expiration date, that the card has been lost or stolen, change of billing address, that the limits on the card have been exceeded or charging privileges have been otherwise revoked or cancelled. Any change in the credit card details may also require the Applicant to complete a Change of Credit Card Details authorization form. Guarantee: The Applicant agrees, acknowledges and accepts full responsibility for, and guarantees payment of all amounts charged in connection with, or arising out of, the use of the ORDA Resort Charge Program pass registered to Applicant, whether or not such use is authorized by Applicant or the registered Holder of such privileges.

4 Default/Non Payment: The Applicant agrees that ORDA may pursue all avenues of collection, to recover any and all charges and other unpaid amounts due and owing by Applicant to ORDA. In connection with any litigation/collection arising out of this Agreement, ORDA shall be entitled to recover all costs incurred, including attorney s fees, which shall include any appellate and post judgment proceedings. Venue, for any action arising from this Agreement, shall be in Essex County, New York. New York statutes and New York State law shall govern any interpretation of this Agreement without reference to any choice of law rules. Credit Card Authorization: I hereby authorize ORDA to charge my credit/charge card for purchases at Whiteface, Gore, Belleayre Mountain, the Olympic Sports Complex (Mt. Van Hoevenberg), Olympic Jumping Complex, Olympic Center, or Conference Center at Lake Placid. Truth in Lending: ORDA and Applicant agree that the transaction between ORDA and applicant is not governed by the Truth in Lending Act (TILA) 15 USC 1601 et.seq., and all disclosures that may be required by TILA have been provided in writing to applicant by his/her credit card company. You may not add additional value onto an expired/inactive pass. Remaining balance may be transferred from an expired/inactive pass to a gift card at the discretion of ORDA. Except as is otherwise provided for herein, this Agreement shall remain in effect (1) at the end of the ski season and so long as you maintain a balance on an expired/inactive pass, and/or (2) for each successive ski season during which you procure or use a pass and participate in the Program. Billing Errors, Corrections: You are advised to monitor your transactions and account balances closely. ORDA reserves the right to correct the balance of your pass account if we believe a clerical, billing, or accounting error occurred. If you have questions regarding your transaction history or any correction, or if you dispute any transaction or correction that has been assessed against your pass, you are requested to notify ORDA immediately. ORDA will conduct an investigation, communicate the results, and correct any error we verify and confirm within a reasonable time period. If no error is found, we will notify you of that fact. ORDA shall have no obligation hereby for any billing error, unless you provide us with notice within sixty (60) days of the date of the transaction or item in question. Liability for Unauthorized Transactions: If your pass is lost, stolen, or damaged, you shall notify ORDA immediately. Because your pass is used like cash for purchases at ORDA you are responsible for all transactions associated with your pass, including unauthorized transactions. However, if your pass is lost, stolen, or destroyed, your pass may be replaced with the balance remaining on it at the time we receive your notification, in accordance with the terms of your pass agreement. Your pass balance is protected from the point in time ORDA actually receives notice from you. ORDA will freeze the remaining balance on your pass at the time we receive notification, and will load that remaining balance on a replacement pass. Charges to Program: ORDA may amend and modify the terms of this Agreement at any time. ORDA will notify you of any change, addition, or deletion by or by posting the terms of the modified Agreement on our web site. As permitted by applicable law, any change, addition, or deletion will become effective at the time we post the revised Agreement or as may otherwise be stated in any notice to you. Cancellation of This Agreement: We may revoke or limit any or all of the rights and privileges granted to you, or suspend or terminate this Agreement, without notice or liability. Termination may result from any fraudulent or unauthorized use of the pass. If ORDA terminates this Agreement, ORDA will refund or issue credits equal to the balance held in your program account, less any amounts that you may owe ORDA. This Agreement supersedes any and all prior or contemporaneous agreements, either oral or in writing, between the parties hereto pertaining to the Program and contains all of the covenants and agreements between the parties. No other agreements, representations, inducements, or promises, not contained in this Agreement shall be valid or binding. In the event any term or provision of this Agreement is deemed to be in violation of law, null and void, or otherwise of no force or effect, the remaining terms and provisions of this Agreement shall remain in full force and effect.

5 Conditions of Purchase: 1. All purchases are final: Future promotions are independent of this offering. NO refunds for any reason including but not limited to: sickness, injuries, relocation, health problems, weather conditions, man made or natural disasters. 2. No rollovers to following season for any reason including but not limited to: sickness, injuries, relocation, health problems, weather conditions, man made or natural disasters. 3. Belleayre reserves the right to change opening and closing dates, operating hours, number of days in the week open, restrict access to any open lift and/or terrain at any time based on weather, snow, crowds, special events or any other conditions or reason. Belleayre also reserves the right to determine the number of lifts in operation or area available for use at any given time based on snow, weather or other conditions or reasons. Belleayre offers the opportunity to ski or ride, not the number of days, lifts or terrain. A minimum number of operating days is not guaranteed. 4. Age at time of purchase will determine eligibility for all passes except the 70+ pass; those turning age 70 during the current calendar year may purchase in advance of their birthday. You must provide us with proof of age or any specialty pass category. 5. A plastic identification pass will be issued for each season pass purchased. This identification pass serves as your permanent lift ticket for the season. This pass must be clearly presented to the Ticket Checker/Scanners at every lift entrance. If the identification pass is lost or stolen, you must notify Belleayre at once. A fee of $25.00 will be charged to process a new pass. A one day ticket will be issued ONLY one time during the season for a forgotten pass. There is a $5.00 fee to print a one day ticket for pass holders that have forgotten their pass after that. 6. Season passes are non-transferable and are for the applicant s exclusive use. It is a crime to transfer passes. 7. Restricted season passes are not valid during the following blackout periods: Dec. 25, 2018 Jan. 1, 2019, Jan , 2019, Feb , For the entire term of this pass, I relinquish my right to a refund of the purchase price of the pass purchased that is allowable under the Safety in Skiing Code for those persons unwilling to ski because of the risks of the sport or the duties imposed upon skiers by law. 9. All dates, rates and provisions are subject to change without notice. 10. All pass applicants must sign this application before it can be processed and the pass distributed. Persons under age 18 must have a parent or legal guardians sign the application and the Season Assumption of Risk Agreement. 11. Ski area regulations are enforced by the reckless skier policy and New York State Code Rule 54, Article 18, Safety in Skiing Code. Any misuse, fraudulent use, misconduct or nuisance caused by the pass holder or failure to follow New York State law or ski area policy may result in confiscation of the pass without refund or other consideration. Belleayre management reserves the right to confiscate season passes depending upon the severity of rules infractions. 12. Upon entering Belleayre your image or likeness may be used in promotional material for the Olympic Regional Development Authority (ORDA) and/or Belleayre. ORDA/Whiteface reserves the right for your image or likeness to be used in its promotional material. By purchasing this season pass, the holder understands and agrees that the New York State Olympic Regional Development Authority and Belleayre may utilize any photograph, videotape, motion picture, or recording for any business or other purpose without further release. 13. Military passes are available for active US or Canadian Military and their dependents with i.d., US Military Veterans, members of the US Reserves & National Guard. Sign Assumption of Risk Agreement Before signing this form or using your pass, please read and understand the notice, warning to skiers and assumption of risk below. NOTICE: SKIERS AND SKI LIFT PASSENGERS - are governed by the New York State Safety in Skiing Code (Article 18, of the NYS General Obligations law). Before accepting this pass or allowing this pass to be affixed to your person, your attention is directed to a posted "WARNING TO SKIERS" which is printed below and where lift passes are purchased. New York Law requires you to seek out, read, review and understand the "Warning to Skiers" before you decide to participate in the sport of skiing. WARNING TO SKIERS: Downhill skiing, like many other sports, contains inherent risks including, but not limited to the risk of personal injury including, catastrophic injury, or death, or property damage, which may be caused by variations in terrain or weather conditions; or, surface or subsurface snow, ice, bare spots or areas of thin cover, moguls, ruts, bumps; or other persons using the facilities; or rocks, forest growth, debris, branches, trees, roots, stumps; or, other natural objects or man made objects that are incidental to the provision or maintenance of a ski facility in New York State. New York Law imposes a duty on you to become apprised of, and understand, the risks inherent in the sport of skiing, which are set forth above, so that you make an informed decision whether to participate in skiing notwithstanding the risks. New York law also imposes additional duties upon you, to which you must adhere, for the purpose of avoiding injury caused by any of the risks inherent in skiing. If you are not willing to assume all of these risks and abide by these duties, you must not participate in skiing at this area. ASSUMPTION OF RISK AGREEMENT: I have read and understand the NOTICE above. I have read, reviewed and understand the WARNING TO SKIERS printed above. In signing this application and receiving the Season, I signify that I am aware of and understand the risks inherent in the sport of skiing and that I am accountable for my action as set forth on the WARNING TO SKIERS signs. I agree that this acknowledgement shall be for the entire term of the pass received. For the entire term, I relinquish my right to a refund of the purchase price of the pass purchased that is allowable under the Safety in Skiing Code for those persons unwilling to ski because of the risks of the sport or the duties imposed upon skiers by law.
