Special Terms and Conditions of HKBN Global Pocket Wi-Fi Service ( Service ) General Service Terms and Conditions 1. Global Pocket Wi-Fi Service is governed by the General Terms and Conditions of HKBN (hkbnes.net/tnc/t&c_eng.pdf) and these Special Terms and Conditions. 2. The Service is a mobile data service supported with designated Pocket Wi- Fi device (product brand name: GlocalMe). Subscriber must use the Service with such designated Pocket Wi-Fi device ( Pocket Wi-Fi Device ). 3. When Subscriber starts using the Service, it is deemed that Subscriber agrees and accepts these Special Terms and Conditions of HKBN and the terms and conditions of GlocalMe (https://www.glocalme.com/index/index/agreement?locale=en-us). 4. The Service is only applicable in designated regions and/ or countries* ( Designated Regions and/or Countries ) [hyperlink of countries list]. HKBN reserves the right to add, remove and/or change the Designated Regions and/or Countries without any prior notice. Specific coverage area(s) in Designated Regions/ or Countries depends on the setup of the local network operator(s). HKBN is not liable for any disputes incurred due to network coverage area(s). 5. Upon the commencement of the Service, Subscriber can enjoy the mobile data service in Designated Regions and/or Countries with the Pocket Wi-Fi Device. No Service will be available if Subscriber locates in area(s) out of the coverage of the Service (https://www.hkbnes.net/tnc/globalpocketwifi_coverage.pdf). 6. Subscriber can login to MyAccount to check the latest mobile data usage record. Subscriber can also refer to the usage information shown on the Pocket Wi-Fi Device (for designated model of Pocket Wi-Fi only). (Actual usage record will be subject to the usage records of HKBN) 7. Before using the Service, Subscriber may disable the email, applications, RSS, automatic update function of Podcast as well as the Mobile Data and Data Roaming setting in mobile device to avoid any unnecessary mobile data usage. 8. The Service shall include mobile data service only, voice and/or SMS are not available. The service fee covers mobile data service fee only, excluding any other fees incurred during the use of any mobile data usage. 9. Subscriber acknowledges that the Service is a form of wireless
communication technology and operates on the basis of transmission over radio frequency spectrum. As such it can be interfered with by, and not limited to, external sources or by obstacles inherent in buildings, vegetation or terrain, and HKBN cannot guarantee a perfect or error free transmission, both in terms of quality or availability of the Service, due to environmental factors, local mobile data network or any other reasons arising from the local network operator(s). 10. Each Pocket Wi-Fi Device can be connected to a maximum of 5 mobile devices at one time. Subscriber understands that the mobile data transmission speed will be affected by the number of connected devices using the Service. 11. Subscriber shall not use the Service for public Wi-Fi hotspot, and abide by local regulations, laws and policies as they may pertain to mobile data usage. 12. HKBN is not responsible for any and all content, information and communications transmitted by Subscriber using the Service. HKBN has no responsibility for the deletion, corruption or failure to any content transmitted using the Service. 13. All unused mobile data is non-refundable and non-exchangeable. Unused mobile data after the lapse of each day /month will be cancelled and cannot be accumulated nor transferred. 14. Subscriber understands that HKBN is only the reseller of the Global Pocket Wi-Fi Service, provided by Hong Kong ucloudlink Network Technology Limited ( ucloudlink ) (https://www.ucloudlink.com). If the service is terminated, due to uncontrollable and unforeseeable circumstances caused by ucloudlink, HKBN is not liable for any service provisioning during minimum commitment period. HKBN can only use its best business endeavors to serve advance notice to Subscribers for such service termination, as deems appropriate. 15. In case of any disputes, all mobile data records, time and usage records of HKBN shall be final and prevail. HKBN reserves the right to charge Subscriber relevant administration charge for handling the enquiry of usage information. 16. HKBN may immediately terminate and/or suspend partly or entirely the Agreement and/ or the provision of the Service without any notice if HKBN suspects fraud or misuse of network or resources of HKBN or its contractors or business partner(s) by any Subscriber until HKBN considers that Subscriber has stopped performing such misconduct or such investigation has finished.
17. Mobile data service in Designated Regions and/or Countries of the Service are provided by respective local network operators. Subscriber acknowledges and understands that there are unavoidable factors (such as the failure of local network operators or natural disasters) which may cause service interruption. No refund and compensation will be made by HKBN in such cases. 18. To ensure appropriate usage of communication service by all customers, Subscriber shall use the Pocket Wi-Fi Device in accordance with these Special Terms and Conditions. The local network operators have the right to change its service plans and policies at any time without prior notice. Subscriber shall abide by all usage policies for the local network operators of different regions/countries, and Subscriber agrees and understands that if abnormal traffic occurs within the coverage of the Service provided by the local network operators, such local network operators have the right to interrupt, or restrict the use. HKBN will not be liable to Subscriber accordingly. 19. Internet Accessibility is subject to local government regulation and security policy; websites or apps such as Google, Facebook, Whatsapp may be affected. 20. Unless otherwise provided, words and expressions used herein shall have the same meaning ascribed to them in the General Terms and Conditions. 21. In case of any disputes, HKBN s decision shall be final and conclusive. Terms and Conditions of HKBN Travel Pocket Wi-Fi: 22. Subscribers can book for HKBN Travel Pocket Wi-Fi using Discount Rental Price through online booking portal. If the Number of Levied Days is higher than the Number of Free Rental Days, extra rental fee will be billed into Subscriber s account. 23. Rental period is counted from the Departure Date until the Arrival Date. The maximum rental period is 30 days. 24. Subscribers can book for HKBN Travel Pocket Wi-Fi through online booking portal from the 3rd to 60th day before the Departure Date, Subscribers must pick up and return the HKBN Travel Pocket Wi-Fi within designated time period and at selected location. When the order is confirmed, Subscribers can review the order details on online booking portal. If Subscribers want to change (including the pickup/return location) or cancel the order, Subscribers must manage through the online booking portal from the 3rd day before the original Departure Date. HKBN will send a redemption email
to registered email address of Subscribers on the 2nd day before Departure Date. 25. If Subscribers redeem free rental days using promo code, Subscribers cannot change the order when the promo code is expired. If Subscribers cancel the order, such promo code will be forfeited automatically and cannot be reused. 26. If Subscribers do not pick up HKBN Travel Pocket Wi-Fi at designated time period and location, will be considered as giving up, the promo code cannot be reused, HKBN will not return any rental fee or any compensation. If Subscribers return HKBN Travel Pocket Wi-Fi before the designated Return Date, the rental fee will not be refunded. 27. Subscribers shall, in accordance with the selected location and within the designated time period indicated on the online booking portal to return the HKBN Travel Pocket Wi-Fi to HKBN. If the Subscribers failed to return the HKBN Travel Pocket Wi-Fi at the designated time period, Subscribers would be liable and charged for Late Return Fee (Original Rental Price) equivalent to HK$58 for each day of delay, which will be billed into Subscriber s account. 28. If Subscribers cannot return HKBN Travel Pocket Wi-Fi 14 days from the Return Date, will be handled as lost. HKBN will charge for Compensation Fee and Late Return Fee from Subscriber s HKBN account according to this terms and conditions without notice. 29. In case of loss, damage or theft, Subscribers shall be liable to pay compensation to HKBN the following Compensation Fee: Full set of HKBN Travel Pocket Wi-Fi including Pocket Wi-Fi, Case and USB Cable HK$1,550 Pocket Wi-Fi HK$1,500 Case HK$30 USB Cable HK$20 30. Full amount of rental fee will be returned to Subscriber s HKBN account if the HKBN Travel Pocket Wi-Fi is not available in stock or due to any other reasons. No further compensation will be given. 31. If HKBN Travel Pocket Wi-Fi cannot function due to any reason within the rental period, Subscribers must notify HKBN by email to HKBNBroadband@hkbn.net. HKBN reserves the right not to refund or any compensation if Subscribers notify HKBN after return to Hong Kong. If Subscribers encounter any problems about accessories (Case and USB cable); HKBN will not provide any compensation. 32. When daily data usage reaches 500MB, maximum upload and download speed for thereafter data access is 128kbps. Daily Charge is levied on a daily basis.
There is no pro-rata calculation of Daily Charge even if Daily Pass is effective and terminated within the same day. A day means from 00:00 to 23:59 (Hong Kong time) wherever a Customer is and the cut-off time is 23:59 (Hong Kong time) each night, wherever a Customer is. Actual data transmission speed that Subscribers experience may vary due to internet traffic conditions, local conditions, hardware, software and other conditions which may arise. 33. Subscribers shall comply with the appropriate usage of HKBN Travel Pocket Wi-Fi as suggested by HKBN, take responsibility and treat the rented HKBN Travel Pocket Wi-Fi as if it s their own and in their best effort to take care and return to HKBN in a state which should not be worse than prior to the Subscribers rental. 34. In case of loss, damage or theft of the HKBN Travel Pocket Wi-Fi, Subscribers should immediately notify HKBN. 35. The Subscribers shall not engage in communications equipment sublease, transfer and pledge in the third person which results in the damage against HKBN ownership. 36. Smartphone and other communications equipment which can connect to the internet using data service may incur roaming charges. Before using HKBN Travel Pocket Wi-Fi, Subscriber shall turn off (stop) your use of the mobile phone roaming (data roaming) and use the phone WI-FI capabilities to connect HKBN Travel Pocket Wi-Fi for data communication. Whether the Subscribers well-intentioned or malicious, where roaming capabilities is not turned off so that Subscribers equipment is directly connected to the 3G/4G network, Subscribers use of the internet data will be charged roaming charges overseas. Please note that in this circumstance, HKBN takes no responsibility for the fees incurred. 37. The service performance might be affected by tunnels, subways, rural areas or distant islands. HKBN will take no responsibility and the Subscribers would still be obliged to pay the rental fee. 38. If the Subscribers suffer an accident or damage due to the use of HKBN Travel Pocket Wi-Fi, HKBN shall not be responsible in any way for whatever reason. 39. HKBN will not be responsible for the failure to access the internet using the HKBN Travel Pocket Wi-Fi, as a result of the Subscribers smartphone error and/or settings which failed to provide Internet services. 40. HKBN takes no responsibility if the HKBN Travel Pocket Wi-Fi is leading to short-circuit or fire through inappropriate, careless use or misplaced by Subscribers, from which causes any casualties and losses as a result.
HKBN advises the Subscribers to pay attention and use the device with care. 41. For any disputes arising from this HKBN Travel Pocket Wi-Fi, the decisions of HKBN shall be final and conclusive.
