1 Specific Terms & Conditions: My.T 100 Mbps 1. Incorporation by reference These terms and conditions shall apply in addition to the terms and conditions for My.T (residential). In the event of any inconsistency between the Specific Terms and Conditions and the terms and conditions for My.T, the Specific Terms and Conditions shall apply. 2. Object The present Agreement defines the terms and conditions under which MT provides up to My.T 100 Mbps to the Customer and under which the Customer accesses and uses the Service. 3. Service provision 3.1 MT shall provide the Customer with up to My.T 100 Mbps as specified on the website or as agreed with both parties as per the terms and conditions of this Agreement. 3.2 The Customer acknowledges and agrees that service availability is subject to availability of resources including, without limitation, availability of a suitable network infrastructure at the time the Service is requested or delivered. 3.3 Two WiFi networks are available: 2.4 GHz WiFi network (speed up to 40 Mbps*) 5 GHz WiFi network (speed up to 100 Mbps*) Depending on the Customer s device compatibility (smartphone/ PC/ laptop/ smart TV/ others), the Customer may be able to see both WiFi networks or the 2.4 GHz WiFi network only. 3.4 To enjoy the experience, the customer must be equipped with devices (laptop/ PCs/ smartphone/ tablet) which are compatible with the 5GHz frequency range. 1

2 3.5 MT will use reasonable endeavours to provide the Service by the date agreed with the Customer. 3.6 In consideration of the payment by the Customer of the charges, fees and/or rentals, MT shall provide the Service during the continuance of this Agreement subject to the compliance by the Customer with all the terms and conditions set out in this Agreement. 3.7 The Customer acknowledges that it is technically impracticable to provide a fault free Service. MT shall however use its best endeavours to repair any reported faults as soon as it reasonably can. 3.8 MT reserves the right to: a) suspend the Service for operational reasons such as repair, maintenance or improvement of the Service or because of an emergency, but before doing so, MT will give as much online, written or oral notice as is reasonable practicable. MT will restore the Service as soon as it reasonably can after the suspension. MT will not be liable for any prejudice suffered by or caused to the Customer as a result of the suspension of the Service. b) give the Customer instructions which it believes are necessary for reasons of health, safety or quality of any telecommunications service provided by MT to the Customer or to any other Customer. 3.9 Upon request, MT s technical team can assist the customer in connecting wireless devices (such as printers) via MT s router MT shall not be responsible for the malfunctioning of these wireless devices and will only help for network configuration via MT s router by inserting the router SSID and password The Customer understands and agrees that the services are subject to immediate termination without compensation for non-compliance with the terms and conditions in this Agreement. Furthermore, the Customer will be responsible for the full amount of any consequential damages this may cause. 2

3 3.12 The Customer consents and agrees to receive electronic invoices for the subscribed and associated services Customer is responsible for the appointment date set and shall make sure that he is at his premises and/or ensure that there is someone at his place on the said day and time. If no one is present that particular day, the customer will have to rebook an appointment. The customer may not get an appointment as soon as he has requested. 4. Minimum subscription period 4.1 The Service shall be provided with a Minimum Subscription Period as stipulated by MT on the Order Form or website In the event that the Service is terminated before the expiry of the Minimum Subscription Period by the Customer for any reason whatsoever or by MT as a consequence of any breach by the Customer of any of the obligations or duties of the Customer, then notwithstanding any provision to the contrary in the terms and conditions in this Contract, the Customer shall pay to MT: a) the charges, fees and/or rentals up to the end of the Minimum Subscription Period. b) the charges, fees and/or rentals due till the date the Service is terminated. 5. Access to the service 5.1 The Service shall be provided with a Minimum Subscription Period as stipulated by MT on the Order Form or website Connection to the Service shall be made on technical availability of the region s network. 5.3 The provisions of MT s Terms and Conditions for the line access shall apply (including but not limited to the provisions relating to the installation, relocation, inspection of the line, or repair of the line) on the line being used for the Service. 5.4 Any connection to the Service is subject to the following: a. The Customer premise to be located within an Exchange Zone. b. Technical compatibility of the CPE with the Network. 3

4 c. The Customer s owned device must be compatible with the CPE. d. Availability of lines and tests being carried out for the Service to be feasible. 5.5 A dynamic IP address shall be allocated for each connection to the Service. This IP address is for use in connection only with the Service and all rights in the IP address belong to MT. The Customer shall not use the Service to provide access to Internet Servers hosted in its premises. 5.6 Wi-Fi network names and Wi-Fi passwords will be provided to have access to the Service. 5.7 Access to the Service is possible 24 hours a day, 7 days a week, except in case of Force Majeure or in case of an event beyond the control of MT or in cases of outage due to interventions and maintenance necessary for the proper functioning of the Service. Installation is not 24/7. However, in case of fault and/ or complaints and/ or info about offer, our dedicated team shall be available to advise as well as follow-up. 5.8 MT reserves the right to bill the Customer in cases where telecommunications service repairs or interventions are needed due to deterioration or interruption of the telephone service or the Service resulting from installations made by the Customer. 5.9 The rights for access and use of the Service are non-exclusive and non-transmissible The Service includes an asymmetric internet connection, with a downstream bandwidth from the network to the Customer and an upstream bandwidth from the Customer to the network as defined on the website 6. Traffic policy 6.1 The asymmetric internet connection is a shared access service depending upon local and international scarce connectivity resources. MT intends to provide to all Users a reasonable level of service and distribute bandwidth among them. This is why depending on the type of subscription that the Customer has chosen, MT may apply dynamically an allocation of the available resources. 6.2 The Service is a best effort one and no guarantee will be made regarding the speed of access. 4

5 6.3 A monthly data usage allowance will be applied on some offers. A monthly data usage allowance is the total amount of data the Customer can download (receiving s/web pages/files, etc.) or upload (sending s/files, etc.) through his broadband connection each month. This data usage allowance applies to a calendar month and does not get carried over to the next month. In the event that the Customer exceeds his monthly data usage allowance, based on the subscribed offer, the customer s internet profile will be reviewed. 6.4 A Fair Usage Policy (FUP) will be applicable. MT will continually measure the performance of its broadband network and take steps to restrict the download speeds. MT will take steps to restrict the download speeds of very heavy users, should their activities significantly contribute towards the risk of reduced speeds being experienced by the majority of our broadband customers. 7. Power failure The Services require power to operate. During a power failure the Customer will not be able to use the Services. If the Customer cannot use the Services, he/she will not be able to make any telephone call including calls to Emergency Services. The Customer may also need to make alternative arrangements if he/she has a monitored alarm or other legacy modem device. 5
