CIMB BANK BERHAD S TERMS AND CONDITIONS GOVERNING THE YEAR-END UNFIXED DEPOSIT CAMPAIGN 1. The Year-End Unfixed Deposit Campaign ( Campaign ) is organised by CIMB Bank Berhad ( the Bank or CIMB Bank ) and shall commence on 1 November 2015 and end on 31 December 2015, both dates inclusive ( the Campaign Period ). The Bank reserves the right upon giving twenty-one (21) days notice to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 2. The following individuals/entities are eligible to participate in the Campaign (collectively referred to as Eligible Customers ):- a) Individual customers who areabove 18 years old and includes joint accountholders and/or trust accounts held for the benefit of minors; b) Customers who are permanent and/or contract employees of CIMB Group and/or their immediate family members (i.e. spouses, children, parents, brothers and sisters). CIMB Group means the groups of companies/legal entities of which CIMB Group Holdings Berhad, being the holding company of CIMB Group Sdn Bhd has a controlling interest, directly or indirectly, either by itself or through its subsidiaries; c) Customers who are representatives and/or agents (including advertising & promotion agents and technology vendors) of CIMB Group and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and d) Non individual customers and shall include business customers comprising sole proprietorship, partnership firms, small medium enterprise entities and corporations with annual sales turnover RM10million and below. 3. Corporations with sales turnover above RM10 million shall not be eligible to participate in this Campaign. Special Interest Rate for Fixed Deposit ( FD ) Placement ( Special Rate ) 4. To be entitled to the following Special Rate under this Campaign, the Eligible Customer(s) must make a minimum single deposit placement amount as per the table below during the Campaign Period; Special Interest Rate for FD Tenure FD Placement ( Special Rate ) 3 Months 4.10% p.a. 6 Months 4.20% p.a. Minimum Single Deposit Placement Amount in FD account RM10,000 12 Months 4.30% p.a. 1

Campaign Mechanics 5. The deposit placement made for the purpose of the Campaign shall comprise of fresh funds deposited with CIMB Bank. The term fresh funds referred to herein shall be defined to mean monies or funds howsoever transferred, credited or paid into the account(s) of the Eligible Customer(s) from other bank(s) and/or financial institution(s) other than CIMB Islamic Bank Berhad through whatever means including but not limited to Inter Bank Giro transfers and collection and payment of cheques drawn on such other bank(s) and where such monies or funds paid or credited into the account(s) of the Eligible Customer(s) are utilised by the Eligible Customer(s) to make new deposit placements pursuant to the terms and conditions herein within three (3) business days after such monies or funds have been paid or credited into the account(s) of the Eligible Customer(s). Deposit placements made by way of cheques are subject to their clearance and will only be considered as deposit placements by the Eligible Customer after the cheques are paid or cleared. 6. The Special Rate is applicable for FD placement of one (1) cycle only. 7. Interest will be paid out upon completion of the Fixed Deposit tenure. 8. For the convenience of Eligible Customers, interest earned will be credited to the Eligible Customer s designated Conventional Current Account or Conventional Savings Account ( CASA ) or Participating CASA Account maintained with the Bank. If the Eligible Customers have an existing Current Account or Savings Account maintained with CIMB Islamic Bank Berhad, the Bank may accept this existing Current Account or Saving Account to be an affiliate account for the above purposes (herein referred to as Affiliate Account ). 9. Employees of CIMB Group participating in this Campaign will not be entitled to additional staff rates. 10. The Bank reserves the right, from time to time, to vary the Special Rate and/or the Fixed Deposit Tenure requirement, upon giving twenty-one (21) days prior notice. 11. Early and/or Part Withdrawal of FD: In the event that the Eligible Customer withdraws or uplifts the FD before the completion of first three ( 3 ) months tenure, the Eligible Customer shall not be entitled to enjoy any interest whatsoever. If the Eligible Customer withdraws or uplifts the FD on the fourth month onwards, the interest payable to the Eligible Customer is half (50%) of the applicable interest earned on the completed months. The Eligible Customer hereby agrees and authorises the Bank to deduct and/or to set off from the principal FD amount in respect of any interest paid or credited to the Eligible Customer s Affiliate Account which the Eligible Customer is not entitled to as a result of the early upliftment of the FD. 12. In the event the Eligible Customer would like to withdraw the FD before maturity, the Eligible Customer may opt to perform a partial withdrawal or a complete early upliftment of the balance in the FD account. 13. Renewal: Upon maturity of the 3 Months or 6 Months or 12 Months FD, the Special Rate will cease to apply and the Eligible Customer hereby agrees and authorises the Bank to automatically renew or roll over the 3 Months or 6 Months or 12 Months principal FD amount to its respective tenure conventional fixed deposit tenure and the prevailing CIMB Bank board rate applicable at the time of renewal or roll over shall apply. General 14. By participating in this Campaign, all Eligible Customers are deemed to have read, understood and agreed to be bound by these terms and conditions and any decision of CIMB Bank. 15. CIMB Bank s decision on all matters relating to this Campaign, including the determination of Eligible Customer and the entitlement to the Special Rates are final, binding and conclusive provided the 2

same must be seen to be fair and reasonable. No correspondence, queries, protests or attempts to dispute the same will be entertained. 16. CIMB Bank has the right and is entitled, upon giving twenty-one (21) days prior notice, to debit the FD or any other account of the Eligible Customer maintained with CIMB Bank at any time as it deems appropriate with the applicable or prevailing statutory fees, stamp duties, commissions, bank charges and/or, service charges. 17. All terms and conditions governing the operation of the Eligible Customer s fixed deposit account and Participating CASA Account shall continue to apply save and except if or where the same are expressly varied or amended by the terms and conditions herein. In the event of any inconsistency between the terms and conditions herein and the terms and conditions governing the operation of Current and Savings account, these terms and conditions shall prevail for the purposes of this Campaign. 18. In no event will CIMB Bank be liable for any loss or damages (including without limitation, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Campaign, even if CIMB Bank has been advised of the possibility of such damages in advance, and all such damages are expressly excluded. 19. CIMB Bank reserves the right, upon giving twenty-one (21) days notice, to cancel, terminate or suspend this Campaign. For the avoidance of doubt, cancellation, termination or suspension by CIMB Bank of this Campaign shall not entitle any of the Eligible Customers to any claim or compensation against CIMB Bank for any losses or damages suffered or incurred by the Eligible Customer as a direct or indirect result of the act of cancellation, termination or suspension unless the same is due to the gross negligence or wilful default of the Bank. 20. CIMB Bank reserves the right upon giving twenty-one (21) days prior notice to vary (whether by addition, deletion, modification amendment or otherwise howsoever) ( the Amendment ) any of the terms and conditions herein. Notification to the Eligible Customer in respect of the Amendment shall be effected at the Bank s absolute discretion through any one of the following means of communication, namely, by posting a notice regarding the Amendment at each of the Bank s branches or by effecting an advertisement regarding the Amendment in one national newspaper of the Bank s choice, or via the Bank s website or by any other means of notification which the Bank may select and the Amendment shall be deemed as binding on the Eligible Customer as from the date of notification of the Amendment or from such other date as may be specified by the Bank in the notification. 21. The terms and conditions applicable to this Campaign are available at www.cimbbank.com.my 22. The terms and conditions herein shall be subject to the application of any prevailing laws, guidelines, directives, notices, regulations enacted, promulgated under the Financial Services Act, 2013 and/ or any other written laws or which are issued by Bank Negara Malaysia, or any other body having supervisory authority over the Bank in relation to or which are applicable to the Campaign or any matters herein. 23. If there is any inconsistency, conflict, ambiguity or discrepancy between the Bahasa Malaysia and English version or versions in other languages of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request had been made by the Eligible Customer and noted and acknowledged by the Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the Fixed Deposit account, then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 3

TERMA-TERMA DAN SYARAT-SYARAT CIMB BANK BERHAD YANG MENGAWAL KEMPEN UNFIXED DEPOSIT AKHIR TAHUN 1. Kempen Unfixed Deposit Akhir Tahun ( Kempen ) yang dianjurkan oleh CIMB Bank Berhad ( Bank atau CIMB Bank ) bermula pada 1 November 2015 dan berakhir pada 31 Disember 2015, termasuk kedua-dua tarikh tersebut ( Tempoh Kempen ). Bank merizab hak untuk mengubah tempoh dan/atau tarikh permulaan dan/atau tarikh tamat Tempoh Kempen dengan memberikan notis dua puluh satu (21) hari terdahulu. Kelayakan 2. Individu/entiti berikut layak menyertai Kempen (dirujuk secara kolektif sebagai Pelanggan Layak ):- a) Pelanggan individu melebihi umur 18 tahun dan pemegang akaun bersama dan/atau akaun amanah yang dipegang untuk manfaat golongan bawah umur; b) Pelanggan yang merupakan kakitangan tetap dan/atau kontrak Kumpulan CIMB dan/atau ahli keluarga terdekat mereka (iaitu pasangan, anak-anak, ibu bapa, adik-beradik). Kumpulan CIMB bermaksud kumpulan syarikat-syarikat/entiti-entiti undang-undang yang mana CIMB Group Holdings Berhad, sebagai syarikat induk CIMB Group Sdn Bhd mempunyai kepentingan kawalan, secara langsung atau tidak langsung, sama ada dengan sendirinya atau melalui anakanak syarikatnya); c) Pelanggan yang merupakn wakil dan/atau ejen (termasuk ejen pengiklanan & promosi dan vendor teknologi) Bank dan ahli keluar terdekat mereka (iaitu pasangan, anak-anak, ibu bapa, adik-beradik), dan d) Pelanggan Bukan Individu dan juga pelanggan bisnes yang merangkumi Milikan Tunggal, syarikat-syarikat Perkongsian, entiti-entiti Perusahaan Kecil Sederhana dan syarikat-syarikat yang mempunyai perolehan jualan tahunan yang tidak melebihi RM10 juta. 3. Syarikat-syarikat yang mempunyai perolehan jualan tahunan melebihi RM10 juta tidak layak untuk menyertai Kempen ini. Kadar Faedah Istimewa untuk Peletakan Deposit Tetap ( FD ) ( Kadar Istimewa ) 4. Demi melayakkan diri untuk menikmati Kadar Istimewa yang ditawarkan oleh Kempen, Pelangganpelanggan Layak dikehendaki membuat jumlah peletakan deposit tunggal minimum RM10,000 semasa Tempoh Kempen; Tempoh FD Kadar Faedah Istimewa untuk Peletakan FD ( Kadar Kempen ) 3 Bulan 4.10% p.a. 6 Bulan 4.20% p.a. Jumlah Peletakan Deposit Tunggal Minimum dalam akaun FD RM10,000 12 Bulan 4.30% p.a. Mekanisme Kempen 4

5. Peletakan deposit yang dibuat bagi tujuan Kempen hendaklah terdiri daripada dana baru yang didepositkan dengan CIMB Bank. Istilah dana baru yang dirujuk di dalam ini ditakrifkan sebagai bermaksud wang atau dana yang walau bagaimanapun jua dipindahkan, dikreditkan atau dibayar ke dalam akaun Pelanggan Layak daripada bank dan/atau institusi kewangan lain kecuali CIMB Islamic Bank Berhad tidak kira caranya termasuk tetapi tidak terhad kepada pemindahan Inter Bank Giro dan pungutan dan pembayaran cek yang dibayar terhadap bank lain dan di mana wang atau dana yang dibayar atau dikreditkan ke dalam akaun Pelanggan Layak digunakan oleh Pelanggan Layak untuk membuat peletakan deposit baru selaras dengan terma-terma dan syarat-syarat di dalam ini dalam masa tiga (3) hari perniagaan selepas wang atau dana tersebut dibayar atau dikreditkan ke dalam akaun Pelanggan Layak. Peletakan deposit yang dibuat melalui cek adalah tertakluk kepada penjelasannya dan hanya akan dianggap peletakan deposit oleh Pelanggan Layak selepas cek dibayar atau dijelaskan. 6. Kadar Istimewa diberikan bagi peletakan FD untuk satu (1) kitaran sahaja. 7. Faedah akan dibayar setelah tamat tempoh FD tersebut. 8. Demi kemudahan Pelanggan Layak, faedah yang diperoleh akan dikreditkan ke dalam Akaun Semasa Konvensional atau Akaun Simpanan Konvensional ( CASA ) Pelanggan Layak yang ditetapkan atau Akaun CASA Sertaan yang dikekalkan dengan Bank. Sekiranya Pelanggan Layak mempunyai Akaun Semasa atau Akaun Simpanan sedia ada yang dikekalkan dengan CIMB Islamic Bank Berhad, Bank boleh menerima Akaun Semasa atau Akaun Simpanan tersebut untuk menjadi Akaun Afiliasi bagi tujuan di atas. (selepas ini dirujuk sebagai Akaun Afiliasi ) 9. Kakitangan Kumpulan CIMB yang menyertai Kempen ini tidak berhak menikmati kadar kakitangan tambahan di bawah Kempen ini. 10. Bank merizab hak, dari semasa ke semasa, untuk mengubah Kadar Kempen dan/atau keperluan tempoh FD 3 Bulan dengan memberikan notis dua puluh satu (21) hari terdahulu. 11. Penunaian FD Awal: Sekiranya Pelanggan Layak menunaikan FD sebelum tamatnya tempoh tiga (3) bulan yang pertama, Pelanggan Layak tidak berhak menikmati sebarang faedah apa jua. Jika Pelanggan Layak menunaikan FD dari bulan keempat dan seterusnya, faedah yang perlu dibayar kepada Pelanggan Layak adalah separuh (50%) daripada faedah digunapakai yang diperoleh untuk bulan-bulan yang telah dilengkapi. Pelanggan Layak dengan ini bersetuju dan memberi kuasa kepada Bank untuk memotong dan/atau menolak daripada jumlah FD, berhubung dengan sebarang faedah yang dibayar atau dikreditkan ke dalam Akaun Afiliasi Pelanggan Layak yang tidak berhak diterima oleh Pelanggan Layak olehsebab penunaian FD awal. 12. Sekiranya Pelanggan Layak ingin menunaikan FD sebelum matang, Pelanggan Layak boleh pilih untuk melaksanakan penunaian sebahagian ataupun penunaian sepenuhnya ke atas baki di dalam akaun FD. 13. Pembaharuan: Apabila FD 3 Bulan atau 6 Bulan atau 12 Bulan matang, Kadar Istimewa tidak akan digunapakai dan Pelanggan Layak dengan ini bersetuju dan memberi kuasa kepada Bank untuk secara automatik membaharui atau meletakkan semula FD 3 Bulan atau 6 Bulan atau 12 Bulan menjadi FD tempoh masing-masing dan kadar sedia ada CIMB Bank yang berkenaan pada masa pembaharuan atau peletakan semula akan digunapakai. 14. Dengan menyertai Kempen ini, semua Pelanggan Layak dianggap telah membaca, memahami dan bersetuju terikat oleh terma-terma dan syarat-syarat ini dan sebarang keputusan oleh CIMB Bank. 15. Keputusan oleh CIMB Bank tentang semua perkara berkaitan dengan Kempen ini, termasuk penentuan Pelanggan Layak dan hak untuk menerima Kadar Kempen adalah muktamad, mengikat dan konklusif dengan syarat yang sama hendaklah dilihat sebagai adil dan munasabah. 16. CIMB Islamic mempunyai hak dan berhak, dengan memberikan notis dua puluh satu (21) hari, untuk mendebit akaun FRIA-i atau mana-mana akaun lain Pelanggan Layak yang dikekalkan dengan CIMB Islamic pada bila-bila masa yang dianggap wajar untuk fi berkanun, duti setem, komisyen, caj bank dan/atau caj perkhidmatan yang terpakai atau semasa. 17. Semua terma dan syarat yang mengawal operasi akaun FD Pelanggan Layak dan Akaun CASA Sertaan akan terus terpakai kecuali dan melainkan jika atau di mana diubah atau dipinda dengan nyata oleh terma dan syarat di dalam ini. Sekiranya terdapat sebarang perkara yang tidak konsisten antara terma-terma dan syarat-syarat di dalam ini dan terma-terma dan syarat-syarat yang mengawal operasi akaun Semasa dan Simpanan, terma-terma dan syarat-syarat ini akan mengatasi yang lain bagi tujuan Kempen ini. 18. CIMB Bank tidak akan dalam apa cara jua bertanggungjawab atas sebarang kerugian atau kerosakan (termasuk tanpa had kehilangan pendapatan, keuntungan, atau nama baik, langsung atau tidak langsung, gantirugi sampingan, berbangkit, teladan, punitif atau khas yang ditanggung oleh mana-mana pihak termasuk pihak ketiga) yang walau bagaimanapun jua berbangkit sama ada dalam kontrak, tort, kecuaian atau sebaliknya, berhubung dengan Kempen ini, meskipun jika CIMB Bank telah dimaklumkan tentang kemungkinan kerosakan sedemikian terlebih dahulu, dan semua kerosakan sedemikian dikecualikan dengan nyata. 19. CIMB Bank merizab hak untuk membatalkan, menamatkan atau menggantung Kempen ini dengan memberikan notis dua puluh satu (21) hari terdahulu. Untuk mengelakkan sebarang keraguan, pembatalan, penamatan atau penggantungan Kempen ini oleh CIMB Bank tidak akan memberikan hak kepada mana-mana Pelanggan Layak untuk membuat sebarang tuntutan atau mendapat sebarang pampasan terhadap CIMB Bank atas sebarang kerugian atau kerosakan yang dialami atau ditanggung oleh Pelanggan Layak yang diakibatkan secara langsung atau tidak langsung oleh tindakan pembatalan, penamatan atau penggantungan kecuali yang sama adalah disebabkan oleh kecuaian melampau atau keingkaran sengaja pihak Bank. 20. CIMB Bank merizab hak dengan memberikan notis dua puluh satu (21) hari terdahulu, untuk mengubah (sama ada dengan menambah, memotong, memodifikasi, meminda atau sebaliknya walau bagaimanapun jua) ( Pindaan ) mana-mana terma dan syarat di dalam ini. Makluman kepada Pelanggan Layak tentang Pindaan akan dibuat menurut budi bicara mutlak Bank melalui mana-mana satu daripada kaedah komunikasi berikut, iaitu dengan menampal notis tentang Pindaan di setiap cawangan Bank atau dengan menyiarkan iklan tentang Pindaan dalam satu akhbar pilihan Bank, atau melalui laman web Bank atau melalui sebarang cara makluman lain yang dipilih oleh Bank dan Pindaan akan dianggap mengikat terhadap Pelanggan Layak dari tarikh makluman Pindaan atau dari sebarang tarikh lain yang mungkin ditetapkan oleh Bank dalam makluman. 21. Terma-terma dan syarat-syarat yang terpakai bagi Kempen ini boleh didapati di www.cimbbank.com.my 22. Terma-terma dan syarat-syarat di dalam ini adalah tertakluk kepada penerapan sebarang undangundang yang berkuat kuasa, garis panduan, arahan, notis, peraturan yang digubal, diisytiharkan di bawah Akta Perkhidmatan Kewangan, 2013 dan/atau sebarang undang-undang bertulis lain atau yang dikeluarkan oleh Bank Negara Malaysia, atau mana-mana badan lain yang mempunyai kuasa penyeliaan terhadap Bank berhubung dengan atau yang terpakai pada Kempen atau sebarang perkara di dalam ini. 23. Untuk maklum balas dan/atau aduan berkaitan dengan Kempen, Pelanggan Layak boleh menghubungi Customer Resolution Department Bank di alamat, alamat e-mel, nombor telefon, nombor faks berikut (atau di alamat, alamat e-mel, nombor telefon dan faks lain yang boleh diubah oleh Bank dengan memaklumkan Pelanggan Layak): Customer Resolution Unit, Tingkat 19, Menara 6

Sekiranya terdapat sebarang ketidakselarasan, konflik, kesamaran atau percanggahan antara versi terma-terma dan syarat-syarat ini dalam Bahasa Malaysia dan Bahasa Inggeris atau bahasa lain, versi terma-terma dan syarat-syarat ini dalam Bahasa Inggeris akan mengatasi yang lain. Meskipun perkara yang disebut sebelum ini, jika permintaan dibuat oleh Pelanggan Layak dan dicatat dan diakui oleh Bank dalam rekodnya bahawa versi terma-terma dan syarat-syarat dalam Bahasa Malaysia akan mengawal operasi akaun FD, maka versi terma-terma dan syarat-syarat di dalam ini dalam Bahasa Malaysia akan mengatasi yang lain 7
